2. Mayor Bishop advised audience that a new speaker system was being demonstrated ;t
and expressed appreciation for the consideration of the audience during the
meeting.
Mayor Bishop also noted that agenda Item 415, Public Hearing for Scholls Summer
Lake would not be held as this item was not required to have Council consideration
at this time.

Rossman, term expiring 12-31-79, to the Park Board.

9. STORM WATER MANAGEMENT STUDY - Agreement for engineering services with CH2M Hill -
approve and authorize Mayor and City Recorder to execute.
(a) City Administrator recommended approval noting that this would provide a master
plan for storm drainage which would take approximately 180 days to complete.
(b) Motion by Councilman Mickelson, seconded by Councilman Cook to approve and s
authorize Mayor and City Recorder to execute.

10. REFUND REQUEST BY HAERTL DEVELOPMENT COMPANY - $125.00 refund on variance request.
(a) Planning Director stated the Haertl Development Company had applied for a
variance, and then realized a variance was not needed for their development.
(b) Motion by Councilman Scheckla, seconded by Councilman Cook to approve refund
in the amount of $125.00.

11. REFUND REQUEST BY LENTZ CONSTRUCTION CO. - $60.00 refund on business license.
(a) City Recorder noted that Lentz Construction Company had purchased a business
license and was not doing business in the city limits, ,therefore, recommended
refund.
(b) Motion by Councilman Cook, seconded by Councilman Mickelson to approve refund
in the amount of $60.00.

12. • BOND RELEASE - Landscaping bond for 9955 & 9957 S.W. Scott Court - $700.00.
(a) Planning Director stated the landscaping had been completed to staff's
satisfaction and recommended refund.

' 13. STATUS REPORT - Street Light Request for S.W. Lomita Avenue.
(a) City Administrator stated staff has requested Portland General Electric to
_ investigate situation. Staff's recommendation is to place 2 additional
lights on S.W. Lomita at an annual cost of approximately $156.00. Staff
will report back to Council when P.G.E. has made recommendation on placement.

(a) Nancie Stimler, 11525 S.W. Terrace Trails, objected to further delay of
the Bellwood hearing.
(b) Mayor Bishop ruled that item No. 14 would be heard at this time, so as not
to keep the developer waiting through the lengthy public hearing on
Bellwood III.
(c) Associate Planner requested Council hear item No. 13 (Bellwood III) first
as the two developments could have interlocking roadways and would have a
great impact on the Wedgewood Development. ;
(d) Consensus of Council was to proceed with the Wedgewood Hearing.

does not show responsible planning between the developments in that area;
noting that there could be a problem with the joint roadways.

An appeal by City Council of the Planning Commission approval of a request by
Raymond J. Bartel for density review of Phase III of the Bellwood Residential
Planning Development at S.W. 128th and north of Walnut (Wash. Co. Tax Map 2S1
4AA, part of Tax Lot 100), which decision has been appealed to the City Council.
(a) Full Evidential Public Hearing Opened.
(b) Planning staff presented synopsis of history and read staff reports dated
September 5, 1978 and October 23, 1978.
(c) Public Testimony

Proponents noted lack of coordination between the developments in the area
and expressed concern regarding density and traffic impact on 128th.
Opponents:
Stan Martinson - Portland Attorney
Ray Bartel - Developer of Bellwood III Subdivision
Opponents requested Council consider alternative with joint roadways being
l utilized by both Bellwood III and Wedgewood developments.
Other discussion was heard between Council, staff and public.
(d) Staff Recommendation
Associate Planner recommended the Bellwood III be considered at a full
public hearing before the Planning Commission after City staff has had
an opportunity to make revisions to the Plan regarding right-of-way's
being increased, etc. Also, Associate Planner noted there should be a
condition to lower the living units to less than 210.
(e) Public Hearing Closed.
(f) Consideration of Council.
Motion by Councilman Cook, seconded by Councilman Mickelson to table item
until the November 6, 1978 Study Session at which time a revised plan, as
outlined on the wallmap, be submitted for Council's review. Input was
requested from both developers and City staff in working out final plan.
Motion to table approved by unanimous vote of Council.

(a) Motion by Councilman Mickelson, seconded by Councilman Cook, to remove
agenda item No. 14 from the table.

STATUS REPORT - KATHERINE STREET SEWER ISSUE.
(a) City Administrator requested item remain on table as there had been no
further contact from .the citizens regarding this issue.

