CALL : Present: President of Council Tom Brian; Councilors: Phil Edin, Jerry Edwards, Ima Scott; City Staff: Frank Currie, City Engineer; Tim Ramis, Legal Counsel; Jerri Widner, Finance Director (left at 8: 18 P.M.); and i._ureen Wilson, Deputy City Recorder. In the absence of Mayor Cook, President of Council, Tom Brian, chaired the meeting. 2. CALL. TO STAFF AND COUNCIL. FOR NON-AGENDA ITEMS a. City Engineer requested item .1 "Labor Relations Contract Approval" be added to non-agenda. b. President Brian requested item . 2 "Civic Center Budget Discussion" be added to non-agenda. 3 . CALL TO AUDIENCE: a. Dave Atkinson SW Summerfield Drive resident, questioned what was discussed regarding Durham Road at the Administrator's Conference reported in the Oregonian. President Brian reported that three Councilors were present at the meeting and tVie portion of Durham Road discussed was in Tualatin not Tigard. b. Scott Gilchrist, NPO #7 rFpresentative and member of Progress Bible Church, discussed the plans for 130th Avenut: and asked Council to agree to hear a CPA on that property out of sequence (moving it up on the agenda of the Planning Commission) and waive the application free for, the church. tie stated that until the use of 130th was decided, the church would not be able to implement any expansion plans. President Brian requested the church file their CPA request with the City. After staff review, the item can then be acted on by the Council. He stated Council would try to respond within Mr, next couple of Council meetings. 4. LID FINANCE. POLICY DISCUSSION a. Finance Director discussed at length the policies for the Finance and Closure section of the new LID policy manual. The following policy statements were modified, or noted for further discussion by consensus of Council present as follows (words underlined were added, words in brackets were deleted) : 6.2.3 The interest rate charged will be the net effective interest rate of the bond sale plus 2% for administrative expenses, i.e. , recording the lien at Washington County, billing costs, etc. Page 1 - COUNCIL MINUTES - JANUARY 14, 1985 Y 6.2.4 Interest on the assessment shall being to accrue ten working days after the passing of the ordinance spreading the assessments for all property owners, whether requesting installment payments or paying in cash. 6.2.5 If the City does not receive an application to pay in installments within ten working days of notification of assessment, it will be assumed the property owner will be paying in cash. 6.2.8 If an applicant to pay in installments [has demonstrated a delinquent payment history] is current on. all payments on other LIDs, sewer bills or property taxes on the assessed property, [the City shall limit the amount financed] the applicant shall be eligible to pay in installments._ 6.2.12 Criteria shall be discussed at a later meeting. 6.2.14 Council wished a fixed fee be established with a percent of the total bill also being due. Staff will return later with more information. 6.2.16 This will be discussed at a later date, Council's intent is to protect the City for one year before the contractor is released from liability on any development. Finance Director left: 8:18 P.M. 5. ORDINANCE NO. 85-01 AN ORDINANCE OF THE TIGARD CITY COUNCIL. SETTING FORTH PUBLIC LAND VACATION PROCESS, SE-1 TING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. a. Legal Counsel reported on the current problems experienced by staff in processing vacation requests and recommended Council approve the ordinance which would set up a process which should address vacation problems before the public hearing process. b. Motion by Councilor Edin, seconded by Councilor Scott to adopt. Approved by unanimous vote of Council present. C. Mr. Jerry Cach, 15970 SW Sunrise Lane, mentioned his concerns that the new process would lengthen the time required for a vacation and make it too expensive. d. After further discussion, President Brian requested Mr. Cach submit recommended changes to staff for review. 6. ORDINANCE NO. 85-02 AN RY SEORDINANCE ENDING THE Y NA SEWERAGE RULES ANDREGULAT ONS ANDDECLARING AN EMERGENCY. a. City Engineer recommended Council approve amending ordinance which would set out City fees in more detail. b. Motion by Councilor Edin, seconded by Councilor Edwards to adopt. Approved by unanimous vote of Council present. Page 2 - COUNCIL MINUTES - JANUARY 14, 1985 7. COUNCIL_ INITIA,LD STREET VACATION DISCUSSION a. City Engineer discussed the problems with a proposed vacation process on the corner of Walnut Place and 99W. He stated that since the signatures required un the petition would include some companies back east that it would make the vacation more feasible if Council initiated the process. b. President Brian rioted he has had recent business dealings with Mr. Hudson and though he does not feel there is a conflict of interest, he will still abstain from voting. C. Motion by Councilor Edin, seconded by Councilor Scott to initiate the street vacation process contingent upon Bob Hudson paying all fees and that all abutting and affecLud property owners be notified by mail. Approved by 3--0 majority vote of Council present, President Brian abstaining. 