2. CALL TO AUDIENCE FOR THOSE DESIRING TO SPEAK ON NON-AGENDA ITEMS.
(a) Mr. Bob Irby, 11515 SW Hazelwood Loop, submitted a petition with 240
signatures from the residents of the Englewood subdivision requesting
the City to mow the grass in the park or greenway areas in the subdivision,
on a regular basis. Mr. Irby stated it not only is an eyesore, but
creates a major safety hazard to the children.
(b) Council and staff discussed the problems with man-hours available to
cut grass in the area. Mayor Mickelson requested that the matter
be turned over to the Park Board for the needs in the greeaway areas
to be identified and requested they assign priorities to those areas
the City should be concentrating their time Director of Public
Works stated he would continue to cut around the pedestrian path
in the area.
(c) Mr. Bill Taylor, 11364 SW Ironwood Loop requested the City also try
to cut the tanzy ragwort which is growing behind his home before it
spreads.

13. AFFIRMATIVE ACTION PROGRAM - Second Year Report
(a) Research & Development Assistant submitted the second year report to
Council and discussed some of the highlights of the report.
(b) Motion by Councilman Cook, seconded by Councilman Brian to receive and
file the report and direct staff to implement the report.

14. APPROVE H.U.D. AGREEMENT - Tigard Senior Citizens Center - CDBG Project #1039 �
(a) City Administrator requested Council approve Contract Amendment for the
1st year contract to extend it to March 31, 1981. He also stated that:

actual construction of the center..

15. AGREEMENT FOR LIBRARY SERVICES WITH WASHINGTON COUNTY COOPERATIVE LIBRARY
SERVICES '(WCCLS) - Approve and authorize Mayor and City Recorder to execute.
(a) City Administrator recommended Council enter into the second year agreement
with;WCCLS;noting that the City would receive '$77,744.00 for the fiscal
year 1980-81 for library services.
(b) Motion by Councilman Brian, seconded by Councilman Cook to approve and
authorize Mayor and City Recorder .to sign.

16. ORDINA14CE No. 80-58 AN ORDINANCE ESTABLISHING VEHICLE PARKING REGULATIONS FOR
DISABLED PERSONS, PROHIBITING PARKING IN SPACE RESERVED
FOR DISABLED PERSONS, AND AUTHORIZING CITATION, REMOVAL,
AND STORAGE OF VEHICLES UNLAWFULLY PARKED IN SPACE

bring the Tigard Municipal Code into conformance with the Oregon
Revised Statutes.

(a) Director of Public Works advised Council bids were received on July 8, 1980

21. STORM WATER CONTROL REPORT
(a) Director of Public Works requested Council consider the request by CH2M-Hill
for additional funds in the amount of $12,500 to cover costs of the study.
Director of Public Works recommended Council only authorize an additional
$1,200 be paid to the contractor for extra work requested by the City and
request the report be prepared and delivered according to the original
contract which was signed for the work.
(b) Consensus of Council was to pay an additional $1,200 over and above the
original contract terms to CH2M-Hill and request the study be delivered to
the City.
22. GREENWAY & OPEN SPACE WARRANTY DEED - Familian Northwest, 9110 SW Burnham Street -
Accept and authorize recording.
(a) Director of Public Works recommended Council approve deed, noting that this
contains a revised legal description from the original deed signed last year.
(b) Motion by Councilman Cook, seconded by Councilman Brian to accept deed
and authorize the City Recorder to record.
Approved by unanimous vote of Council present.
23. OTHER.
(a) City Administrator discussed with Council a problem being experienced in
the Summer Hills L.I.D. area with sewer connection charges. The Amart/
Wedgewood sewer contract has become effective as of July 1, 1980 and
requires an additional $360.00 fee be charged for the area at the time of
sewer connection. The City failed to notify the L.I.D. participants of.
this char-ge: increase since the contract language was not clear as to
the boundaries of the sewer charge area. After lengthy discussion regarding
the issue,, Council consensus was to temporarily waive the sewer contract
connection: charge of $360.00 until the City.Attorney and staff could discuss
the problem with Amart and Wedgewood. Staff to report back to Council shortly.
(b) Finance Director requested Council authorize downpayment of $4,360 to Cogebec
as required in the software contract for the computer system.:
Motion by ;:Councilman Brian, seconded by Councilman Cook to authorize payment
of $4,360 to Cogebec :per the contract requirements.
Approved by unanimous vote of Council present.
(c) Director of Public Works requested Council approve and sign a' contract
with Marlin deHaas and Associates forthepreliminary engineering, services
for the 72nd Avenue L.I.D. "project. He noted that this "fee would be about
5� to 62% of the total cost of the project, which was below the
national average.
Motion by Councilman Cook, seconded by Councilman ,Brian` to approve contract
and authorize the Mayor and City Recorder to execute.
(d) Director of Public Works requested Council consider releasing part of the
{ performance bond on Exodus Subdivision (at the end:of Fairhaven Drive).
The sidewalks and bikepath are not going to be required as there is no
" room to install them. The -curbs`have 'a 2" trench behind them that needs
to be filled and there are two storm drain locations which need to be done.
Director of Public Works recommended release of that portion of the
performance bond other than the 20% amount for maintenance and enough money