24. OTHER.
(a) City Administrator noted that the County wished to have someone from the
City serve on the Community Development Policy Board for the Community
Development Block Grant.
Consensus of Council was to appoint newly elected Councilwoman after the
November 7th election.
(b) City Administrator noted that citizens from the Summerfield area had
complained regarding the lack of action by Prestige Properties in
removing the model homes from that subdivision. City Administrator noted
Council on 10-9-78 had voted to close the sales office by October 15th,
and to close the model homes by October 20th. City Administrator asked
Council what their intent was as staff wants to follow their direction.
Legal Counsel noted that the ordinance was not clear on this item and
suggested Council not prosecute this operation until the ordinance was
changed to give more authority.
Council requested Legal Counsel prepare ordinance for November 6th Study
Session addressing the current problem in Summerfield and also dealing
with future problems of this type. The ordinance should state that model
homes will be for limited or reasonable time, and stipulating that models
should be limited to the area of active development.
(c) Mayor Bishop submitted letter from the Tigard Area Historical & Preservation

Association requesting $50.00 application fee for temporary use be refunded.
City Administrator reported that expense to the City had been $27.54 and
that the difference of $22.46 could be refunded if Council wished.
Motion by Councilman Scheckla, seconded by Councilman,Cook, to refund
$22.46 to the Tigard Area Historical Preservation Association.
Approved by unanimous vote of Council. _
(d) City Recorder noted League of Oregon Cities convention will be held November
12th through 14th in Portland, and encouraged Council and staff to attend.
A brief synopsis of workshops was read.
(e) Councilman Scheckla requested City Administrator report on the Skourtes/Bonita
Road development.
City Administrator gave brief synopsis of project noting areas of concern to [
staff and stated the City was proceeding to issue citations to Mr. Skourtes

Gentlemen:
The purpose of this letter is to clarify any misunderstanding
between our company and the city in regards to a desk and
telephone located at 8605 S.W. Greensward Lane, Tigard. The
subdivision has 36 lots and this particular "model house" is
the sixth residence in which we have located a table and tele-
phone.
The function of the various "model" houses has been threefold:
1. A place where workman can use the bathroom facilities.
2. The workman use the telephone to order inspections and
materials.
3. Salespeople show the property and discuss home purchases
with prospective buyers.
If these functions constitute a branch office, we request the city's
approval for that function. We request a floating location
approval because we assume each house will sell soon and we would
relocate the table and telephone at a different house in the
Greensward Park subdivision.

SUBJECT: Monthly Report, September 1978
1. administration:
a. Librarian attended meeting of the ltiashington County Cooperative
Library Services (ICCLS) committee studying computerized circulation
systems. Of interest: The libraries represented discussed standard-
dizing circulation procedures as much as possible as a service to
patrons who use more than one library. It is anticipated that bids
will go out early in 1979 and the computer will be installed in Beaver-
ton sometime in the summer. Tigard is tentatively scheduled to go
on line one or two years later, depending on funding available. (See
paragraphn le below.)
b. The Library Board held its regular meeting on October 12.
Minutes are attached.
c. The hCCLS Citizens advisory Board met October 13. Librarian
did not attend. Of interest: The Board is proceeding with incorporation
as Friends of Washington County Libraries to recti%;o capital improve-
ment funds. They have decided to ask ecah library governing body to
appoint one person to represent that library's interests. This will
be presented to the library Board at its meeting October 10.
d. The Library received a second telephone line so that the
public number will not be tied up for long periods when, staff is
conducting business calls. This number is 639-2083.
e. Librarian attended hCCLS professional bard meeting on September
27. Of interest: Material was presented indicating that Measure 6
will probably wipe out the serial levy passed in May, whereas Measure 11
will allow it to continue much the same.
f. The broken front window was replaced on September 22.
2. Personnel:
a. Loss of the 2 volunteers named last month has reduced the active
list to 11.
b. On September 8, volunteers, library staff and spouses got to-
gether for a pot luck dinner at the Ertells.
c. Volunteer hours totaled 125.5, averaging 5 per day.
d. Kiku Kawata, Portland Community College sutdent, completed
100 hours practicum.

