7. NUISANCE ABATEMENT PETITION - S.W- 121st Avenue, Scholls Ferry Road, 135th
Avenue, and Katherine Street.
(a) City Administrator noted that the City had received a petition from residents
on S.W. Katherine Street and 127th Avenue in the Bellwood Subdivision request--
Council stop the landstripping' work being conducted by Dairy Rich Co.

(a) City Administrator noted applicant's request and hi ;tory of problem. City
Administrator recommended Council request developer to appeal to the State
Board of Appeals seeking a variance to the 7'6" ceiling height of 7'0" and
that the applicant be allowed to continue construction noting that an
occupancy permit will not be issued unless a variance is granted by the
State Board of Appeals or the new Uniform Building Code is adopted allowing

32. ACCEPT BID TRAFFIC COUNTERS
(a) City Administrator stated the traffic safety grant shows $3,570 for the
purchase of trafficcounters. The bid from Leopold &' Stevens, Inc. is in
the amount of $4,707 for four traffic counters. These counters have two
(2) hoses each and can read two (2) streets or two (2) sides of a '
at the same time, so in effect you get eight readings instead of four street

City Administrator recommended approval of the purchase from Leopold &
# Stevens and recommended the city pickup the $1,137 over the budgeted amount.
(b) Motion by Councilman Cook, seconded by Councilman,Brian' to award the bid in
the amount of $4,707,00 to Leopold & Stevens, Inc. for four traffic counters.
Approved by unanimous vote of Council.
33. ACCEPT POLICE. CAR BIDS
(a) Chief of Police reported the following bids were received:
Wentworth Chevrolet $6,803.34 ea. with exceptions to specifications and
no limit on inflation prices.
KnLuss Chevrolet — $7,203.45 ea. with exceptions to specifications and
no limit on inflation prices.

3.5% limit on inflation or maximum cost

Chief of Police recommended awarding the bid to Carlson Chevrolet as low
bidder noting that price was delivery F.O.B.
(b) Motion by Councilwoman Stiml.er, seconded by Councilman Scheckla to award the
bid to Carlson Chevrolet.
Approved by unanimous vote of Council.
34. PEMBSOOK. SEWER L.I.D. PETITION
(a) City Administrator stated that a petition from the Pembrook area had been
received for formation of a sanitary sewer L.I.D. and recommended Council
approve contracting with an engineer to start the project.
(b) Motion. by Councilman Cook, seconded by Councilwoman Stiml.er to authorize
Regional Consultant Inc. to proceed with the preliminary engineering.
Motion failed 3 to 2 - Councilman Brian, Councilman Scheckla and Mayor
Mickelson voting nay.
(c) after lengthy discussion, Councilman Brian moved to have Harris & McMonagle
Engineering firm do the prel.:hninary engineering since they drafted the
original petition, contingent upon the fact that they can perform the task
by October 1, 1979. Motion seconded by Councilman Scheckla.
- Councilman Cook and Councilwoman St:imler voting nay.
Motion passed 3 to 2
35. OTHER
(a) City Administrator stated that he authorized the public works department to
have Administrator
do major repair work to Canterbury Lane since the
rain. Cit
road caved in during the last heavy y Administrator nested that
du. to the 'extreme danger presented to the vehicles on the road the project
could not wait for Council action .but had to be corrected immediately'.
Motion by Councilwoman Stimler, seconded by Councilman Brian, to declare an
emergency existed and radifyithe action of Dick Eagle of Eagle-Elsner Inc.
who did the road work for $7,040.
Approved by, unanimous vote of Council.
(b) City Administrator reported the audit field work has been completed and
the annual 'report will be printed when we receive the final financial
informationfrom, the auditors.
(c) Councilman Scheckla noted the restrooms in Cook Park are in poor condition
and requested staff to make sure they are cleaned up.

(d) Councilman Scheckla questioned the Chief of Police as to why there are less
warnings and more citations being issued.
Chief of Police stated there are more accidents and moving violations that
take the officer's time so that there is less time to issue warnings to
people for the minor violations.
(e) Councilman Scheckla presented pictures to Council, requesting staff place in
file, of the. Canterbury Woods project which show the screening p
robl
City Administrator stated that he advised Mr. Hoffman verbally and the
Associate Planner advised Mr. Hoffman in writing that an occupancy permit
would not be issued until there was proper screening and the chimmney chases
are corrected.
City Administrator noted that Legal Counsel had requested Council not discuss
any items on the appeal until the appeal is heard.

