10. AMENDMENT #3 - GREENBURG-TIGARD PEDESTRIAN/BIKEWAY CONTRACT.
(a) City Administrator reported that Amendment #3 would be the last amendment to
the contract which would delete the extruded concrete curb on Greenburg thus
decreasing the contract by $708.00.
(b) Motion by Councilman Mickelson, seconded by Councilman Cook to approve
Amendment #3 and decrease the contract amount by $708.00.
Approved by unanimous vote of Council.
(c) Mayor Bishop requested staff watch bikepath over the next few months for
accidents, noting whether a curb would be needed at a later date.
11. APPROVE FINAL PAYMENT - GREENBURG-TIGARD PEDESTRIAN/BIKEWAY CONTRACT.
(a) City Administrator recommended approval of final payment in amount of $4,601.03.

Planning Commission denied request and asked applicant to resubmit as a
Planned Development.

Proponents
Mr. Ken Cole, Architect from Vancouver Washington, presented his concerns
regarding zone change and requested Council reverse Planning Commission denial.
(d) Cross Examination
Council, staff and Mr. Cole discussed application and whether a Planned
Development is necessary for site in question.
(d) Associate Planner recommended Council uphold Planning Commission denial of
request, however, noting that if Council wished to uphold staff recommenda-
tion, the following conditions be attached.
1. That applicant provide a soil analysis test by an independent company
to identify any problems and possible solutions to be reported to the
City Engineer and Building Department for approval prior to issuance
of permits.
2. That construction and drainage plans be submitted and approved by the
City Engineer and Building Departments prior to issuance of permits.
3. That the site drainage system be subsurface (or other method as requested
by the Building Official) to the approval of the Building Department prior
to final building inspection.
4. That a significant vegetation survey be submitted to the City Community
Design Planner for conditions to required landscaping approval prior

5. That ingress/egress be provided between the subject site on the northwest
corner and the HI HAT RESTAURANT with a joint use agreement signed by
both property owners prior to final building inspection.
6. Lighting shall be provided on site to the satisfaction of the Building

t HI HAT RESTAURANT property and the subject site.
F 7. Access from 69th onto the site will be the same as the existing access
on the PLANKHOUSE parking area (or as otherwise required to the

8. No final building inspection approval will be given until a traffic
light is installed and operating at the intersection of 69th and 99W
highway to the approval of Oregon Department of Transportation.
9. All on site vehicle passageway shall be no less than 50 feet radius.
10. That applicant submit a bond agreement covering complete public work
improvement on all portions of public right-of-way to include full
street improvement (to collector street commercial standards) on 69th
extension to subject projects prior to issuance of any city permits.

Council and staff discussed further the conditions which had been recommended.
Associate Planner recommended amending conditions #5 & #6 as follows:

Scheckla voting Aye.
Motion to remand back to Planning Commission as a Planned Development with
10 amended conditions approved by unanimous vote of Council.
20. VARIANCE APPEAL - V 11-78 (Gordon D. Carpenter) NPO #2
The Planning Commission approval of a request by Gordon D. Carpenter for variance
to place sidewalk immediately adjacent to curb without planted area in A-2 "Multi-
Family" zone at 9432-9465 S.W. Tangela Court (Wash. Co. Tax Map 1S1 35DC, Tax Lots
3900 & 4001), which devision has been appealed to the City Council.
(a) Mayor Bishop noted that applicant had withdrawn appeal request and that no
public hearing would be held on this item.

24. RESOLUTION No. 78-96 A RESOLUTION OF THE TIGARD CITY COUNCIL MAKING APPOINTMENT

(a) Mayor Bishop stated the Selection Committee recommended Roy Bonn be
appointed to the unexpired term of Tom Brian, effective Jan. 1, 1979, which
term will expire on July 1, 1979.
(b) Motion by Councilwoman Stimler, seconded by Councilman Mickelson to approve.

