Public Hearing Reopened b. Planning Director summarized memo regarding some lots which are designated either' partially or totally open space which do not fit into any of the three categories. Problems arise for owners who want to develop or sell the property, and in addition the property is not publicly owned so they are paying property taxes. Staff recommended two alternatives to the Planning Commission. COMPREHENSIVE PLAN AMENDMENT/CPA 10-84/COMMUNITY DEVELOPMENT CODE A recommendation by the City of Tigard Planning Commission regarding various 'sections of the Community Development .Code. A complete list of the Sections recommended for amendments and the 'proposed language changes are available in the City's Planning Department. a, Public Hearing', Reopened b. Planning Director commented some of the changes suggested on the errata sheet were by other agencies which have reviewed the Comprehensive 'plan. Most changes were recommended by staff as 'a result of having 'implemented the code for the last, few months. Changes recommendedareprimarily for clarification of sections of the code. Planning Commission recommended changes and staff recommended approval. C. Public Testimony Mary Clinton,' 9865 S.W. View Court, , Tigard, Oregon, commented on Section'18.98.030 and suggested theinsertionof the word "Or" any abutting lot.' She also proposed that ;flag lots should' be in larger areas because of setbacks. This would be a more restrictive requirement. Staff responded they felt Mrs. Clinton's recommendation was too restrictive and changes the meaning entirely. { Public Hearing Closed. d. Planning Director reported agenda items 2.10 through 2.14 were not heard at the Planning Commission meeting and recommended Council open the public hearing and continue to May 14th. b. Public 'Hearing Opened for agenda items 2.10 through 2.14. C. City Administrator noted Mrs. Clinton, 9865 S.W. View Ct., Tigard, and Geraldine L. Ball representing DJB, Inc. , 11515 S.W. 91st, Tigard, had signed up to speak on agenda items 2.10 and 2.11. d. Motion by Councilor Cook, seconded by Councilor Scott to continue agenda items 2.10 through 2.14 to May 14, 1984 Council meeting. Motion approved by unanimous vote of Council. 13. L.C.D.C. STATUS REPORT a. Planning Director reported on presentation to L.C.D.C. and stated 4 major policy issues remain to be resolved: Goal 2, Land Use Planning, and Goal 5, Open Spaces,' Scenic and Historic Areas, and Natural Resources have been dealt with. Goal 10, Housing, Item 1 has been taken care of. Item #2 additional manufactured homes; Item 4, Housing Density, and Item 5, Subsidized Housing are issues that need a solution. Staff reported they had direction how to handle the need assessment, and this would not affect the Comprehensive Plan. b. Council and staff discussed the requirement regarding density of 10 units per acre, and how to achieve that goal. Staff must have a way to increase the density from 9.1 to 10 units' per acre. Staff suggested the following alternatives: 1. Up-zone some areas. 2. Argue with L.C.D.C. 3. Zone some areas in downtown and triangle, first floor commercial and the rest, overhead, be used for residential. 4. All undeveloped land zoned medium high density; now zoned 13-20 units per acre, be zoned 13-25 units per acre. This would equal 10 units per acre and solve the density issue. C. Council discussed strategies, opinions and options available. Mayor pro tem Scheckla suggested staff work with Washington County to give us some ideas. Consensus was to keep the plan f as consistent as possible without going back through the 'NPOs, `and ,still satisfy L.C.D.C. Consensus of Council, staff to do some research and come back with preliminary information before going to the Planning Commission. Item 5 Subsidized Housing; Staff noted they will clean language up and suggested the following 'options. (1) draft another ,policy, or (2) consider dropping,, policy. The original purpose was to limit the number of subsidized housing in an area. Consensus of Council was ;to more clearly define the terms. Item 10. Manufactured housing. Staff recommended adding conditional use standards. Council discussed older mobile homes going into new development mobile parks. Councilor Scott requested City Attorney research issue of State law prohibiting the 'moving' of older homes into new developments. Staff to come back with recommended language. 9:50 P.M. He suggested Council consider appointing at least 4 members to avoid delay, and get the project going. Council discussed appointments by Mayor with unanimous decision of Council present. Mayor pro tem Scheckla reiterated he would not make an appointment unless it was a unanimous vote for candidates. Council discussion followed concerning candidates and attempting to reach a compromise and appoint a 4-member Committee.
