2 . Mayor Bishop welcomed Mr. Ed Sullivan on board, noting that he is
the new City Attorney .
3 . ANNEXATION DISCUSSION
(a) Duffy Annexation : Planning Director noted area is on SW
McDonald Street at 102nd Avenue and recommended Council approve
a resolution at the June 8th meeting to send this item to the
Boundary Commission hearing of July 30, 1981 .
Consensus of Council was to consider at the June Sth meeting .
(b) Haglund/Hall Annexation: Planning Director advised Council
that there was one parcel in this annexation on Hall Blvd.
which was originally set out in the Metzger Plan. Washington
County has told the applicant to submit for annexation through
the City of Tigard because of street access problems on the
parcel . The Planning Director recommended hearing on June 15th.
Consensus of Council was to consider at the June 8th meeting .
(c) Bechtold Annexation : Planning Director stated that this
property runs From 121st Avenue and Gaarde up to Walnut Street
at 135th Avenue . He advised Council that there had been a meet-
ing with property owners regarding this annexation proposal and
requested Council consider resolution at the June 22nd meeting .
Director of Public Works stated there has been a sewer plan
approved for the area. Mayor Bishop requested this plan be
presented to Mr. Moore ' s attorney before the June 22nd meeting .
Consensus of Council was to consider at the June 22nd meeting.
Planning Director stated if the Council were to approve the
resolution and the Boundary Commission approved the annexation,
he would return to Council on August 3rd for a study session
with property owners regarding the annexation of the island
created by the Bechtold annexation. The August 10th meeting
would then be set for consideration of a resolution for annexa-
tion. The citizens in the created island will be advised of
these meeting dates by letter July 3 , 1981 .
(d) Bull Mountain Road Ri ht-of-Wa Planning Director recom-
men a Counci approve

to the existing city boundaries . This would facilitate more
uniform street maintenance . He noted that two islands with
two parcels each would be created by this annexation.
Attorney, Fred Anderson, 11550 S .W. Bull Mountain Road,
appeared and discussed with Council the proposal . He submitted
a letter from Larry Rice (Washington County) dated February,
1981 , which stated the County would not turn jurisdiction of
the road over to the City for maintenance even if it were
annexed. Attorney Anderson also requested reason for annexa-
tion if the road could not be maintained by the City, as
in Mr. Rice 's letter. shown
Mr. Bernard Clark, 13400 SW Walnut Street, advised Council that
he opposed his property being included in the Walnut Street
annexation (Bechtold) . He felt this property had been includ-
ed only to form an island.

4. 72ND AVENUE PROPOSED LID
(a) Mayor gave background of issue as presented before Council dur-

ing the last four plus months . He stated that the Council has
had a chance to meet with the Ad Hoc Committee regarding th•2i-r
proposals . Mayor Bishop presented to audience his proposal

Committee 's Alternate #1 . (See attached exhibit "A" which sets
forth the Mayor's proposal . )
(b) Audience participation
Hiese Sadoff, 14750 SW 72nd Avenue , questioned how long the
process would be until the bids could be received.
Council advised him the process would take at least three (3)
or four (4) months .
Lenore Warner, 10300 SW Century Oak Drive (residential property
owner inside LID area) , read letter of objection to the scope
of the project .
Tony Maksym, SW 72nd Avenue , requested properties #9, & #10 be
added to the deferral option noted in the Mayor ' s proposal under
item number 6 as these properties are also residential land .
(Mayor Bishop agreed this should be amended . )
Mr. Maksym also requested that the residential home owners be
allowed to have the assessment non-interest bearing until land
is sold. Mr. Maksym requested that Council set a limit to the
amount of money to be paid by the property owners .
Beth Blount, Attorney, for L-he Ad Hoc Committee, 2437 Pacific
Avenue, Forest' Grove, stated she, on behalf of the ad hoc

approximately $1 .4 million being the top the property owners
would support for their share .
Mr. Bingham, 3937 NW. St. Helens Road, Portland, questioned
what type of assessment distribution would be used in the new
proposal .
Staff and Council discussed and stated a decision would need
to be made .
(c) Public Hearing Closed
(d) After some discussion regarding the bottom line estimated
figures presented by the Mayor, Mayor Bishop suggested the
Council accept the alternate for the bidding process and
authorize the engineering to be done . After the bids are
_ - received, then the decision would be made as to whether to
proceed with the project.

