City Administrator reported that staff has received numerous requests to extend the consideration of the Comp Plan to give additional time to the NPOs and CCI to consider the issues. He recommended Council extend the time 45 days due to the Christmas season and stated that this would allow more time for input from NPOs and CCI. WES MYLENBECK - Washington County/City Relations (a) Mr. Wes Mylenbeck, Chairman Elect of the County Commissioners appeared to expressed his concern regarding the lack of intergovernmental relationships and cooperation especially between Washington County and the cities. (b) Council expressed their appreciation to Mr. Mylenbeck for his concern ( and noted they are anxious to discuss this topic in the future. 15. FIRST QUARTER FINANCIAL REPORT AND RECOMMENDATIONS. (a) City Administrator submitted report of mid-year 1982-83 budget revisions, or control budget, which he has implemented. He noted that overall revenues are down 2% with General Fund revenues being down a total of 4.5%. (b) Motion by Councilor Cook, seconded by Councilor Brian to accept report. FINANCE AND RECORDS/MUNICIPAL COURT ANNUAL DEPARTMENTAL REPORT (a) Finance Director/City Recorder introduced department presenting some statistics on the department and described Finance Director/City Recorder duties and functions. (b) Records Manager/Municipal Court Clerk, Billie Rawlings, discussed her Section's performance over the last year and introduced Judge Anthony Pelay, Jr. The Judge noted his concerns regarding space allocation for Court sessions. r // (c) Office Manager/Deputy City Recorder, Loreen Wilson, presented various � t statistics and information on Word Processing and the Support Services Division. t (d) Accounting Manager, Mary Strickland, advised Council of the tasks performed in the Accounting Division and discussed some areas of concern regarding financial reporting. Approved by unanimous vote of Council present. 20.6 COUNCIL RETREAT DEVELOPMENTS - City Administrator requested Council's pleasure on what date to hold the retreat. Consensus of Council was to hold meeting on December 12, 1982 from 9:30 A.M. to 3:30 P.M. 20.7 ILLEGAL SIGNS REPORT - City Administrator stated he would submit a written report shortly on this issue. 20.8 MARTA FRANK RESPONSE BY STAFF - As Councilor Scheckla had left the meeting, Council requested this item not be considered at this time. 20.9 COMMENTS ON FEDERAL GAS -AX - Mayor Bishop requested staff advised Council of amount of Federal Gas Tax to be received and wished to discuss at a later date the use of these monies. 20.10 SABRE CONSTRUCTION LAND AQUISITION PAYMENT - Director of Public Works requested payment in the amount of $17,467 to Sabre Construction for right-of-way acquisition for 72nd Avenue LID. (a) Motion by Councilor Cook, seconded by Councilor Stimler to pay $17,467. C1 T1 RD WASHRI, N COUNTY,OREGON December 6 , 1982 Mayor and City Council City of Tigard, Oregon SUBJECT: COMPREHENSIVE PLAN TIMELINE iHonorable Persons : Staff is cognizant of the requests, both formal and informal , of the various advisory boards and committees for additional time to review the Comprehensive Plan. Staff recognizes that some of the NPO' s have not been able to review all chapters, but Council should know that several of the NPO' s have reviewed them and staff has already responded. A timely submittal of the Comprehensive Plan is essential for many reasons, but not at the expense of undoing any NPO' s confidence in its opportunity to be involved_ I , therefore, recommend a 45-day extension to the Comprehensive Plan timeline within the following: e 12/7 , 12/9 & 12/11 -- Planning Commission Hearings e 12/13, 12/14 & 12/15 -- City Council Hearings e Week of 12/13/82 -- NPO and CCI Meetings v Week of 12/20/82 -- NPO and CCI Meetings • Week of 1/3/83 -- NPO and CCI Meetings o 1/11 and 1/13 -- Planning Commission Hearings e 1/24 , 1/25 & 1/26 -- City Council Hearings It would be my recommendation that those chapters which can be adopted with substantial agreement be adopted in December. On December 15, 1982, the Council should then identify those remain- ing chapters to be concluded in January. The Development Code itself can be deferred until February. This timeline allows those NPO' s who have not finished reviewing the Final Drafts to do so without unduly delaying City financial and work program decisions. Box 23397 Tigard, Oregon 97223 Re: Time extension for comprehensive plan hearings. Dear Mr. Bishop, and Council Members: The NPO #4 members have expended considerable time and effort informing all property owners in the NPO #4 area of the new Comprehensive Plan. The NPO mailed out over 250 questionaires / advisements to all property owners inviting them to a neighborhood meeting to discuss and answer their questions on several critical issues affecting their neighborhood. By