• Meeting was called to order at 6:35 p.m. by Mayor Edwards.
1. ROLL CALL
Council Present: Mayor Jerry Edwards; Councilors Judy
Fessler, Valerie Johnson, and John Schwartz. Staff Present:
Patrick Reilly, City Administrator; Ed Murphy, Community
Development Director, and Catherine Wheatley, City Recorder.
STUDY SESSION
Update by Jeff Johnson of Tualatin Valley Fire & Rescue: Mr.
Johnson reviewed the City of Tigard Quarterly Report (April -
June). Of the 4,352 total runs, 626 incidents were within Tigard
city limits. Programs and events sponsored by TVF&R included:
Residential Smoke Detector Program (includes free detector and
installation); City of Tigard Firework Display; Handicapped Fishing
Derby (thanked Council members who participated).
Mr. Johnson advised that the Tigard Police Department assisted them
in the confiscation of 1,500 pounds of illegal fireworks at one
location.
Billboard on 217 @ Greenburg: Community Development Director
Murphy advised, after questions by Councilor Johnson, that he would
inspect this billboard for regulation compliance.
Proposal by Rena Cusma to consolidate Washington, Multnomah,
Clackamas, Tri-Met and Metro: Mayor Edwards and Councilor Johnson
advised they would attend the July 23, 1992 meeting of the Metro
Council should the Government Affairs Committee forward the
consolidation proposal to the full Metro Council. Council agreed
that a letter to Metro should be sent advising of Tigard's
opposition to the proposal at this time, especially since the
Charter Commission's work is not finished.
Metro Charter Committee: Committee has been meeting three times a
week to finalize their recommendations. In order to forward ballot
measure to the voters in November, the Committee's proposal must be
finished by August 6.
Water Update: City Administrator advised that we are receiving
about 100 calls a day on water conservation and other District
matters.

The Watermaster has temporarily revoked rights for Tualatin River.
The City has used this water for irrigation of Cook Park.
The Administrator (Jerri Chenelle) of Tigard Water District will
prepare a resolution for the Tigard Water Board's consideration.
This resolution will outline the intended process for a review of
formation of a 11190 operation." Subsequently, it is expected that
the Cities of Tigard, Durham and King City will adopt similar
resolutions.
The Water Board will be meeting on the 14th to clarify watering
restrictions for District users.
Calendar Review:
The following changes were made to the Council calendar:
• No meeting on July 21
• The August 18 meeting will be a business meeting
• No meeting on August 25

7. ADMINISTRATIVE REVIEW/UPDATE
• A-Boy has asked for State Supreme Court review.
• Fuel tank removal: Ground water has been testing
"clean." Waiting for additional soils test and testing
of ground water before filling of hole.
• Mayor Edwards noted problems with picking up of tar on
street patchwork. Some patchwork, done some time ago, is
still soft. Staff will report back.
• Councilor Fessler requested staff look at entrance to
storage units (next to BP Station) on Greenburg Road a
there is no stop line and cars are stopping out too far
onto Greenburg. a
• Work on Gaarde Street is going well. Elmer's Restaurant
has reported no problems.
• City Engineer Wooley will check on progress on Scholls
Ferry Road.
• City of Tualatin laid off 38 people. The recreation
program has been cut and buildings are being closed down.
There will be no School Resource officer at Tualatin.
• 10, 000 people attended the 4th of July fireworks display.

AN ORDINANCE CONCERNING THE VACATION OF A PORTION OF SW GREENBURG
ROAD, AT THE NORTHEAST CORNER OF THE INTERSECTION OF SW GREENBURG
ROAD AND SW CENTER STREET, IN THE CITY OF TIGARD, WASHINGTON
COUNTY, OREGON.
WHEREAS, the Tigard City Council initiated this vacation request r
pursuant to Section 15.08.040 of the Tigard Municipal Code on May
26, 1992; and
WHEREAS, This portion of SW Greenburg Road is a dedicated public
right-of-way, giving the public rights over the land for street and
utility improvements; and

WHEREAS, the purpose for this vacation is to vacate a portion of SW
Greenburg Road that is no longer needed because access is available
to all abutting properties; and
WHEREAS, the vestee of this property, Mrs. Margaret Davis, supports
this vacation; and
WHEREAS, the vacation has been initiated by the City Council and
approval has been recommended by the Community Development
Department; and
WHEREAS, the City of Tigard (Grantor) has signed an agreement for
negotiated settlement for purchase of property rights for the
Greenburg Road Realignment Project parcel two, which is the impetus
for this vacation request; and