M[NUTF'S Tigard Library Board September 12, 1978
Call to Order The regular meeting of the Tigard Library Board
$ Roll Call: was called to order by chairman Yvonne Burgess.
All members were present.
Reports; Minutes of the July 11 meeting were read and amended
to excuse the absence of George Vaternick. Amended
minutes were approved.
Old Business: Nancie Stimler moved that the Board not subscribe
Motion to The Library Trustee Newsletter . Motion was seconded
and passed.
The Librarian explained decision of the WCCLS Citizens
Advisory Board to incorporate themselves rather than
form a new committee to receive funds for capital
improvements. (September 12, 1978 monthly report for
August, paragraph lc.)
New Business: Darlene Laughlin nominated Betsy Chick to be chairman
of Library Board during 1978-79. Darlene Laughlin
Motion also moved that the nomination be accepted on a un-
animous ballot. Motion was seconded and passed.
The Stryker report on captial improvement needs for
Washington County was discussed. Betsy Chick moved
Motion that the Board formally adopt the report. The motion
was seconded and passed.
Goals $ Objectives The Librarian reported that the Goals and Objectives
for WCCLS as submitted by the WCCLS committee had
been accepted by the Citizens Advisory Board and the
Washington County Board of Commissioners.
Librarian gave an up-date on work of the 1VCCLS Committee
Administration to Study Administration of County Libraries. Final report
of County Libraries will come to Board for acceptance.
Librarian reported on VISTA program for- out-reach to
VISTA program senior citizens. Concern was expressed that the pro-
gram might extend services that would have to be
withdrawn at the end of the VISTA program. Librarian
indicated that a primary goal of the program is to
organize a volunteer group that will carry through
after the VISTA is gone.
Open House Librarian reviewed plans for the open house on Sep- .
tember 30 which is being sponsored by the Friends
of the Library as a celebration of the state aid
grant received in January. * A suggestion was made
that St. Anthony's be contacted aboutplacing a notice
on their outdoor display sign. Jeri Cundiff agreed
to take this suggestion to the Friends of the Library.
Jeri also announced that the Friends of the Library
Friends of Library will have a meeting on October S at the Library,
meeting featuring Mrs. Duncan, who will give a book review. '
Librarian reported on WCCLS Computerized Circulation
Computerized Circu- Committee, indicating that a system in Eugene is
lation being favorably considered and that it is planned
to begin the operation in Beaverton next July.
Tigard would probably go on line in one to two years.
The committee is also working on uniform circulation
procedures for all libraries using the system.
Kathy Tremaine Librarian announced that staff member, Kathy Tre-
maine, plans to go on maternity leave beginning the
first part of December. From Octoberl6 until December
1, she will work half-time.
MI\UT1iS, Tigard Library Board, September 13, 1975 -
Intellectual Librarian announced that there will be an Intellectual
Freedom Workshop Freedom Workshop for all library staff and board members
in October at the Hillsboro Library. It was urged
that as many as possible attend. it was also agreed
that following the workshop, the Board will review
Tigard Public Library's selection policy.
D. Laughlin Darlene Laughlin tendered her resignation because
she will be moving to Beaverton. The resignation was
accepted with regret. Appreciation was expressed for
Darlene's service on the Board and as a volunteer.
Board vacancy Two names were suggested as possible candidate;
Sandy- Clifton and Vi Cotter. Librarian was asked
to see if there are other applications on file at City
Hall.

VIII. TRAINING
A. Departmental Training. On 9-12-78 the department was given
training on the use of the radar gun. Total man hours spent was
17.
B. Sex Crimes Investigation. Det. Sgt. Branstetter and Officer
deBrauwere attended a two day seminar on sex crimes investigation.
This meeting was held in Newport, and total man hours spent was
32.
1 C. Crime Prevention Meeting. On Sept. 26 and 27, a total of 32
man hours were spent by Lt. Rea and Officer Martin in Cottage
Grove, attending a 2 day seminar on crime prevention.
. D. Police Civil Liability. Officers Killion and Myers attended a
two day conference on police civil liability in Cottage Grove.
A total of 32 man hours were spent.
E. Juvenile Law. On Sept. 28, 29 Officers Martin and Grisham
attended a two day conference sponsored by the Oregon Juvenile
Law Enforcement Association in Bend; topic of discussion was
current juvenile law and legislation. A total of 32 man hours were
spent.

