CALL TO AUDIENCE, COUNCIL AND STAFF FOR THOSE DESIRING TO SPEAK ON NON-AGENDA ITEMS . (a) Finance Director stated that Council would be considering the City Administrator contract under other business . (b) Mr. LaValle Allen, NPO #4 Chairman, expressed his thanks to the City Council for holding the informational meeting on August 20 , 1981 , to discuss the annexation election and mentioned that 4 Councilwoman Stimler was the only Councilperson present . Councilman Scheckla noted that he was on vacation. (c) Finance Director introduced Mr. Tim Ramis of O 'Donnell, Sullivan & Ramis, and noted that he would be attending Council meetings until Mr. Sullivan returned. r 3 . APPROVAL OF MINUTES : August 10 & 17 , 1981 (a) Councilwoman Stimler requested the minutes of August 17th be amended as follows : Page 5 fourth paragraph of executive session minutes , second sentence, "Council tentatively agreed to pay for moving expenses from Pratt, Kansas , not to exceed $3 ,000.00 ; starting salary to be the low advertised salary which was reported to be $33 ,500 (later it was determined that the low advertised figure was $34,000) with a review after six (6) months . " Councilwoman Stimler also requested that the minutes of August 17th be amended as follows : Page 6 - 4( f) change the date from August 23rd to August 20th. (b) Motion by Councilman Brian, seconded by Councilwoman Stimler to adopt as amended. Approved by unanimous vote of Council . 4. APPROVAL OF UNOFFICIAL MINUTES : August 11 , 1981 . RESOLUTION No. 81-96 A RESOLUTION OF THE TIGARD CITY COUNCIL REQUEST- ING AN ANNEXATION PETITION BE FORWARDED TO THE BOUNDARY REVIEW COMMISSION (Short Title - McIntosh) . (a) Motion by Councilwoman Stimler, seconded u : Councilman Brian to adopt. (b) Planning Director explained that the parcels are under the triple majority annexation plan and that the proposal creates a one lot island. (c) Mayor Bishop stated that he could not support the annexation because it creates an island. Motion to approve passed by 3 to 2 majority vote of Council , Councilman Scheckla and Mayor Bishop voting nay. 12 . RESOLUTION No. 81-97 A RESOLUTION OF THE TIGARD CITY COUNCIL APPROVING ENTERING INTO AN AGREEMENT WITH THE OREGON DEPART- MENT OF TRANSPORTATION FOR THE 72ND AVENUE INTERCHANGE. (a) Council questioned whether engineering staff ' s concerns were met regarding the wordage of the contract . Finance Director reported that the Director of Public Works would have to speak to that . (b) Motion by Councilwoman Stimler to remove from the agenda and consider at another time when the Director of Public Works can be present. Motion seconded by Councilman Brian. Approved by unanimous vote of Council . 13 . LIBRARY PER CAPITA STATE AID GRANT - Authorize execution (a) Finance Director requested Council approve the document for PAGE 3 - COUNCIL REGULAR MEETING MINUTES - August 24, 1981 signing so that the City could receive state funding under the state aid grant . The City would be receiving $1949 . She noted that a supplemental budget would be adopted at the time of receipt of the money. (b) Motion by Councilwoman Stimler, seconded by Councilman Scheckla to approve and authorize the necessary signatures be attached . Approved by unanimous vote of Council . 8 :00 P.M. (c) Motion by Councilman Brian, seconded by Councilman Cook to adopt . Approved by unanimous vote of Council . 8 :00 P.M. PUBLIC HEARING 15 . TIGARDVILLE HEIGHTS LID No. 29 PUBLIC HEARING (a) Mayor Bishop noted that the Director of Public Works was not able to attend the meeting due to illness and that the Council would not be making a decision until he was able to make his recommendation to the Council . (b) Public Hearing Opened (c) Motion by Councilman Cook, seconded by Councilwoman Stimler to set over the public hearing until September 14, 1981 when the Director of Public Works could be present. Those present for the hearing requested Council open the public testimony portion of the hearing and accept their testimony at this time . Councilman Cook and Councilwoman Stimler withdrew their motion. PAGE 4 - COUNCIL REGULAR MEETING MINUTES - August 24, 1981 (d) Public Testimony Proponents : No one appeared to speak Opponents : Aase Otto, 14200 S .W. 97th, stated that there had been no facts and figures presented to the property owners until just recently . She supports the LID only if the properties along McDonald street are not included. Arlie Mawhirter, 14265 S .W. 80th Place , noted he had a letter on record and requested that all property along McDonald be excluded from the LID proposal . Paul Deemie, 9740 S .W. McDonald, noted that he did not wish to take any more of Council 's time and said he already had filed his concerns with Council . City Recorder read two letters into the record from Lionell Domeries and Gideon Thompson objecting to their properties being included in the LID. (e) Stu Cato, Harris & McMonagle , reported that staff held an informa- tion meeting at City Hall to answer questions the citizens might have regarding the LID and that process . He felt the main con- �ern was the requirement of the magnitude of improvement along McDonald Street and citizens were questioning if Council would vary or waive the City standard improvement for that street . (f) Motion by Councilwoman Stimler, seconded by Councilman Cook to continue the public hearing until September 14, 1981 . Approved by unanimous vote of Council . 