WHEREAS, all affected service providers, including utility
companies and emergency services, have reviewed the vacation
proposal and have no objections; and
WHEREAS, notice has been mailed to all property owners abutting
said vacation area and all owners in the affected area, as
described by ORS 271.080; and
WHEREAS, in accordance with TAC 15.08.040, the Recorder posted
notice in the area to be vacated and published notice of the public
hearing; the owners of the majority of the area affected have not
objected in xriting; and
WHEREAS, the Council having considered the request on July 14,
1992, finds that it is in the public interest to approve the
request to vacate that certain portion of public street right-of-
way for SW Greenburg Road because the public interest will not be

prejudiced by the vacation as provided by ORS 271.120 and TMC
Section 15.08.130
NOW THEREFORE, BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The Tigard City Council hereby orders the vacation
of that certain portion of public street right-of-
way, as described on the attached Exhibit A (map of
area to be vacated), Exhibit B (November 1, 1990
agreement between City of Tigard and adjacent land
owner), and Exhibit C (legal description of area to
be vacated) and by this reference made part hereof.

SECTION 2: In no situation shall this ordinance be effective
until the 31st day after its enactment by the City
Council, approval by the Mayor, and after a
certified copy of this ordinance has been recorded
with the Washington County Clerk, Assessor, and
Surveyor.

Dear Ms. Davis:
The City of Tigard is planning the construction of_the above-
captioned project.- As you are aware through our discussions,
property you own will be affected by this project. . A Warranty Deed
and Temporary Construction Easement will b6 necessary in order to
give the City of Tigard the legal right to complete the
construction of the street-
In exchange for executing the documents and granting the above
rights, and subject to approval, the City of Tigard agrees to the
following:
1. To compensate you, in full, for the Warranty Deed and
Temporary Construction Easement in the amount of
$1,835.00, including paving and curbing mentioned below.
2. To clean up the construction debris at the conclusion of
the project and replace asphalt paving, which is removed
to accommodate the street construction work, located in
the area with the temporary easement to the back edge of
the new sidewalk.
3. To terminate the edge of the new sidewalk no closer than
one foot away from the foundation wall at the end of the
existing building facing Greenburg Road.
4. To convey to Ms. Davis by Bargain and Sale Deed, all of
the City of Tigard°s interest in that portion of the

existing S. W. Greenburg Road right-of-way which is
located north of a line drawn 0.5 feet north of the back
edge of the new sidewalk, which shall include that
portion within 1.0 feet of the foundation wall of the
existing building on the end of the building facing S.
W. Greenburg Road, with said legal description to be .3°

necessary to assist Ms. Davis in obtaining clear title
to the described property in the event. that any other
interests in or claims to said property appear.
5. To construct an extruded curb approximately 3 feet north
and parallel to the back edge of the new sidewalk t
adjacent to the existing parking lot behind Ms. Davis'
existing building.
The total compensation for the above is $1,835.00. Payment will

A tract of land located in the N.W. 1/4 of the S.E = of Section 35,

COUNCIL GOALS
The primary mission of the city of Tigard is to enhance the quality
of life of its residents. Pursuant to this mission, the Council
adopted the following seven broad goals in 1989 to guide the
governance of the city:
I. To create a strong sense of identity.
II. To participate in issues impacting the well being of our
community.
III. To develop and maintain a positive corporate culture for
the municipal organization.
IV. To prudently manage the assets and resources of the City.
V. To provide a level of service to our citizens that
enhances a high quality, comfortable, safe living
environment.
VI. To strengthen the quality of interaction with our

ISSUE BEFORE THE COUNCIL
To approve an amendment to the existing Intergovernmental Agreement with the
Washington County Consolidated Communications Agency (WCCCA) to allow
expanded membership into WCCCA to include the rural fire protection districts
of Tri-Cities, Gaston, Cornelius, and Forest Grove; and the City of Forest
Grove Fire Department.
STAFF RECOMMENDATION
Recommendation is for Council approval. This change of membership has no
adverse impact on existing WCCCA Users and a slight reduction of user costs
will be realized. This also moves the agencies in the County one step closer
to a single emergency dispatch center.
INFORMATION SUMMARY
The WCCCA Board of Commissioners approved the expansion of membership and
this Amended Agreement and Letter of Agreement must be approved by each
existing participating jurisdiction. With this amendment, all emergency
(Police & Fire) service providers in Washington County will be dispatched by
WCCCA except for the Forest Grove Police Department.
PROPOSED ALTERNATIVES
1. Approve'Amendment to original Intergovernmental Agreement with WCCCA.
FISCAL NOTES
No adverse impact. Slight reduction of User fire costs and a major step to
establishing one emergency dispatch center in Washington County which would
result in cost savings to us.

meeting 04-29-92. This expansion will add the following jurisdictions to WCCCR:

