Sunrise Lane, expressed his concern over the legality of conversion members voting rights. (b) Legal Counsel stated that he would be willing to explain the matter to Mr. Cooper. Mr. Cooper felt that that would be agreeable. 19. PROPOSED VACATION OF CERTAIN SIDE LOT EASEMENTS IN GAARDE PARK SUBDIVISION IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON. (a) Planning Directorexplained that as the developer was proposing common wall structures vacation,of these side lot easements was needed. He went on to say that some side lot easements would remain to allow the northern residents to hook onto the sewer line. (b) Mayor opened public hearing. No one;appeared as a proponent. (c) Bibianne Scheckla, 10890 S.W. Fairhaven, spoke in opposition both of the common wall structures and the problems this project would create in terns of the northern residents hooking onto the sewer line. (d) Mel Johnson, 10860 S.W. Fairhaven Lane, spoke in opposition primari"lv to the expense of sewer hook up. He addressed several questions to Council about options in sewer hook up. (e) Planning Director concluded byrecommending approval. He went on to q say that an arrangement :might ,be made to install a sewer line along the northern'property line, thereby reducing the sewer rook up Foxe to the northern neighbors. He stated that he would inform these residents of the possibilities`. CITY OF TIGARD, WASH- INGTON COUNTY, OREGON. Motion by Councilman Brian, seconded by Councilman Cook to approve. Councilman Scheckla announced a possible conflict of interest as he owns property in the area, but stated that he intended to vote anyway. Approved by unanimous vote of Council. 20. ZONE CHANGE ZC 32-78 - Robert Randall A request by the Robert Randall Co. for a zone map amendment from City R-7 "Single Family Residential" to City A-2 "Multifamily Residential" zone on A 9.16 acre parcel. The subject property is located at 7955 S.W. Bonita Road (Wash. Co. Tax Map 2S1 12B, Tax Lot 401). (a) Planning Director recommended approval, noting that Planning Commission had approved this zone change. (b) Councilwoman Stimler moved to amend this Ordinance by adding a new cond- ition as follows: No changes will be made to approved plans or specifica- tions unless formal application is made to the appropriate departments and changes are approved by that department. Application for changes will be made in writing and shall include applicable drawings, engineer- ing specifications and other details requested by the department. No construction shall take place in these instances until after the charges have been approved. Any deviation from this condtion will result ir. (b) Councilwoman Stimler noted her problems with items 9 and 10 relating to street widths. She objected to the minimal widths specified espe- cially in light of consideration on a later agenda item of setting City street width standards which are wider than those specified here. RATIFICATION OF T.M.E.A. `1979-80 CONTRACT (a) City Administrator reported that T.P3.E.A. had met twice in the past week, and at both meetings had not ratified the contract. He felt however, that there was not reason for Council not to ratify the con- tract and recommended such action by Council. (b) Motion by Councilman Cook, seconded by Councilwoman Stimler to table until T.M.E.A. ratifies. Tabled by 3 to 2 vote of Council. Mayor Mickelson and Councilman Brian voting„Nay. 23. RESOLUTION No. 79- RE NEW GARBAGE RATES (a) Legal. Counsel reported that this item was not yet ready for Council consideration and asked that it be delayed 'until, next :reek. 24. APPROVE CH2M HILL - STORM WATER STUDY AGREEMENT (a) City Administrator reported that this was merely a change in the contract to put it under a different branch of the organization- He PAGE 6 _ REGULAR COUNCIL MEETING - MARCH 26p' 1979 went on to say that this would not affect time frames or staff on the project. He concluded by recommending authorization for the Mayor to sign and execute. (b) Motion by Councilman Brian, seconded by Councilwoman Stimler to authorize the Mayor to sign and execute. (b) After much discussion by Council regarding the possible triclusion of the 25 year flood plan, Councilman Cook moved to approve. Seconded by Councilman Brian. Approved by unanimous vote of Council. 