(a) City Administrator reported proposed resolution was prepared with 1
assistance of City Attorney's office and language compliance had been
checked with Secretary of State's office.
• Council discussed proposed measures. With respect to question number
53, Councilor Brian suggested changing language under "Purpose" to
state.. .new equipment will include, base station, tape recording,
console, station control and other radio items.
• Consensus of Council was to amend language as suggested by Councilor
Brian.
(b) RESOLUTION NO. 83-38 A RESOLUTION OF THE TIGARD CITY COUNCIL x
CALLING FOR A SPECIAL ELECTION TO
SUBMIT TO THE REGISTERED, QUALIFIED
VOTERS OF THE CITY TAX LEVIES FOR
CERTAIN HUMANITARIAN PROJECTS AND
VARIOUS LEVELS OF SERVICE FOR THE CITY.
(c) Motion by Councilor Cook, seconded by Councilor Brian to adopt as 'f
amended.
Approved by unanimous vote of Council present.
• Mayor Bishop read a letter from Councilor Scott indicating her
support of the tax measures being placed before the voters.
Councilor Scheckla endorsed her comments.
3. COUNCIL COMMENTS
• Mayor Bishop read a letter addressed to Council indicating his
intention to retire as Mayor effective 9:00 P.M. January 9, 1984.

RE: Ash/Pacific LID #38 Financing
Dear Ed:
Upon my further research into the risk and financial situation regarding LID
#38, I have some questions which will require legal assistance. I spoke with
the applicant, J.B. Bishop, and he has agreed to pay the costs in this regard
providing they can be charged to the LID upon formation.
Rebecca Marshall of Clements and Marshall advises me that it may be difficult
to get a purchaser of the LID bond while J.B. is in bankruptcy. It may also
be that once the ordinance is passed that we may have to go forward with the
project using City funds if we cannot get financing. As to security and risk,
both of concern to the Council and bond purchaser, it may be possible to set
up a reserve in the bond sale as would be done in a revenue bond.
With these concerns, I would ask that your office, Rebecca Marshall and 'bond
counsel be retained to recommend a legal and financing plan addressing those
s, concerns. I would ask that an appropriate legal document be prepared whereby
J.B. Bishop agrees to pay said costs if the LID is not formed, and where they
are included in the LID if formed. I would hope for your collective
recommendation by April 25, 1983. I will ask the Council to continue
consideration and adoption of the LID ordinance to April 25, 1983.
My request is therefore:
1. ) Prepare and have J.B. Bishop, sign an agreement whereby the City
retains legal and financial counsel to be paid by J.B. Bishop; and,
2. ) Recommend a reserve or alternative approach to assure the City and
bond purchaser in the above concerns.
As I will be out of town the week of April 12-17, please proceed and then
brief me the week of April 18, 1983.

SUBJECT: ASH/PACIFIC LID INFORMATION REQUEST BY COUNCILOR SCOTT
On Tuesday, April 5, 1983, Councilor Scott requested that I attempt to obtain
information from J.B. Bishop regarding his current financial status and the
lease status with G.I. Joes. I advised Councilor Scott that there was no
legal requirement for the LID applicant J.B. Bishop to provide the
information, but that I would ask.
J.B. Bishop has agreed to furnish a current summary of his financial condition
F and to allow that summary to be made a part of the public record on the LID.
That summary is attached.
There is an understanding and final draft agreement between Main Street Land
Corp. J.B. Bishop) and G.I. Joes. Since the final document contains
privileged information between the two private parties, that information has
not been made a part of the public record. Mr. J.B. Bishop has, however,
indicated that he would share such information with the Council in Executive
Session or any other lawful manner whzch would protect the confidential nature
of the information.

Dear Council President Kenneth Scheckla,
Councilors Tom Brian, John Cook and Ima Scott:
Monday of this week I lost one of my strongest
and highest quality supporters, my brother Gene
Bishop.
Last Thursday, March 31 , I was priviledged
to spend a few minutes with him in his room at the
Stanford University Hospital. It was an encouraging
occasion. I was optimistic. We made an agreement
following some of our discussion about Tigard the
community in which we were both born and love.
He did not want me to continue to strive for
the good of Tigard at the expense of taking the
personal insults and degradation that apparantly
come with being mayor.
We made a pact, that Thursday morning. I promised
him that I would do my best during the rest of this
year to do the right things to make Tigard the community
we believe it could be, then retire. He said he would
try to get better and recover from his recent operation.
He wasn't able to keep his part of the bargain but, I
am able and I will keep my promise to him and to the
people of Tigard who have elected me five consecutive
times.
Following the commitment I have made, I am hereby
notifying you of ray intention to retire as mayor and
a member of the council effective 9 p.m. , January 9, 1984.
Between now and that time I shall continue to give
my sincere efforts to accomplish goals and directions
that will make Tigard a more desirable community in
which to live.