soliciting their recommendations we can more accurately represent their desires during the present comprehensive planning process, providing that the NPO and CCI are given enough time to develop policies that reflect those desires. The NPO #4 feels that the new Comprehensive Plan stresses the obvious and does ' not address in detail the specific planning concerns of each individual area. The Committee for Citizen Involvement is attempting to review and refine the plan in these special areas, and will do so much more effectively then the Planning Commission hearings scheduled December 6 through 11. In addition, the second most critical element, - transportation, has not been available to the NPOs or reviewed by the CCI. NPO #4 would like to go on record as requesting a postponement of the planning commissions hearings scheduled for the week of December 6 through 11, concerning the new comprehensive plan . NPO #4 recommeds that a extention of time be obtained from LCDC, and the Planning Commissions hearings be rescheduled for sometime in 1983. Very truly yours, Gordon S. Martin 3r. NPO #4 Chairman WAM Tigard City Council Tigard, OR 97223 Council Members : This is a request for additional time to review the Tigard Compre- hensive Plan and to extend hearings and any decisions for 60 days to allow citizen understanding and citizen input before the plan is adopted. The request is made for the following reasons : NPO members received the plans in entirety only last Wednesday. There has not been time for discussions or for citizens to be aware of what actions are contemplated. Many areas of concern have not been addressed. The Tigard Comprehensive Plan is too important to be hastily ramroded through. After it is adopted, the citizens and the Council are going to have to live with it. Care should be taken so that there are not regrettable loopholes or nasty surprises. With the present schedule, all that will be possible for the Planning Commission or the Council will be rubber stamp approval. Persons donating their time to the NPO's are dedicated to the idea that citizen input is inportant in government. If this is going to be ignored, there is no significance in having Neighborhood Planning. The holiday season is too busy a time to try to push such an important plan through because people are involved and have their businesses to attend and their lives to manage. Since there has al- ready been delays , an extra few weeks is not going to make that much difference when the benefits of careful study are considered. New Council members should also have time to consider the plan and to be aware of citizen concerns because the new Council is the one that is going to have to live with the plan and make the future decisions based on it. With the present schedule and one new council member unable to attend hearings over the next week or two because of terminal illness in the family, it seems only courteous to extend the hearings and actions. The meeting was held at Fowler Junior High School - Lecture Room, 10865 S.W. Walnut Street, Tigard, Oregon. 2. ROLL CALL: Present: President Tepedino; Commissioners Clifford Speaker , Don Moen, Bonnie Owens, and itoy Bonn. Excused absence: Phil Edin, Mark Christen, Deane Leverett and Richard Helmer. STAFF: William Monahan, Director of Planning and Development; Jeremy Coursolle, Associate Planner; and Diane Jelderks, Clerk Typist . 3. The minutes from November 9, 1982 were considered. President Tepedino stated that minor corrections had been made to staff prior to the meeting. Commissioner Owens noted that on page 4, second paragraph that she was concerned that the number of units per acre was correct not the size of the lot. Commissioner Bonn moved and Commissioner Moen seconded to approved minutes as corrected and amended. The motion carried unanimously by members of the Commission present. 4. COMMISSION COMMUNICATION o NPO #3 submitted a memorandum regarding the Energy Element of the Comprehensive Plan. 5. PUBLIC HEARINGS • President Tepedino opened the Public Hearing by reading the usual statement of authority for the procedure to be followed in the meeting. e President Tepedino wanted to publicly congratulate Bonnie Owens as he had heard a number of comments on how well she had handled the CCI meeting in his absence. She has been doing a fire job for the City, Planning Commission and staff. • President Tepedino provided his personal thought from his perspective as Chairman of the Planning Commission. He emphasized the urgency of the timing of this effort. There is a lot of pressure both externally and internally. We have a responsibility to the growth of the City with the planning that is being done. We have the responsibility as Planning Commissioners to the City, the public, ourselves and the NPO's. The NPO's will gain from a Comprehensive Plan. For too many years we've been