(c) Councilman Mickelson directed staff to make available copies of the Tigard
Municipal Code as soon as possible to the new appointees. Requested also
Planning Staff and Planning Commission Chairman meet with new appointees to
answer questions and give guidance.
25. MATERNITY LEAVE POLICY.
(a) City Administrator requested Martha McLennan and Steve West present findings
and recommendations to Council.
(b) Martha McLennan & Steve West, Research & Development Aides, presented synopsis
of history and noted that question presented for an Attorney General's deter-
mination had been revised at the request of the T.P.O.A. Attorney.
(c) Councilwoman Stimler noted dissatisfaction with wordage of question and wished
to have it dealing with both contracts not just the TPOA question.
(d) Staff stated the question on the T.M.E.A. benefits for maternity leave had
already been found illegal and a question directed to the Attorney General
at this time would be inappropriate.
(e) Council requested another Representative be addressed to request the Attorney
General's opinion on the T.P.O.A. contract question.
(f) Steve West presented synopsis of solutions and the effects it would have
on the City.
(g) After lengthy discussion, Mayor Bishop requested Legal Counsel and City
Administrator give their recommendation regarding issue.
(h) Legal Counsel and City Administrator stated their recommendation would be to
treat all employees equally and noting that the Maternity Leave policy should
be the same as all other sick leave, which allows up to 90 days leave with
certification from a doctor, stating the employee is physically unable to
return to work. This would be Plan 3, Solution 1, as presented by Steve West.
(i) Motion by Councilman Cook, seconded by Councilman Mickelson to follow Plan 3
Solution 1 as recommended by City Administrator and Legal Counsel.
Approved by unanimous vote of Council.
26. OTHER
(a) Councilman Mickelson stated the next Washington County Election Officials
Caucus would be at Beaverton City Hall on December 7, 1978 at 7:30 P.M.
The M.S.D. Director will be speaking.
(b) Councilman Mickelson requested Council consider holding a special council
meeting to swear in the new Council members either January 2nd or on the 18th
of December.
After lengthy discussion, Council consensus was to swear in the new member •
of Council at the January 8th, 1979 Regular Meeting.

SUB.JECT: Monthly Report, October 1978
1. Administration:
a. City Council, on October 2, adopted the report of Capital Needs
of Libraries in Washington County,
b. On October 3 Librarian and VISTA worker visited the Divisica
for Blind and Handicapped at Oregon State Library.
c. Librarian was unable to attend meeting (staff shortagej of the
Guidelines and Administration Committeeon October 4. The Committee is
now working on recommendations for the establishing of local library
boards for those libraries outside of municipalities. On October 27
(Librarian out of town) a hearing on the proposed Guidelines for
Receiving County Serial Levy Funds (attached) was held. Comments
of attendees and Tigard Library Board memorandum are attached also.
d. Attending either session of the Intellectual Freedom Workshop
were: Board Members Betsy Chick, Nancie Stimler, Yvonne Burgess and
.Jean Carlisle, staff members Karrin Hawes, Claire Sheldon, Kathy
Tremaine and Irene Ertell.
' e. Library Board met on 10 October. Minutes attached.
f. Librarian spoke to second grade *ss at St. Anthony's school
on October 19.
g. A meeting of the Volunteers was held October 19. Of interest :
In light of possible staff shortage c(Wsed by CETA curtailment and preg-
nancy leave of Kathy Tremaine, Volunteers were asked to indicate any
extra hours they were available and whether or not they could be called
in an emergency. They were also asked to submit names of possible
new volunteers. Interlibrary Loan procedures were reviewed.
h. Librarian was unable to attend WCCLS professional board
meeting (out of town) on October 25. Of interest: CETA lay-offs
threaten to curtail WCCLS reference service at Pacific University.
The problem of patrons not picking up material requested on inter-
library loan was discussed.
i. On October 9 a 6 gallon hot water heater was installed to
provide hot water in both bathrooms.
j. A new 10-drawer card catalog has been installed in the Adult Fiction Room.
The old one will be used for shelf list,
k. Omitted from September report: Friends of the Library held an
Open House on September 30 to celebrate renovation and redecoration of the
front room made possible by City of Tigard (new floor), Friends of the
Library (new carpet) and State Aid Grant of $3000 (new furnishings) .
State Representacive Pat Whiting and Mayor Bishop were honored guests.
r 2. Personnel:
a. Staff members Claire Sheldon and Kathy Tremaine began WCCLS
reference course on October 4. They will receive 3 college credits
from Portland Community College.

4. Pro rams:
a. Beginning October 4 a group of volunteer mothers began doing the
two weekly pre-school story hours. They will continue until Kathy Tremaine
returns from maternity leave March 1, 1979.
b. The Ganrde St. Elementary School is using the library three days
a week. Occasionally a staff member provides help with their programs.
Start Right Day Care comes on alternate Tuesdays for a story time conducted
by staff.
c. St. Anthony school is now utilizing the Tigard Library for
reports and projects inasmuch as their own library is so small. This
does not involve extra staff time, but increases the utilization of our
resources.
d. Friends of the Library presented a book review by Mrs. Diane
Duncan at the October 5 meeting.
e. The Tigard Area Historical and Preservation Association held
its quarterly meeting on October 25. The display case will be used by
the TAIIPA each month in which they meet. Friends of the Library will
provide displays the other eight months.

