ROIr, CALL: Present: Mayor Jerry Edwards; Councilors: Carolyn Eadon and Valerie Johnson. Staff Present: Patrick Reilly, City Administrator; Ron Goodpaster, Chief of Police; Keith Liden, Senior Planner; Ed Murphy, Community Development Director; Liz Newton, Community Involvement Coordinator; Tim Ramis, City Attorney; Catherine Wheatley, City Recorder; and Randall Wooley, City Engineer. 2. STUDY SESSICH: Update on Gang Activity, in Tigard - Chief Goodpaster Chief Goodpaster outlined Tigard's experience to date with gangs. Tigard has had some problems with gang-related graffiti and incidents of auto and auto-part theft. Chief noted completion of gang-familiarization training within the Police Department with additional training scheduled in the near future. There was discussion about community awareness and educational programs which could be implemented. &M Mmm a i n ' ail Study Com-auni_cy Development Director and City Engineer updated Council on the Bull Mountain Transportation study; to date, this has been a fairly informal process. The draft study was reviewed at a public meeting last week. There was concern expressed over the proposed Murray Boulevard Extension; the majority of the comments received on the remaining traffic route alternatives were either favorable or neutral. City Engineer advised the next step was to add language to the draft study concerning the Urban Planning Area Agreement with the County. Then, the updated document will be forwarded to the Planning Commission for their review. Surface Water Management Steering Cmmittee Councilor Johnson advised she attended the Surface Water Management Steering Committee meeting on November 30. A draft Surface Water Management Plan has been prepared. After reviewing and editing the numerical information, individual cities will be asked to approve a resolution adopting the final draft and enter into an Intergovernmental Agreement with Unified Sewerage Agency. She noted she agreed with Councilor Schwartz's earlier reconanendation that the City remain involved with the Surface Water Management process. CITY COUNCIL MEETING MIN(HES - DECEMBER 4, 1990 - PAGE 1 Furth Day { Councilor Johnson noted April 22, 1990, will mark the 20th Anniversary of Earth Day. Virginia Hartman is the contact person. It was suggested the Utility & Franchise Coimnittee may want to get involved in commemorating the event in Tigard. 3. VISITM' S AIM IM D a. Ron Rutledge, Vice Chairman of Washington Square Estates Homeowners' Association, residing at 9682 S.W. Ventura Court, r Tigard, Oregon, advised Council of two issues of concern to him: E 1. There is new construction underway near the National Guard Armory. He noted mud and debris from the construction site was clogging drains and causing problems. 2. He has heard an extension of 69th Avenue from Locust Street to Ventura Drive was being considered by the City. He advised he was opposed to a thoroughfare in his neighborhood. Mayor noted Mr. Rutledge's concerns and requested Mr. Rutledge contact Community Development Staff for more information on these two issues. 4. CONSENT AGENDA 4.1 Receive and File: a. Council Calendar b. Certified Election Results (City Center Development Plan) Motion by Councilor Johnson, seconded by Councilor Eadon, to approve the Consent Agenda. The motion was approved by a unanimous vote of council present. 5. PUBLIC I iNMM - ZONE CMIGE AN1J9MCK ZC"A 89-10 SIEYU/BRIAN ALPO #3 A j request for approval to annex 96.86 acres of unincorporated Washington County land to the City of Tigard and change the zoning designation from Washington County R-6 (Residential, 6 units/acre) to City of Tigard R-7 (Residential, 7 units/acre). a. Public Hearing was opened. { b. There were no declarations or challenges. C. Senior Planner Liden Summarized the staff report and the annexation process in general. No objections had been received by reviewing agencies. Council packet material included a resolution to forward the annexation request to the Boundary Commission and an ordinance to change the zone designation from Washington County R-6 to City of Tigard R-7 in conformity with the City's adopted Comprehensive Plan. The staff recomavnded the adoption of PD (Planned Development) overlay zone as well. i CITY COUNCIL MEETING MLNT= - DECEMBER 4, 1990 - PAGE 2 d. Public Testimony: o Ted Magnuson, 14405 High Tor Drive, Tigard, Oregon, noted concerns over potential traffic problems with the development of the subject parcel. He noted the Washington County Bull i Mountain Community Plan currently describes this area as residential. He said he would not want to see any through- streets bearing commercial traffic through the designated residential neighborhood. He noted concerns over maintaining the R-2 zoning character of the area of the neighborhood in which he lived when considering a higher-density development proposal immediately adjacent. t Mayor Edwards responded that the issue before Council was whether the city was going to forward to the Boundary Commission a request that 96 acres be annexed to the City of Tigard. The issues Mr. Magnuson was raising concerning development would be studied and discussed during hearings at a later time, if and when the property was developed. He also noted staff was recd miending a PD overlay, which may address Mr. Magnuson's concerns with zoning issues. In addition, the total portion of Bull Mountain Road was included in the annexation request; the City would have jurisdiction with regard to traffic issues. Councilor Johnson advised