8. HALL. BLVD./BURNHAM LID DISCUSSION a. City Engineer distributed map showing area of Hall Blvd. between Burnham Street and O'Mara. With the Civic Center project, the Water District offices and the Christian Church all needing to construct half street improvements within the next couple of Years, 'iP suggPsted an LID might be the best tool by which to �iccomplish this task. He stated the Water District may not wish to bancr•ofL the assessment. The City Engineer also noted that the intersection of Hall and Burnham could either be signalized or have the turner redesigned to eliminate some of the sight obstruction. He also felt with the Water District and City offices being located in the same area, the increased traffic would be another reason the LID concept would be beneficial. b. Don Geary, 17832 Cardinal Place, Lake Oswego, represented the Church of Christ and stated they would like to participate in the LID plan process. He explained the church would be building in the next couple of years and realized the LID process could be cost effective for them. He did mention that Uie Church would not be interested in participating in any cost for the bridge reconstruction on Hall Blvd. C. Consensus of Council was to direct the City Engineer to check with other surrounding property owners for an indication of interest on their part in the LID process and to also check w;th tax lot 600 across Hall Blvd. from the Christian Church. City Engineer reported on the Washington County Major StrneLs Transportation Improvement Program. The task force has prepared a list of streets that would benefit from the passage of a bond sale. The areas within the City Limits are: Scholls Ferry Road/Fanno Creek to Murray Blvd. Greenburg Road and 99W Intersection Hall Blvd, Bike Trail/ Durham Road to 99W Bull Mt. Road and 99W Intersection Durham Road/ 99W to Carmen Interchange b. Eunice Day, 15940 SW Oak Meadow, represented Summerfield and rioted that they are very concerned about the proposed development plans for Durham Road and noted they are serious about protecting their homes. C. After lengthy discussion, consensus of Council was to have the City Engineer request information for proposed development plans on Durham Road and report back at a future meeting. 10. Motion by Councilor Edwards, seconded by Councilor Scott to delete items 10.3 and 10.9 and continue to a date uncertain, and approve the remainder of the Consent Agenda. Approved by unanimous vote of Council present. / 11. NON•-AGENDA ITEMS: From Council and Staff t Page 4 - COUNCIL MINUTES - JANUARY 14, 1985 11. 1 LABOR RELATIONS CONTRACT APPROVAL a. Councilor Scott requested air fare be deleted from the contract and she wished lodging and meal charges to be identified. b. Councilor Edin and Edwards expressed confidence in Mr. ScoLt and noted concern in modifying the proposed contract to any great extent. C. After further discussion, Councilor Edwards moved to approve the contract with Donald W. Scott and authorize signatures with the following amendments: Air fare be deleted, a cap of $5,000 be inserted, and meals and lodging be limited with the wordage "reasonable local commercial rates" added. Motion seconded by Councilor Scott. d. Mr. Bressley, a Summerfield resident, encouraged Council to not quibble over nickles and dimes on the contract. Approved by unanimous vote of Council present. 11 .2 CIVIC CENTER BUDGET DISCUSSION a. Councilor Scott expressed concern regarding the use of revenues on the Civic Center Building Project which were formerly set aside for furnishings . She requested Council reconsider their vote of 12/17/84. She was concerned that monies should not be borrowed from another fund to cover the $105,000 anticipated revenue from the sale of the old City Hall site on Main Street:. b. Councilor Edin noted history of issue and stated he would consider borrowing $80,000 from another fund with the condition LhaL Lhe $80,000 plus interest be paid back upon the sale of the property . He also stated that to cut back the project now by $105,000 would be more costly in change orders than the risk of borrowing the money from another fund. C. Councilor Edwards stated Fie understands interfund loans and realizes that is would be more cost efficient at this point than to change the plans. He also requested the Civic Center advise Council of their concerns. d. President Brian stated he has talked with Jim Blaurock, Chairman of the Park Board, and that the Park Board members approve the monies being used for the Civic Center as long as it is the last funds to be spent of available revenues and they understand the funds will be used on the Fanno Creek side of the project. He also mentioned concern regarding the inadequate marketing effort to date on the old City Hall site. He suggested a marketing group may have to sell the property. f Page 5 - COUNCIL MINUTES - JANUARY 14, 1985 e. Valerie Johnson, Chairman of the Civic Center Advisory Committee, synopsized the history of the issue and expressed the desire of the committee was to carry--out Council's directive in cutting other areas if revenue sources are reduced. f. Lengthy discussion followed. Motion by Councilor Edin, seconded by Councilor Edwards to reduce the $2.5 million budget by $25,000 which is to come out of the line item for the old City Hall sale, and condition the final approval of bids with Council's right to a full range of options to choose which revenues will not be spent in light of a low bid. Motion approved by a 3-1 majority vote of Council present. Councilor Scott voting nay. g. Consensus of Council was to see an active renewed effort to sell the old City Hall site and requested staff bring back a marketing plan for Council review. 