16 . Both proponents and opponents will be given an opportunity to give evidence and to cross- examine . Mayor Bishop stated the Council would limit testimony to 20 minutes per side. (a) Public Hearing Opened PAGE 5 - COUNCIL, REGULAR MEETING MINUTES - August 24, 1981 (b) Planning Director gave sysnopsis of issue and discussed the traffic access to the property and questions which were raised at the Planning Commission hearing. He stated that it would be possible to place a signal light at Naeve Road if the street could meet warrants with the State of Oregon . Other access onto 99W could be considered also. (c) Public Testimony Proponents : Mayor Bishop read into the record a letter of support of the request by Mr. B. Sanders . Mr. John Block, 20400 S .W. Boones Ferry Road, Tualatin, noted he was a planning consultant and is the spokesman for the six (6) property owners involved. He stated there were thirty-four (34) acres involved in the request . He expressed his appreciation for the Summerfield residents attending the meeting and spoke to the issues of density, traffic impact, and soil and slope condi- tions . Mr. Block advised Council that the applicants agree with the Planning Commission decision. Mr. Mel Kroker advised Council that the property owners banned together and wished to give support to the overall concept of higher density. Attorney Bob Miller, 3100 First National Bank Towner, Portland, spoke on behalf of the property owners , he stressed that this review is only for the density issue and advised Councii that traffic analysis and concerns would be spoken to during the general plan review process . PAGE 6 - COUNCIL REGULAR MEETING MINUTES - August 24, 1981 �tTy. lF Opponents : Mr. Bill Foster, Summerfield Resident, expressed concern regard- ing traffic increase in the Summerfield area . Mr. Fred Joenhke, 10455 S .W. Centery Oak Drive , President of Summerfield Civic Association, wished to go on the record as strongly opposing the revision to the comprehensive plan. Mr. Dick Brown, 10580 S .W. Highland Drive, requested Council_ refuse the plan change at least until LCDC makes Goal 7#10 an official law. Mr. Tom Bailey, 10505 S .W. Greenleaf Terrace, expressed his appreciation for the information submitted by Mr. Block and Mr. Howard, however, was still concerned with 109th being a through street and the traffic impact upon Summerfield. Mr. Dave Atkinson, 10460 S.W. Century Oaf: Drive , was concerned with traffic impact upon Summerfied. Jackie Shipman, 10620 S .W. Highland Court, expressed support of the opposition. Marge Davenport, 109th Avenue, submitted a petition with 170 names in opposition to the development, due to the steep terraine and the increased traffic impact. Cross Examination Council, Proponenets and Opponents discuss traffic analysis , physical lay of the land and traffic movement options . (d) Planning Director recommended approval of the increase in density. (e) Public Hearing Closed (f) Councilwoman Stimler expressed her support of the area having an increase in density, however, felt that the traffic must be routed in such a way as to discourage the use of 109th Avenue and Summerfield Drive. (g) Councilman Brian agreed with Councilwoman Stimler and noted that traffic was the major issue of the opponents during the public hearing. He stated that if the traffic issues and slope issues are not addressed during the planned development general plan review process, then he would not support the review at that time. (h) Councilman Scheckla stated that the traffic and density issues must be addressed before any support will be given to the project . If traffic were routed to 99W and not 109th he could support the density change. PAGE 7 - COUNCIL REGULAR MEETING MINUTES - August 24, 1981 C (i) Mayor Bishop stated that the Planning Director who was present during the adoption process of NFO #6, stated no more than 2-3 units per acre be placed on this property due to the slope and drainage problems . He also noted that Attorney- Miller ' s exhibits were not Tigard rules and ordinances but those of MSD, Metro and LCDC. The Mayor stated he could support the density change if Beef Bend Road extension were a requirement with signalization. (j ) After lengthy discussion regarding the issues Councilman Cook moved to have staff and the applicant write up the findings from the public hearing and to indicate that major access for traffic from the development area would be at the Beef Bend Road Inter- change and 99W and de-emphasize the 109th Avenue access , write an ordinance for adoption on September 14, 1981 , and reduce the total build out to sixteen (16) units per acre for the Sanders property. Councilman Brian seconded the motion. It was noted that Naeve Road could be another access point to 99W but it was requested that the intersection use of 109th and Naeve be de-emphasized. Approved by unanimous vote of