SUBJECT: Guidelines for Receipt of Serial Levy Funds
1 . At the regular meeting on October 109 1978 the Tigard
Public Library Board reviewed the proposed guidelines for
receipt of serial levy fundi. The only question was iegardind
the first item, Non-Fee Acess.
2. The Board feels, and I agree, that it should be worded in
such a way that it does not specifically li::t the items which
may or may not be charged for. The concenous was that a
statement regarding fees should embody (1) the prohibition
against charging fees for services made possible by the levy
and (2) the right of libraries to charge other fees as deemed
necessary for the efficient running of their systems.
3. Otherwise, Tigard Library Board concurs with the guidelines.

GUIDELINES FOR RECEIPT OF SERIAL LEVY FUNDS
i. Non Fee Access d� 91-7
Each public library shall provide non fee access to any
Washington County resident. No Washington County resident
shall be charged_ fees for any public library servicer Except#m
photocopying, overdue
books, meeting room charges or computerized searches.
2. Hours of Operation
Each public library shall provide a minimum of 30 hours per
week including at least one evening and one weekend day
per week (excluding holidays)
3. Circulation Policies
It is expected that uniform circulation policies will be
adopted countywide in anticipation of a computerized cir-
culation system.
4. Book Selection Policy
Each library shall have a written book selection policy
adopted by its governing body.
5. Staff
Each library should have at least one full time paid staff
person designated with the responsibility for the administration
of the library and its programs. Each staff person in each
library should have a written job description.

in accordance with the Oregon State Library requirements.

enforced by one level of government upon another. He gave
public schools as an example for their receipt of state support.
He also mentioned that the amount in the next levy will be ample
for the cities to be able to support the minimum levels
being proposed.
Donna Selle, Coordinator, WCCLS:
-Ms seeTTe pointed out that community libraries should not be asked
to comply with guidelines that are not accepted by the city libraries.
Pam Daves, Citizens' Advisory Board, WCCLS:
Ms Oaves stated that the guidelines serve to define "library
services" for the purpose of a contract between the county and
the contracting agency. She objected to the practice of banking
the funds for a library in the future when the contract should
be for services rendered at present.
Stephen Goodrich:
He explain' e tit the City of Cornelius is planning for the future
and that if the city continues in its present policy of planning
for the future that the quality of service which residents of
the county receive from the Cornelius Library will be improved
to a greater degree than would be possible through expenditures
under the present situation.
Kates Mann, Librarian, Cedar Mill Community Library:
Kathy Mann felt that the guidelines were very minimal. She didn't
feel that a library could provide service with less than the proposal .
Debbie Brodie, Librarian, Hillsboro Public Library:
Ms Brodie stated that Hillsboro Library Board is mixed in their
reaction to the guidelines. The city administration has not been
polled for their reaction as yet.
Due to the library's closure, the hearing was closed.

Call to order The regular meeting of the Tigard Library Board was called
& Roll Call: to order by Chairman Betsy Chick at 7:30 P.M.
Excused: Jeri Cundiff and Irene Ertell.
Reports: Minutes of the previous meeting were approved as read.
VISTA Debby Smith, VISTA outreach worker, outlined program for
getting library materials to senior citizen shut-ins,
emphasizing need for volunteer group to manage the program
after her year is finished.
BUSINESS: Status of the CETA program was reviewed. Librarian had in-
CETA cut-back dicated to Chairman that Library may well be affected inas-
much as Claire Sheldon and Chrys Green face lay-off is
funds are drastically reduced. - It was noted that shortening hours
might be necessary. Nancie Stimler suggested staying open same
hours but fewer evenings. The Board concurred.
Motion Jean Carlisle moved that the Librarian be authorized to use
her discretion concerning hours and other necessary cutbacks.
Motion was seconded and passed.
Maternity Leave It was noted that City of Tigard is contemplating a change in
maternity leave policy to comply with Oregon State Law
659.029 which ways that maternity leave must be treated the same
as regular sick leave. It was also noted that this would
affect staff member, Kathy Tremaine, who plans to take
maternity leave from December 1 to March 1, 1979.
Washington County George Vaternick nominated Doris Hartig to serve on the
Friends of Library Washington County Friends of the Library (organization
established to receive funds for building libraries) . Motion
was seconded and passed unanimously.
WCC LS Admin. Proposed guidelines co) receiving county serial levy funds were
Committee reviewed. Board recommended that the section dealing with fees
be stated in way so that libraries may charge for services that
are necessary for operation but not for those made possible
by the serial levy.
Open }louse It was noted that the outdoor sigWat•St. Anthony's was
successful in calling attention to the Open House on
September 30.
Meeting Time In discussing possible new Board members there was agreement
that the meeting night could be changed to accomodate personal
schedules.
Intellectual Betsy, Jeri and Nancy planned to attend evening session of
Freedom Workshop Intellectual Freedom Workshop on October 18. Yvonne and
Jean planned tentatively for the 18th as well.
Meeting was adjourned at 8:30 P.M.

