SPECIAL MEETING MINUTES — FEBRUARY 11, 1987 — 4:34 P.M.
1. ROLL CALL: Present: Mayor Tom Brian (arriving at 4:36 PM);
Councilors: Carolyn Eadon, Valerie Johnson (via speaker
phone), and John Schwartz; City Staff: Bob Jean, City
Administrator; David Lehr, Chief of Police; Tim Ramis_
Legal Counsel; and Loreen Wilson, City Recorder.
Councilor Eadon called the meeting to order in the absence of Mayor Brian.
2. SOUTH METZGER PREANNEXATION AGREEMENT
a. Legal Counsel reported the Boundary Commission staff questioned
the intent of the preannexation agreement which was signed with
various property owners in the Washington Square area. Legal
Counsel reported that the intent of the agreement was that any
phase—in of a tax differential would apply only to those
properties signing the agreement. lie further stated that after
discussion with the Square's Legal Counsel, Mr- Terry Hauck, the
language did seem to include a scribner's error. To clear up any
chance for misinterpretation of the intent, Legal Counsel
suggested the following change.
Page 4 — first complete sentence at the top of the page should be
changed as follows (brackets [] note language to be deleted with
underlining to note added language):
"The Washington Square Area [, which] includes the Real Property
[,] which shall be taxed at the Specified Ratio set forth
opposite the applicable fiscal year set as set forth below: . . ."
Legal Counsel stated that Mr. Terry Hauck will be supplying a
letter showing the understanding of intent from all property
owners entering into the agreement.
MAYOR BRIAN ARRIVED AND TOOK THE CHAIR (4:36 PM)
Legal Counsel recommended approval of the resolution which would
readopt the agreement with the correction of the scribner's error.
b. RESOLUTION NO. 87-23 A RESOLUTION OF THE TIGARD CITY COUNCIL
FORWARDING THE PROPERTY OWNERS' REQUEST FOR INCLUSION IN SOUTH
METZGER ANNEXATION PROPOSAL #2344 TO THE BOUNDARY COMMISSION.
C. Motion by Councilor Eadon, seconded by Councilor Johnson to
approve.
Approved by unanimous vote of Council present.

NOTICE OF SPECIAL CITY COUNCIL MEETING
Notice is hereby given that a special City Council meeting, called by the
Mayor with the common consent of the Council, will he held on February 11,
1987, at 4:30 p.m. in the City Administrator's Office, Tigard Civic Center,
13125 S.W. Hall Boulevard, Tigard, Oregon. The meeting is called for the
purpose of considering a preannexation agreement for South Metzger Annexation
Proposal No. 2344.
