ORDINANCE No. 79-26 AN ORDINANCE SPECIFYING THE ANNEXATION PLAN FOR VARIOUS UNINCORPORATED LANDS WHICH ARE WITHIN TIGARD'S URBAN PLANNING AREA AND MORE SPECIFICALLY DESCRIBED AS SEVEN DISTRICT AREAS REFERENCED BY ADOPTED NEIGHBORHOOD PLANNING ORGANIZATION PLANS; PRESCRIBING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. (a) Mayor Mickelson pointed out that there was an error in the agenda in that this was the Second Reading of the Ordinance rather than a Tabled item. He went cn to describe the public hearing process that this Ordinance has been through, and stated that no further testimony would be heard tonight. He explained his feelings on the Ordinance: stating that this was only a eplan", it would not mean the immediate and forced annexation that some citizens are concerned about; that there would still be thorough review of each individual annexation; and that the Ordinance would, in fact, protect areas which are not yet developed in that the Tigard Planning and Building requirements are more stringent than either Washington County or the state. (b) Motion by Councilman Brian, seconded by Councilman Cook to approve. Approved by 4 to 1 vote of Council. Councilman Scheckla voting Nay. 9. PROCLAMATION -• Centenarian Day - June 2, 1979. (a) City Administrator, referring to a letter from the Tigard area Girl Scouts, explained that they wished to plant trees (with name plaques) in Cook ,Park to honor local persons achieving the age of one hundred. Their hope is to make this an annual event. (b) After discussion by Council, the Mayor directed staff to prepare the necessary documents for the proclamation. 10. RESOLUTION No. 79 ,51 RESOLUTION OF THE ;TIGARD CITY;COUNCIL ACCEPTING THE PUBLIC JIVROVEMENTS CONSTRUCTED WITHIN TANGELA'SUBDIVISION, SUBJECT TO HEREIN SPECIFIED CONDITIONS. (a) City Administrator recommended acceptance of the public improvements subject to the specifiedconditions. (b) Motion by Councilman Cook, seconded by Councilman Brian to accept. (a) 'City Administrator reported that the Selection Committee had interviewed several candidates and unanimously` recommended Susan Herron. (b) Councilman Brian asked about Ms. Herron's background. City Administrator stated that she has a Masters degree in Education, is a local teacher at Chas. F. Tigard School, and is a fifteen year resident of Tigard. TEMPORARY USE TU 2-77 (Richard A. Cooper) A request oy Richard A. Cooper for a one year extension to retain a temporary mobile office at 13935 S.W. Pacific Highway (Wash. Co. Tax Map 2S1 3DD, Tax Lot 1000). (a) Planning Staff referring to the Memorandum to Council explained the concerns of this item including landscaping, sidewalks, sewer and access. He recommended additions to the conditions specified in the memorandum to include the addition of_a new_(d)_ requiring sewer hookup within 30 days; and the addition of (f) to require the applicant to go before Planning Commission again on the Conditional Use prior to development due to the length of time since the initial granting of the Conditional` Use. (b) Legal Counsel explained that this action (f) was allowed by Ordinance. (c) Councilwoman'Stimler stated that she had a'.probl'em with the requirement' to return to Planning Commission as the delays have been due in a large' part to the continued development surrounding this lana. (d) Mr. Cooper, Tigard Motors, questioned the requirement of the access through the "backyard" of his property, stating that he had never agreed to that access and .had not been involved in development plans of adjacent'lands. APPEAL - ZONE CHANGE ZC 2-79 (Tindal Cedar Homes) (a) Planning Director explained that this project had been denied by the Planning Commission on the basis of the one acre minimum Commercial- Professional development specified by the NPO. (b) LaValle E. Allen, 7540 S.W. Hermosa, NPO 464 member and resident explained that the one acre minimum was designed to discourage small developments which would not provide continuity in this zone. He went on to say that the NPO wanted to "discourage" these developments unless "hardship" could be shown on the part of the developer; in which case the development would be rubJect to Site Design Review (to prevent the feared lack of continuity). (c) Planning Staff explained the definition of "hardship", stating that it is intended to cover cases where an owner had purchased property for a specific type of development, after which the zones were changed to prohibit such development. He went on to say that since the developer had purchased this property after the NPO placed the one acre minimum restriction, the developer should have known of the restriction and did not have a "hardship" placed on him. (d) Planning Director summarized the problem and recommended that Council deny the appeal. (e) Motion by Councilman Brian, seconded by Councilman Scheckla to deny the appeal and uphold the action at the Planning Commission. Appeal denied by unanimous vote of Council. 18. (b) City Administrator reported that the County Charter Review Committee would be meeting on Thursday, April 26, 1979, 7:30 P.M. at Fowler Junior High to solicit citizen in-put regarding the Charter. (c) City Administrator, referencing to a letter received from Councilwoman Jean Young, Ring City, stated that the Washington County Community Action Committee is seeking nominations from Tigard for an alternate to serve on the Committee. City Administrator suggested that Council begin thinking about whom they would like to nominate. (d) City Administrator told Council that he would be meeting with Straam Engineering and the State Traffic Safety Board on Tuesday, regarding the proposed traffic safety project grant. (e) City Administrator stated that a request had been received from Colony Creek Estates (a 28 lot subdivision) for a Subdivision Compliance Agreement. He went on to recommend that Council approve such an agreement. Motion by Councilman Cook, seconded by Councilman Scheckla to approve and authorize signing of the Subdivision Compliance Agreement. Approved by unanimous vote of Council'. (f) City Recorder recommended_the following meeting schedule: April '30th and May 7th Study Sessions, May 14, regular meeting, May 21 special meeting. (g) Councilman Scheckla asked the Chief for an explanation of the "chase scene" involving Tigard police cars going a great distance out of the city . Councilwoman Stimler, reported that she had been riding in a patrol car at the time. She went on to say that'partol'cars did remain in Tigard and that the necessity for the chase was due to a lack of assistance from other jurisdictions. (h) Councilman Brian questioned the status of the Street Overlay Bids. City _Administrator reported that bids will- -be opened on April 26th at 3:00 P.M., and report would be brought before Council at the following Study Session. (i) Councilman Brian questioned the status of the CH2M Hill project. City ' Administrator reported that the project was being delayed due to the need for information from the Corps of Engineers which will not be available until ' July. Councilman Brian then questioned whether or not CH2M Hill would be in- volved in the Summer.lake Project. City Administrator reported that he did't know. The applicant has been granted two Temporary Use Permits from May, 1977 thru May, 1979 2. The Council may grant a third Temporary Use Extension. 3. If the City Council grants an extension, the following conditions must be required. te a.