AGREE:IENT TO FURNISH ENGINEERING SERVICES
TO THE
CITY OF TIGARD
FOR A
STOR24 WATER M.ANAGEiv[ENT STUDY
For the consideration hereinafter set forth, the firm of CH2M HILL, INC., a
professional engineering corporation, hereinafter referred to as the ENGINEER,
agrees to provide engineering services to CITY OF TIGARD, OREGON, hereinafter
referred to as the OWNER, for a storarvater management study within Tigard's
urban growth boundaries (map thereof attached hereto).
ARTICLE 1.
The ENGINEER agrees to furnish all necessary services, materials, labor and
equipment, to complete in a professional and workmanlike manner all work
shown and described in Exhibit "A" and Attachments one (1) and two (2), in
compliance with the contract, to the OWNER.
All items of work shown on Exhibit "A" will be addressed to fit the study budget
as estimated by Attachment 2. Att..chment 1 shows the proposed time schedule
for completing the work. If tiie Corps Flood Insurance Study (FIS) work is not
completed in a timely manner, =he Tigard study may be detained while waiting
the FIS. The ENGINEER shall 'keep the OWNER informed of the current status of the
Corps expected and actual FIS terminal date, as such affects this contract.*
Under nc circumstance shall the Tigard study be detained unduly thereafter.

The ENGINEER shall save, keep and hold harmless the OWNER and all officers and
employees thereof from any damages, costs or expenses in law or equity that
may at any time arise or be set up because of damages to property or of
personal injury received by reason of or in the course of performing said
work, which may be occasioned by any negligent act or omission to act which
amounts to negligence upon the part of the ENGINEER or any of said ENGINEER'S
employees, or any sub performing any of the work contemplated by the contract.
Further the ENGINEER shall be liable and responsible for any accidental loss
or damage happening to the works referred to in the contract prior to such time
as such is completed and accepted by the OWNER.
ARTICLE 2.
As consideration for providing the engineering services enumerated in ARTICLE 1,
the OWNER shall pay the ENGINEER the lump sum of thirty—thousand ($30,000) dollars.
For ADDITIONAL SERVICES authorized by the OWNER, not specifically provided for ��.. .
hereunder, the OWNER shall pay the ENGINEER the amount of the ENGIN'EER'S salary costs
as defined in ARTICLE 4, expended for the services, multiplied by a factor of
2.3, plus direct expenses in connection therewith.
ARTICLE 3.
Payment to the ENGINEER as prescribed in ARTICLE 2 is to be made as follows:

A. For engineering services enumerated in ARTICLE 1, within thirty (30) days
after date of billing, the ENGINEER'S estimate of the value of work
accomplished during the month, less ten (10x) percent retainage.
E. Within sixty (60) days of such time as all services to be performed hereunder
are complete and delivered and are accepted in writing by the OUNER, the
final payment (retainage withheld) for such services shall be made, provided
that no liens or claims have been filed with the OWER against the ENGINEER'S
work hereunder.
C. For ADDITIONAL SERVICES, within thirty (30) days after date of billing, the
amount due, as prescribed in ARTICLE 2, for such services rendered during the
month, less ten (10a) percent retainage.
D. ENGINEER'S billing shall be in the form of an invoice certified by and
submitted by the ENGINEER, on or before the first (1st) of each or any
month, and audited and processed in the usual manner of payment of the
OWNER"S obligation.
ARTICLE 4.
Ic is further mutually agreed by the parties bereto :
A. That, the ENGINEER will not begin work on any of the services listed in
ARTICLE 1 until the OWNER directs him in writing to proceed, the City
Administrator to have authority to give such approval.
B. That, if ADDITIONAL SERVICES not specifically provided for in this
Agreement are to be performed, written approval of the 014N`ER must be
given the ENGINEER, City Administrator to have authority to give such
approval.
All deletions or modifications or change orders to this contract shall be ,
made in writing and must be approved by both the ENGINEER and the 0WNER
before being of any binding force or affect, the City Administrator to have
authority to give such approval.
C. That, the ENGINEER will make every reasonable effort to complete all
engineering services which are specifically to be furnished under this
agreement within one-hundred-eighty (180) calendar days after written
notice to proceed, subject to delays beyond the ENGINEER'S control;
such as iterated in the second (2nd) paragraph of ARTICLE 1.
Further, if conditions or delays encountered during the work make it
impossible or impracticable to proceed further, the OWNER, upon ten (10) days
notice to the ENGINEER, may order termination of the contract.
D. That, the ENGINEER'S Salary Costs, as iterated in paragraph two (2) of
ARTICLE 2, are defined as the amount of the wages or salaries of the
ENGINEER'S employees working on the PROJECT, plus, 32 percent of such
wages or salaries to cover all taxes, payments, and premiums measured by or
applicable to such wages or salaries, such as, but not limited to,
Worker's Compensation Insurance, Social Security, State and Federal unemployment
insurance, medical-hospital insurance, salary continuation insurance, pension
plan costs, and pro rata allowances for vacation, sick leave, and holiday pay.
E. In case suit or action is instituted to enforce the provisions of this contract,
the parties agree that the losing party shall pay such sum as the Court may
adjudge reasonable as attorney's fees to be allowelthe prevailing party, together
with such sum as an appeallate court shall adjudge reasonable as attorney's
fees in the event of appeal.