1. Administration:
a. The Library Board held its regular meeting on July 9. Minutes are
attached.
b. Librarian attended Washington County Citizens Advisory
Board meeting
July 11. Of interest: (1) Board approved funds for Librarian to attend
Pacific Northwest Library Association meeting in Boise, Idaho, August 21-25,
as representative for Washington County Cooperative Library Service NCCLS) :
(2) Approved WOCLS request to try reciprocal borrow.ing with Clackamas County
for the FY 79-80 to determine amount of cross-over borrowing and feasibility
of a reciprocal borrowing agreement.
c. Librarian was guest speaker at the Kiwanis noon-time group on July 18,
reviewing last three years of growth.
d. Librarian attended ISIS professional board meeting on July 25. Of
interest: (1) A ccnmdttee was formed to help %CCMS libraries organize infor-
mservices;tion and referral serces; (2) The new outreach librarian will be i.nven-
torying the large-print book collection and establishing a procedure for
continual circulation to the using libraries.,_
e. Librarian attended Computerized Circulation CcnTnittee meeting July 31.
The caTputerized`circulation system was removed from the'serial levy contract
be
at the meeting of the Serial Levy Contract Ccnittee on July ll and will
negotiated in separate contracts with each city as they go "on line. There
has been concern by the County Ccmni.ssioners (see merro of 12 June with June
report) regarding the feasibility of the whole project. Beaverton has ex-
pressed concern.that the project might be scrapped. However, the Ccrmittee
has decided to revise the specifications as quickly as possible and try to
! get the system set up in Beaverton during FX 1979-80. After that,each city
will be asked to go "on line" when they feel that they can support the system.
2. Personnel:
a. Volunteer hours totaled 81, an average of 3.2 per day.
b. Ida Mae Heck, student at Portland Community College, worked 100 hours
practicum in July. This is-Tigard's second year to participate in this program.

Call to Order The regular meeting of the Tigard Library Board was
and Roll Call called to order by Chairman Betsy Chick at 7:30 PIM.
Present: Dick Bendixsen, Yvonne Burgess, Jean Carlisle,
Jim Sidey. Guests: Carolyn Laurentz, Sharon Takahashi
and Madalyn Utz.
Reports: The minutes of the previous meeting were approved. The
monthly report was noted and there was sane discussion
on the Washington County menorandrmi regarding the com-
puterized circulation system.
Old Business:
Serial Levy Contract Yvonne Burgess and Jean Carlisle (or Betsy Chick) will
attend the next serial levy contract meeting on July 11
in Hillsboro.
SB 31 Librarian announced that the state Aid Bill passed the
legislature, amended to yield $.21 per capita the second
year of the biennium.
Loss of Books Librarian presented the Board with an estimate for
Problem installing an alarm system on the doors to curb book
thefts. The estimate was $540 and not considered feasible.
.aim Sidey offered to e.,plore a more economical route.
Building Plans There was open discussion between the Board and Friends of
the Library guests regarding the launching of a building
campaign. Through consensus the group decided to begin
gathering information with which to formulate,sane_plans
for approaching citizen groups and the City Council for
support. Dick Bendixsen will gather information on con-
mercial property, i.e., availability, costs. Jim Sidey
and Dick Bendixsen will talk to Otto Sorg regarding possible
ways ,to utilize the present site. Irene`Ertell will write
a needs assessment for presentation to groups and City
Council. Friends of the Library Board will ascertain
support of their membership and plan ways to integrate
background information being gathered into a planned'
campaign. The group also agreed that as soon as possible
the City Council should be presented with a joint "letter
of intent" and asked to support the project.
The meeting adliourned at 8:35 Pm.

VIII. TRAINING
A. Dispatch School. Dispatches Teresa Eley received BO hours of training in
dispatch procedures at a school taught by the Board on Police Staudardv and
Training at the police Academy in momouth. This school was from July 9
through the 70th.
B. Search and Seizure. An B hour class on search and seizure procedures was
presented by BPST on July d, which was held at the General Motors Training
Center in Tigard. 77 man hours of training were received, as this class was
attended by Sgtb. Newman and Branstetter; Corporals Martin, Myers and
Featherston; and Officers Call, Grimhso, deBrauwere and Hedstrom.

EVALUATION OF RETIREMENT PROGRAM
ORS 237.520 requires that the benefits provided by local governments be "equal to
or better thanf° the benefits employees could be receiving from the Oregon Public
Employees Retirement System.
An evaluation has been performed on the benefits of Tigard's retirement plan and we
have received a letter from the assistant director of the Oregon Public Employees
Retirement System stating that our program, as it relates to PERS, provides our
employees with benefits that are "equal to or better than" those they could receive
under PERS. No further action is required on the part of the City at this time.
This exemption shall continue to apply as longs coverage remains substantially
u
unchanged.
TIGARD HAS BEST SAFETY RATING
The State accident Insurance Fund recently completed an accident experience rating
analysis of all cities in Oregon and the results show that Tigard's rating is the
best of all cities in the State and is "about as low as we can go" according to SAIF.
D.E.Q. RELUCTANT TO APPROVE USE OF EFFLUENT
The City just received a letter from Mr. William Young, Director of the. Department of
Environmental Quality regarding our request to use treated sewerage effluent for
irrigation of Cook 'Park.
Director Youn stated "we are very reluctant to approve the use of treated sewage
effluent for the irrigation of a public park which is visited by small children...
lie also said that "the only way that the Department could approve the use of the
effluent would be if that effluent 'met the Environmental Protection Agency (EPA)
drinking water regulations."
He further stated that D.E.Q. would require that the water used for irrigation
be tested for coliform and turbidity each day that it is used. Testing for other
contaminants would have to be done annually.
