2. CALL TO AUDIENCE FOR THOSE. DESIRING TO SPEAK ON NON-AGENDA ITEMS.
(a) Mr. Norm Smith, State Representative, 8705 S.W. 75th, Tigard
r nested Council consider the problem facing residents of
Bellwood Terrace Apartments as their landlord has issued a
30 day eviction notice along with a notice to convert to
condominiums. Mr. Smith noted his concern for the residents
and extended an offer to assist Council in their deliberations
however possible.
Mr. Frank Wells & Mr. Jack Saner, both residents of Bellwood
Terrace Apartments advised Council as to their concerns regard-
ing housing for the 80 tenants L2ing evicted and requested
Council extend the time of -esidence for the tenants to the
end of the school year.
Mr. Steve Mimnaugh, Attorney for the Landowners, Sterling and
that the landlord had offered to assist

area where they could move, and offered other kinds of assistance
for the tenants. He noted that the renovation was 'scheduled to
six weeks and would lake 45 days to complete

on the 33 'apartments.
Mr. Frank Tepedino, Planning Commission Chairman, requested Council
consider the item carefully noting that this question will be coming
up more and more since housing is becoming more difficult to find.
Also he questioned the right by state law for the owner to evict
tenants with a 30 day notice, and how this trend of conversions
H would change the NPO and land use ordinances.
Council. and staff discussed the legal ramifications of this action
by the landlord as it affects the City. It was noted that the land-
lord and tenants were meeting on .February 12 1980 to try and work out
a mutual solution. Mayor Mickelson extended his sympathy to the tenants,
advised them to retain legal counsel and expressed his concern: that
the'ci_ty might not be able 'to legally extend the eviction notice for
the tenants to ,the end of the school year.
Mr.. Jack Saner stated he would advise City Administrator, of the
outcome of the meeting with the landlord on February 12th.

10. ORDINANCE No. 80-11 AN ORDINANCE CALLING A SPECIAL ELECTION TO SUBMIT TO
VOTERS A TAX LEVY FOR TIGARC COMMUNITY YOUTH SERVICES,
INC.
(a) Motion by Councilman Brian, seconded by Councilman Scheckla to approve.
(b) Councilwoman Stimler advised her desire to see TCYS become a separate
taxing entity in the future;
Motion to approve Ordinance No. 80-11 was approved by unanimous vote of
Council.
1I. COMPUTERUPDATE
(a) City Administrator advised Council that staff has been working with
Coopers and Lybrand and Wang to have more information available for
Council regarding the computer and software question. He state that
Mr. Terry Fleming, Wang Representative, has sent a letter to Council's
attention noting that Wang would guarantee the software functions will
meet the needs of the City, and ,take full. responsiblity for Telios as
local support of the Cogebec system. This would cost approximately
$5,000 in addition to the cost of the hardware and software.
(b) Mr. Terry Fleming discussed at great length the process of software
selection and the contract method for that. He noted that there would
be an additional 1.% discount now on the purchasesinceGSA has gone up
to '5% and prompt payments in 20 days' has gone up to 2%. Mr. Fleming
recommended Council use the Cogebee system through the local support
services of Telios.

(c) Mr. Dave Br.azins•ki, Coopers and Lybrand, noted that the next step
for Council is to get the computer order i.nitiated and that Coopers
and Lybrand will assist in the contract phase for the software vendor.
He noted that this would not be legal advice but technical advice
in regards to the contract.
(d) Councilman Brian questioned why the City should pay Coopers and
Lybrand to do this work when Wang would also do the technical side of
the contract and system. Mr. Brazinski stated that his primary con-
cern would be to determine that the system being implemented would
protect the City as far as audit requirements and financial report-
ing trails were concerned.
(e) Consensus of Council was to initiate the hold order for the computer
and begin work through Coopers and Lybrand to draw up the software
contract.
12. McDONALD SEWER ASSOCIATION REPORT - LID
(a) Director of Public Works stated that tie and the City Administrator had
met with the citizens in the McDonald Street area and questioned their
desire for sewer. The meeting was lengthy and discussion was dealing
more with their desire for no annexations in the area. The consensus
of the citizens was that sewer would not be needed if annexation was
required.
The Director of Public Works recommended that if the property in quer-
tion was to be developed, a pump station would have to be installed.
He recommended the following requirements for that installation:
1. Council consider and approve the concept of installing a pump
station tinder theguidelinesof the sewer pump station policy
of May 7, 1979, and installation should be according to the
policy except where it refers to permanent installation.
2. A one year advance maintenance and operation bond be deposited,
add to the monthly sewer billings charges maintenance and
operation cost, and require a<non-remonstrance- agreement be
signed for an LID to replace the pump station when necessary.
3. Continue the Comprehensive Plan Study for unsewered areas.
4. continue to ;pursue any means of providing sewer in this area.
5. Council direct staff to request USA to put McDonald trunk area on
their master plan.
(b) City Administrator read a letter dated January, 1980, from Mr. John
Butler regarding the sewer issue and noting opposition to the pump
station.