(e) During discussion by Council regarding the scope of the project ,
Mayor Bishop and Councilman Scheckla supported the Mayor ' s pro-
posal. with one-third of the project area being completed to
full standard. The other three Council members expressed their
desire to try and accomplish the full project area being develop-
ed to at least 36 feet of paved improvements .
( f) Acting City Administrator stated that the Mayor ' s proposal
would spend one--half of the System Development Charges currently
held by the City. He also expressed his concern that he could
not recommend a street improvement that would not meet the 44 '
arterial requirements by City policy. Furthermore , he questioned
the use of System Development Charge funds on a street that was
not fully developed to a major collector standard . However ,
he noted that he would act on Council ' s decision in the matter .
(g) After lengthy discussion regarding the costs and extent of
improvement to be made, Councilman Cook moved to request the
engineering work be done and bids be solicited for the improve-
ments with the following alternates to be setforth :
Alternate "A" : The basic project from southern end of project
through-Boones Ferry Road intersection, be improved to 44 ' ,
curb to curb, and 40 ' curb to curb improvement from Boones
Ferry Road intersection to the northern end of the project .
Alternates under this section will be : Street lights on their
own poles , railroad crossing improvement , traffic signals , and
sidewalk along full project on one side of the street .
Alternate "B": The basic project from southern end of project
through Boones Ferry Road intersection be improved to 44 ' , curb
to curb, and from Boones Ferry Road intersection to the northern
end of the project have grading and open ditching done to 44 ' ,
with only 28 ' of paving done with no curbing : (This has been
referred to as the Mayor ' s Proposal . ) Alternates under this
section will be : Traffic signals , and railroad crossing improve-
ments . An additive alternate shall be an additional. h Tout �dicltl�
marked for pedestrian and bicycle traffic .
Street lights will be placed on their own poles if money con-
straints allow, otherwise street lights will be place on exist-

ng poles .
The assessments will be distributed on the same formula as in the
original proposal , but using varying rates for different street
sections .
The limit for property owner participation will be $1 .3 to
$1 .5 million.
Motion seconded by Councilman Brian
(h) Council noted that citizens should be made aware of when the
bids have been opened and given notice of ten or more days
before the Council meets to consider awarding the bids .

(3-) Council discussed the possibility of giving the residential
properties an assessment deferral interest-free , until the
property is sold or a zone change is requested.
Council requested Legal Counsel investigate the possibility of
deferring assessments interest-free for residential properties
and also whether Bancroft funding could be used at the time pay-
ments begin on the property.
Legal Counsel will report back at the next Council meeting .
(j ) Consensus of Council was to not limit the City ' s percentage of
participation in the project until bids were received and a
cost is determined.
(k) Council approved by unanimous vote the motion to send to bid .
(1) Staff was instructed to prepare an ordinance to formally adopt
decision made by Council and present at June 8th Council meeting .

5. OLCC APPROVAL
(a) Chief of Police requested Council approve two liquor licenses .
Godfather Pizza , SW Pacific Highway and Plaid Pantry, corner
of Hall Elvd. and Durham Road.
(b) Motion by Councilman Cook, seconded by Councilman Brian to
approve and authorize forwarding to OLCC.

6 . CANVASS OF VOTE - Loaves and Fishes
(a) City Recorder stated the Loaves and Fishes measure on the May
19th ballot passed with 950 votes Yes and 355 votes No. She
recommended Council approve the canvass of the vote .
(b) Motion by Councilman Cook, seconded by Councilwoman Stimler to
accept the canvass of the vote .
Approved by unanimous vote of Council .
7 . STATUS REPORT - Street Vendors
(a) Acting City Administrator reported that copies of ordinances
from other cities dealing with this issue have been received
and do not address the concerns of the City.
Council suggested that City Attorney meet with staff and work
out an acceptable solution to the issue and report back at a
future study session.