F. That, if any engineering services covered by theAgreement to be carried
out by the ENGINEER, shall be suspended, abated, or abandoned, the OWNER
shall pay the ENGINEER only for the actual services rendered for such suspended,
abated, or abandoned work, the payment to be based insofar as possible on the
fees as established in this Agreement.
G. That, insofar as the work under this Agreement may require, the OWNER shall
furnish the ENGINEER all existing maps, field survey data, grades and lines
of streets, pavements, and boundaries, rights-of-way, and other surveys, utility maps,
records, reports, and all other pertinent data presently within OWNER'S control.
All information supplied, all maps and other documents prepared or developed
pursuant to this contract shall upon completion be the property of the OWNER
and all reproduction or uses in whole or part is prohibited except with the
prior written consent of the OWNER.
H. That, estimates of cost for the alternative plans/selected plan, etc. are to
be prepared by the ENGINEER through exercise of his experience and judgment in
applying presently available cost data, but it is recognized that the EN'GINE'ER
has no control over cost of labor and materials, or over competitive bidding
procedures and market conditions, so that he cannot warrant that project
construction costs will not vary from his cost estimates.
I. That, this Agreement is to be binding on the heirs, successors, and assigns
of the parties hereto and is not to be assigned by either party without
first obtaining the written consent of the other.
ARTICLE 5 .
IN WITNESS WHEREOF, the parties hereto each herewith subscribe the sale in triplicate.

I. Findings of Fact:
1. On Monday August 21 to Monday August 28, 1978 the City Traffic
Engineebetweenrl22nduandd123rd, between 124thcounts (average

129th and 132nd.
2. The results were as follows:
122nd and 123rd = 3,320 ADT
124th and 128th = 2,613 ADT
129th and 132nd = 1,556 ADT
Walnut is presently jurisdiction of Washington County with a
capacity for 3,500 ADT. Therefore, no overcapacity impact
was evident.
3. A traffic counter was also placed on 128th (on Aug. 21, 1978)
to measure the existing ADT of the local collector street that
will be the public street used for access/egress into the proposed
Phase III Bellwood Park Subdivision. The counter malfunctioned
and therefore, no accurate account of ADT for this street was
Available at the September 5, 1978 Planning Commission meeting.
4 . The staff was in the position to estimate the increase ADT that
would come from the proposed 78 additional units in Phase III.
Using the standard 10 traffic trips per unit per day the total
increase would be approximately 780 ADT. The staff also, had to
estimate if this additional number would overcapacitate the
existing local street (128th) . Using the rationale that a local
street usually services just the traffic generated by the adjacent
neighborhood, that the existing traffic was not overcapacitating
128th and therefore, additional ADT would not.
5. On Tuesday, September 19 , 1978 to Tuesday, September 26 , 1978 the
City Traffic Engineer conducted an average daily trip count on
128th and 127th. The results indicated that 128th from Walnut
Street to the corner intersection of 127th received 1,320 ADT.
6. The maximum ADT per local street standard with 50 foot right-of-
way having 34 feet paved (2 lane) is 1,000 ADT. Therefore, the
existing traffic is over the capacity of 128th.
II. Conclusionary Findings:
1. In evaluating the updated information on traffic count as it
would apply to the impact the additional requested 78 units would
cause; it is realized that any further development would increase
an existing overcapacity situation.

2. It is also realized that the minutes of 1968 for Bellwood Park
stipulated the tentative understanding that a total of 210 units
may be developed with a condition that density be reviewed at such
a time that the owner would develop Phase III.
III. Staff Recommendation:
1. Staff recommends approval on only 58 units to bring the total
unit number up to the original 210, and that the cutback of the
number of units from 78 to 58 be from the proposed attached
units to alleviate the grade and slope elevation impact in
area where the attached units are proposed. the

that the current staff report represents the agreed position
of the applicant with regard to staff conditions and
recommendations. The developer will develop those common
wall units in such a manner as to promote individual owner-

Ray Bartel, Architect for project, stated that all multi-
family units :ere now condominium. The duplexes had been
deleted. Actual vegetation on site will be respected and
the greenway preserved_

