That a cul-de-sac be placed in S.W. 89th Ave at the north project boundary to prevent through traffic northward into the residential area on 89th, This cul-de-sac shall have an emergency vehicle access point connecting the two portions of 89th. ORDINANCE No. 77-69 AN ORDINANCE ADOPTING NEIGHBORHOOD PLANNING ORGANIZATION PLAN NUMBER FIVE TO THEREBY ATTAIN THE PURPOSES AND OBJECTIVE OF CHAPTERS 197 AND 227 ORS INSOFAR AS APPLICABLE WITH RESPECT TO THE NEIGHBORHOOD PLANNING ORGANIZATION NUMBER FIVE PLANNING AREA THUS SUPERSEDING THAT PORTION OF THE TIGARD COMMUNITY PLAN AS ADOPTED BY ORDINANCE No, 73-6 HERETOFORE APPLICABLE TO THE SAME AREA, AND FIXING AN EFFECTIVE DATE. (a) Motion by Councilman Scheckla to deny approval of NPO#5 plan due to policy #26. Motion died from lack of a second, Motion to adopt Ord. No,, 77-69; Councilman Cook, seconded by Councilman Wakem, Planning Director referred Council to staff memo regarding NPO #5 plan revisions resulting from the August 1st study session. Proposed revisions to the NPO #5 Plan map and text were con- sidered by Council as follows: Page 2 - Regular Meeting Minutes, August 8, 1977 1 . Amend 'Llie Plan map to designate the Tax Lot 2100 on Tax Map 2S1 13A as Coum.e-rcial-Professional, This is the last lot in the city on the east side of 72nd. Motion to approve; Councilman Cook, seconded by Council- man Wakem. Approved by unaZimous vote of Council. 2. Designate the area around the Unified Sewerage Agency Treatment Plant (all land south of Durham Road and West of Fanno Creek) as a study area, subsequent to making a further detailed analysis of the proper land use designation for this area, Staff stated intent to return to Council with alternatives for developing area within 3 to 4 -weeks. Motion by Councilman Mickelson, seconded by Councilman Cook, to approve staff recommendations, Approved by unanimous vote of Council. 3. Policy #26 be reworded to read as follows: "Within the residential portions of the NPO, on Durham Road, Hall Boulevard, and Bonita Road, the City's arterial street standard shall be reduced to the follow- ing standard: The improved pavement section shall consist of a two lane roadway with a center turn lane at intersections, a landscaped median strip where turn lanes are not necessary, a bikepath on one side and a sidewalk on the other; with all these improvements to take place within a 90 foot wide right-of-way section. " Lengthy discussion by Council and staff followed. Councilman Scheckla and Mayor Bishop expressed opposition to 90 foot right-of-way and recommended standard be a 65 foot right-of-way. Motion by Councilman Mickelson, seconded by Councilman Wakem, to approve policy #26, as proposed by staff, with the exception of Bonita Road - Bonita Road street standard to be 60 foot right-of-way. Approved by 3 to 2 vote - Mayor Bishop and Council- man Scheckla voting nay, 4. The Plan map be amended for the Bonita Triangle area according to the compromise proposed by staff and re- commended by the Planning Commission. In addition, the map presented in the staff report is to be amended to show the proposed spine road intersecting Bonita Road at 79th Ave. Motion to approve; Councilman Wakem, seconded by Council- man Mickelson, Approved by Unanimous vote of Council. (a) The- I un map be u .ended tc designate a 50 foot wide buffer strip on the south and west sides of the Rolling Hills subdivision and a reference also be made on the map to specific wording in the plan text relative to the development of these: properties. (b) The Plan text be amended as follows: Present Wording "There is one instar ^,e where this plan finds it un- necessary to rezone M-3 property to M-4; the approximate 38 acre property west of the Rolling Hills Subdivision. This is due tp the sloping characteristic of the land, away from Rolling Hills, and the potential for retaining a row of the existing fir trees as a buffer. " Revised Wording "There is one instance where this plan finds it un- necessary to rezone M-3 property to M-4 - the approx- imately 38 acre property west of the Rolling Hills Subdivision. This is due to the sloping characiaristic of the land, away from Rolling Hills, and the designation on the Plan map of a 50 foot wide evergreen vegetative buffer,- to include utilization of the existing trees where feasible. In addition, the proximity to resident- ial development requires that the following uses normally permitted in a M-3 zone be prohibited as permitted uses: a. Planing Mill b. Shops; sheet metal, machine and welding c. Sash and door manufacture" Councilman Cook recommended M-4 zoning. Motion by Councilman Wakem, seconded by Councilman Mickelson, to amend revised wording proposed by staff, line 6 to read "foot wide evergreen vegetative, sight obscuring and sound attenuating buffer, to include utilization. . . . ", and item b, be designated as conditional uses. Approved by 4 to 1 vote - Councilman Cook voting nay. Ordinance No. 77-69 approved as amended by 4 to 1 vote - roll call vote as follows: Mayor Bishop and Councilmen Cook, Mickelson and Wakem voting aye and Councilman Scheckla voting nay. RESOLUTION No. 77- A RESOLUTION AMENDING RESOLUTION No,, 75-51 AND PRESCRIBING NEW FEES FOR SUBDIVISION AND ZONING APPLICATIONS REQUIRING PLANNING COMMISS- ION AND CITY COUNCIL REVIEW. (a) Councilman Wakem expressed concern regarding item being presented to Council without adequate time to consider and study proposed fee increas.:P. (b) Mayor Bishop commented proposed increases had been included in projected revenues for 1977-78 without receiving Council action, (c) Motion by Councilman Wakem, seconded by Councilman Mickelson to table item to be considered at August 15th study session, staff to provide additional information for comparison purposes. Approved by unanimous vote of Council. 15. ORDINANCE No. 77-73 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 10.28, OF THE TIGARD MUNICIPAL CODE BY ADDING TO SECTION 10.28.130 TO PROHIBIT PARKING ON A PORTION OF S.W. UPPER BOONES FERRY ROAD, BETWEEN S.W. 72nd AVENUE AND INTERSTATE No. 5, DECLARING AN EMERGENCY AND FIXING AN EFFECTIVE DATE. (a) City Administrator stated this recommended action was in response to letter from Sherwood Inn (Marko Susnjara) and if 'approved the State Highway Department will install the signs„ (b) Motion to adopt; Councilman Cook, seconded by Councilman Wakem. ORDINANCE RELATING TO BINGO - Report from Legal Counsel (a) Attorney Bailey advised Council no ordinance was required to permit bingo games when conducted by fraternal, charitable and/ or religious organizations. BOARD ACTION Re: Pacific Highway Traffic Lighting Project (a) City Administrator reported the Pacific Highway project had received unanimous vote from the C.R.A.G. Board for $731 ,000 federal funds to finance project. 19.
