Mayor Cook explained that the City is now in the process of gaining jurisdiction over the entire road. After discussing the matter with Legal Counsel, it was determined that because this issue deals only with annexation and not the use or zoning of the land+ it was not deemed a conflict of inter*st. c. L*gal Counsel indicated that his firm is representing Albertsons on another proj*ct in another jurisdiction but they have never discussed this matter with him, and there is no conflict of interest. d. Community Development Director synopsized report. The request submitted by the property owner to change the Comprehensive Plan and zoning designation will be heard by the Planning Commission and City Council in October. e. Public Testimonye o John Sh+onkwiler, 3730 SW Carman Drive, Lake Qswego, representing Albertsons, Inc. explained that a small portion of the situ Tax Lot 100, is already in the City. To avoid strip _ development on this site, it is necessary to annex the remainder of the property to obtain services to bring the land up to urban densities. This has been included in the Comprehensive Plan and City's Urban Planning Area. o Cotton Scheckla, 10200 SW Durham Road, said he did not receive a public hearing notice but is within the 300 feet. He was concerned about traffic generated by an Albertsons. Mayor Cook explained that this public hearing is strictly for the purpose of annexation and not the use of the land. f. NODI-AGENDA ITBMSi 13.1 Chessman Downs Subdivision a. Community Development Director reviewed the situation between the City and Pacific Frontier Wood Markets, Inc. with regard to the placement of a substandard sewer line. He further discussed the options available. b. City Administrator entered a fourth option to place temporary rings around the manholes to soften the effect of the height difference until the final lift of asphalt can be placed on the street. If the City pursues legal action, it may take six months before the situation can be remedied. c. Mike James, 8721 Avon Street, indicated that there are only 2 or 3 manholes but the major problem exists on the driveway approaches. The same type of temporary patching could be accomplished to provide some relief. Mr. Danes also pointed out that all the catch basins in the subdivision are full of construction sediment and will cause major flooding in the fall if they are not cleaned. d. The Council discussed the cost of providing the temporary patching and the alternatives for permanent improvements. e. Motion by Councilor Brian, seconded by Councilor Johnson to have the City provide temporary patches around manholes and driveway approaches while the City continues legal action against Pacific Frontier Wood Markets, Inc. Motion approved by unanimous vote of Council present. 13.2 Regional Library a.. City Administrator updated the status of the Regional Library Study. He suggested that the Council and County Commission discuss this issue at their workshop in September. 13.3 Council Filings 3 a. City Administrator reviewed the council candidates for the November election. .. City Administrator reviewed the calendar through the end of the year. The Sept*mber 10, 1986, Council and Washington County Commission Workshop and 980 was set for 6130 p.m. 13.8 Block Grant Advisory Committee a. Councilor Edwards had received a letter from the Washington County Department of community Development requesting that a member be appointed to a steering committee. Due to the daytime meetings, it may be advisable to appoint a staff member. b. City Administrator recommended that Planner Dwayne Roberts be appointed to the steering committee. c. Motion by Councilor Edwards, seconded by Councilor Eadon to approve the appointment of Dwayne Roberts to the steering committee. Motion approved by unanimous vote of Council present. 13.6 Hall Boulevard Bike Path a. Community Development Director said there is an opportunity to apply for State funds for a bike path. He reviewed the existing and planned bike path on Hall Boulevard. The State would provide a maxima of $309000 and the City would pay a maximum of $13,500 to cos* from the Street System Development Charges Fund. The City Administrator said this would not affect the CIP approvals already budgeted for the current year. b. Councilor Brian suggested radiating the bike paths fromthe elementary schools linking them to the major systems. Community Development Director said staff will review the bike paths with this philosophy in mind. c. Motion by Councilor Johnson, seconded by Councilor Edwards to authorize the City to sake the application for State funding. Motion approved by unanimous vote of Council present. At that meeting the Council voted unanimously to reverse the Planning Commission's recommendation of denial of the application request. Attached is an ordinance for Council adoption which amends the Comprehensive Plan designation from Low Density Residential to Medium Density Residential and Zoning from R 9.5 to R-7. The City Attorney has determined that because the City has adopted a new Comprehensive Plan, the Cochran's will need to refile for MLP approval. ALTERNATIVES CONSIDERED Adopt the attached ordinance. A separate report from the City Engineer shows the status of each project. A jurisdiction transfer of a portion of Durham Road and a number of other streets in Tigard was completed. City staff are now incorporating these roads into regular City programs (i.e. sweeping, brushing, patching). -- A 38.95 annexation (Dover Landing) was approved by the Council and submitted to the Boundary Commission. - Codes