STUDY SESSION MINUTES, JANUARY 29, 1979. 7:30 P.M.
1. ROLL CALL: Present: Mayor Alan Mickelson; Councilmen Tom Brian,
John E. Cook, Kenneth W. Scheckla; Councilwoman Nancie
Stimler; Chief of Police, Robert B. Adams; Legal Counsel,
Joe D. Bailey; City Administrator, R.R. Barker; City

2. CHAMBER OF COMMERCE REQUEST TO AMEND FIRE PREVENTION CODE WITH RESPECT
TO FIRE HYDRANTS.
(a) City Administrator gave a history of the Chamber's request and
asked for further comments from both proponents and opponents.
(b) Bill Elliott, 9407 S.W. Ochoco Dr., Tualatin, an active member of
the Chamber of Commerce, explained the Chamber's position on this
issue pointing out that the proposed change from 250 to 500 feet
between hydrants would bring the City in line with the National
Fire Code. He went on to say that the T.R.F.P.D. could make
variations to the code for particular buildings. He concluded
his testimony by stating that the Chamber does not see this pro-
posed change as a reduction in safety standards.
(c) Chief Russ Washburn, T.R.F.P.D., spoke in opposition of the
change, stating that the National Code was viewed as the mini-
mum safety level. He also discussed the possible effects, both
short term and long range, on the fire insurance rates in the
City.
(d) Bob Santee, Tigard Water District, spoke in opposition of the
change pointing out that 391 of the insurance rating is based-
upon the 'wa.ter/hydrant system. He also mentioned that Tigard
had suffered higher insurance rate in the past due to too few
hydrants.
(e) Cheryl Beshears, Manager, stated that they are not asking or
a degradation "of the standard, they merely want a justification
eduction in the
for the higher than average standard, or a r
standard if it 'cannot be justified.
(f) After lengthy discussion by Council, Councilman Cook moved not
to amend the Fire Prevention Code. Seconded by Councilman Brian.

3. TIGARD COMMUNITY YOUTH SERVICE REQUEST TO CALL FOR ELECTION.
(a) City Administrator gave a ,brief overview of TCYS`s record of
service to the community and stated that TCYS was requesting Council's
permission to place a one.year levy on the Washington County Special
Election ballot of April 3, 1979.
Bill Elliott, Chairman of TCYS, 9407 S.W. Ochoco Dr., Tualatin,
reported the figures for the levy were not ready but requested
Council's favorable consideration to allow the citizens of Tigard
an opportunity to vote on the levy.
(b) After lengthy discussion by Council, Councilman Brian moved to
allow TCYS to present to the Tigard voters a levy, and directed
staff to prepare an ordinance to that effect. Seconded by
Councilwoman Stimler.
Approved by 4 to l vote of Council. Councilman Scheckla voting
Nay.
4. LOAVES AND FISHES REQUEST TO CALL FOR ELECTION ($6000 LEVY)
(a) City Administrator gave a brief overview of the request, pointing
out the record of the organization.
Vern Christianson, 11540 S.W. Greenburg Road, Tigard, reviewed the
proposed budget and requested the City call for an election on
April 3, 1979, for a one year levy of $6000.
(b) After lengthy discussion by Council, Councilwoman Stimler moved
to allow Loaves and Fishes to present a one year levy to the
voters, and directed staff to prepare the necessary ordinance.
Seconded by Councilman Cook.
Approved by unanimous vote of Council.
5. AMENDEDRESOLUTION NO. 79-09 RESOLUTION ESTABLISHING FEES TO BE CHARGED
TO PERSONS APPEALING DECISIONS OF THE PLAN-
ivliJG CO1 AISSION FOR THE PURPOSE OF DEFRAYING
COSTS ASSOCIATED WITH THE HEARING OF SUCH
APPEALS BY CITY COUNCIL-
(a) Planning Director explained the resolution;pointing out the +
changes that have been made as per Council's request.
(b) After discussion by Council, staff was directed to make further
chances in the 'resolution` and present it to Council at their
next meeting. ; Councilman Brian also,requested that staff develop
criteria for Council for granting waivers.
6. 121ST STREET SEWER PETITION REQUESTING FORMATION OF LID
.(3) City A' inistrator recommended that this be treated the Same as
the Katherine Street request; i.e. - soliciting the services of
an engineer for preliminary cost estimates. He went on to re-
commend that the same engineering firm (Harris u McMonagle) be
used. Council Concurred.'