Mr. Magnuson the City was developing a Bull Mountain Transportation Study. Additional copies of the study were available in the Engineering` Department, City Hall. o John Martin, 14105 S.W. High Tor Drive, Tigard, Oregon, advised he agreed with Mr. Magnuson's concerns. One issue he said needed direct attention was providing sewer service. He noted the topography of the area and the possibility that the. sewer would need to be pumped. He suggested additional i; property be annexed at the same time in order to tie in the utilities. i E Councilor Johnson posed a question on process: If additional property was annexed, would this hold up the process on this proposal? Senior Planner Liden responded that, yes, this proposal would be held up because of advertising requirements and also another hearing would be necessary. o Lavelle Day, 14055 High Tor Drive, Tigard, Oregon, noted his issues and concerns were of the same nature as expressed during preceding testimony. In addition to the sewer problem, he noted concerns with development of the property prior to providing access to S.W. 135th Avenue. Without such access, the entire development would utilize Bull Mountain Road which would significantly increase traffic load. CITY COUNCIL MEETING MINUTES - DECEMBER 4, 1990 - PAGE 3 F'k • 2' Another issue of concern was the protection of views of those persons already living in the area; i.e. restricting tree and building height of new development. i Mayor commented that he thought Mr. Day's concerns were valid; he reiterated that development issues would be addressed during the hearing process when the property developed. Councilor Johnson noted, as far as she knew, restriction of tree planting was not covered in the Tigard Development Code. She suggested this may be an issue which would be addressed C in deed-restriction language. Mr. Day said he hoped the entire parcel would be proposed for t development at once. Senior Planner Liden said this would be ; preferred and noted the applicant, in his testimony, may speak to this. It was his understanding that at least a concept for the entire parcel would be proposed. There were no restrictions in the Code which would limit tree or building heights. When reviewing the plan, there may be some ways the developer would be willing to accommodate the adjoining property owners. Mr. Day suggested it would be appropriate for the City to rs' address the issue before the development takes place. o Rod Kvistad, 13535 S.W. Fern Street, Tigard, Oregon, signed in to testify but declined to speak. o Tom Brian, 7630 S.W. Fir Street, Tigard, Oregon, advised he represented Sieyu Corporation which was the owner of the 97- acre parcel. He advised they have held two large CPO' meetings, one in October and one in November, to gather preliminary planning ideas and to identify/mitigate concerns. A number of meetings with individuals have also been held with regard to concerns over sewer hook-ups, laterals, etc. He ! noted he was also aware of the broader concerns over traffic, view obstruction, and sewer access. He advised they have offered to give, at no cost, sewer lateral easements to the abutting property on 141st and High k Tor. He noted design techniques which would preserve view corridors. Mr. Brian advised their goal was to enhance the area and noted some design detail had been completed. He further advised that while the property may be zoned R-7, they plan to develop at about 2.8 to 3.0 units per acre and would prefer a Planned Development overlay. with regard to concerns about traffic, Mr. Brian advised the CITY COUNCIL MEETING MINUTES - DECEMBER 4 1990 - PAGE 4 developer plans to build the 135th Street extension (name of street may change) at full-improvement standards all of the way through this property and an adjacent parcel (40 acres) owned by the developer. He advised they planned on constructing safe ingress/egress with area for school buses to stop. In response to comments by Councilor Johnson, Mr. Brian advised he would be willing to submit a letter to the City noting the density (about 2.8 to 3.0 units/acre) at which they planned to develop. e. Community Development Director advised staff recommends the property be annexed with the zoning designation changed to R-7 PD. The actual development, if annexed, would be subject to City development process which would include a review by the Planning Commission. The Planning Commission can look at items not specifically outlined in the code; i.e., protection of views. Also, it would be appropriate for development issues, including traffic concerns and sewer-connection issues, to be discussed at that time. f. Council Discussion: Mayor Edwards asked that staff review the concerns over views and height obstructions and report back to Council. He agreed this may represent a greater concern as development continues. Councilor Johnson asked if there was anything in writing which could be included in the record noting it was the developer's intention of building the full 135th Avenue extension at one time, rather than in segments. Senior Planner said there was nothing in writing on file. Councilor Johnson said she realized this was normally a condition of development and not annexation; however, when considering the City's ability for providing services, transportation issues overlap this question. Councilor Johnson asked the meeting record reflect the developer's stated commitment; that is, the 135th street extension would be built at full standards through this and the adjoining 