STUDY SESSION MINUTES, JUNE 18, 1979, 7:30 P.M.

2. PROPOSED COUNTY ROAD LEVY - Washington County Representative.
(a) Mr. John Crockett, washingcon County `rubiic works Department, gave a
brief synopsis of history of the proposed road levy. He noted that the
roads in the Tigard area to be improved would be Walnut Street, 72nd
Avenue, McDonald Street, Greerburg Road and Durham Road.
(b) Council and staff questioned Mr. Crocket regarding road jurisdiction,
concerns of quality of improvement, and which portions of the roads
mentioned would be improved.
(c) In response to City Administrator's inquiry regarding collector streets
included in the proposed program that have been taken over by the City,
Crockett commented it was the intent of the program to provide funding
for the improvement of S.W. 72nd, S.W. Durham, etc., and the City would
take over and supervise the actual type of road improvement.
3. KATHERINE STREET L.I.D.
(a) Mr. Stu Cato, Harris & McMonagle, appeared before Council to explain
locations and cost of the proposed L.I.D. Final recommendation would
come' to_Council when the Corps of Engineers finished their flood plain
study.
(b) Marie Blum, S.W. Katherine Street resident questioned when the flood
ompleted. City Administrator' stated the City

should receive the information within the next 6 weeks.
(c)'- Mr. Allison, S.W. Katherine Street resident noted which property owners
were requesting storm water sewer and sanitary sewer service.
Mr. Howard arrived - 8:20 P.M.
(d) City Administrator recommended Council set a public hearing regarding
this item.

4, 121ST AVENUE L.I.D.
(a) Mr. Stu Cato, Harris McMonagle, appeared to present the plans for
the 121st Avenue area.
(b) Mr. Feber, 121st Avenue; Dennis Murphy, Bellwood Subdivision; and Bill
Richey, tax lot 9OO; appeared to questionF Council regarding annexation
in the area, and seek explanation of the LID process.
(c) City Administrator recommended Council set public hearing.

. Gene Ginther, Ginther & Associates, gave brief synopsis of history of

project, noting that Tax Lot 1000 cannot have access to 72nd or Varns
Street per Planning Commission action.
(b) After brief discussion, Councilman Brian moved to direct staff to prepare
an ordinance setting a public hearing for July 9,1979, amending
assessments (delete TL 1000), and to include street light costs in the
assessments. Motion seconded by Councilwoman Stimler.
Approved by unanimous vote of Council.
6. BISHOP SEWER AGREEMENT
(a) City Administrator noted that the following were the unresolved issues
from the last Council meeting.
1, :will the developer be able to recover a portion of his costs for
engineering and for City fees?
2. Precisely which land parcels shall be included in the computation
for determining how much owners or users of the sewer trunk line
will have o pay before they can connect to the sewer?
3.
Should the developer be required to provide a sewer easement to F
Pietro's, Rebel Car Stereo and Awful Brothers Service Station

2. That the developer be eligible to receive reimbursement for up to
90% of his certified engineering costs. The total engineering costs
to be included in the sewer installation_ costs when computing the
square foot rate.
3. That the developer be responsible for providing a sewer easement for
the lots where Pietro's, Rebel Car Stereo and Awful Brothers Service
Station are located unless he can document that these structures are
going to be removed and that any new use of these lots will not
require sewer service, i.e., will be used for parking, etc.
(b) J.B. Bishop discussed the private easement for Pietro's and requested
Council grant the payback from the duplex property to him so that the
business books would be kept straight.
(c) City Administrator recommended easement be provided to Rebel Car Stereo
property.
x (d) Councilwoman Stimler moved to table, Councilman Brian seconded.
Councilman Brian removed his second. Motion failed for lack of second.
(e) J. B. Bishop noted that he did not wish reimbursement from Awful Brothers
and Rebels Car Stereo.
(f) Motion by Councilman Brian to direct staff to draft official document based
on the first draft specifications; staff recommended easement be granted to
Rebels parcel with no engineering or City fees included and duplex lots not
be included in reimbursement. Motion seconded by Councilman Scheckla.
Approved by unanimous vote of Council.
(g) Consensus of Council to consider at future Study Session whether'City
should consider engineering and City costs on any reimbursement request-
and set up guidelines for the reimbursement request process.
7. WASTE WATER FOR COOK PARK FROM UNIFIED SEWER AGENCY & COOK PARK GRANT.
(a) City Administrator stated the City had requested` $49,O10 BOR Funds for
project. The Washington County Park Review Advisory Board is recommending
to the Washington County Board of Commissioners that only $27,800;be approved.
This would be'enough to do the 'restrooms and part of the sewer line, no
irrigation line would be included.
Since monis wouldn't be available for irrigation lines, City Administrator
noted that it might be possible to take effluient from the Unified Sewerage
Agency Treatment Plant on Durham Road. D.E.Q., at the; present time, is>
investigating whether the City would-be allowed to irrigate the park with
effluient since .children 'use the park.
The price comparison for water'costs is:
Tigard Water District - l million gallons of water at $866.
Unified Sewerage Agency effluient - l:million gallons of water at $80.

