PREPARED BY: Michael Anderson DEPT HEAD OK CITY ADMIN OK ISSUE BEFORE THE COUNCIL Should the City Quit Claim an existing, now unused, public sanitary sewer easement to extinguish it., a STAFF RECOMMENDATION Approve the resolution quit claiming the existing, now unused, sanitary sewer easement. -INFORMATION SUMMARY f The easement proposed to be quit claimed is described and illustrated on the attachment herewith. The easement is no longer necessary; the sanitary sewer - 1 line contained therein has been relocated to facilitate development of the .---,Main Street Apartments. The relocated sanitary sewer line is operational. An easement for the new, realigned sanitary sewer has been created. The easement proposed to be quit ! claimed is now encroached upon by newly constructed buildings. OTHER ALTERI4ATIVES CONSIDERED i 1. Retain the existing, now unused, sanitary sewer easement not recommended by City Staff. 2. Quit claim the existing, now unused, sanitary sewer easement recommended by City Staff. G Alfsan DEFT HEAD 0%{ ~ CITY ADMIN OK ISSUE BEFORE THE COUNCIL j Shall the Council dedicate right of way required for Gaarde Street from the property purchased by the City for the new roadway. E' a STAFF RECOMMENDATION i Approve the dedication and authorize the City Administrator to sign the € 3 document. INFORMATION SUMMARY Several properties were acquired in order to construct the Gaarde Street F Major Streets Bond project. The project has been constructed and portions of v r-he properties are now occupied by the new Gaarde Street pavement and sidewalk. The right of way could not be recorded earlier because property transactions were held up regarding transfer of ownership and releases from the lending institutions. All of the transfers have now been closed and the a` right of way can be completed. A legal description and map has been prepared dedicating this portion of the properties as right of way. This action will transfer status of the portions of properties from City owned tax lots to public ownership. The three remaining remnant properties are proposed to be deeded to the adjacent properties in a separate action. I The attached Resolution declares the Council°s desire to dedicate right of i way for Gaarde Street and authorizes the City Administrator to sign the dedication.