12. EXECUTIVE SESSION: The Tigard City Council will go into Executive Session under the provisions of ORS 192.660 (1)(d) to discuss labor relations issues. a. INFORMATION SUMMARY The Civic Center Project and the Water District's intent to improve their interest at the intersection of Burnham and Hall have given rise to the possibility of making a complete improvement on Hall Blvd. , from the railroad to Fanno Creek, and on Burnham from Hall Blvd. to the curve, with the possible inclusion of a traffic signal at the intersection as an extra capacity improvement. An L.I.D. could include 4 property owners - the City, Dick Sturgis, the Tigard Electric parcel and the Water District. The Water District has indicated a desire not to be included as they have already taken steps to accomplish their responsibility at a lessor estimated cost than would be expected in an L.I.Q. The inclusion of the Water District doesn't affect the formation of an L.I.D. in any substantial way, as long as they accomplish the improvements to make a logically complete project . I will attempt to contact the other two owners prior to the Council meeting date of January 14, 1985. ALTERNATIVES CONSIDERED 1. Proceed with Civic Center improvements only, and let the rest fall into place as it will. 2. Initiate the L.I.D. process on motion and direct staff to prepare an engineer's report and feasibility study and contact the owners for input. SUGGESTED ACTION Staff recommends formation of an L.I.D. to complete the improvements from Fanno Creek to the railroad tracks in two phases allowing the Water District + to contract its own portion and act as its' own general contractor. In order to pay in installments, the current property owner at the time of the assessment may make application. If accepted, the installment payment becomes part of a Bancroft Bond issue. If the property changes ownership during the life of the installment agreement, the new property owner must make application to assume the outstanding assessment balance. In order to protect the City's position, the following criteria are proposed for assumptions: ASSUMPTION CRITERIA FOR BANCROFT ASSESSMENTS 1. No assumption on any Bancroft less than $3,000.00. 2. Assumptions will be at current bond selling interest rate allowed by ORS 288.520, which is 13% unless no bidders then 14%. 13% would be the rate used. 3. Assumptions will be payable monthly and will be for a period 1/2 of the outstanding period of the current installment agreement. 4. An assumption fee of 2% of the outstanding balance will be charged. Fees for recording the lien and the release of the lien will also be charged. 5. There will be no assumption, if Bancroft is on vacant land that is being parceled for residential or commercial development. 6. In the event that such action be brought, the Petitioner and the Petitioner's surety shall be required to promise and agree to pay, in addition to the amounts accruing and allowable, such sum as the cou_t shall adjudge reasonable as attorney's fees and costs incurred by the City, both in the Trial Court and Appellate Court, if any, or the City may at its option bring proceedings to enforce against the Petitioner and/or Petitioner's surety specific performance of the contract and compliance with the standards adopted by the City of tigard, and in any event, in a like manner, the City shall be entitled to recover such sums as the court may adjudge reasonable for the City's attorney's fees and costs, both in the Trial Court and Appellate Court, if any. 4. Petitioner, concurrent with the execution hereof, has deposited with the City an amount estimated to equal rental and maintenance fees with respect to the street lighting facilities according to Portland General Electric Schedule 191, Option B together with a further sum equal to the estimated cost of providing electrical energy to energize the street lighting facilities for a period of two (2) years from the date of initial energizing of said lights, in the sum of $279.36 5. The City agrees to make and provide periodic and final inspections which in the City's interest are desirable to assure compliance herewith, in consideration whereof the Petitioner has paid prescribed inspection fee of 4% of the total estimated cost of the constructionx aaf3d fma,being $ 986. 18 ; Also, the perscribed main line sewer inspection fee, being $100.00. 6. The City agrees to installation of certain street identification and traffic signs for said street, in consideration of payment in the amount of $ 76.25 7. At such time as the public improvements have been completed in accordance with the City's requirements, Petitioner shall submit a "certificate of installation conformance" to the City to notify the City of the readiness for acceptance consideration inspection and upon notification by the Department of Public Works that the requirements of the City have been met, the Petitioner will submit to the City a good and sufficient maintenance bond, if not already provided with the performance bond form approved by the City, in the sum of $ 5_600.00 to provide for correction of any defective work or maintenance becoming apparent or arising within one (1) year of tentative acceptance of the public improvements by the City. 8. Within one year of tentative acceptance of the public improvements the Petitioner agrees to place a one (1) inch asphaltic concrete Class "C" overlay on all roads. 9. Monahan, Director of Community Development SUBJECT: Report on Subsidized Housing Since our acknowledgment hearing before (_.CDC in November, two important meetings have been held. The first meeting, attended by Mayor John Cook in Salem, was held on December 7, 1984, with Assistant Director Fldun Hout and LCDC staff. The discussion during that session centered on LCOC's requirement that policy 6.1 .2 and 12. 