The change of membership has no adverse impact on existing WCCCA Users, and a

WASHXNGTON COUNTY CONSOLIDATED COXMU1 XCATIONS AQENCY
THIS AMENDMENT to the Washington County Consolidated
Communications Agency Intergovernmental Agreement ("Agreement")
is made and entered into pursuant to ORS 190.010 and by and among
the Washington County Consolidated Communications Agency
("Agency") participating jurisdictions, as identified in the
Agreement, and Tri-Cities Rural Fire Protection Districts Gaston
Rural Fire Protection District; Cornelius Rural Fire Protection
District; Forest Grove Rural Fire Protection District; and the
City of Forest Grove (collectively referred to herein as
"Participating Jurisdictions").
WHEREAS the Participating Jurisdictions desire to amend the
Agreement to provide for expanded membership in the Agency and to
provide further changes to facilitate such expanded membership;
now therefore in consideration of the mutual promises contained
herein, it is agreed as follows;
1) The Washington County Consolidated Communications
Agency Intergovernmental Agreement is by this reference
incorporated herein,and except as expressly modified or
amended below, shall remain in full force and effect.

The participating jurisdictions of the "Washington County
Consolidated Communications Agency" hereby agree to an interim
process allowing for adjunct representation to the E-Board of
the "Washington County Consolidated Communications Agency."
Adjunct representation to the E-Board will be provided to the
new participating jurisdictions. The new members shall appoint one representative.
The adjunct E-Board representative will be a voting member.
Adjunct I<epiaearsi,tat:0:? is provided due to the consolidation of
personnel and operations from the "City of Forest Grove Dispatch
Center" to the "Washington County Consolidated Communications
Agency."
Adjunct membership to the E-Board shall remain in effect for a
period of 60 days after the effective date of the

Should the City Council initiate vacation proceedings for a portion of SW
67th Avenue?
STAFF RECOMMENDATION
It is recommended that Council initiate vacation proceedings by adopting the
attached resolution.
INFORMATION SUMMARY
Mr. Robert Cline, petitioner, is requesting that City Council initiate
vacation proceedings for a portion of the SW 67th Avenue right-of-way
adjacent to property located at the northeast corner of SW 67th Avenue and SW
CBaylor Street (exhibit A).
A street vacation for SW 67th Avenue extending from SW Baylor Street to the
ODOT access control line, south of SW Clinton Street plus a portion of SW
Clinton Street (exhibit B) was approved by the Council in 1985 (Ord. 85-37).
It was later determined that SW 67th Avenue was still under the jurisdiction
of Washington County. The City therefore did not have the authority to
approve a street vacation for SW 67th Avenue. On March 3, 1986, the Council
amended Section 1 of Ordinance 85-37 by removing all references to the
vacation of 67th Avenue (Ord. 86-16, exhibit C). The City assumed
jurisdiction of SW 67th Avenue in July, 1986.
The City Engineering Department and Planning Division have reviewed this
proposal and recommend that this vacation request be extended to include that
entire portion of 67th Avenue which the City attempted to vacate in 1985.
Appropriate agencies shall be contacted for comments.
PROPOSED ALTERNATIVES
1. Adopt the attached resolution thereby initiating vacation proceedings and
calling for a public hearing on August 25, 1992.
2. Take no action at this time.

STAFF RECOMMENDATION

INFORMATION SUMMARY
The FY 1992-93 capital improvement program for streets includes funding for
slurry seal in 48 locations and pavement overlay on 19 streets. On June 9th
authorization was granted to advertise for bids. The bid opening is
scheduled for July 7th. Bid award has been scheduled for July 14th to assure
C adequate time to complete the work during the current construction season.
Bid results will be available on July 9th and will be mailed with the Council
newsletter.
PROPOSED ALTERNATIVES -
1. Award each contract to the lowest responsible bidder.
2. Reject all bids.

On July 7th bids were opened for the 1992-93 Pavement Major
Maintenance projects. Bid results are shown below.
Slurry Seal
Three bids were received for the slurry seal program, as follows:
Asphalt Maintenance Associates, Eugene, OR $115,625.00
Blackline, Inc., Vancouver, WA 127,500.00
Valley Slurry Seal Co., West Sacramento, CA 137,100.00
The engineer's estimate was $125,000.

