APPROVE POLICE COPIER AWARD a. Councilor Scott questioned the bid specs. Deputy Recorder explained the needs of the Police Department and tied that to the specs which the City used to go out for bid on a copier. Page 1 - COUNCIL MINUTES - NOVEMBER 12, 1984 b. After further discussion, Councilor Brian moved to approve the r three year lease purchase of the Xerox 1048 copy machine with sorter. Councilor Edin seconded the motion. Approved by unanimous vote of Council present. COUNCILOR SCHECKLA ARRIVED: 7:57 P.M. 7. BURNAM SEGREGATION DISCUSSION a Mr. Willard Mendenhall, representing Mary Burnam, requested that they be able to pay for each lot when it is sold. b. Legal Counsel cautioned the Council to check the legality of segregation on an 1_IO which was bonded prior to the 1983 legislative year. y titer C. After further discussion, Councilor Edin moved to remove the preconditions from the approval to segregate the LID to lots in the proposed subdivision, that the segregation be reaffirmed, a fee for lot release of $1,500 be placed on each lot and must be paid as it is sold, further that the City is not limiting any foreclosure options. CIVIC CENTER PROJECT - Budget 6 Fee Waivers a. Valerie Johnson, Civic Center Committee Chairperson, gave a brief report on the work the Committee has done to date, and introduced the architects, Larry Smith and Norm Dull. b. Norm Dull presented the site plan, floor and roof plans, and discussed elevations for the exterior walls. After lengthy discussion with the Council, he introduced Mary Carter-Spies from Lee Loveland, who discussed the interior color and texture finishes and patterns. C. Consensus of Council was to recess to view the models up close. RECESS: 9:15 P.M. RECONVENE: 9:29 P.M. d. Councilor Edin requested this item be held over one week to give him a chance to study the issue further. e. After further discussion, Councilor Scheckla moved to approve the project concept and authorize preparation of the bid packet. Approved by a 4-0 vote of Council present, Councilor Edin (" abstained. Paige 2 - COUNCIL MINUTES - NOVEMBER 12, 1984 9. NON-AGENDA ITEMS: 9.1 Councilor Scheckla stated that he was concerned that Council mail is not getting delivered to Council in a timely fashion. City Administrator stated this has been discussed on a staff level and in the future mail will be opened so that Council can be called. 9.2 Mayor Cook asked if Council wished to have Councilor-elect Edwards attend Executive Sessions and receive full Council packets between now and the beginning of his term of office, January, 1985. Consensus of Council was to give Councilor-elect Edwards all information which is given to Council and to invite him to attend all Executive Sessions. 10. RECESS TO CITY HALL a. PERSONNEL RULES DISCUSSION a. Staff and Council reviewed the Personnel Rules. City Administrator recommended the Personnel Policies be discussed in open meeting and labor relation strategies be considered in Executive Session. Council is to give written comments to City Administrator prior to November 19th meeting. City Administrator discussed City Recorder position noting the change in functicris since the adoption of the Charter. More information will be supplied on this matter at a later date. 12. Alderbrook Circle discussed the City Administrator's contract stating he felt there was no equity in the contract and requested it be amended. 4. CIVIC CENTER PROJECT 6 0QWaTTEE REPORT a. Valorie Johnson, Chairman of the Committee referred to the project h time lines and stated they were ready to go through the preliminary review with the appropriate agencies. The schematic has been firmed up, all within budget. The project is in balance in each of the areas as to space needs as given to them. o Larry Smith, Architect gave program status as follows: City Hall 9087 sq. ft; Town Hall/ -public meeting space 2400 sq. ft. ; Library 11724 sq. ft and Police 8238 sq. ft. He showed a site model and explained, site, parking, traffic patterns and revisions to the Library space. Total space for the project 31449. sq. ft. o Councilor Scott noted the main entrance should accommodate the handicapped. COUNCILOR SCHECKI.A ARRIVED AT 8:15 P.M. o Architect Norm Dull reviewed special costs, noting with the cut backs and adjustments the estimated cost is $1,698,000 and within budget. o Council, Committee and staff discussed traffic hazard at entrance on Hall Blvd and suggested the speed be reduced. Councilor Scott suggested Council meet with Committee to consider interior walls and C space relationships. Consensus was, interested Council members to attend Civic Center Committee meetings. b. !Lotion by Councilor Brian, seconded by Councilor Edin to accept the Committee report and to direct the Architect to proceed with design development. Consensus was there was still time to address the issue and there will always be Some minor adjustments in a 10 year plan. Approved by unanimous vote of Council present. RECESS 8:55 P.M. - RECONVENED 9:25 P.M. 5. STORM DRAINAGE DISCUSSION a. Director of Public Works discussed Washington County's storm drainage plan, noting the County has been concerned with plan, financing and forming a county-wide drainage utility. He noted the City has already in place a drainage utility for the Fanno Creek Basin and the City is reluctant to s-pport a county utility tax. Council discussed issue and consensus was that staff should continue to attend the County meetings and have input. 