1. ROLL CALL: Present: Mayor Wilbur Bishop (arrived at 8:05 PM); Councilmen John
E. Cook, Alan W. Mickelson, Kenneth W. Scheckla; Legal Counsel, Joe
D. Bailey; City Administrator, R. R. Barker; Planning Director,
Kenneth Weaver; Administrative Secretary & Recorder pro-tem, Loreen
Wilson.
2. President Mickelson advised audience that agenda items 411, #12 & 113 would not
be able to be heard at this meeting and would be set over for a future date.
Legal Counsel explained that on item 411 the verbatim transcript was not complete
and thus the City must hold a full evidential hearing. The hearing would be
re-advertised for October 23, 1978.
3. CALL TO AUDIENCE FOR THOSE DESIRING TO SPEAK ON NON-AGENDA ITEMS.
(a) Cheryl Hartung - 11517 S.W. Lomita - presented a petition from 29 residents
on Lomita Avenue requesting the City Council relinquish funds to provide
two street lights to be located on Lomita Avenue for safety and the prevention
of theft and property damage.
(b) Council thanked her for advising them of the needs, and requested staff
investigate item further.

7. APPLICATION FOR TEMPORARY SALES OFFICE - Prestige Properties Realtors - 15740 S.W.
Highland Court.
(a) City Administrator advised Council that City had been advised of the operation
of a sales office in the Summerfield residential area, and that the residents
were present to discuss the problem further.
(b) Attorney Fred Anderson, 8861 S.W. Center, advised Council that this type of
operation seemed to be in direct violation of the law as set forth in Section
17.12.070 of the Tigard Municipal Code. Others testifying were as follows:

Each resident spoke to the problems created by the business, especially
noting traffic and parking hazards. A petition was presented with approximately
83 signatures requesting removal of the business from the residential location.
Mr. Bob Bailey, Broker for Prestige Properties, stated the office had tried
to eleviate all the parking problems and also noted that some individuals had
called him requesting their names be removed from the petition.
Mayor Bishop arrived at 8:05 P.M.
(c) City Administrator recommended gate house be used for the only permanent
sales office and that the City deny the application for temporary sales office.
(d) Councilman Scheckla moved to deny the request for a temporary sales office
application and request the business move from the office by October 15th
and close the model homes by the 20th of October. Councilman Cook seconded.

8. STREET VACATION - Proposed vacation of a portion of S.W. Katherine Street, a 50
foot wide public right-of-way, in the City of Tigard, Washington Count

(b) City Administrator gave brief synopsis of background and noted that the street
portion being vacated was from Katherine Street to S.W. 121st Avenue across from
S.W. Katherine.

23. KATHERINE STREET SEWER ISSUE
(a) City Administrator reported that the City had received no further information
from the residents regarding this item.
24. STATUS REPORT ON C.E.T.A.
(a) City Administrator reported there had been a meeting with C.E.T.A. and the
other cities in Washington County. It was noted that Tigard has 6 C.E.T.A.
Title II positions, and 7 C.E.T.A. Title VI positions funded at the current
time. This would make up approximately 20% of the City's employees. When
further information is available regarding funding cutbacks, Council will be
advised.
25. OTHER
(a) City Administrator recommended Council approve the following resolutions.
RESOLUTION No. 78-82 RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE
PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN BARTON SUB-
DIVISION, SUBJECT TO HEREIN SPECIFIED CONDITIONS.
(1) Motion by Councilman Cook, seconded by Councilman Scheckla to approve.

RESOLUTION No. 78-83 RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE

SUBDIVISION.
(2) Motion by Councilman Mickelson, seconded by Councilman Cook to approve.
Approved by unanimous vote of Council.
(b) Mayor Bishop noted that he had received letters of resignation from Gene
Rossman and Eleanor Quimby from the Planning Commission.
Planning Director requested Council consider the possibility of cutting the
number of people serving on the Planning Commission from 9 to 7 in order to
make it easier to get a quorum at a meeting.
Legal Counsel requested Council ask the Planning Commission for a recommenda-
tion on this issue at the joint meeting which will be held on October 16, 1978.
Mayor Bishop stated he would ask Gene Rossman if he were willing to serve on
the Park Board.
(c) Mayor Bishop noted he had received a typed copy of Mr. Howard's discussion
with the Boundary Review Commission regarding the City's annexation policies.
Mayor Bishop requested this item be heard at the October 16th Study Session
if the minutes arrive from the Boundary Review Commission by that time.
(d) Councilman Mickelson expressed appreciation to the Mayor for the Proclamatior
declaring October 14, 1978, as Jogging Day.

but I have retained much of the information I obtained in
Seattle.
My thanks, again, for allowing me to serve on the Tigard
