The NPC approved the proposed phasing-, e Sally Arroyo, 5505 S.W. Riverwood Lane, Tigard, distributed copies of a letter from the Audubon Society regarding the wetland issues. o Marrone Jenkins, 16465 S.W. 93rd ,Avenue, Tigard, presented a petition from residents of Kneeland Estates II. The issues of concern were part of the original appeal but were not all discussed because of time constraints. o Norm Harker, Alpha Sngineering, representing owner, had no objections to the items presented by staff and the neighborhood association. He was concerned about the safety of a meandering road from an engineering standpoint but this can be worked out with the City, Engineor• Phasing would allow them to begin work on four lots while obtaining the necessary 404 permit from Army Corps and meet the requirements of the Division of Stage Lands. o Kris Hdmna, reviewed items of aesthetic concern including frontage appearance and setbacks. III, several � concerns have been raised regarding traffic and streets. Based on spy research and on discussions at the April 2, 1986 meeting of NPO 96, I have the fo l lowing commments. 1'. There is a great meal of concern about vehicles traveling at excessive speeds on Sial 92nd Avenue between the High School and Cook Park. This is apparently an existing problem, not related to the subdivision. It e r appear:: to me that this is a traffic; engineering problem which we 1' should address this sumapr as a City problem, rather than as a � subdivision condition. about through traffic on neighborhood 2. There is a great deal of concern streets, f- special concern is the Comprehensive Plan designation of . Riverwood Lane as a minor collector connection between Sia! 92nd Avenue and sw 108th Avenue. I feel that it is a valid concern. Therefore, I recommend a review of this portion of the Comprehensive Plan Transportation Map for possible thisent. The review needs to be initiated promptly, as several amendmdevelopments are contemplated in the area in the near future. 3. There was a guest ion whether Riverwood Lane should be extended east of ; SW 92nd. Review shows that such an extension would require substantial fill in the floodplain and wetlands areas. A better location for an �. eastward access road appears to be approximately 350 feet north of Riverwood Lane at the top of the hill. I recommend that Rivemood Lane not be extended eastward from SW 92nd Avenue. 4. The concept of constructingRiver-wood Lane as a narrower—than—standard street was discussed. NPO #6 slid not support the idea. Therefore, I recommend that Riverwood Lane in Kneel and Estates Ill be designed at the same width as the existing River-wood Lane in: the adjoining subdivision (approximately 34 feet) . ' A traffic study was suggested to address this concern. I feel that we can achieve better results by specifying certain design criteria. Therefore, I recommend that Planning Commission Condition No. 12 be amended to recd as follows: 12. The public improvement plans for SW 92nd Avenue shall' provide a minimum stopping sight distance of 300 feet along 'SW 92nd Avenue and a minimum intersectionsight distance of +350 feet for vehicles entering from Riverwood Lane. These criteria are based on national standards developed by the American Association of StateHighr ay and Tr^anspoA^tat on Officials_ (Af3S4iTb) . The AASHTO standards are somewhat conservative, thereby providing for the fact that some vehicles will exceed the design speed of 35 MP14 (the current speed limit). These requirements'are greater than'what 'we would usually require on a minor collector such as SW 92nd. 6 There was a request for additional traffic studies to determine 'existing r , traffic volumes and traffic speeds on SW 92nd Avenue. MEMORANDUM CITY OF TIGARD, OREW9 TO: Members of City Council / April 3, 1956 FROM: Randy Dooley, City Engineer SUBJECT: Proposed Plat of Kneeland Estates III In discussions regarding the proposed plat of Kneeland Estates III, several concerns have been raised regarding traffic and streets. Based on; my research and on discussions ` at the April 2, 1986 meeting of NPO $6, I have the following comments: 1. There is a great deal of concern about vehicles traveling at excessive speieds on Sens 92nd Avenuebetween the High, School and Cook Parte. This is apparently an existing problem, not related to the subdivision. It t appears to re that this is a traffic engineering ;problem which we should address this , summer as a City problem, rather than as a subdivision condition. 2. There is a great deal of concern about through `traffic on "neighborhood streets." Of special concern is the Comprehensive Plan designation of Riverwood Lane as a minor collector connection between SW 92nd Avenue and SW 108th Avenue. I feel that it is a valid concern. Therefore, I recommend a review of this portion of the Comprehensive Plan Transportation Map for possible amendment. The review needs to be initiated, promptly, as several developments are contemplated in the area in the near future. 