40 acres awned by the applicant as well. g. Public Hearing was closed. h. Consideration by Council: Councilor Eadon called for a reading of the resolution noting the legal description of said resolution included all of Bull Mountain Road as opposed to just the north half. RESOLUTION NO. 89-90 A RESOLUITON INITIATING ANNEXATION TO THE CITY OF TIGARD OF THE TERRITORY AS OUTLINED IN EXHIBIT "A" AND DESCRIBED IN EXHIBIT "B" ATTACHED (ZCA 89-10 SIEYU). CITY COUNCIL MEETING MDR).PES - DECEMBER 4, 1990 - PAGE 5 Mayor Edwards noted the amendment to the resolution with regard to the legal description including all of Bull Mountain Road. Motion by Councilor Eadon, seconded by Councilor Johnson, to approve Resolution No. 89-90. The motion passed by a unanimous vote of Council present. ORDINANCE NO. 89-29 AN ORDINANCE ADOPTING FINDINGS AND CONCLUSIONS TO APPROVE A ZONE CHANGE (ZCA 89-10 SIEYU RnM;VATIONAL) AND DECLARING AN EFFECTIVE DATE. Motion by Councilor Eadon, seconded by Councilor Johnson, to adopt Ordinance No. 89-29. Councilor Johnson registered her dissatisfaction with the County's original zoning of R-6 (Residential, 6 units/acre) which appears to be inappropriate for this property. She explained that the city is bound, through an agreement with the County, to annex the property at a comparable zoning designation; hence, the proposal for City of Tigard zoning designation of R-7 (Residential, 7 units/acre). Should the City desire to decrease density, then a density transfer elsewhere within the City may become necessary in order to maintain the average density mandated by State planning regulations. Mayor Edwards pointed out the R-7 City zoning designation was comparable to the County R-6. Minimum lot size in both the City and county zoning designations would be 5,000 square feet; thus, no significant change in density was being proposed. INFORMATION SUMMARY This annexation request consists of seven parcels of 96.86 acres that is contiguous to the City of Tigard. This property is located within Tigard's area of interest. Attached is a resolution to forward the annexation request and an ordinance to change the zone designation from Washington County R-6 to City of Tigard R-7 in conformity with the City's adopted Comprehensive Plan. The staff recommends the adoption of the PD (Planned Development) overlay zone as well, for reasons noted in the staff report. Attached is the annexation resolution, zone change ordinance, site map, and staff report. ALTERNATIVES CONSIDERED 1. Adopt the attached resolution and ordinance to forward the annexation request to the Boundary Commission and to assign plan and zone designations to the property in conformity with the Comprehensive Plan. 2. Deny the Proposal. FISCAL IMPACT Since this area is not with Tigard's Active Planning Area, the applicant will pay the Boundary Commission fee of $980 for annexation of 96.86 acres. The current land assessment is $84,320.00. No significant fiscal impact is expected until development occurs. As development occurs, there will be attendant demands for services. However, based upon prior cost/benefit studies of annexation, it is expected that the overall fiscal impact of this developed parcel will be positive. A more precise analysis requires development details not available at this time. SUGGESTED ACTION Adopt the attached resolution and ordinance to forward the annexation to the Boundary Commission and to assign plan and zone designation to the property in conformity with the Comprehensive Plan. General Information CASE: Zone Change Annexation ZCA 89-10 REQUEST: To annex 96.86 acres of unincorporated Washington County property into the City of Tigard and to change the zoning designation from Washington County R-6 (Residential, 6 units per acre) to City of Tigard R-7 (Residential 7 units per acre). (WCTM 2S1 4, Tax Lots 900, 1000, 1100 and WCTM 2S1 9, Tax Lots 101, 102, 103, and 104. 2. Background Information No previous applications have been reviewed by the City relating to this property. 3. Vicinity Information Bull Mountain Road and High Tor Subdivision lie to the south of the subject property. Benchview Estates Subdivision and Three Mountain Subdivision lie to the east and two forty acre tracts are immediately north of the property. Small acreage homesites and a Bonneville Power Administration electrical transmission line are present near the western property boundary. Benchview Estates Subdivision and Three Mountain Subdivision are within the City of Tigard as is the eastern forty acre tract on the north side of the subject property. The City of Tigard R-4.5 (Residential 4.5 units per acre) zone applies to both of these abutting subdivisions and the forty acre tract within the City is zoned R-7 (Residential 7 units per STAFF REPORT - BRIAN/SEIYU (ZCA 89-10) PAGE 1 acre). All of the surrounding land in Washington County is designated as Residential, 6 units per acre in the Bull Mountain Community Plan. 4. Site Information The southern portion of the property is presently in farm use and contains two residences. The lower northern portion, slopes more steeply and is predominately wooded. The applicant requests an annexation to the City and has indicated a desire to develop the property for single family residential use. 5. Agency and NPO Comments The Engineering Division has the following comments and recommendations: The site is included within the study area of the Northeast Bull Mountain Transportation Study. When adopted, the Study will define the collector street system