7. REQUEST FOR REIMBURSEMENT FOR CAR DAMAGE. j
(a) City Administrator explained the incident of Peter Green damag-
ing his car on the steel posts used as support for the wooden car
stops in the City Hall parking lot.
(b) Legal Counsel recommended Council leave the question of reimburse-
ment up to the insurance company.
b. AMEND EXISTING PARKING ZONE ON TIGARD STREET
(a) Chief of Police recommended that (1) the No Parking Ordinance be
amended to prohibit parking on the entire southwesterly half of
Tigard Street from the northeasterly corner at Grant and Tigard,
to the east side of the 99W overpass: and (2) that an ordinance
be prepared to identify a 2 hour parking limit on Tigard Street
from the east side of the 99W overpass, to Main Street on the
southwesterly side of the street. The Chief cited volume of
traffic, the bike path, available off--street parking and merchants
complaints to justify these changes.
(b) Motion by Councilwoman Stimler, seconded by Councilman Cook to
direct staff to prepare such ordinances.
Approved by unanimous vote of Council.
9. REDUCE SPEED LIMIT ON 99W, FROM BULL MT. ROAD TO S.W. DURHAM, TO 40 MPH
(a) Chief of Police recommended this reduction stating that the number
of accidents and the large elderly population justified it. He
went on to explain that the Oregon State Speed Control Board was
recommending the speed;stay at 45 m.p.h.>and 'asked 'Council to go
on record with the Board as ,recommending"40 m.p.h.
(b) RESOLUTION NO. 79-19 A RESOLUTION REGARDING SPEED LIAfIT ON HIGH-
WAY 99W BETWEEN BULL MOUNTAIN ROAD AND DUR-
HAM ROAD
Motion by Councilman Cook, seconded by Councilman Brian to approve.
Approved by unanimous vote of Council.
(c) Chief of Police requested that Council forward a copy of the Reso-
lution" to King City and request that King City take a similar
action.
10. APPROVE AGREE14ENT STRAAM ENGINEERING, TRAFFIC SAFETY STUDY
(a) City Administrator recommended approval.
(b) Councilman Brian requested that another "WHEREAS" be added to the
resolution which would specify that the City was required to
hire the consultant engineer. City Administrator said that this
could be done.

(c) Motion by Councilwoman Stimler, seconded by Councilman Cook to
authorize the Mayor to sign the agreement.
Approved by unanimous vote of Council.
11. REDUCE PERFORMANCE BOND - MORNING HILL SUBDIVISION
(a) City Administrator recommended that Council authorize the re-
duction as per the January 25, 1979 memorandum to the City Adminis-
trator from John Hagman, Supt. Engineering Department.
Mike Beardsly, Wedgewood Homes, pointed out the problem of tied
up captial with the cash bond. City Administrator felt that another
form of bond could be arranged (other than cash).
(b) Motion by Councilman Cook, seconded by Councilman Brian to authorize
reduction as per the recommendation.
Approved by unanimous vote of Council.
12. CODE OF ETHICS FOR GOVERNMENT SERVICE
(a) City Administrator mentioned that if Council desired, this could
be included in the new Personnel Manual.
(b) Councilman Brian suggested that we compare this Code with those
used in other jurisdictions.
13. REVIEW ROUGH DRAFT FLOOD PLAIN AND DRAINAGE ORDINANCE
(a) Planning Director requested that Council deal with this at a
later date as further review was needed.
24. COMMITTEE FOR CITIZEN INVOLVEMENT APPOINTMENT
(a) Planning Director explained that one Council member was needed
to serve on .the Committee for'Citizen Involvement.
(b) Motion by Councilman Cook, seconded by Councilman Brian to
appoint Mayor Mickelson to serve on the CCI.
Approved by unanimous vote of Council.
15. REPORT' - JOHN TIGARD HOME CONDITIONAL USE PERMIT.
(a) Planning Director explained that the TemporaryUse Permitgranted
by Council would expire on February 23, 1979, but the r Dist.
had requested a hearing which 'could not be scheduled until March
20, 1979. For this reason an extension would be needed on the
Temporary Use Permit and staff would prepare the necessary resolu-
tion. He vent on to say that he expects that the project will be
under control and ready for site design review by mid-April.

