We are also providing Brian Rager with information related to the driveway access easement and the Atlanta Street dedication. Contrary to the fee details in your March 12th fax (attached), our records indicate that Tri -Met has already paid the $320.00 land use application fee. I have attached a receipt to that affect. For expediency's sake, I have not deducted this from the total check being submitted today. I would anticipate a refund from the City once this portion of the fees have been resolved. Please let me know as soon as possible if any additional information will be needed prior to issuing the permits. First, Tri -Met has requested Kampe Associates Inc to proceed with development of the dedication documents needed for Atlanta Street. Documentation appropriate for recording will be to the City within the next 30 days. Should Tri-Met fail to do so, Tri -Met's project manager will order work to be stopped until the documentation is complete available to the City for recording. Please forward appropriate City forms for this purpose to Dale Windus at your earliest convenience. Given there is no impact to the easement dedication area as part of this project, we request that the final dedication of the street not hold up the construction process at this point in time. Attached is the signature page from the easement agreement between Tri -Met and Act III Theaters allowing access to the proposed Tigard Park and Ride per your request. I hope this letter resolves the remaining issues for the project. If not, please call Rick Kindig at 239- 2180 as soon as possible. We appreciate your attention to this project. Scott directed my attention to the county code 3.17.040.B.7 and indicated it would be up to our. "director" to decide whether we would impose TIF. Could you please review the section indicated and let me know whether we will be assessing TIF? As some insight, TIF was not assessed (per Tri -Met) at the Tualatin Park N Ride. Per Scott King, TIF is being assessed at the Light Rail Park N Rides. It seems their opinion is the local Park N Rides only generate local traffic while the Light Rail generates traffic from non -local origins such as Forest Grove, etc...
