A special circumstance exists because an apparent error was made when the bicycle parking standard was adopted. The standard does not reasonably fit the use. 3 . A motel is a permitted use in the LC zone. 4. Public facilities and natural features will not be affected by this variance. 5 . With the amendments required by this final order, the bike parking variance would represent the minimum variance needed to alleviate the hardship. DECISION Based upon the above facts, findings, and conclusions, the Planning Commission APPROVES the proposed site plan, conditional use, and variance application subject to the following conditions: 1. By mutual agreement, the applicant and the condominium association may select an alternative landscaping/screening arrangement. f. A 6 - foot tall solid wood or masonry fence along the northern boundary of the property from the northwest corner to a point that has the same front yard setback as the house on the property to the north. The provision of utilities shall be approved by the City Manager and/or the City Engineer. 5. The necessary permits from the Unified Sewerage Agency shall be obtained. 6. The necessary permits from ODOT to amend the access to the property and for public improvements along the Pacific Highway frontage shall be obtained. • 7 . At the option of the City Manager, issues related to the interpretation or administration of conditions of approval may be brought before the Planning Commission for resolution. 8. This approval shall be valid if exercised within one year of the final approval date of this application. No trees shall be removed or damaged prior to final city approval of the items listed in conditions 1. through 6. above.