to cover the completion of the trench and storm drain locations.
Motion by Councilman Cook, seconded by Councilman Brian to release
performance bond retaining 20% for maintenance upon; completion of
all items less the sidewalk and bikepath requirements.
Approved by unanimous vote of Council present.
(e) In reviewing the bills, Councilman Brian asked what the dollar amount was
for the deductible on the City vehicle insurance. The City Administrator
responded that was $250,00 for collision.

RECONVENE: 9:15 P.M.
2.4. EXECUTIVE SESSION - Council went into executive session under the provisions of
ORS 192.660 (2) (a) to discuss the sale of the Pinebrook property.
City Administrator reported on offer to purchase the property and asked
Council direction. Council considered appraised value, current value and market
conditions. City Administrator was provided with guide lines to further
negotiate the sale of this property. Consensus of Council was to reject the
offer at this time.

program providing services to youth and families of the Tigard-Tualatin
area with offices in Tigard and in the Tualatin City Park. Since we
presently receive funding through the City of Tigard as the result of a
levy approved by Tigard voters last spring, I am enclosing for your

The original CDBG agreement between Washington County and _The City
O T(aard expired on June 30, 1980 (Re: Paragraph
6, Part 1 ).
Because your first year activity has not been completed, it will be
necessary ,to extend the term sof the original agreement. Extension will
be made retroactive to July 1, 1980.
Please note, the attached amendments not only extend the 'term of our
original agreement but also incorporate HUD and County mandated covenants
that are now applicable to all CDBG projects. '
Your project is currently undergoing a performance review, and the
continuation of your project, despite any extensions granted or implied,
is subject to the provisions of the changes cited under paragraph C
of the amendment.'
Upon the receipt of the fully executed amendments I will process them
through the Board of Commissioners. I would appreciate having;them
returned at your earliest convenience.

AMENDMENT

This Amendment, entered into this 1St day of July 19 80 ,
between Washington County, State of Oregon (hereinafter referred to as the
COUNTY) and The City of Tigard (referred to as the AGENCY)
amends the agreement originally entered into between said parties on
July 3 19 79
WHEREAS, both parties acknowledge the need to: (1 ) modify the original agreement
by extending the term of said agreement, t2) incorporating supplementary
commencement and termination of Project criterion (formally adopted by the COUNTY
which is applicable to a! I Blocq errant subgrantee Agencies effective
July 1 , 1980)
and, (3) changing, per Department of Housing and Urban Development instructions,
the Retention of Records specifications.
NOW THEREFORE, in consideration of covenants and promises contained herein, it is
expressly agreed that:
A. The term of the Agreement shall be extended nine (9) months from the
termination date cited in Part 1 , Paragraph 6, Compensation and Method
of Payment.
B. Further extension of the term of agreement for an additional three (3)
month period may be granted the AGENCY by the COUNTY7s Office of Community
Development provided the AGENCY requests such an extension, in writing,' to
the COUNTY, at least two (2) weeks prior to the last expiration date
contained in any previously granted extension.
C. In addition to the current language related to the condition for
f m Commencement and Termination of Project, Part ! ,' Paragraph 3, a neer sub-
paragraph
ub-paragraph B is added as follows:
"'The Agreement is subject to termination upon 30 days written notice
by the COUNTY should: The AGENCY fail to obligate or expend all project
monies within the program year they are authorized, unless specifically
authorized to extend into the next year by the Board of County
Coi=lssioners upon review and recommendation by the Policy Advisory
Board and Citizens Advisory Committee, acting jointly. The COUNTY

can reject, or accept and enforce a recommendation to continue the
project; or may direct a partial , or total withdrawal of funding."
D. Paragraph 4, Part ill , Retention of Records, is amended to read as follows:
"Required records shall be retained for a period of 3 years from the
date of the submission of the annual performance report, except as
follows:
A. Records that are the subject of auc; I- findings shall be retained
for three years or until such audit findings have been resolved,
whichever is later.
B. Records for nonexpendible property shall be retained for three
years after its final disposition. Nonexpendible property is
defined in Appendix N of OMB Circular A-102.
C. Records for any displaced person shall be retained for three years
after such person has received final payment.
D. Records pertaining to each real property acquisition shall be
retained for three years after settlement of the acquisition or
until disposition of the applicable relocation records in accordance
with paragraph (c) above, whichever is later.
E. All other covenants and promises in the agreement are unaltered and remain
in full force and effect.