Butler thanking him ,for his concern.

(a) City Administrator stated police Department had recommended approval.
(b) Councilwoman Stix:ler moved to approve all requests except for Yakiniku
House, which should be held over to the next meeting for the Chief of
Police to report on, and forward to the OLCC. Motion seconded by
Councilman Brian.

19 OTHER
(a) City Administrator reminded Council of the mediation session scheduled
with TMEA' for February 13th at 9:00 A.M. and requested Council- members
attend if at all possible.
(b) City Administrator recommended the Selection Commission meet soon and
appoint members to the vacancy on the Park Board and the Budget Com-
mittee, After discussion, Council asked that the meeting be hold Wed-
nesday, February 13th at 5:15 p.m.
(c) City Administrator presented an offer to Council from Sam Gotter on the
Pinebrook Property which is in the process of being advertised for ;sale.
Mr. Gotter offered an amount which is '$3,500 under the appraisal price
from last summer. City Administratorrecommended,that Council not
approve offer and request Mr. Gotter list the property in multiple list
ing service.
Consensus of Council was to fol.low City Administrator's recommendation.

(d) Councilman Scheckla questioned what the status was on Harvey King's
sewer problems.
Director of Public Works .stated that there will be a resolution pre-
sented to Council at their next meeting to form an LID in the area.
(e) Councilwoman Stimler questioned the Water. District's intention in
patching Gaarde Street.
Director of Public Works advised Council that Bob Santee of the Water
District called him today and stated that Gaarde Street would be paved
by Thursday, February 14th.
(f) Councilman Cook requested Council receive. Planning Commission minutes
again.
(g) Planning Director mentioned several items Planning Staff is working on
at the time and advised Council that Site Design Board dissolution and
an overall transportation plan would be coming up in the future for
their review.
(h) Councilman Brian questioned the status of the Annual Report.
Staff stated that the report would be printed in blue line form this
week and the report should be ready shortly thereafter.
(i) Councilman Brian asked if Council and staff were still planning on a
rap sess.-ion.
After lengthly discussion, Council expressed their desire to have this
after the Police Department study is completed.
(j) Mayor Mickelson stated that Dr. Tracy had sent a communication to each
of. the Council members dealing with the Police. Department Study and if
there were any: questions 'or concerns that Council should contact Dr.
Tracy directly.

The present Branch Office for Adult and Family Services is in s
Hillsboro. All clients in Washington County must go to Hillsboro to
apply for assistance and services.
The Region Office for administrative management of the Clackamas
kamas and Columbia counties) is in Tigard.

However, no direct client services are provided by this Office.
Presently we are studying various options to improve our delivery
of services to clients. Additionally, we are reviewing the Hillsboro
Branch Office, since it is the largest Branch Office of Adult and
Family Services in
,he state and is continuing to grow at a rapid rate.
One consideration is the possibility of developing either a satel-
litel-Off,ice or'a full-scale Branch Office in the Tigard area.