enforcement activity was quite high with a high level of voluntary compliance, - Business tax revenues are trending well as a result of a stepped--up notification and enforcement. OREGON TO Mayor, Council, and Administrator August 18, 1986 FROM: Chief of Police SUBJECT: April, 1986 Monthly Report On April 16, 1986, I began my duties as Chief of Police of the Tigard Police Department. A considerable amount of my time was expended in April in riding with officers, getting to know them, and learning their perceptions of the department in terms of function, organization, manpower, and programs. Captain Jennings and I also attended the Spring Neighborhood Meetings. letting the public know what our perceptions were of the status of the Department and what direction it would want to take given the resources. Time was also spent with chiefs of other local law enforcement agencies to gain an understanding of the level of cooperation within the local law enforcement community. I was not impressed. It appeared that there were v issues of "turf" getting in the way of meaningful cooperation between and on" local law enforcement agencies. The ray of hope was the Southeast County Chiefs. It will be the intent of the Tigard Police Department to push cooperative effort. During the neighborhood meetings, I also began hearing from the community a sense of frustration with the direction that the Department had taken over the last several Mears. There were expressions of concern about the isolation of the Department. At the same time the community seemed reasonably pleased with the service that they were netting. The Department will develop an attitude of openness and partnership with the community. My overall initial impressions of the Department are pretty positive. a, Programmatically the Department is on solid ground. Planning for 2 important processes began in June. The first process will be the recruit/selection process to develop an eligibility list for new hires by September 1st. The Police Department is developing an unique and innovative process of selection. In lieu of the traditional interview process the Department is planning an Assessment Interviews and Assessment Center Process. We are also planning on using a citizen from the community to act as an Assessor in the selection procedure. The second process being planned is an Assessment Center to select the SRO. We have also been advised that there is an interest in the School District for a second SRO for the Junior High. During June, I had the opportunity of meeting with the Neighborhood Watch Implementation Committee. I found them to be committed to the Program. Utilizing a •civilian committee to organize Neighborhood Watch areas is unique and a positive display of the police/community partnership in policing the community. I was able to provide some suggestions to the Committee and hope to explore some concerns and issues with them during the coming months. Our goals for July include: developing the selection process for entry level officers; identifying performance dimensions for an entry level assessment _ center; identifying a civilian assessor; conducting assessor training and putting on the assessment center and identifying an eligibility list. We also will being planning for an assessment center for SRO. The mobile home has been on the property for at least four months. The applicant requests a Temporary Use Permit for a period of one year. On June 9, 1986, the Council voted to deny the application and Resolution 86-68 was signed by the Mayor on June 23, 1986. On July 14, 1986, representatives of Tigard Electric appeared before the Council and requested a rehearing. Council voted in favor of the rehearing. On August 11, 1986, the proposal was again heard by the Council. Council voted in favor of the Temporary Use but the expiration data was set for February 28, 1986. Attached is a resolution for Council adoption. ALTERNATIVES CONSIDERED 1. Approve the attach resolution. 2. Approve with modifications. Before accepting this Rasemer...t we felt you should be aware of certain information. Ronald Dyches is not,� under L.I.D.#42. He was originally on the list of property owners but did not respond in time to be included in the Bancroft Bond =mounting to 4141,301. Several accounts were removed for non-service and a number paid cash. Of the balance Ronald Dychea is the only one who is not bonded under L.I.D. #42 Bancroft Bond. The City of Tigard has allowed him to psar separately and. Jerri Widner told no a few weeks ago when I checked the records at the City that he would be included in the next L.I.D. available. This means he will not be sharing in!ie additional expenses of L.I.D. #42. We do not feel Ronald Dyohes easements should be recorded until you know this is Who" Ford Leasing Development wants the connection to sewer to service T. L. 4009 Map 2 S 1 1 L. Our attorney has written to them in this regard. Ronald Dyches has a sewer connection within a few feet of the south end of his property and also a drainage connection close by where the swampland water on his property could drain. Also I want to show you a picture of the illegal fill that was put on Dyches Property without a City Permit. When we asked the fellow who was dumping if a drainage was put in he said no it would be taken care of when they put in the sewer, so naturally this is a concern especially since the City opened the drain that comes across 66th with water originating on the Fast side of I-6. I am also showing you a picture of fellow cutting tree without a City Permit and the swampland on T. L. 