(a) Planning Director reported that recruitment for the interns for
the Planning Department was progressing and that interviews were
almost completed
17. REPORT - PURCHASE OF MAG/CARD TYPEWRITER
(a) Planning Director reported that one estimate had been received,
but wished to delay Council action until more estimates could
be obtained.
18. SHERWOOD DOWNS
(a) Planning Director asked for clarification from Council on their
action on the Sherwood Downs appeal. He wanted to know if the
project was now to go back for preliminary review or on to general
plan and program review,
(b) Legal Counsel stated that it nest go back for preliminary review,
but no new fee would be assessed.
19. APPOINTMENT TO CITIZEN ADVISORY COMMITTEE FOR THE CONLNNITY DEVELOPMENT
BLOCK GRANT PROGRAM.
(a) Councilwoman Stimler reported that Dick Brown and Iry Larson
had been interviewed and were both interested in serving on the
Committee.
(b) Motion by Councilwoman Stimler, seconded by Councilman Scheckla
to appoint Dick Brown to serve on the Citizens Advisory Committee,
and appoint Iry Larson to serve as an alternate.
20. `OTHER
(a) City Administrator reported that authorizationwas needed from
Council to proceed with the 'six month training program for the
Code Enforcement Officer, noting that the City's contribution
to the training program would be 50% of salary plus fringe"benfits.
Motion by Councilman Cook, seconded by Councilman Brian to 'authorize.
Approved by unanimous vote of Council.
(b) City Administrator reported that appraisals were needed for the
Tract "C" Pathfinder and other surplus lands. Council suggested'
that Iry Larson be engaged for this purpose.
(c) Legal Counsel reported that the Hunziker LID litigation was rc-
solved and the Bancroft Bonds could now be sold.

EXECUTIVE SESSION
Council then went into Executive Session to discuss litigation under provi-
sions of ORS 192.6601 (1) ,(b).
City Administrator reviewed his memo- and requested Council consider the matter.
_ There was lengthy discussion by Council and staff regarding the issues and the
handling of the suit Staff will make records available to Council members
who wish to review the file.
It was the unanimous decision of Council to review the record and consider the
matter within the next 30 days.

Dear Mayor Mickelson
After a recent discussion with Mr. Kenneth Weaver, Director of Planning, we
are submitting this letter to request that the City of Tigard initiate the vacation
of an additional portion of SW 122nd St., which has already been vacated
between SW Scholls Ferry Rd. and SW Springwood Drive, It has been the
intention of the city to complete this street vacation of this additional 500' to
the south and we have signed a non-remonstrance agreement as a specific
condition for planning commission approval of our project.
Since our project consists of condominiums, unless we are able to landscape the
portion of 122nd which would revert to this site during construction, we are
concerned that when the street vacation takes place later, the right of way may
remain essentially unimproved for an indefinite period of time. As it is now,
our landscape contractor is expected on the job by late March or early April.
We are agreeable to hire hien to complete the landscaping to the centerline of
the right of way of 122nd if vacation can be completed by that date.

Re: Car Damage
Dear Mr. Barker:
On the morning of November 28, 1978 L pulled my car, 1978 Volkswagen Rabbit, into
a city parking stall,and the front of my car got hung up on an exposed steel stake.
Not being able to move my car I went into City Hall and got P.ldie Howard to help
me get the car off the stake. He lifted the front of the car while I backed up.
The car received considerable body damage.
I reported the incident to Doris Hartig and then filled out the appropriate forms.
I then talked with the insurance company who instructed me to make an appointment
to get the car fixed, and informed me that a claims adjuster would be out in a few
days to assess the: damage. I .then made an appointment with Riviera Motors to get
the car body repaired.
Several days later the claims adjuster saw my car and said a check_ would be mailed
to mein a few days. I was satisfied the problem had been handled effectively and
efficiently. Monday, December 18, 1978, I brought ray car into Riviera Motors to get
repaired. The car.was not ready until Friday, December 29, :1978. During this long;
period I waited for the insurance check to arrive to cover the damages.
When I picked up my car I had to pay $143.75 for the repair work. ' After paying the
bill,I called the 'insurance company to remind them that I had not yet received the
check. They said a letter would be sent out shortly. The following week I 'received