fighting the difficulty of the various Neighborhood Planning Organizations diverting from what was the main thrust of the plan or disagreeing with Neighborhood Plans on the other side of the street. c NEW He feels it is necessary to adopt a Comprehensive Plan at this time. lie also wanted to emphasize thMt Life is a compromise and those who { will not compruulise are like trees which refuse to bend in the wind, and we all will suffer from those who refuse to compromise. The staff is doing its uCmost to provide the NPO's, the CCI , Planning Commission and City Council with the best information they have been able to develop. However, lie would submit today that the Comprehensive Plan will not be perfect. lie would suggest that we take a long range, philosophical view, and try to get something in place, because the right to amend is theirs, the NPO's, CCI and City Council, to modify and correct as needed. In his estimation it would be worse to leave Elie City without a plan than to have a plan that is not totally adequate. He felt to drop the ball now would be a terrible disservice to the City of Tigard. 5.1 COMPREHENSIVE PLAN: ENERGY Jeremy Coursolle , Associate Planner explained how this is the second element of the Comprehensive Plan. The first element, Citizen Involvement, was adopted by the City Council, November 22, 1982. The second element deals with energy and conservation, the City's role and the energy sources that are economically feasible to any structure within the City of Tigard. (Staff has attempted to set some direction rather than placing mandates. ) That way when information is available to us, the economy turns around, and interest is there within the community, we then will start looking at some means to help to conserve the energy that we do have. The NPO's have all had an opportunity to look at this document. Unfortunately, the CCI did not reach a total consensus. Staff has requested that each NPO chairperson have comments submitted prior to the public hearing. Mr. Coursolle, reminded the Commission that this is a legislative hearing requiring a recommendation from the Planning Commission to the City Council. Staff is proposing one change, adding policy 9.1.3. THE CITY SHALL ENCOURAGE LAND USE DEVELOPMENT WHICH EMPHASIZES SOUND ENERGY CONSERVATION, DESIGN AND CONSTRUCTION. (This was a suggestion from a member in NPO #4.) Associate Planner Coursolle reviewed the energy document which includes Energy Conservation and Local Governments' Role, Alternative Energy Sources, Findings, Policies and Implementation Strategies. The document was reviewed page by page with staff and Planning Commissioners making changes and corrections as necessary. y NPO #3's submission was read into the record by Associate Planner Coursolle. Discussion followed between Commissioners and staff as to the intent of this recommendation. • Associate Planner Coursolle explained locational criteria. He stated that established and developing areas should be compatible and that locational criteria would insure this would happen. How does the new Fire Code amended in 1980 address accessory structures? Another matter to address at this time would be "dish” type antenna. Lake Oswego has in their ordinance to be placed in rear yards, on the ground, and must be screened by landscaping. TO: City Council FROM: Planning Staff qV 4 SUBJECT: Status Report, NPO's & CCI Over the last several months the Planning Staff has been working hard towards the completion of the Citywide Comprehensive Plan. A major part of that work has centered around the input of the CCI (Committee for Citizens Involvement) and the NPO's (Neighborhood Planning Organization.) Several issues relating to the NPO's have been brought before City Council recently. Specifically regarding membership status and the role of the NPO's. The following is a summary of the CCI and NPO membership and activities. CCI The role of the CCI is to monitor and evaluate the City's overall citizen involvement program. Normally the CCI meets for an hour on the third Thursday of each month. However, over ing for eve in tast two months the to go over Comp. CI Planasbeen issues. The CCI two hours every Thursday g membership is made up of all of the NPO Chairpersons, the Park Board Chairman, two City Councilors and a Planning Commission Member. Attendance to the CCI meetings has regularly been around eight members. Given the amount of Comp. available to review it, the CCI has acted as Plan information and short time { monitor and evaluator and has been asked to reach a consensus on issues prior to Planning Commission review. The CCI has given staff direction on many issues which may otherwise have been unresolved prior to public hearings before the Planning Commission. i NPO's NPO # 1 - NPO #1 has been active since its inception in 1975. Currently, NPO #1. An eighth member has been