8 . DOWNTOWN COMMITTEE - Submit names for consideration
(a) Mayor Bishop drew Council ' s attention to a letter submitted
from the Water District stating they would not be able to
meet the deadline set by Council for the submission of a name
for the Downtown Committee .
Consensus of Council was to encourage the Water District to
submit the name of someone who could give input on this matter
from their board in the future .
Council will be submitting names to the Mayor of others who
might be interested in serving on the committee .
9 . OTHER
(a) Mayor requested Council submit more names for the Civic Center
Committee. Councilwoman Stimler suggested that John Skourtes
might be interested in serving on the committee . Mayor noted
that from the list of 200 plus names , Council would need to
appoint a steering committee at a later date .
(b) Mayor stated that he had attended an LCDC hearing on Thursday,
May 28, 1981 . He went in support of the Washington County
comprehensive plan and felt the meeting was helpful in that
he had a better understanding now of the meeting process .
After discussing the City' s comprehensive plan review before
LCDC, consensus of Council was to instruct the City Attorney
to look at the plan in regards to the density issue (Goal #10)
and report back to the Council addressing his concerns and
opinions .
(C) Mayor Risher*. �� 7 a
r ��teU a copy of his statement of economic interest
with the Council and advised them that when his son, J. B .
Bishop, comes before the Council with property issues , he will
not chair the meeting but turn it over to President John Cook
to preside . He stated that he had no economic interest in the
properties owned by his son, however, he would not want anyone
to question his intent were he to chair t � '
land use discussions , h� meeting during the
Mayor Bishop did state that there could be some major traffic
circulation issues that would come up that he would want to
participate in since they would not affect the property issues
directly, and would have major impact on a city-wide basis .
(d) Finance Director stated that Helen Terry, City of Vancouver, had
mailed a packet of information for the Council to look over be-
fore the June 4th Council meeting. After lengthy discussion
between Council and staff the consensus of Council was to call
ads into the professional newsletters (ie. League of Oregon
Cities and ICMA) and to word the ad as follows :

CITY ADMINISTRATOR: Tigard , Ore. Pop: 14,855 ; $498
million assessed valuation, $5, 120 ,250 budget ; city
staff 74; salary range $34-38 ,000 depending on
experience ; Desire advanced education and minimum 5
years experience in public administration, 10 years
preferred. Persons familiar with local government in
the N.W. are particularly encouraged to apply. Write

97223 by July 10 , 1981 .
(e) Councilman Scheckla requested staff see that the banner over
SW Pacific Highway is taken down since it is advertising an
event that occured two or three weeks ago.
(f) Councilman Scheckla requested staff also see that the tent at
Ripley ' s Maple shop is removed as their sale is over.
(g) Councilman Brian asked if Council had any objections to the
Chamber of Commerce doing their promotional project (which
is partially funded by the City) by making a simultaneous
Production of the brochure and the multi-media show. The
Chamber reported that it would be fiscally more responsible
if the two projects were produced simultaneously.
Consensus of Council was that if the budget were approved
authorizing funds for the project , that the Chamber should
do what would be economically more feasible .
(h) Councilman Brian distributed copies of flyers he has received
regarding City annexation and City services in other jurisdic-
tions . He suggested that the City look at these as examples
mom of what could be developed for Tigard' s use to advise citizens
of the services provided by the City.
Mayor Bishop and Councilman Brian were authorized to begin
work on this project .
(i) Councilman Brian stated that he would like to see the City
Council send a letter to METRO expressing their disapproval
of the recent vote which that jurisdiction took to increase
the entrance fees to the Portland Zoo to metro residents .
He expressed the feeling that the residents of the metropolitan
area already pay taxes to support the zoo and should not be
charged a high fee too.
Consensus of Council was to instruct Councilman Brian to draft
the letter with the help of city staff and submit at the June
8th meeting for Council approval .
(j ) Councilman Cook requested a clarification from Acting City
Administrator as to the letter referred to by Attorney Fred
Anderson from Larry Rice regarding Bull Mountain Road.