26. RESOLUTION No. 79-46 A RESOLUTION ADOPTING RECOMMENDATIONS TO FURTHER..THE IMPLEMENTATION OF THE HOUSING PLAN OF THE CITY OF TIGARD. (a) Legal Counsel referring to previous discussion of the matter, recommended approval. (b) _ Councilwoman Stimler expressed concern over the minimum street widths, pointing out an error in quoting the Portland Fire Department. (c) After lengthy discussion By Council, Councilwoman Stimler moved to amend';the Resolution in 'Item F, Recommendation 3, by deleting the words, "changed from", inserting a period after "34 feet.", and deleting the remainder of the sentence. OTHER (a) City Administrator reported that further information had been received from H,U.D. regarding the required audit to the effect that there were monies available from the original grant which could be used to perform the audit. He went on to say that the reaction was positive, and they would be considering this for approval on Tuesday. (d) City Recorder reported that Council had been invited to attend a Pot- luck next Monday for the students from Shipley, England (prior to the Council meeting at Fouler Junior High School). (e) Councilwoman Stimler asked about the status of the Katherine Street LID. City Administrator reported that the consulting engineers are almost ready to make a presentation to Council. (f) Councilwoman Stimler suggested that there •was a problem with the NPO's in that they lacked validity. She proposed that rather than filling the vacancy on the Planning Commission, Council should allow the NPO the Planning commi�sinn whenever a matter representatives to sit ;,n ..ening - relating to their NPO was under consideration, thereby rotating the ninth Commission seat. Councilman Brian pointed out that this would create problems in terms of disrupting the continuity of the Commission. He suggested the revitalization of the NPO's as per the plan being work- ed on by Planning staff. Councilman Cook saw the same types of problems as Councilman Brian. After much discussion by Council, Planning Direc- tor suggested that the NPO representative be invited to sit with the Commission, have full speaking rights, but no voting rights. Council agreed that this possibility should be explored. Planning Director said that he would discuss the possibilities with the NPO's and Planning Com- mission. (g) Councilman Cook asked if any information was yet available on the applicability of the Model Home Ordinance on the Summerfield Project. Legal Counsel stated that the Ordinance would :apply;, as soon as it becomes effective. RECESS OF REGULAR MEETING: 9:35 P.M. RECOVENE< UNDER EXECUTIVE SESSION 9:55 P.M. Council Tient into executive session under provision of ORS 1.92.660 (2) (a) to discuss personnel matters. Council discussed salaries for unclassified positions and some specific employees. Council went back to regular open session at 11:07 P.M. The monthly report was reviewed by the Librarian. It was suggested that the. Library set up a means of sclic_iting suggestions for book purchase from patrons so as to get more citizen involvement in the Library. Discussion developed regarding the Library public relations program. It was suggested that the Library actively seek a volunteer to help with per, article public relations. It was decided that a newspa announcing the Library's need would be tried as a recruit- ment device. Old Business; Librarian distributed.copies of the new contract for 1979- Librarian fcr� 8O county serial levy funds. Administration: a. Librarian attended all day workshop on management techn.iyues at Long- vicw Public Library, Washington, on February 2. Session was productive in that if focused on management problems related to libraries. b. Librarian has begun regular attendance at the weekly computerized circulation meetings. Of interest: Using specifications develoaed by Eugene Public Library, the committee is writing specifications for a computer circulation system .for public libraries in Washington County. One meeting as a tour and demonstration of the CLSI system which Multnomah County uses. Two other, meetings included update demonstrations by Gaylord and CLSI. c. Library Board held its regular meeting on February 12. Minutes are attached. d. Librarian atterided publicity meeting at Sherwood Library on Febraury 13. Wianda Moore, tri-county library consultant for publicity, met with several librar°inns from the smaller libraries to discuss specific problems encountered with small staff and limited budgets. e. A suggestion box soliciting book purchase suggestions was irrstit 1ted and is beginning to get good response. Jim Sidey submitted a release to the newspapers regarding the need for a public relations volunteer. f. It was announced that as a part of the April "I Love Libraries" program T-shirts and buttons with the logos will be avail- able as part of the promotion. There. was a report regarding regional library development indicating that Multnomah, Washington and Clackamas have been formed into a region for purposes of sharing LSCA grants designed to foster cooperation over regional areas rather than individual grants to particular libraries. 2.