Bonnie Owens, NPO T7 Chairman, stated that NPO #7 was
opposed to the increased density.
Selby stated that Walnut is designed to handle 3,500
cars per day. Sidewalks are a school district concern
in that the school district sets the standards and when
a street is judged unsafe for pedestrian travel, the
schools bus the children.
Bartel stated access width would be 30 feet for common
wall units. The adjacent development to the north is
required to have the same access width so the proposed
access roads will line up. Stated that there was a
possibility of through automobile access but it had not
been discussed as to whether or not that information would
be recorded on the final plat.
D. Staff Recommendation:
1. That the developer receive approval from the City
Engineering Department prior to. construction, and
especially in regard to the effect that the construction
may affect existing grade.

E. Commission Discussion:
Joe Bailey, City Attorney, questions the legality of
staff condition 06. In that the City does not have the
tool within the ordinances to request or enforce such a
recommendation. Recommend removing the second sentence
of staff condition #6 .
Smith asked what is the overall density allowed for that
zone.
Selby stated 12 units per acre.
Smith wanted to see a cost/benefit description with regard
to the developer adding 16 additional units and creating
the greenway area. He did not think that it was a fair
trade off.
Speaker stated that the greenway trade off nay not be
acceptable to the residents for the increased density.
Thought the staff had worked with developer to solve
drainageway problems.

Tepedino asked about the agreement and bond referred in
staff condition r2.
Staff recommended that condition €2 is routine as requested
by the City Engineer.
Speaker moves to adopt the staff recommendation with the
conditions as stated with the deletion in #6 of the second
sentence (that the common wall units be condominium in
design and indiv--.clually platted.
Brian seconded the motion.
Motion fails 4-3. Rossman abstains.
Joe Bailey, City Attorney, stated that a whole range of
densities is available to the Planning Commission for the
density of Phase III, but some density should be decided
on and approved so the applicants could act accordingly.
Smith recommended eight (8) additional units above the 210
either single family or multifamily, with the conditions
as recommended by staff with the recording of #6 as
previously agreed on.
Brian agreed with Smith.
Funk recommends the 228 units be accepted as submitted at
that time.
Speaker agreed with Funk. Thought that the Commission was
responsible for providing good city planning and seeing
that a range of housing was available in the city.
Quimby agreed with Smith and Brian.
Corliss thought that the commission should either go with
the original 210 units or 228 as presented; liked the
greenway but preferred the lower density_
Tepedino thought it was best to go with the staff
recommendation as presented.
Smith moves that the applicant return with a compromise
density. i
Brian seconded the motion.
Smith withdrew his motion.

Selby stated that the applicant meet code requirements
and that any additional units would have an impact on
traffic but it was not the responsibility of one
particular development.
Corliss moved to approve the request as submitted with
the conditions as stated by staff with the exception
that staff condition #6 be reworded as agreed and that
staff condition 1#5 be submitted to site design review.
Speaker seconded the motion.
Quimby recommends that staff condition #5 be submitted
to the site design review board (motion modified) .
First vote four in favor, 2 abstain, 2 against.
Second vote five in favor, Rossman abtains, Brian and
Smith opposed.
Motion passes unanimously.

Ken Cole, Architect for project, presented proposal. The
first phase would be 80 units, two stories with basement.
The second phase would be an intermediate care facility of
90 beds or 45 units. The buildings would lie on either
side of the stream. The stream area would be made into ponds
with landscaping and pathways. He stated that few of the
of the occupants would drive and that the majority were not
active members of the community.
C. Public Testimony:
Ms. Arlanskas objected to the increased traffic, density, and
the two story building and asked about greenway. Felt that
Tigard has supplied enough facilities for the aged through
Summerfield and King City. Submitted letters of objection
that sited the disrupption of the creek, and increased traffic

1 . Bellwood Part: Planned Development subdivision was approved
in September 3968. The first two phases have already been
constructed. Proposal was continued at tonights hearing
so that staff may have adequate time to address the concerns
involved with this project . Documentation that exists on
approved density is as follows:
a. In the minutes of the meeting, a representative for the
applicants, atates that there was a total of 210 units.
The approved preliminary plan specified 155 single
family lots and two apartment areas with no density
specified.
b. Existing density:
Phase I and Phase II consist of 107 single family units,
6 duplexes (12 units) and 33 apartment units for a total
of 152 units.
c . Projected density:
Phase III proposes 78 additional units. If this number
is approved, the total number of units for the Planned
Development would be 230 units.
2. The proposed development will be located on grades ranging
from 200 - 14% at the steepest and 80 - 2% at the most
level.
3. It is possible that the proposed development could impact
a natural drainageway.
Policy 3: "The City shall restrict alteration of natural
drainageways unless it can be demonstrated that the
benefits are greater than the detrimental effects. . ."

with reasonable alternatives, acknowledgment or solution
if agreed upon by applicant.