there are seven approved members serving on recommended for approval to the Planning Commission. The Chairperson is John } Butler, the Vice Chairperson/Secretary is Harry Owen. NPO #1 has been meeting regularly the first Wednesday of every month with some special meetings to cover Comp. Plan issues. NPO #2 - At the present time, there are only two approved NPO #2 members. However, staff has received two additional applicantions and will be interviewing those two candidates on Friday, December 3, 1982. On more than one occasion ostafPlanhas issuesindicated gowever, no meetings have been held.current NPO 4�2 members on Cmp NPO #3 - NPO #3 was reactivated in January of 1982 primarily due to opposition of the Bechtold/Walnut Island annexation. Currently, there are seven approved NPO #3 members. Regular meetings are held on the 3rd Wednesday of every The ( month. However, NPO #3 has been meeting almost weekly the past two months to Lou ne Mortensen review Comp- Plan issues. The NPO #3 Chairperson is is Bob Bledsoe. A large portion e of landwithin the Vice Chairperson/Secretary NPO #3 boundaries is not in the City but is within the Urban Growth Boundary. i S NPO 464 - NPO 464 has been active since its formation in 1975. Currently, there are 12 approved members in NPO 464. Regular meetings are held the first Wednesday of the month. Special meetings have been held frequently over the past several months to review Comp Plan issues. The areas of major concern to r1PO 464 members are transportation and the conversion units. The NPO 464 t- Chairperson is Gordon Martin, the Vice Chairperson is Rick McMahan and the s Secretary is Dave Brook. g NPO 465 - The original NPO #5 group was disbanded in 1978 because the NPO 465 Plan had been adopted and the group saw no reason to continue meeting. On February 23, 1981 four people were approved for membership to NPO 465. Although four members do not constitute an active NPO, John Smets was notified by mail of all activity occurring within the NPO 465 area. However, no meetings were held so the four members appointed in February 1981 forfeited g their membership. In 1982, seven new members for NPO 465 were approved by City Council. Of the four previous members, two have resubmitted for membership. Bill Bieker has reapplied and will be interviewed on December 3. John Smets will be submitting a new application. John Havery has declined to reapply if John Smets will be or. the NPO. On July 21, 1982 those seven certified members elected Chris Vanderwood as Chairperson, Craig Hopkins as Vice Chairperson and Sharon Takahashi as Secretary. NPO 465 holds regular meetings the third Wednesday of every month but has been meeting more frequently the last two months to deal with Comp. Plan issues. The major issue concerning NPO 465 was the Plaid Panty business locating at SW Hall and Bonita. NPO 466 - NPO 466 was reactivated in July 1981 primarily to halt a proposed residential development in the area which residents felt was too dense. There are seven members at the present time. The Secretary, Faith Holmes will be :. resigning as of December 1, 1982. The Chairperson, Phil Pasteris will be resigning his Chairmanship as of January 1, 1983. However, he will continue to serve on the NPO. Phil Pasteris expressed his concern with the fact that he was inclined to be more supportive of staff than area residents on the Durham Plaid Pantry liquor license and that he felt he would be more effective as an NPO member. NPO 467 - NPO #7 was reactivated in June 1982. Currently, there are six approved members. City staff has no pending applications for new members. Nancy Robbins is the Chairperson, Barbara Priest is the Secretary. Due to a recent increase in workload at my present place of employment, and combined with several other factors directly relating to my own time management and preservation of attitude. I must decline from my present involvement with NPO #6, as well as city concerns in general. I'm hoping to have the opportunity to volunteer again, but for now it is simply a matter of not having that time to give. I trust, you will all do a good job regardless of my presence. I've enjoyed working with everybody and look forward to living in Tigard for many years to come. Special recognition to Liz Newton, Jeremy Coursolle, and Bob Jean. Based on the first five months of information, total revenues are down from budgeted amounts by $87,646 or about 2%. This is not too bad, given the continuing uncertain economy, but the variations are not an even 2% by fund. The General Fund is down $106,960 or 41%, so most of the needed adjustments will have to occur in General Fund related areas. The slow economy has also worked some to our advantage. Equipment purchase prices are coming in way below reasonable Budget estimates and construction project bids are continuing below estimates. The failure of