1 .1 of the plan dealing with subsidized housing dispersal be deleted. We explained our concerns and convinced LCDC that we need to have the option of inserting an alternative policy if we eliminate 6.1.2 and 12.1.1 . Our discussion resulted in a commitment from LCDC that they would work with us to draft language we hup to accomplish our purpose of drafting a policy or Code provision which LCDC can support. The alternative could be proposed as an amendment. Lu our plan at post acknowledgment. Although LCDC is not required to approve our modifications at post acknowledgment, being in a position Lo argue that, the language which we may propose is language which LCDC supports could be in our favor. Li:DC staff, Jim Sitzman and Dale Blanton, met with I_iz Newton and I on December 27, 1984, to discuss their ideas for alternative language. Our intent was to develop a policy or implementing technique which performs the same purpose as our original policy, that i.s, preventing an undue concentration of subsidized housing. One possibility being discussed is a process which requires a review of any subdivision which will result in common ownership of over Lhree adjacent units or more than thirty per cent of the units in the subdivision. The review would involve an analysis of building type, siding, and maintenance of the structure and grounds. Thus, the concern which were raised during the comprehensive plan process about subsidized units such as appearance and preservation of property values could be dealt with within a review process which is not restricted only to subsidized units. Such a process could eliminate the criticism of our plan that we are singling out subsidi.z-d units only for additional review. We are awaiting revised suggested language which LCDC is working on. Once this language is received, the staff and City Attorney' s office will review it then submit it to you for consideration. Ann Culbertson with the office of Community Development has contacted the City and requested that under the rules of Lho Community Development Plan, Lhe City Council acknowledge submission of the application. A copy of the Application is attached for your information. PROBLEM STATEMENT: Due to the inadequate storm drain system, storm water runoff has been flooding foundation { homes, basements and the railroad. Numerous storm drainage complaints have been received from residents in the area. In addition, these are areas of severe erosion. Areas of flooding and erosion are indicated on the map attached as Exhibit "B". 9. PROJECT DESCRIPTION: A. Describe how the neighborhood project activities address the need or alleviate the problem identified in the problem statement. The installation of an adequate storm drainage system will meet the storm runoff needs of the area. The project will allow storm water runoff to be piped out of the area into Fanno Creek rather than running over the surface of the land or through open trenches. The total project cost is $ 342,000. There are 584 equivalent service units included in the project area. Approximately 321 equivalent service units are under the control or ownership of individuals in low to moderate income brackets. The Southern Pacific and Burlington Northern railroads will contribute $42,000 to the project. The remaining $300,000 will be divided by the 584 esu to equal payments of approximately $525.00. The CDBG funds will pay the assessment for individuals in the low to moderate income bracket. B. Now wi l l CDBG funds be used? Describe tasks and provide timeframe for completion of project. Preliminary Engineering - May - June 1985 - This task will be started as soon as the CDBG a►oney is awarded and involves preliminary design work to allow for formation of the LID. Formation of LID - May - Oct. 1985. This task would be started as soon as the CDBG money is awarded and involves educating the neighborhood residents of the project purposes, public hearings, and recording assessments. Detailed Design - Oct. 1985 - March 1986. This task involves preparation of detailed construction plans. Construction April 1986 - July 1986 - This task involves actual project construction. • R C. What are the consequences if the project is not funded? The storm drain system as it presently exists in the area will continue to deteriorate. The ionly alternative to CDBG funds will be to form a Local Improvement District (LID) at full cost. It is unlikely that an LID would be formed in an area of low-moderate income individuals at full cost as the assessments would place an undue burden on low-moderate income home owners and renters. The LID would be more likely to be accepted by the area residents if they could receive the benefit of improved storm drainage at a reduced cost. 10. Explain whether this project is part of a coordinated effort involving other CDBG projects in the neighborhood. There are no other projects involving CDBG funds currently being undertaken in this neighborhood. r s 11. CITIZEN SUPPORT: A public hearing was held on January 4, 1984, to consider needs for Community Development Block Grant funding. A copy of the minutes are attached. Also attached are complaints from area residents regarding storm drain problems. 14. PROJECT MANAGEMENT CAPABILITY: City Engineer, Frank A Currie will be the project manager. Mr. Currie is currently Public Works Director for the City and has 20 years of experience in Public Works, Engineering and Management.