401. Another concern is the gas line you show on the Basement map. Q; SANITARY SEWER COMPLIANCE AGREEMENT THIS AGREEMENT dated this 17th day of July 1986, between the CITY OF TIGARD, a municipality of the State of Oregon, hereinafter termed the "City", and Tigard Christian Church, an Oregon Corporation hereinafter termed "Petitioner". W I T N E S S E T H: WHEREAS, Petitioner has applied to the City for approval of construction of a public mainline sanitary sewer, to be known as Tigard Christian Church Sanitary Sewer Extension being illustrated on the attached Exhibit "A", and by reference made a part hereof; and WHEREAS, the City of Tigard requires applicants for construction of sanitary sewers, and appurtenances thereto, to submit to construction plan review, construction inspection and testing, and, further, to provide performance assurances, to grant public easements and to remit payment of relevant fees and charges; and WHEREAS, the City has adopted the Standard Specifications for Public Works Construction Oregon Chapter APWA, for street, storm drain, structure and related work, and Unified Sewerage Agency Sanitary Sewerage rules, regulations and specifications for sanitary sewers via Ordinance No. 84-58 and amendments thereto; and WHEREAS, the public sewer improvement to be constructed by the petitioner is incomplete, and petitioner has nonetheless requested that the City permit granting of easements to the public, and the parties herein named desire to protect the public interest and assure that the improvement will be installed as required and completed within the time hereinafter set forth. NOW, THEREFORE, in consideration of the foregoing promise and the covenants and agreements to be kept and performed by 'the petitioner and petitioners surety, IT IS HEREBY AGREED AS FOLLOWS: 1. Petitioner shall proceed to complete all public improvements shown on the improvement plan, approved by the City of Tigard and prepared by Thomas H. Burton Engineering 6 Surveying (Tigard, Oregon) dated May 22, 1986; said improvement to be completed no later than one (1) year from the date of this agreement and Petitioner hereby agrees to comply with all rules, regulations and specifications set forth by the City and, to use only such materials and to follow such designs as is required to conform thereto. Petitioner shall provide certification of installation conformance and one as-built mylar, both stamped by a registered civil engineer, to the City prior to City inspection of petitioners improvement work for City tentative acceptance consideration. 2. To assure compliance with the City's requirements and the provisions thereof, Petitioner agrees to obtain, provide and tender to the City, a surety bond(s) in form approved by the City, with liability in an amount equal to the contract price of $6,150.00 prior to City issuance of a permit or approved construction plans for construction of said . improvements; Petitioner's contractor shall be licensed, bonded and insured. f: t _1_ � 3. Notwithstanding anything contained in such p � easement to the cofitrary, the rights granted in such ease ment shall not be assignable to any person or entity, excepting a transfer to a successor public agency having t . jurisdiction over storm drainage systems. 2. Notwithstanding anything contained in such easement to the contrary, the grantee thereunder shall exercise its rights thereunder in such fashion as to reason- ably minimize the burden and inconvenience suffered by the grantor thereunder, and its assigns, and shall in any event upon completion of activities pursuant to such easement leave the premises in a neat and orderly condition with all excavation to be refilled and successively refilled and settled and compacted with topsoil to a level with the adjoining surfaces and with a compaction as equivalent as possible to that which previously existed, with all debris and residue removed from the premises. No earthen materials shall be taken from the premises, and any excess earthen materials shall be disposed of according to instructions of the grantor under such easement, or its assigns. Any vegetation, foliage, trees or other natural or man-made improvements or obstructions shall be restored or replaced, as the case may be, to a condition as near as practicably possible to the condition existing previously. 3. Notwithstanding anything in such easement to the contrary, there shall be a maximum of only one storm drain pipe installed within such easement, and such pipe shall have a maximum interior diameter of no more than 18 inches. 4. S CITY OF TTGARD, OREGON MEMORANDUM TO: Honorable Mayor and City Counc' August 20, 1986 FROM: Bob Jean, City Administrator SUBJECT: Employment Agreement Renewal a Merit Increase The attached Resolution and Agreement per Council consensus was inadvertently left out of Council packets for the August 25, 1966 meeting. I request that it be added to the Consent Agenda. The Resolution ratifies and extends the attached Agreement as amended per our discussions and grants a 2% merit increase up to the $50,000 annual FY 1986-87 salary. The Agreement itself is the same with the following changes we agreed upon: o Section 2 - TERM: Renewed for 1 year. o Section 5A - SALARY: Increased to $4,167 per month effective 7/1/86. o Section 6 - RETIREMENT: No change in intent, but changed from "other general employees" to read "other management/ professional employees" per last year's changes. o Section 76 - Car allowance language included per last year's changes. o Section 9D - Temporary relocation language provided per our discussion.