the 1J% property tax limit means we can now continue with LID projects which were tabled, allowing us to firm up some of those previously uncertain finances. All of this allows some reallocation of resources to occur between funds and programs. Approximately $50,000 in program cuts will still be necessary, however, to keep this year's Budget in balance. Attached to this memo is the summary information reporting the changes I have directed within what I consider to be the limits of my authority. No formal Budget Committee or Council action is needed, although I want to make sure that you are adequately informed. The major changes involve: ® Police cuts of $29,118 or 2#% by freezing a vacant position and implementing some reorganizational changes; e Legal Services increased by $8,000 after last month's review by Council ; m Waste Water cut by $14,000 to offset added costs for setting up new Storm Drain fee accounts and legal services share; ® Parks cut $30,000 by staff turnover freeze and shift of some major equipment capital outlay from General Fund to Parks Fund; Public Works Shops/Support increased $12,000 for Auto Service Worker, offset from Parks staff attrition and delay in Superintendent hiring; o Contingency total cut $26,528 to $79,460; • All other programs squeezed for $8,000 in cuts or forced to absorb unforeseen expenses within Budgeted amounts. . . . The Police union contract remains unsettled at this writing and will have to be absorbed within the Department's new control Budget estimate of $1,080,000. Obviously, the longer we go without a settlement, the greater the likelihood of some service level change or layoff. Hopefully, this too will all be resolved and any further adjustments accomplished by our next meeting in : February. It repeals the existing Comprehensive Plan and Plan of Develop- ment. It proposes to make only minor changes in the 185th East-West Study Area; Metzger/Progress and Raleigh Hills/Garden Home Community Plans. Ordinance No. 264 adopts a new Community Development Code for the urban area. This is very similar to a zoning code. It implements the Comprehensive Plan. It may also apply new procedures to the existing Community Plans. It repeals most of the existing Develop- ment Ordinance. As is the case for small cities, we are finding it very difficult to get our efforts to take off due to limited resources and the economy in general. Recently the City combined the municipal Planning and Building Departments into the Department of Planning and Development and hired me to coordinate the ongoing functions and provide staff to the Tigard Urban Renewal Agency (TURA) and its Advisory Committee. This action on the part of the City was prompted by Tigard°s commit- ment to downtown revitalization and economic development in . general. I believe that the City is in a unique position in its downtown revitaliztion process which would make it a valuable participant in the Oregon "Main Stz ,et" Program. First, we are in the initial stages of renewal -end in need of technical assist- ance to- get our efforts on course. Second, the character _ of the downtown area has changed. Third, Tigard is part of the fastest growing part of Oregon and the downtown area is in close proximity to three major transportation routes, 99W, Highway 217 and I-5. Finally, the City has both TURA and the TURA Advisory Committee in place and functioning with an initial plan of direction charted. TURA is made up of the members of the City Council while the TURA Advisory Committee is made up .of represent- atives of the downtown .business .community, the Chamber of Commerce, and other interested parties. Due to the number of requests from Oregon communities for downtown redevelopment ideas and assistance, we are creating the Oregon 'Main Street' Program. The Main Street project is nationally acclaimed and is currently operating in 48 cities in 6 states. Unlike most downtown programs, this one has been specifically designed to address the Cspecial needs of small cities and towns. Currently National Main Street cities are strengthening their downtown business base by cutting the start-up business failure rate in half and spurring an 11 : 1 private to public dollar investment ratio, despite the present poor economy. The ODDA Board of Directors has been working closely with the National Main Street Center to design Oregon's program. We will select five cities in Oregon to be 'Main Street` cities. If all goes well, those cities fortunate enough to be selected from the statewide competition will receive one year of technical assistance for their downtown revitalization project . A number of cities have already contacted us expressing a high degree of interest in the program. As a statewide organization, we feel it is important that every community be given a fair chance to compete to be an Oregon Main Street City.