AGREEMENT FOR LIBRARY SERVICES
This Agreement entered into by and between the
City of Tigard
and Washington County, Oregon on behalf of Washington County
Cooperative Library Services hereinafter called WCCLS; and
Whereas, the voters of Washington County have approved
purposes of pro-
five year serial levy dedicated for the

viding non fee access by county residents to contracting public
libraries (Resolution and Orders dated 3/14/78 - 55 and 56);
and
Whereas, the levy will provide revenues to compensate
contracting public libraries by providing funds for non fee

library services; and

Whereas, the City of Tigard agrees to `offer
library services to county residents and WCCLS agrees to pay a
$77,744.00 for the 1980/81 fiscal year as compensation for }
services provided 'such amounts are available from receipts of

the above-mentionedserial levy. Time and manner of payment
shall be consistent`_with the receipt of tax levy collections
for c.ty libraries, monthly payments for Community Libraries.

Therefore: in consideration of the mutual promises of
the parties hereto and by virtue of the authority granted
by the provisions of ORS Chapter 190 and ORS 357.410, it is
mutually agreed as follows:
A. This agreement will commence on July 1 , 1980 and
terminate June 30, 1981 . This contract is subject
to renewal on an annual basis by written agreement
of the parties.
B. Washington County Cooperative Library Services agrees
to provide the following services for each participating
public library:
1. Daily Courier Service excluding weekends and
holidays.
2. Toll 'free calling within Washington County,
3. Reference Services at Pacific University Library
44 including Interlibrary Loan and Union Catalog

9. Public Relations for countywide programs
with a special emphasis on Library Week in 1981.
f 10. Grant writing, planning for fundraising for
capital construction via Friends of Washington
County Libraries and other agencies.
11 . Coordination and administration of above and
with the Tri-County Region, State and Northwest.
C. The City of Tigard agrees to provide,
at a minimum, the following library services:

1 Non Fee Access:
Each agreeing public library shall provide
county residents free (non fee) ,access to their
normally circulating library materials under
established circulation policies.

2. Each participating library hereby agrees to
expend a minimum of all WCCLS funds in providing
library services according to the policies estab-
lished by their respective bodies. Library service
shall mean the facility shall be open for and pro-
viding public access and public usage.
3. Staff: °
Each participating public library shall have one
paid staff person designated with the responsibility
for the administration of the library and its programs.
4. Record Keeping:
Each participating public library shall '
supply WCCLS with a copy of the annual report
it makes to the Oregon State Library in accord-
ance "with ORS 357.520. WCCLS shall also require
that each participating public library keep cir-.
culation records of resident and non-resident use.
5. Financial Audit:
WCCLS shall be furnished a copy of each city's
annual audit. Each community library shall be
responsible for yearly certified financial audit,'
6. - Performance:
Each contracting public library shall have a
� . specially publicized annual public meeting to receive
information from its library's patrons concerning the
programs of service the library offers.

7. Subject to adopted budgetary constraints, each
contracting public library shall attempt to annually
acquire library materials equivalent to 5% of the
number of volumes it: their collection at the end of
the previous fiscal year.
Should any party hereto breach terms of this agreement, the
exclusive remedy of the other party shall be the right to cancel-
lation of this contract effective upon sixty days written notice
to the other party with payment of funds by WCCLS to be made on a
pro-rata basis to termination date; provided however, that each
agreeing public library shall return to WCCLS all funds received
hereunder not earned ,by disbursed in anticipation of services
to be rendered. Any issue arising under this paragraph shall be
reviewable in the Circuit Court, ;State of Oregon.
In witness whereof, the parties hereto have hereunto set
their hands on the dates indicated below.

The City was not able to obtain any "Tigard Daffodil" bulbs to send to England since
they had just been dug and had not cured yet. We did, however, purchase a myrtle
wood bowl and sent it with an explanation sheet- noting how unique it is to the
Oregon Coast.