6. REVENUE MANUAL DISCUSSION a. Joy Martin, Administrative Assistant briefly reviewed the revenue manual, noting the authority, rates and revenue sources. She then asked Council direction as to whether or not to continue the policy of setting rates by Resolution. She explained how fees and charges are made for specific services, noting this is a refining of the estimate of costs for normal processing of applications for specific services. Council was requested to give direction as what to use as a guide line. Council discussed the matter noting the fees were increased 2 years ago and their reluctance to raise then at this time. Consideration was also given to the impact of the 1-1/2% property tax measure and consensus was to wait for the outcome of the election and then reconsider. Staff to bring back next week specific fees to be changed, showing the per cent difference. o Staff recommended Council approve ordinance removing permit fees from the Tigard Municipal Code and setting the fee rates by Resolution b. ORDINANCE No. 84-54 AN ORDINANCE OF THE TIGARD CITY COUNCIL AMENDING SECTION 15.04.030 OF THE TIGARD MUNICIPAL CODE RELATING TO FEES CHARGED FOR STREET AND ALLEY EXCAVATION PERMITS, CHANGING THE METHOD BY WHICH FEES ARE ESTABLISHED AND DECLARING THE EFFECTIVE DATE AS OF NOVEMBER 1, 1984. Mechanical and electrical department are being asked to detail their areas of the planning. Interiors department is starting to put a possible color scheme together. Planning is beginning the half—street improvement preparations. Architects have met with a City Planner and are preparing for site design review. Process takes about 45 days. Meeting schedule for the Committee was discussed. Our next meeting is October € 18, 1984. We will schedule another meeting November 1, 1984. Tentative meeting with the City Council for final approval on the Design Development phase is November 12, 1984. Cost of standing seam metal roofing vs tile roofing was discussed. Architects research shows that tile is more expensive and probably not going to work as well for our building' s appearance as the metal would. Also, the standing seam metal is more compatible with the proposed window system. Lee Lovlin Interiors will be the interior consultants for our project. Mary Carter Spies will be the representative from that firm. She made a brief presentation showing some of the preliminary types of products they are looking at. Brief report made on the architects presentation to NPO #1 was very pleased with the project. They will be seeing the final plans during the site design review process. $1895.00 has been charged to the Committee in attorney fees. We have a total budget of $8,000.00. Committee decided to meet next Thursday, October 11th at 5 P.M. on the site to look at some interior colour samples in the natural light. Meeting adjourned 9:45 P.M. ADJOURNMENT \ a s 1 1 f i (607p) TIGARD CIVIC CENTER COMMITTEE October 18, 1984 Meeting convened at 7:40 P.M. by Chairperson Valerie Johnson. Committee members present were: Susan Mueller, Bob Carn, Ed Duffield, Dennis Derby, Carolyn Eadon, and Valerie Johnson Chairperson. Present from architectural firm: Larry Smith, Norm Dull, Mary Carter Spies-Lee Lovlin Interiors. Also present statt liaison Joy Martin. Visitors: Walt Munhall, Barbara White, Irene Ertell. Update of a budget draft was presented by Joy Martin. 1l Norm Ratith then explained the construction costs of the project. During construction the contractor will be responsible for monthly reporting to the firm of Smith 6 Dull. They in turn will report to the Committee. Property closing was final October 17, 1984. The city is now the proud owner of the site. Project update of the consultant's activities was presented by Norm Dull. His Cpresentation was accompanied by a written outline. Apparently there had been some misunderstanding at the October 4 meeting in regard to the Committee's action regarding color palettes. The Committee had felt they had offered "direction" in a color choice, but the interior designers had interpreted that as a firm choice and were building on that assumption. That misunderstanding has now been clarified. A meeting for input from staff and library has been held. General consensus from them is a blue and grey scheme, with a brighter accent color. Their comments and suggestions were relayed to the Committee by Norm Smith and Mary Carter Spies. After reviewing color paletes again, the Committee directed Mary to start developing the green-gray pallet. Multnomah County, (Oregon Tax Court No. 1762). The opinion o the Court was that Multnomah County was obligated, pursuant to ORS 294.080(3) , to pay the School District interest earned on property tax revenues collected by the County for the City. This opinion was inconsistent with the long-standing practice of all Oregon counties. Multnomah County and the School District chose to settle their dispute and the matter was not appealed to a higher court. Washington County believes the opinion of the Oregon Tax Court is in error. However, as you are likely aware, the County has taken the position that it will begin to pay interest earned on the unsegregated tax account to the taxing entities beginning fiscal year 1984-85 unless otherwise provided by law. Beaverton School District No. 48 and Tigard School District No. 23J have filed complaints against Washington County in the Oregon Tax Court alleging entitlement to interest earned on property tax revenues collected on their behalf for fiscal year 1983-84. Both school districts are represented by the same attorneys who represented School District No. 1 in the Multnomah County case. Washington County has denied any obligation or responsibility for interest to those taxing districts for that period or any other period. However, in order to resolve the disputes between Tigard and Beaverton School Districts the County and the Districts have reached a settlement understanding. The settlement is based upon a lump sum figure claimed from the County by the Di stricts. In return for the lump sum payment to be paid over a period of three fiscal years the Districts would agree to release, hold harmless and covenant not to sue Washington County' s agents or employees for any responsibility or obligation to pay interest earned on the unsegregated tax account for the tax years preceding 1984-85 including any penalty or interest ds provided by ORS 311.345 or otherwise. an equal opportunity employer Page 2 The County has computed a lump sum amount, using the same manner and process { used by School District Nos. 48 and 23J , for your City.