I recommend award of the contract to the low bidder, Asphalt
Maintenance Associates.
Overlay Procrram
Five bids were received for the overlay program, as follows:
K.F. Jabobsen & Co., Inc., Portland $221,220.00
Oregon Asphaltic Paving Co., Portland 228,400.00
Lakeside Industries, Portland 229,650.00
Eagle-Elsner Inc., Tigard 234,824.00
Baker Rock Resources, Portland 301,150.00
The engineer's estimate was $225,000.
Lakeside Industries submitted a letter requesting a 5% preference
due to their intention to use recycled asphalt materials. State
law requires that a preference be given to bidders using recycled
materials under certain conditions. However, the City Attorney's
office has determined that the recycling preference does not apply
to contracts for public works improvements. Therefore, I recommend
that no bid preference be given to Lakeside. It should be noted
that the specifications allow the use of recycled materials and
that any of the bidders may choose to do so.
I recommend award of the contract to the low bidder, K.F. Jacobsen
& Co., Inc.

Approval of the attached resolution authorizing the signing of the agreement.
INFORMATION SUMMARY
The City's capital improvement budget for streets includes a project to
install traffic signals at the intersection of Hall Boulevard and Bonita
Road. The project is funded by the City from traffic impact fees. However,
since Hall Boulevard is a State highway, the signals will be owned and
operated by the State.
C The attached agreement provides for the sharing of responsibilities for
installation and maintenance of the signals by the City and the State.
PROPOSED ALTERNATIVES
FISCAL NOTES
Under the agreement, the City will pay installation costs and on-going energy
costs for the signals. The State will provide all remaining maintenance.

four parcel site on the south side of Bull Mountain Road from Commercial
Professional (3.19 acres), and Low Density Residential (4.54 acres) to
Medium-High Density Residential?
STAFF RECOMMENDATION
It is recommended that the proposed Comprehensive Plan Map amendment be
continued until August 11, 1992.
INFORMATION SUMMARY
The subject properties are presently outside the City limits but within the
City's planning area. The applicant has an application for annexation
pending. The property is currently zoned R-6 (Residential 6 units per acre)
by Washington County.
Since the May 12, 1992 Council meeting, the applicant met with NPO #3 and
agreed to include low density single-family residential for the western most
part of the property. The applicant intends to revise his proposal for staff
and City Council review. It is suggested that staff send notice of the
revised proposal to adjacent property owners and provide an analysis of the
revised proposal for the Council's August 11, 1992 meeting. See packet
material of May 12, 1992 for further information.
PROPOSED ALTERNATIVES
1. Deny the Comprehensive Plan Map change as originally proposed and direct
staff to prepare a resolution and findings.
2. Approve the Comprehensive Plan Map change as originally proposed, and
direct staff to prepare an ordinance and findings.
3. Continue the public hearing until the August 11 meeting to allow the
applicant to revise the proposal to include single-family residential on
the western edge of the property.
FISCAL NOTES
No direct impacts.

Dear Mr. Offer:
As we discussed in our conversation of this date, my client wishes to request that the
public hearing on. the above-referenced Comprehensive Plats Amendment application b-
rescheduled to the August 11, 1992 City Council agenda. As you know, our meeting with
members of the surrounding neighborhood has resulted in our reaching a consensus with
those neighbors for a modified proposal. The essence of this modified proposal is to with-
draw Tax Lot 1600 and an approximately one-third acre area surrounding the existing home
on Tax Lot 2100 from the proposed Plan Amendment application. This area would remain
under the present plan designation and would be used for single family residential purposes.
The balance of Tait Lot 2100, as well as Tax Lots 1300 and 1400, would continue to be in-
cluded in the application for a Plan Amendment to the Medium-High Density Residential
(R-25) designation. However, as agreed with the neighbors who attended the meeting, the
applicant will record deed restrictions on this proposed R-25 property which would limit the
density of development to no more than 18 units per acre.
A revised narrative is attached which modifies our proposal as described above and
provides a revised discussion of applicable comprehensive plan policies. Thank you for your

STAFF RECOMMENDATION
It is recommended that Council approve the vacation by adopting the attached
ordinance.
INFORMATION SUMMARY
Council initiated this vacation at a meeting held on May 26, 1992.
The City of Tigard, petitioner, requests City Council approval to vacate a
C portion of the SW Greenburg Road right-of-way adjacent to property located at
:he northeast corner of SW Greenburg Road and SW Center Street (exhibit A).
An agreement, signed by the City Attorney's Office on November 1, 1990
(exhibit B), states that the City will convey to the adjacent property owner
(upon final approval of the vacation request) that portion of the Greenburg
Road right-of-way described in exhibit B, upon completion of the Greenburg
Road Realignment Project. A legal description of the area to be vacated is
attached (exhibit C). Attachments are: A) map of the area to be vacated; B)
November 1, 1990 agreement between City of Tigard and adjacent land owner;
and, C) legal description of area to be vacated.
All appropriate agencies, have been contacted for review of this vacation
request and have offered no objections.