Acting City Administrator stated that this was a communication
from Larry Rice to him and that it was only stating streets
and roads that were not completely in the city limits at the
time and should bec.Dnsidered as needing county maintenance .
(k) Councilwoman Stimler thanked the city staff for preparing a
letter to the Tigard Water District acknowledging the cost
reduction for installation of the water service to the
Senior Center.
(1) Acting City Administrator requested Council authorize him to
make an agreement with Dorner and Tusk to do the engineering
work on the Huskvarna and Loute subdivision proposals . This
firm has completed preliminary work on these projects and would
reduce the final engineering costs .
Consensus of Council was to have agreement drawn up.
(m) City Attorney advised Council that the pending litigation
handled by his firm between Vanderwood vs the City of Tigard
was settled on May 27 , 1981 .

the crews were working on the grass problems .
10. EXECUTIVE SESSION : The Tigard City Council went into executive
session under ORS 192 . 660 (2) (a) to discuss possible land acquisi-
tion. 10 : 52 P.M.
(a) Mayor, Council and staff discussed the possibility of moving
all departments from City Hall to a new location and studied
the problems of access for the public, costs factors , and
spate constrai-nts .
(b) Consensus of Council was for the negotiating team to work
further on the location and report back to Council .

This proposal is offered after an extensive review, many meetings, and
in consideration of the property owners' sincere concerns, over the past
OEM four months.
It will provide for a quality, but basic improvement, for 72nd
Avenue from Varnes Street south to Jean Road.
It addresses the Ad Hoc Committee 's acceptable alternate proposal
#1--to reduce the scope of work to fit the property owners ' limited
resources and it brings the City's participation up to 25% of the
proposed costs. It cuts the L.I.D. cost from 83,097,137 to an estimated
$1 ,879,565. (These figures will need to be reviewed by Frank Currie and
the engineers for final determination)
My proposal provides for the following:
1 . South 1/3 of L.I.D.--Install full 44-foot street, curbs, storm drain,
sidewalks and lighting from a point just north of the 72nd-Boones Ferry
intersection to south Tigard City limits on 72nd and on Boones Ferry
to Durham Road.
2. North 2/3 of L.I.D.--fully graded for future extenstion to 44-foot
street and curbs with ditches in place for future storm drain instal-
lation. Minimum of 28-foot pavement for two travel lanes and possible
6-foot additiotia.l pavement, set off by street buttons for bike and
pedestrian use.

3. Complete: Bonita and 72nd Avenue/ grade elevations and full S-curve
grading and road bed corrections.
4. (Eliminate: (1 ) Cherry Street improvement. (2) landscaped mediars.

5. Place for alternate bids:
(1 ) Railroad signals IF paid for substa-ttially by State Grade Crossing
protection Account and Southern Pacific.
2) Traffic signals IF paid for by state or federal funding sources.

ential. Ident numbers: 3, 5, 6, 7, 8, 16, and 17.
7. Assessments to property owners would be refigured on basis of improve-

in the far right column of figures on each page. These are my projections
and will have to be verified by Mr. Currie and Mr. De Haas.

Because during the next few weeks and months there will come before
this Council agenda items dealing with property owned by my eldest son,