Council . RECESS : 10 :42 P.M. RECONVENE : 11 :01 P.M. 17 . TRINTTY EVANGELICAL CHURCH - MLP 8-81 Half Street Improvement Require- ments (121st Ave . ) (a) Planning Director stated that as a condition of a MLP the church was required, per Council directive , to do a half street improve- ment along an area which will be an extension of S .W. 119th Ave in the future. He requested Council allow the church to sign a non-remonstrance agreement for this improvement since a street is not developed at the present time . (b) Greg Retzloff, President of the Church Trustees Committee , re- quested Council allow this non-remonstrance signing at the present time . (c) Council consensus was that this would be appropriate in this case and instructed staff to proceed to procure the necessary signatures . 18. ORDINANCE No. 81-76 AN ORDINANCE REVERSING A DECISION OF THE PLANNING COMMISSION, RELATIVE TO CONDITIONAL USE (CU6-81) (a) Motion by Councilman Brian, seconded by Councilwoman Stimler to adopt . (b) Councilman Scheckla questioned why the Electro-Sport center began operating on Saturday when the Council had not confirmed its motion of approval by an ordinance. PAGE 8 - COUNCIL REGULAR MEETING MINUTES - August 24, 1981 (c) Councilman Brian amended his motion to request inclusion of the rules of the business in the ordinance and require that they be posted at the business location. Councilwoman Stimler amended her second to include the rules of business . Motion to adopt as amended approved by majority vote of Council , Mayor Bishop voting nay. Ordinance No. 81-76 will require a second reading. 19 . TIGARD ASSEMBLY OF GOD - CU 8-81 Half Street Improvement Requirement (Gaarde Street) (a) Planning Director stated that he and the Director of Public Works would recommend Council allow the church to sign a non-remonstr- ance agreement for street improvements since they have 650 feet of frontage and the improvement would cost them $52 ,000 . Council- woman Stimler stated she felt it might be more appropriate to have the non-remonstrance agreement signed and then wait for an LID in the area to do the improvement of the street all at once . (b) Councilwoman Stimler moved to grant the non-remonstrance agreement for the one-half street improvement requirement of the condition- al use . Motion seconded by Councilman Brian. Approved by unanimous vote of Council . 20 . APPROVE AGREEMENT - DOWNTOWN REVITALIZATION COMMITTEE CONSULTANTS (a) Planning Director stated that Ed Sullivan has okayed the con- tract as to form and he recommended approval . (b) Council requested the following changes be reflected in the contract. . Page 1 third paragraph delete the last seven (7) words as follows : (and to establish an Urban Renewal Agency) . Page 2 create a new Section 12 and renumber the following sections accordingly. 12 . The Consultant shall pay strict attention to direct com- munication with the Downtown Committee , Neighborhood Planning Organization, City Council , and Staff. Timely reports shall be prepared for promulgation to all interested parties . Work Program Page 2 , add to the end of the section entitled "A report accompanying the plan will include : " Survey results and analysis of the low to moderate income residents in the downtown area and their housing and transporta- tion needs . Approved by unanimous vote of Council . 21 . OTHER (a) Planning Director stated that Mrs . Ball and her Attorney, Fred Anderson, have been able to work out their differences with the City and everything seems to be moving smoothly. (b) Finance Director requested Council approve the contract for the new City Administrator Mr. Bob Jean. Mr. Jean and the Council discussed some areas of concern in the wordage of the contract. On Page 5 section 51, Council agreed to insert the amount of salary at $34,000 instead of the $33 ,500 as currently appeared. Other areas discussed was the amount of time needed by Mr. Jean to find a home within the Urban Growth Boundary and the yearly fringe benefits should be the same as the average unclassified employee. Mr. Jean requested that if he and the Mayor can' t agree upon the contract language between now and September 1st, that at the September 14th Council meeting, Council could consider the issue again. Motion by Councilman Cook, seconded by Councilman Scheckla to enter into an agreement with Mr. Bob Jean by September lst if the wordage of the contract can be agreed upon by the Mayor and Mr. Jean. In the past Council had requested staff cut down on copies . Elect New It was announced that Betsy Chick was retiring from the Board Chairman after serving two terms, as defined in the City of Tigard ordinance. Since there was no quorum, the item will be placed on the August agenda. Reports: Minutes of the previous meeting were approved as circulated. Librarian reviewed monthly report for June. There was discussion on the RAIN ballot which was defeated June 30. Members felt that the information given to voters was deficient regarding the low cost to each household (15c per $1,000) and the fact that the levy was only for one year. Madalyn Utz, Friends of the Library Committee, reported the success of. the