VIII. TRAINING
A. Advanced Officer's School. Officer Jim Newman received one
week's training at the Board on Police Standards & Training
Advanced Officers School, held at the Police Academy. This
school was held from October 2 to the 6th.
B. Supervision of Police Personnel. Records Supervisor Alice
Carrick attended the Police Academy for two weeks from
Oct. 23 to Nov. 3. She received 80 hours of training from
BPST on supervising police personnel.

TO MAYORS OF OREGON CITIES:
You and your community are invited to again participate in Tree City USA,
a national community improvement project sponsored by the National Arbor
Day Foundation in cooperation with the National Association of State
Foresters and the U.S. Forest Service.
This program has been designed to recognize those communities that are
effectively managing their tree resources and to encourage implementation
of a local tree management program.
The Tree City USA standards are fairly basic. Your community may already
be eligible for recognition by following these standards:
Have a legally constituted tree body (a department board,
commission, or other authority with statutory responsibility
for developing and administering a comprehensive city tree
program).
Have adopted city ordinances or statutes providing for tree
planting, maintenance, and removal according to p-.-oper muni-
cipal forestry principles.
Have an active, comprehensive community forestry program,
supported by a minimum one dollar per capita public funds.
Have a formal Arbor Day proclamation by the Mayor and have a
commemorative tree planting each year.
In 1977, two Oregon cities received the Tree City USA certificate and flag -
Salem, for the second straight year, and Portland.
If you believe your community is now eligible and are interested in seeking
recognition this year, please contact our office for complete nomination
information by December 8. If you would like additional information on
the program and advice on qualifying for next year, please contact this
office or one of the Department of Forestry offices on the enclosed list.

Meeting commenced at 9:05 A.M.

Committee discussed the future appointment to Planning Commission that would be necessary
when Tom Brian leaves Planning Commission to serve on City Council.
Committee voted unanimously to recommend to City Council the appointment of Mr. Roy
Bonn to the Planning Commission effective January 1, 1979 to fill the unexpired term
of Tom Brian (Term expires July 1, 1979). Mr. Bonn was interviewed by the Committee
on November 17, 1978.
Meeting adjourned at 9:20 A.M.

Meeting called to order at 5:15 P.M.
Present: Councilman Alan Mickelson and City Administrator Raeldon Barker
The Committee interviewed the following individuals who are interested in
serving on the Planning Commission:
1. Geraldine Kolleas
2. Roy E. Bonn
The Committee recommended that Geraldine Kolleas be appointed to the Planning
Commission to fill the unexpired term of Joanne Corliss (term expires 7/1/81) .

Public Works reports that the automatic sander works perfectly. .
Last Sunday was spent putting snow tires on vehicles and equipping
some other vehicles with chains.
COUNTY GRANTS STREETS
i
Washington County has given the City jurisdiction of the streets �
we had asked for except Durham Road, Sattler Road and a small portion
of Bonita. A complete list of the streets is available at City Hall.

BOUNDARY COMMISSION
Tigard was number 24 on a 27 item apenda at the November Public
Hearing before the Boundary Commission. The' Casey parcel on 79th
and the Husvar property on 97th and McDonald were both approved.
LEAGUE OF OREGON CITIES
The Leapue has asked the City for financial information which will
be compiled for use in the upcoming Legislative Session in the
tax cut debates.
THANKSGIVING
City Hall will be closed on Thursday and Friday, November 23 & 24.