III of the Bellwood Residential Planned Development at. S.W.
128th & North of Walnut (Wash. Co. Tax 4lap 2S1 4AA, part of Tax
Lot 100) .

B. Applicant 's Presentation:
Stan Martinson, Attorney, represented J.W. Brayson Builder.
He stated the preliminary plat was approved in 1968 as a
Planned Development to be completed in 3 Phases with
conditions including the following:
1. Dedication of a park.
2. Change of location of certain multi-family units.
3. Paying for park improvements
Stan Martinson - Phase III was left open for density
review prior to its development . All conditions concerning
Phase I & II had been met. In 1977 develoners received
verbal commitment of 52 units for Phase III from staff.
Staff then requested a Greenway be part of the development
for Phase III which caused a loss of 12 single family units.
Final plat submitted in July 1978 for approval. A compromise
plat has since been submitted and is under consideration
at this meeting. Statues provide for the developer to
proceed with his plans without the City changing their mind.
Stan Martinson - stated that the owner had done all
required to do under preliminary plat approval. City is
bound to approve final plat as it substantially conforms
to the preliminary plat. Impossible to have through streets
for apartment complex due to Wedgewood.

Ray Bartel - Architect , stated Greenway was not part of
the original plat . All single family lots were pulled
away from difficult grade, no lots or buildings are
.located in any drainage way, all specimen trees are on
open space ground, there will be no fill or grading.
C. Public Testimony:
John Bloomer, 12610 S .W. Katherine, stated Bellwood I
is the most crime ridden neighborhood in the City of
Tigard. If there must be multifamily dwellings, the
density should be as low as possible.
Coleen Graham, asked what was the actual number of units
being proposed.
Ray Bartel - Phase III originally was approved for 42
single family and 18 multifamily units. Staff criticized
the location of some of the single family units.
Developer then changed lucaLion of some single family
and omitted two single family units. Number of units
presently up .Por approval was 40 single family and 40
multifamily units, an addition of 22 units.
Coleen Graham stated concern with crime. What is the
percent of apartments to single family units in Bellwood
area and how does that figure compare with the rest of
Tigard and the Portland area.
Bill Giebel - what will. be the traffic impact on Walnut
Street? Had the traffic problem been addressed?
Hal Steadman stated Walnut Street already does not meet
traffic needs. Swale too steep to be of use as even a
park. Stated Brayson had not been responsive to
resident 's needs.
John Taylor stated there was a lack of traffic signs,
dangerous to children, lack of sidewalks.
Dennis Murphy stated it was a poor development plan to
use 128th as a major access. What will be the sewer
impact on development, radius of turns should be
checked.
Shirley Brans asked the question of where will children
go to school?
Nancy Stilwell stated there were no NPO's prior to 1968,
and the neighborhoods have changed since 1968.

Gary Able stated a need for traffic studies on 128th
and 124th.
Coleen Graham stated it was unfair for residents to
bear the environmental costs of the developers proposal .
Developers proposal contains more units than were
approved and will therefore bring in more money to him_
D. Staff Recommendation:
Staff recommends tabling of request due to lack of information
or denial of application.
Rebuttal :
Larry Hockstart asked who will maintain the Greenway?
Brayson - City will maintain and have deed to Greenway .
Lois Peck asked about duality of the future homes? What
will the minimum lot size be (50,000 sq. ft. ?)
Joe Cromwell asked if there would be a through street to
Scholls Ferry?
E. Commission Discussion and Action :
Corliss stated could not approve density review at this
meeting - wanted a narrative addressing the problems
brought up at this meeting from the applicants. Requested
denial.
Rossman requested denial.
Smith stated he could see no compromise on the part of
the developers.
Tepedino requested tabling of issue for lack of an
adequate staff report addressing the issues brought up
that evening.
Tepedino made a motion to table request . He directed
City staff to put all efforts behind the project and to
reschedule Bellwood for the earliest possible hearing_
Speaker seconded the motion.
Motion passes unanimously.
Speaker acknowledged problems in dealing with subdivisons
and noted the special concerns:

Request: For a density review of a Phase III of the Bellwood
Residential Planned Development.
Location: Southwest 128th & North of Walnut (Wash. Co. Tax
Map 2S1 4AA, Part of Tax Lot 100) .
Applicant: Raymond J. Bartel
I. Findings of Fact:
1. Bellwood Park Planned Development Subdivision was
approved in September 1968 the first two phases
have already been constructed. Documentation that
exists on the approved density is as follows:
In the minutes of the meeting a representative
for the applicants states that there was a total
of 210 units. The approved preliminary plan
specified 155 single family lots and two apart-
ment areas with no density specified.
Existing density:
Phase I and Phase II consist of 107 single
family units, 6 duplexes (12 units) and 33 apartment
units for a total of 152 units.
Projected density:
Phase III proposes 40 additional units. If
this number is approved the total number of
units for the Planned Development would be
192 units.
2. The apartments will be an island of multi-family
dwellings surrounded by single family. Unless access
is provided through the Wedgewood Development all
traffic will funnel onto one local street.
3. The proposed apartments are located on grades ranging
from 20% - 14% at the steepest and 80% - 2% at the
most level.
4. It is possible that they could impact a natural
drainageway.
Policy 3: "The City shall restrict alteration of
natural drainageways unless it can be demonstrated
that the benefits are greater than the detrimental
effects. . ."

Similar use interpretation on item 5.5. Staff
requested of the Commission to determine if a retail
sales and rental store being proposed at the intersection
of Canterbury Square and Gaarde Street was a similar
use as a hardware or department which are permitted
uses in a C4 Zone.
Herb Jandt explained proposed project, that it would be
considerably smaller than typical rental operation 3,000-
4,000 square feet as opposed to 20,000 square feet -
combined retail/rental. One area devoted strictly to
ski rental and sales, plus complete hardware/department
store.
Quimby stated she was not sure if it was similar in use.
Sakata stated it should be a conditional use because
she was not sure.
Brian, Wood and Popp felt the use was similar to a
hardware or department store.
Brian moved and Wood second the motion that the
proposed use be interpreted as being a similar permitted
use in the C4 Zone.
The vote was unanimously approved.

not segregated - does not see any reasons for judging

Tepedino saw main issue related to zoning/planning
not being static. New plans/policies have been.
developed. The question 'is who assumes the burden
of the change in policies.
Brian saw considerable difference in applicant 's
proposal (1968) •with a 2-3 projected time schedule
as opposed to 10 years that the developer assumes
the risk that things will change over time.
Sakata saw need to apply new regulations.
Quimby felt City should not be held to an agreement-
or decision made 10 years ago.

6. 2 ASSEMBLY OF GOD free standing sign on S.{Y. Gaarde
Street.
Staff informed the Commission that the Assembly of
God Church on S .W. Gaarde is proposing to erect an
internally illuminated free standing sign. The
Commission directed staff to inform the applicant that
he must make application for a conditional use permit.

CH214 HILL CONTRACT.
We have received the Storm Water Contract from CH2M Hill signed. It is
anticipated that the actual study will commense soon.
GREENBURG AND TIGARD.
The "buttons" have been installed along the bikepaths on Greenburg Road and
Tigard Street. Both areas have been signed also.
ASSESSED VALUE FIGURES.
The 1978-79 assessed value for this taxing district is $325,258,171.00. The
property tax levy is $218,221.49. A rate of$.68 per $1,000.00 has been
computed for this district. This figure includes $.07 for Tigard Community
Youth Services and $.02 for Loaves and Fishes. These figures were received
from Washington County on the 10th of October.
IS IT TO EARLY FOR CHRISTMAS?
All persons wishing to attend the T14EA Christmas Party at the Rhinelander
Restaurant in Portland in December are urged to sign-up now. The limit
is 30 persons for this event.
UNITED WAY.
Pat Robertson reports that the contributions towards our quota for United
Way have surpassed our goal. Thanks to every employee for their contributions.
PUBLIC ADDRESS SYSTEM.
The City Administrator will meet Friday with representatives of the
Lanier Public Address Systems Company. An attempt is being made to
remedy the difficulties encountered with present equipment. Other
systems will be reviewed prior to a final recommendation to Council.
CETA HOLDS.
We have not received a definate word from the CETA Consortium. Mr. Jackson
was at City Hall on Tuesday but could offer no 'light' .