June 6 Book and Bake sale. The committee has not met since that time. The workshop was sponsored by Oregon State University as part of the Endeavors for Excellence series. d. Librarian attended network meeting of Washington County Cooperative Library Services on July 30. Of interest: Storer Cable TV will probably be awarded the franchise for Washington County. Our Castles and Dragons summer reading program got into full swing in July. A unique program held on July 30 was very successful. All children who had already completed the summer program (read 10 books) were invited to a special presentation of new books -- about 50 or 60. Children attending the "book talk/medicine show" checked out nearly all of the books shown. A lot of planning has been done for the Tigard TOWN & COUNTY DAYS parade (August 1). Of special concern was the counties authorization process and enforcement. The Washington County Public Works Director is authorized to install such traffic control devices under Washington County Resolution and Order #?1-209. Attached is a letter from Washington County offering to fabricate and in- stall the necessary signs. The proposed ordinance before you tonight references the restriction to one of definition of Gross Vehicle Weight (GVW) as defined in ORS 481, but further restricted to 20,000 pounds. Enforcement would be pursued based upon the licensed GVW required to be displayed on the truck. In this manner, any police officer — city, county or . . . — could stop a vehicle on the labeled GVW. If no GVW is displayed, the County Weight Master could be called in to determine the weight. I would recommend that the City Council approve this ordinance and direct staff to request the County to install the signs and to notify the public through appropriate means. We will fabricate and install the "No Trucks" signs upon request. I can see no drawbacks, only positive benefits to the residential neighborhoods involved. Since Scholls Ferry Road (Highway 210) , Pacific Highway (Highway 99) and a portion of Greenburg Road will be directly impacted and are State facilities, I would suggest that a reqeust to the State from the City of Tigard be considered. LOAD LIMITS - Durham Road, Walnut Street, 121st Avenue (a) Mr. . Art Marhettie, 15930 S .TJ. Oak Meadow Lane advised Council that 312 residents along Durham Road have signed a petition _ to imit the loa -"_ for trucks on that street . The noise factor, Pollution and vibration caused by heavy truck traffic were issues spoken to. He stated that his concern was not the truck traffic servicing the area (i .e. garbage trucks) but the through traffic that uses Durham Road for a connector between 1-5 and 99W. He requested Council change the load limit to 30,000 gross pounds . (b) Daniel A. McCain, 13950 S .W. 121st Avenue requested Council ban heavy truck through traffic on the Gaarde Street/121st connec- tion to Scholls Ferry Road. Ile stressed the safety problem of ( narrow roads , no shoulders and the noise created by the heavy trucks . (c) Director of Public Works gave brief history of the issues and stated that staff would support a restriction for heavy through trucks "short cutting" on Gaarde/121st and Walnut/Tiedeman. This use of the streets is inappropriate use where an alternate route exists for the purpose of carrying commerce related traffic . However, he noted that staff feels that the truck traffic on S . W. Durham Road can best be answered by i Tr,Drovi ng S .W. Durham to City standards . Much of the noise , vibration and unsafe conditions can be eliminated by providing appropriate grades, width and traffic control . (d) Chief of Police and Director of Public Works advised Council that enforcement of a load restriction would be enforced by . the County. (e) Mayor Bishop stated that Durham Road was not originally set up for an arterial . (f) Consensus of Council was to instruct staff to pursue issue on 121st/Gaarde, Walnut/Tiedeman., and 135th/Walnut and bring back to Council with approval from Washington County for posting for no through truck traffic . Durham Road was considered with next agenda item. 3 . DURHAM ROAD LID (a) Planning Director and Director of Public Works discussed with Council the present conditions and proposed LID for Durham Roc The Planning Director stressed that with a road that is 24 feel wide, with open ditch drainage, poor grade, poor site distance , poor lighting and traffic control , the truck traffic will create increased hazards along the road. However, with an LID along Durham Road the road could be developed to arterial standards and eliminate much of the hazard, noise and vibration being experienced by residents along the street . The staff suggested doing the LID in three phases; Phase 1 is proposed from Serena Court to Hall Blvd; Phase 2 from 99W to Serena Court; and Phase 3 Hall Blvd. to Upper Boones Ferry Road. (b) Consensus of Council was to direct staff to proceed on the LID process noting that it should be developed in phases and informa- =ion should b_ collected on load limits , traffic counts ( Ill vehicle and tr-lcks only if possible) and cost estimates . (c) Consensus of Council was also to have staff develop a committee to study these issues . There will be two members from the Summerfield Civic Association, one county staff member, two city staff members , one school district representative and one representative from the trucking industry. Mr . Marhettie stated he would be willing to serve on the committee along with Mr. Atkison. 