(b) Consensus of Council to direct staff to pursue subject further with
D.E.Q.
8 ANNUAL REPORT
(a) City Administrator reported the budgeted figure for the annual report
is $1,457.00. After many quotes were received, staff recommended Times
Litho typeset and print the report with Richard's Studio doing the
paste--up and artwork. The total cost would be approximately $1,442.00.
(b) Consensus of Council was to instruct staff to proceed with project.

9. PROPOSED ORDINANCE AMENDING CHAPTER 18.50 COMMERCIAL-PROFESSIONAL ZONE (C-P)
(a) Planning Director recommended the addition of veterinarian offices and
animal hospitals to the (C-P) zone since it is already found in the
General Commercial Zone (C-3) and Main Street Commercial Zone (C-3M).
Planning Director noted this item would appear on the June 25, 1979 agenda.
10. RICHARD RHODE VACATION OF GREENWAY - 124TH Avenue.
(a) City Administrator noted that a portion of the area in question was
greenway, and a portion was dedicated right-of-way for the street. City i
recommended Mr. Rhode extend the sidewalk and have a wheelchair ramp to
the street. City Administrator recommended the matter be turned over to
the Legal Counsel to advise legal ramifications of vacating greenway and
right-of-way and how best to accomplish this goal.

Legal Counsel arrived at 10:09 P.M.
Consensus of Council to have Legal Counsel handle matter.
11. 1979-80 BUDGET
(a) City Administrator noted that there is three times as much money budgeted
for capital improvements,over last year. Staff recommended a new line item
be added to allow the Street inventory Study to be implemented by adding
$1,000 to the Capital Budget.
(b) Planning Director recommended Mag Card Typewriter be cut from the budget
and raise the travel and subsistence account in 1.4.1 by $500.
(c) Motion by Councilwoman Stimler, seconded by Councilman Brian to reduce
1:4.1.651 by '$1,000 and adding $500 to 1.4.1.637.
Approved by unanimous vote of Council.
(d) Councilman Brian expressed concern over 90% increase in Library Budget.
Motion by Councilman Brian, seconded by Councilman Scheckla to cut $5,973
from the Library Budget with the City Administrator and Head Librarian
determing where the cuts should be.
Approved by unanimous vote of Council.

(e) Councilman Cook questioned if a line item for sidewalk construction
was in the budget.
Motion by Councilwoman Stimler, seconded by Councilman Bian to form a
700 account for sidewalk construction by taking $3,000 from contingency.
Approved by unanimous vote of Council,
(f) Council and staff discussed increase in dollars, personnel and overtime
in the budget.
(g) City Administrator requested Council take action shortly to evaluate the
City Recorder and Municipal Judge for salary review purposes.
(h) Councilwoman Stimler stated there should be a separate line item for
Finance Director so that later in the year, if Council wishes to, they
can split the City Recorder/Finance Director position.
Councilman Brian requested City Administrator's opinion regarding the
necessity of splitting the position at this time.
City Administrator replied that at this time there was no need for a
split position, but that in the future the workload would necessitate
a split.
Legal Counsel left - 11:01 P.M.
Planning Director left - 11:04 P.M.
After. further discussion regarding general budget, City Council consensus
was to;consider and adopt at the next Regular Meeting of June 25, 1979.
12. OTHER
(a) Councilman Cook noted that a letter had been received from the Planning
Commission Chairman regarding Flood Plain Generalenforcement. Consensus
of Council was to place on the°next Study Session agenda.
(b) City Administrator requested an Executive Session for the June 25,';1979
meeting to consider`evaluation of City Recorder and Municipal Judge.

Tigard's Annual Flood Insurance Program Report has been filed
with '-MD. This report includes all newly annexed areas to the
City and lists the structures within the floodalain.

The "expected" date of arrival of the new Police Vehicles is
Tune 17, 1979. No "exact" date has been guaranteed.
SENIOR CFNTEP1.
Staff exTerienced minor difficulties in porving to TJD that
y certain percentages of the senior population in this area would
be served by the proposed Senior Center. Figures contained in

relative to income of persons over 65 in the area and we were
able to receive assurances from Washinton County that we did
oualify for the funding.

Staff has arranged a meeting with the residents of Fairhaven
concerning an LID for sewer instal.laticn. The meeting will be
Wednesday, June 27th at 7030 `p.m. `at City Hall.

Appropriate letters have been sent requesting the forms necessary
to apply for an increase in the gas allocation to the City. I-le
have been assured that gas will be available for Police and Fire.
Other departments are assured of allocations at an 80 level.