as:an The William''Yrichette :insurance Company informing me' that'the City of c
Tigard was not liable because they had not been previously warned or informed of the
lack of maintenance in the parking lot, and that 'I would not be reimbursed for
damages received to my car.

Being disturbed by this letter, I went to Doris Hartig and explained to her what
had transpired and felt I had been dealt with unfairly. Doris Hartig recommended
I submit this letter to you in hopes that the City would consider what has occurred
and would reimburse me for the damage to my car. Hopefully, the City will pay me
for the damages or I will be forced to take other steps to recover my loses. Being
a City employee I do not want to create any waves or hard feelings at City Hall, but
I will exercise any means at my disposal to correct this injustice. I hope you
understand my predicament and interpret this letter not as a threat but as a possible
remedy to my problem.
Note: Although the City of Tigard leases the Parking area from another party, the
City installed the large, wooden,parking lot dividers which are held in place by
the steel stakes.

RE: Oregon State Speed Control Board, Speed Limit
Recommendation
Sir:
The above Board is proposing that the 45 m.p.h. speed zone be
retained on Pacific Highway (99W) in the area between Bull Mountain
Road and S.W. Durham.
I have recommended that they reduce the speed 5 m.p.h. to 40 m.p.h.
whereas it will be consistent with that portion of Pacific Highway
within the city limits, and that the majority ,of people entering
and leaving this portion of the highway are of advanced years,
whereas the developed property abutting this highway (King City and
Summerfield) are planned community developments catering to retired
citizens. It has been our experience in covering accident. on 99W
in this area, that the majority people involved in these accidents
have been residents of King City or Summerfield.
Unfortunately, the State is judging this area on fatal accidents
per million miles traveled, and the average speed of vehicles on
this portion.of Pacific Highway; rather than the total number of
accidents and subsequentdevelopment along the highway.
If the speed limit were reduced to 40 mph, it may have some impact
upon the frequency and severity of the accidents in this area.

Final action will be taken at the next meeting of the Board.

Dear Mr. Barker:
I met with Ken Rolfe, Region Right-of-way Supervisor, January 23
to discuss the pronress on the above project. He had reviewed
the documentation on the Walnut Place parcel and the proposed
Tigard commercial development parcel. Mr. Rolfe feels the
dedications will be in compliance when conducted using the
method you are using, provided they will be made apart of
public record by acceptance through the City Council , after
acknowledgement by the individuals of their right to compensation.

The Site Design process was briefly interrupted when Peter Greene departed
last Tuesday. A report to Council will be made Monday at the Study Session.
This process will continue with present Staff.

Our friend, Mr. Meade, suffered a minor difficulty recently and is now
in the hospital. The exact nature of the complications are not known,
but we will have a report soon,

rir. Robert Gray, R.A. Gray Construction Co., has submitted an estimate
for the restoration of the John Tigard. Home, and has donated the site
grading, excavation and foundation. Business firms and individuals
wishing to contribute materials of labor may notify the Tigard Area
Historical andPreservationdissociation Restoration Committee through;
Ruth Croft,, Treasurer. _
KIWANTS ANNEXATION.
The planning Director was the guest speaker at a recent meting of the
Terrific Tigard Kiwanis Club. The topic was "Annexation". One discus--
sion,becmv--rather heated when a tronber of the audience suggested that
Tigard had nothing to offer the residents in unincorporated areas.
PLANNING CM4ISSION AGENDA.
The agenda for the Planning Commission has been substantially reduced. At
this time there are no applications for meetings in March or beyond. A
nice change, but one that will not last.
NPO'S RESTARIED.
Following Council action last Monday evening Staff has started the process
of reorganization of all NPO;structures. Letters, petitions and maps will.
be posted early next week.