needed to serve the area as development occurs. The Study is nearing completion. It appears that a completed transportation plan will be in place early in 1990. The Study specifically addresses the transportation needs of the annexation site. The proposed zoning designation is consistent with the assumptions of the Transportation Study. Under City policies, the needed streets will be constructed as development occurs. The site contains steep slopes. It is drained by four ravines that flow toward the north. Three of the ravines discharge into developed areas of Tigard. During development of the site, special attention will need to be given to storm drainage to control erosion and to protect existing downstream development. Some downstream drainage improvements may be needed. Coordination of the needed drainage improvements will be facilitated if the site is annexed to the City prior to development. The site can be served with sanitary sewer by extension of existing City and USA lines to the north and east of the site. The Engineering Division has no objection to the annexation. The City Building Division, Portland General Electric, and the Tualatin Valley Fire and Rescue Department have no objection to the proposal. The Tigard Water District indicates that for adequate service to be provided, several water line improvements will need to be made as a condition of developing this property. The Police Department has no objection at this point but would like to review the future development application(s) to identify the Department's manpower and resource needs. h CPO # 4 has no objection to this annexation. However, the group does indicate a concern relating to the traffic impact on Bull Mountain Road, STAFF REPORT - BRIAN/SEIYU (ZCA 89-10) PAGE 2 i i 135th Avenue, Walnut, Scholls Ferry Road, and 121st Avenue once this property is developed. No other comments have been received. B. FINDINGS AND CONCLUSIONS The relevant criteria in this case are Tigard Comprehensive Plan Policies 2.1.1, 6.4.1, 10.1.1, 10.1.2, and 10.1.3; and Chapters 18.136 and 18.138 of the Tigard Community Development Code. The Planning staff has determined that the proposal is consistent with the relevant portions of the Tigard Comprehensive Plan based upon the findings noted below. 1. Plan Policy 2.1.1 is satisfied because the Neighborhood Planning Organization and the Community Planning organization as well as surrounding property owners were given notice of the hearing and an opportunity to comment on the request. 2. Plan Policy 6.4.1 is satisfied because the annexed land will be designated as a developing area on the development standards area map. This designation allows the use of planned development techniques which are better suited for preserving natural amenities, such as those found on the subject property. In order to further assure that these techniques will be utilized, the staff recommends that the PD (Planned Development) overlay zone be applied to the property in addition to the R-7 zone designation. 3. Plan Policy 10.1.1 is satisfied because the City has conducted the Bull Mountain/Walnut area Urban Services Study which includes the subject property. This Study, as well as the comments from the Engineering Division and other service agencies indicate that adequate urban services are available in the vicinity and may be extended to accommodate the subject property. Transportation issues will be further clarified at the conclusion of the Northeast Bull Mountain Transportation Study as indicated by the Engineering Division above. At the time a development application is proposed, the City will be prepared to determine appropriate street alignment options for this property. 4. Plan Policy 10.1.2 is satisfied because the annexation will not create an irregular City boundary, the Police Department has been notified of this request, the land is located within Tigard's area of interest and adequate service capabilities can be made available to accommodate the eventual development of the property as noted above. 5. Plan Policy 10.1.3 is satisfied since the City will apply the R-7 zone to the property which is the designation which most closely resembles the existing R-6 Washington County designation. STAFF REPORT - BRIAN/SEIYU (ZCA 89-10) PAGE 3 The Planning staff has determined that the proposal is consistent with the (r relevant portions of the Community Development Code based upon the findings y noted below. 1. Section 18.36.030 of the Code is met because all facilities and services can be made available. The applicable Comprehensive Plan policies discussed above have been satisfied and the property has been determined to be a developing area in accordance with criteria in Chapter 18.38 of the Code. The Urban Planning Area Agreement between the City and Washington County requires that when annexing land within the City's area of interest, the City adopt a zone designation which most closely resembles the County's Plan and zone designation. In this case the property is designated in the Bull Mountain Community Plan for single family residential use with a minimum lot size of 5,000 square feet and a maximum density of six units per acre. The City R-7 zone with an identical minimum lot size requirement and maximum density of seven units per acre is the most similar to the present County designation. 2. Chapter 18.38 of the Code is satisfied because the property meets the definition for a developing area and shall be designated as such on the development standards area map. C.