First, I would like to share with you copies of my 1981 Verified
Statement of Economic Interest filed, under oath, April 15, 1981 with
the Oregon Government Ethics Commistion. This statement lists financial
ownership with my wife only, in our home at 10590 SW Cook Lane in Tigard,
and a small office building at 12290 SW Main Street in Tigard. I nor
my wife dd4lnot own or have an interest in any other property, stocks,
bonds or any financial interests of any king in the State of Oregon.
We have absolutely no financial interests with any other individuals,
corporations, companies or businesses in the state except our personal
bank accounts.
Secondly, I have discussed, at length, with Betty Reynolds, Executive
Director of the Oregon Ethics Commission my situation and she has in-
formed me that I have no conflict of interest in any matter that might
come before this council with regard to property owned by my son and
any, of his burliness partners.
However, you and I k-,-- thµt
PUD-10s mind there is bound to
be a suspicion and a possible public perception that a conflict of
interest may exist. So in view of these concerns, I informed Council
President John Cook more than six weeks ago that I would ask him to
take the gavel and preside over items on the agenda in which my son
is involved.
I have every confidence in m'y' fellow Council ierubers ' fairness and
judgment in arriving at decisions that are unbiased, and are in the
best interests of the city and its future, but I do think that you will
feel less constrained if I am not sitting in the position of chairman
on these occasions.
On decisions that concern the effects of traffic, street locations
and general transportation direction that may effect the entire city
and its future, I wish to participate. On other issues I may not.

I accept the Council's offer to be City Attorney for Tigard.
I understand that my partners Mark P. O' Donnell , Timothy V. Ramis,
and one associate, Kenneth M. Elliott, as well as myself, will be
undertaking to represent the City by:
1. Attendance at all council meetings , unless otherwise
requested by the Mayor or City Administrator;
2. Attendance at monthly planning commission meetings ,
as requested;
3. Availability for advice to the Mayor, Council members ,
and department heads;
4. Municipal Court prosecutions;
5. Representation of the City in State and Federal
Courts and administrative agencies ; and
6. Performing other duties as required by Council.
For our services, we will charge at the rate of $65 per hour for
a partner, '1-0 per hour for an associate, and $30 per hour for

law clerks, plus any costs we may incur (e.g. long distance
phone charges, postage, special typing, etc. ) . As we discussed
previously, I believe that I should bear the brunt of the position
until my vacation in the last week of August, but in the Fall,
I would like to see an associate ready to handle most City business ,
and partners handling only those matters which the City deem to
be more important.
I also suggested to the City Council members present at my
interview that the City should consider for the 1983-84 budget,
the possibility of a fulltime City Attorney and necessary support
staff.
Because we are a firm in private practice, we occasionally will
have conflicts as we will have represented people, or are repre-
senting people, who do business with the City. In that event, I
have spoken to Joe Bailey who has indicated his availability in such
cases and I recommend that Council allow our firm to utilize his
services in those events.
I appreciate your confidence in us and look forward to a mutually
fulfilling relationship with you.

Dear Council Members:
Staff of the Tigard Area -Chamber of Commerce is well into the
final stages of planning for the publication of a Tigard map
and brochure. You will recall that this project, originally
scheduled for completion on June 30, 1981, was approved for
city funding (through transient room tax revenues) by the
1980-81 Budget Committee and City Council.
The Chamber now looks forward to embarking, with the City,
on a second promotional project: the production of a portable
multi-media show, recommended for funding by the 1981-82
Budget Committee and scheduled for completion in June of 1982.
What the Chamber has discovered in recent weeks is the sub-
stantial advantage that could be obtained from simultaneous
production of the brochure and the multi-media show. This
advantage stems from the following points:
1. Because of weather; photography for the slide show must
be scheduled in summer.
2. All professional color photography - an estimated 2.5
days of shooting - will become Our property upon completion
of the slide show.
3. For the sake of quality and continuity between the two
projects, we should definitely use the professional color
photographs available to us in the production of the
Tigard map/brochure as well as in the slide show.

simultaneously. once again, the primary advantage will lie in
the improved quality of both projects. (We should point out
that cost savings will be minimal, due to the fact that earlier
plans called for no professional photos in the brochure.) Another

projects will be completed by September, 1981 -- a full nine
months ahead of schedule for the multi-media program.