3. There was a question whether Riverwood Lane should be extended east of SW 92nd. Review shows 'that such an extension would require,substantial fill in the floodplain and wetlands areas. A better location for an eastward access road appears to be approximately 350 feet north of Riverwood Lane at the top of the hill. I recommend that Riverwood Lane not be extended eastward from SW 92nd Avenue. 4. The concept of constructing Riverwood Lane as a narrower-than-standard street was discussed. NPO #6 did not support the idea. Therefore, I recommend that Riverwood Lane in Kneeland Estates III be designed at the same width as the existing Riverwood Lane in the adjoining subdivision (approximately 34 feet) ra-1121 NO Ell 'J $� Memo to:Council April 3, 1985 , Page 2 c Vii. There was concern that adequate sight distance be provided on Sid 32nd Aveniiefor safe traffic operations A traffic study was suggested to t address this concern. T feel that we can achieve better results by specifying certain design criteria. Wherefore, I recommend that � Planning Commissions Condition No. 12 be amended to read as follows* 12.. The public improvement 'plans for SW 92nd Avenue shall C provide a minimum stopping sight 'distance of 300 feet $ along SW 92nd Avenue and a ` minimum intersection sight t distance of 350 feet for vehicles enter°ng from Riverwood Lane. These criteria are based ;on national standards developed by the American Association of State Highway and Transportation Officials (AASHTO). The j AASHTO standards are somewhat conservative, thereby providing for the 6 fact that some vehicles will exceed the design speed of 35 MPH (the f current speed. limit). These requirements are greater than what we would usually ,require on a minor collector such as SW 92nd. . _- 6.' There was a request for additional traffic studies to determine existing (� traffic ' volumes and traffic speeds on Sid 92nd Avenue. such studies °r would pe useful in addressing existing traffic concerns< on Sad 92nd Avenue, but would probably not help much in deciding hose to design ` Kneeland Estates III. The terse "water of the United States" r includes the territorial seas and all waters, up to their ordinary high -d water mark, that are part of a surface tributary system to and including ! navigable waters of the United States. Wetlands adjacent to these waters e'en are also "waters of the United States". w Based on a recent inspection by Corps personnel, parts of the proposed development site are within wetlands adjacent to the Tualatin o River. In particular, S.W. Riverwood Lane, west of`the 's ewer line, and :j lots 1, 2, 3, 4, 5, and 18 contain wetland areas (enclosure 1). aherefore,'an individual permit must be processed prior to placing fill in these areas. For activities involving fill in wetlands, a permit will be denied if there is a less environmentally damaging practicable alternative. Practicable alternatives, such as developing at other locations, reducing the scope of the project to minimize wetland filling, or redesigning the'-,., project to avoid filling wetlands, must be considered in our evaluation. �•. � If no practicable alternative exists, and a need for the project to be 'located in the wetlands and river corridor is justified, then the project should include measures to mitigate for the impacts of the fill i ' Jactivity. Army Corps of Engineers; Norm Harker, Alpha 4 Engineering; Keith L.i den, city of Tigard planner and one other city representative. The objective of this field visit was to identify what wetland issues there might be regarding future development of this site. The impetus of the site visit was � letter I sent to the Tigard planning department dated March 3, 1486. 1 have attached a copy of that letter for your infor ration. In that -letter I pointed out that logs 1 , ^ 3, 17 and IS were all "clearly within existing wetlands and should not be built on." I assume that. since I mentioned in t: iat letter that a Section 404 permit Froin the Array Corps would be required they were consulted in this matter by your staff. This morning three issues emerged which 1 would like to address: 1 . Westland and riparian wildlife habitat regarding the Kneeland development. 2. Wetland identification on a city-wi.de? basis relating to your comprehensive plana. 3. City of Tigard parks; natural habitat vs. developed park lands, especially as parks management relate=s :to wetland issues. Regarding the first issue: .There are several 'points I 'd like to make about the proposed development. As I pointed out in my March 3rd letter, there are wetlands invol*ted with some of the lots- Lots 11 29 3 and 18 are clearly within wetlands. Of these, lot IS also appears to be within the 100 year floodplain. In my opinion this lot should have no development on it. It is adjacent to a significant ff wetland. What exists on this site is a well-defined emergent t` wetland to the south of lot IS which is bordered by a scrub-shrub airtl rad consisting Of wOGdy plants such as willow, Oregon while f' ash, willow and other wetland species. This scrub-shrub wetland is also an a significant portion of lot, 18. The rest of lot IS � consists of typical riparian vegetation that is found along watercourses such as rivers, streams, ponds and wetlands in the 2 Tigard area. The wetlands appear on the draft copy of the U. Fish; and Fish and Wildlife's National wetlands inventory (Beaverton area) . I have enclosed a copy of that map with the areas in question circled. The wetlands appear to be more extensive on the ground than might appear on their map. I will bre sending a copy of this letter to Ben Harrison, National Wetlands Inventory office in Portland for their information. Most of 'their wetland mapping i s done `through aerial photography interpretation and, while generally excellent, cannot catch all of the wetlands in the metropolitan area. it is significant to note that they do show the emergent wetlands to the east of Sol 1 92nd on theirmap. Keith d_iden indicated that these' may ,not appear on your comprehensive plan map for wetland resources. � Reference to your "Flood Plain And Wetlands", on page 1-23 of R your plan would indicate this to be the case. There are no wetlands noted on `either side of "SW 012nd on this map. I will discuss this further under point 2 of this letter. I have � enclosed a copy of your flood plain and wetlands map as well . Lot ''1� does appear to be out of the riparian and wetlands, altd ough it does have an excellent stand Of riparian vegetation. This site, assuming the slope characteristics are not limiting, could be developed without significantly impacts the adjacent' wetlands. This is not the case with lot IS for the reasons I have pointed out. b. Lots I and 2 are also within wetlands. I would urge your staff to take a careful look to determine whether they are also within the 100 year floodplain. The adjacent wetlands, although significant, are not as high quality as those east of 92nd, south of lot 18. It is my opinion that, if the applicant can secure the appropriate permits, and if an acceptable mitigation plan can be worked out with Oregon Department of Fish and Wildlife, these two lots could be developed. This will require adequate buffering between the proposed development and the existing wetlands and should include some modifications of these wetlands to enhance their wildlife habitat values (plantings, increased plant diversity, digging of ponds, etc.) . All of this, of course, should be done in concert with the part's department developing its own plans for the continued protection of these wetlands (discussed under point 3 of this letter) C. Lot 25, seems to be intermediate between the first two subnunits I 've addressed. It has more diverse wetland plant features ( more rushes, willows, etc. and is much less a monoculture of reed canarygrass ) ." This lot seems even more likely to be aiithin the 100 year floodplain,. If it is not, and nd a 404 permit can be obtained for development is allowed, a limited vaetland fill , then mitigation would be in order. My recommendation would be that any mitigation plan that is developedbe coordinated for lots 11 2, and 3 so that a biologically and hydrologically sound plan can be developed. d. It is unclear whe=ther the Corps has jurisdiction over thee on the hillside which 1 i e 'upsl one from the proposed road. Darla Siegfried expressed doubt about their jurisdiction this morning. It is obvious from the existing vegetationthat a considerable amount of water does flow' down' the hill toward the wetland. < Therefore, there is a hydrologic connectio., between the two areas. Oftentimes seeps 'such' as this dei represent important wildlife habitat for suet•: species. as amphibians 1 feel their value should be recognized in the development of plans for the proposed development. e. The proposed road appears to be above the wetlands, altilough the seeps support wetland species throughout ,the alope. The hydrology of the entire slope; should be studied by the applicant to determine what impacts relating to drainage will be induced by placement of the road. f. l am concerned about the future of the small pond adjacent to SW 92nd. It clearly has significant wildlife habitat val lees and should be included in the overall site design to ensure its integrity is protected. I suggested this morning . that a 1.imiteq amount of public access for wildlife viewing would be desirable. sufficient planting of wildlife-attracting plants around the "pond would limit the -incursion of humans 'aroused the perimeter while allowing an observation site. The motorized vehicles which presently have a major negative impact on the site need to be discouraged. g. Resource agency involvement: The resource agency staff who most often work can issues of this nature are Gene Herb and Joe Peseh, Oregon T}epa,r tment, of Fish and Wil cis i f W z Di arra, Hwang and Nancy El l i f ri t, U. ' S. Fish and Wildlife se=rvice and representatives from the Regulatory Functions, Permit Section of the U. S. Army Corps of Engineers < I assume in this case that would be Duna Siegfried ) . I strongly suggested during our site visit that these individuals should be t:on5ulted before an,, mitigation plans are established since your staff does not have a background in development of such plans. It is my opinion that there are very significant wetlands present on the Kneeland site as well as on adjacent kinds. The "for sale" � y sign to the east of 92nd, which is place in an emergent wetland indicates that future conflicts are in storey for this property as well .