4. TIGARD SCHOOL DISTRICT - 92nd Avenue and Auditorium plans . (a) Planning Director advised Council that staff is working on the plans which the school district has presented for the auditorium on 92nd Avenue. This item will be considered at the October 6 , 1981 , Planning Commission Hearing. Planning Director encouraged Council to attend the hearing so that they can be informed of the issues surrounding this improvement. He stated that this plan does not have to come before Council in a public hearing but that staff will bring the site design review findings to Council for their information . S . DvidNTOIWIN COMMITTEE DISCUSSION - New roles and changes (a) Planning Director discussed with Council the role of the Down- town committee. Allan Paterson, Chairman of the committee requested the Council adopt a resolution setting out the role of the committee now that the consultant is studying the down- town area . (b) Consensus of Council was to direct staff to prepare a resolution setting forth the role of the committee now that the consultant is working on the project. This will be on the September 28, 1981 agenda. OREGON 97223 Elm } IiD U, P A WEEKLY NEWSLETTER VOLUME III ISSUE 19 AUGUST 20, 1981 PLANNING DEPARTMENT HAS NEW SECRETARY August 18th was the first day on the job for Diane Jelderks our new Planning Department Secretary. She was formerly employed by Allied Van Lines as a Moving Consultant. She was born and raised in Oregon and has two sons. Welcome aboard Diane! CABLE TV UPDATE Planning Director reports that the Cable TV Commission voted to enter into an agreement with Storer Metro Communications Inc. The contract will be discussed at the MAC level on September 16, 1981 and then will be presented to City Council at the end of September or early October. City Council's duty will be to either ratify the contract with any modifications it feels necessary, or to pull out of the MAC system. NEW CITY ADMINISTRATOR After four long months without a full time City Administrator, Tigard will have a new man on the job September 1, 1981. His name is Bob Jean and has 10 years experience in public administration. He was formerly the City «u ministrator at Troutdale, and most recently the City Manager of Pratt, Kansas. This will mean the City will also have a full time Public Works Director again, as Frank Currie will be taking off the additional hat of "Acting City Administrator". LIBRARY Ai`ISWERING SERVICE If you call the Tigard Library now during 'closed' hours, an answering machine will advise you that the Library is closed and what hours they are open to the public. This was a budgeted item for the Library and Irene Ertell, Head Librarian, reports that much time is being saved by not having to answer the phone while staff works before and after hours. LIBRARY TO SPONSOR "Z00 TO YOU" On August 25th at 10:30 A.M. a representative of the Washington Park Zoo will come to the Library with many small, live animals for "children's hour". The children (of all ages) will be introduced to manv animals and allowed to touch them. POLICE OFFICERS TO ATTEND THE ACADEMY Two new police officers, Bob Harberg and Steve Ober are scheduled to start 7 weeks of basic training at the Oregon Police Academy on Sunday, August 23rd. NEW DISPATCHER HIRED On August 16th, the Police Department hired a new dispatcher, Mr. Chris Conboy. Chris is a member of the Tigard Reserves and recently was discharged from the Army Military Police. Welcome aboard, Chris. STREET WORK ON MAIN STREET Public Works crews have been reinforcing weak sections of Main Street this week. First two layers of course asphalt mix is layed to give strength to the repair and then a final layer of fine asphaltic mix will be layed. This total project should be completed by the end of next week. ENGLEWOOD GREENWAY UPKEEP The Englewood greenway has been mowed and swept, however, it is time to do the job again. This job has been scheduled for the first part of next week. ---OVER--- BUILDING DEPARTMENT INVESTIGATING STUDS The Building Department is becoming more concerned with the 2 x 4 studs which are being used in new construction around town. Their concerns are that these studs don't seem to meet west coast grading rules not only in strength requirements but also nail holding power. Ed Walden has taken samples of these studs down to the State of Oregon Department of Commerce Building Codes Division today to appraise them of the possible deficiencies. FIRE LIFE SAFETY REVIEWS Tualatin Rural Fire Protection District has now received their 'exempt' status from the State of Oregon and are ' now doing their own fire life safety reviews of plans brought into the City of Tigard for construction. The Building Department is currently - working with TRFPD to implement the new plan review system. AUDIT IS CONTINUING .