Subject: McDonald Trunk Sewer
Dear Sirs,
I reside in the proposed McDonald sewer trunk area and would like
to submit my personal opinion on the project. I surveyed many of
my neighbors(their opinions have been submitted in a previous
letter) ,along McDonald and Omara, I talked to Frank Currie Tigard's
City Engineer, I attended. the 5 February sewer information meeting,
and the 6 February NPO #1 meeting; therefore, I feel fairly well
informed on the issue.
Firstly, I believe allowing a pump station is not in the best
interests of the City of Tigard or the people who are hooked up to
it. A pump station system is expensive to install and expensive to
maintain; moreover, it places a constant financial burden on the
.homeowner connected to it. In addition, a pump station, being mech-
anical, will wear out and either need to be replaced or must be con-
verted to a gravity system. Either option is expensive. The pump
station option does not make sense when a gravity system is possible.`
Secondly, it can be plainly seen by the McDonald St. LID Ques-
tionnaires results that most people responded favorably to a future
sewer system(Question #6) Whether Tigard or United Sewage Agency ;
(USA) puts in the system, it should be planned now for orderly de-
velopment in the future. In my survey many residents stated that
the whole hillside from above McDonald clown to Fanno Creek should
be included if the entire area will eventually need sever. It makes
sense financially to plan and implement a sewer system in as large
an area as possible to lower costs for each participant. Of the
people at the 5 February meeting and of those I surveyed, many
a
property owners with no present septic tank problems realize the
advantages of a gravity sewer system.
Thirdly, the only real problems, as far as I could see, was
not with the sewer system itself but with its costs and the forced
annexations involved with hoofing up to the system if it is in-
stalled by the city. It seems reasonable to assume that costs
might be reduced with a larger included area, bonding alterna-
tives, etc. , and if the sewer can be constructed by USA with urg-
ing from the city, then immediate annexation ceases to be a prob-
lem. People could then join the City of Tigard as they truely want-
ed to, not when they had to or needed to because they wanted some-
thing from the city.
In conclusion, the entire unincorporated area from above
McDonald down to Fanno Creek is included in the Tigard growth
boundry; therefore, a sewer plan should be formulated by the City
of Tigard and the plan implementeA as logic and need dictate. The
city should never be forced to enter into a situation which is a-
gainst its better judgement and a piecemeal solution to a totally
larger problem.

I am a. member of the Neighborhood Planning Organization #1 and a
resident of the area under consideration for the 11cDonald Street sewer.
Being can interested citizen and NPO member, I undertook & survey of the
NPO l residents: effee.ted by the Hedonald sewer project. I interviewed
a3. majority of the the affected NPO 1 residents; however, not m.11'due to
some residents not being home, and other residences being rented(ie. 87th
Court residences: are entirely rented).
Of the twenty—four residents in NPU 1�1 did interview twelve were
against the proposal, tw:o were for the proposal, three had no reaction
as yet, and six were rentals. The people that were against a McDonald
sewer line had definite feelings that came through the interview because
many of them have been through this before either here or somewhere
else. luny people feel that the projectinstead of affecting just the
residents off bcdonald, should include every readdent from above Ile—
Donald dawn to Fanno Creek(the whole imincorpora.ted area). Most of this

Another feeling brought out by many residents is that concerning
the Burnham/Jansen project verses the City of Tigard and its connection
With this proposal. Many area residents feel that they are going to
be subsidizing the few'. developern that do need the newer so they can
subdivide their properties into the smallest lots possible. Residents
on Owaara and in Hillview Court are wondering how they are to be served
from a McDonald Street sewer.
One of the largest concerns was that of cost. How much per each
property owner, .hoer assessed, when aassesaed, the amount of Federal or
local funding provided, etc. A great concern was the affect on the
home ) on a mingle]nonsubdividaable)l€arge let as there are in the NPO 1
area.. Are they to be assessad—penal ized for their home on a large
lot in contrast to those who can subdivide into smaller R®7 lotas.7
Many of these lots are asst least aa+ third of an acre due to their septic
aystems, yet they are not subdividable due to the placement of their
structure or other restrictions. More of these people did seem agree—
able, however, with the option mentioned in the paper where there
would be no forced maserssments or hook-ups unless wanted or needed by
the property owners or possibly eA the time of sale or trasfer of the
property.
Lastly, of the taro property owners that did repand favorably to
the McDonald sewer proposal, one would like to subdivide his property
and the other believes that: 1) Possible future health hazards in the
future would be eliminated, 2) property valueaa would be increased, and
3) with the ensuing development the city's tax base would be increased.
In. conclusion, not one person interviewed indicated that they now
haor in the past had a septic tank problem or failure. In addition,
one person a ked if there were not definite criteria to establish the
need for asever system over septic tanks and asked if any runoff
a aaaples had. been analyzed to establish the coliform bactordAl levels
for the areaa, in question. Manny persons I talked to indicated that
they would attend the & February;1980 meeting*