from Roger Anderson

On May 21, 1979 the Council created an R-5 zone for this parcel by passing
Ordinance 79-44. A development group - Lumpkin-O'Neel - applied for
change from R-7 to R-5 and appeared L-� p a unite
rr-�+��� uclore the Planning Commission on June
19, 1979. The zone change was approved with conditions. On August 13, 1979,
this matter was brought before the City Council and approved with condition
#3 changed by the Council. Originally I had requested that SW 94th be constructed
as a local street from SW North Dakota South through this proposed development to
connect eventually with the portion of 94th North from Greenburg Road.
Frank Currie became the Public Works Director just after this proposal went to
the Planning Commission. Frank drafted a letter to the Planning Commission
requesting a through street. At this Council meeting Mr. Anderson, with others,
objected to a through street. A cul-de-sac was ordered by Council an6 Ordinance
79-64 was changed to reflect this.
The market fell apart and this development fell with it.
On March 25, 1931, Falcon Construction applied for a Subdivision Review. The
reason for this was that Lumpkin didn't make significant improvements within
one year and sold to Falcon Construction.
Problems developed with the Public Notice schedule and the preparation of
my Staff Report. A new secretary came on line and errors were made. I gave
the surrounding property owners time to respond, but the Staff Report had
been prepared, and Falcon agreed with the conditions. Frank Currie and
discussed the through street vs. I
the cul-de-sac. We decided that a through
street was necessary. This showed up on the Public Notice and my decision was
appealed by property owners.
I was prepared to draft an amendment to Ordinance 79-64 had we not had an appeal.
The surrounding property owners would then have been notified of this change in
the conditions of development and could then have appeared before you. As it
stands now, their issue will be before the Planning Commission on June 2, 1981
as an appeal of my approval of the subdivision.
One of the ironic facts is that 94th will not become a through street with the
completion of this subdivision. We will have a street plug in place until future
development takes place unless the City agrees to complete the public improvements.

attitude of contempt. . ." is rather weak considering the fact that this
development has been basically approved since 1979. The real issue is that
we now have a Public Works Director who feels as I do, that S14 94th should be
a through street eventually. I anticipate an appeal of the Planning Commission
decision Which I think will uphold my approval of Dales' Glenn. The issue will
be the size of the lots, possible "low-income housing," the street and reduced
property values in the area if this development is approved.
All of this is just another indication that we are becoming urbanized.
We will see more appeals from surrounding property owners when density increases.
I suspect that the reactions for the future will be just as vitriolic as Mr.
Williamson and Mr. Anderson are today.

Aldie Howard, Planning Director, has been awarded a Master ' s Degree
in Public Administration from Portland Stag University. Howard
completed 70 credit hours with a cumulative grade point average of
3 . 19 . Congratulations , Aldie .
STAFF ATTENDS WORKSHOPS
Corporal Don Myers participated in a Homicide Investigation Workshop
in Salem May 26-27 . The training seminar, sponsored by the Board of
Police Standards and Training and the Salem Police Department, focused
on blood stain evidence and interpretation. Officer Joe Grisham
attended a Crime Analysis Workshop in Portland, May 21-22 . Liz Newton,
Assistant Planner, participated in a Growth Allocation Workshop May
27th at Metro.
POLICE OFFICER SELECTION
The six finalists for the position of Police Officer are being inter-
viewed May 27th and 28th by Chief Adams and Lieutenant Jennings .
_RECRUITMENT FOR CLERK II BEGINS
Upon the termination of Ann Gaylord, recruitment has started to find a
new Planning Department Secretary. Closing date for application is
Monday, June 8 . Interviews are scheduled for June 10 with final selec-
tion completed by June 12 .
SEWER CUSTOMERS NOTIFIED
Letters were processed May 28th to notify sewer customers of the rate
change effective July Ist.
ANNEXATIONS TO BE DISCUSSED
The Bull Mountain Road -right-of-way, Walnut to Gaarde (Bechtold) ,
Hall Blvd. /Haglund and Duffy annexations will be discussed at the City
Council meeting of June 1 .
ASH AVENUE TO BE HEARD BY PLANNING COMMISSION
The extension of Ash Avenue will be the subject of discussion before
the Planning Commission Tuesday, June 2nd at 7 :30 P.M. at Fowler. Junior
High School .

Linda Sargent, Research and Development Aide, served as a rater on the
Fire Battalion Chief examination for the City of IKilwaukie on May 21st.
The team of raters scored a leaderless group discussion, an in
