and the City of Durham on the south. The revision requested would amend both

Planning Director commented Planning Commission was aware of proposed
Commercial/Professional zoning of property between I-5 and 72nd and felt it
warranted Council's consideration.
General discussion by Council and public followed.
(d) Planning Director recommended Council adopt NPO #5 plan with the following
Proposed changes:
1
(1) Policy #26, concerning the future improvement of Durham Road, to be
reworded according to staff's recommendation providing for a tree-lined
median strip on a 90 foot right-of-way.
(2) The Plan map be amended to designate the area west of Rolling Hills to
Wall Street for Industrial Park (M-4) development.
;:3) The paragraph on page 15, following Policy #24, be deleted.
(4) 'The Plan map for the Bonita Triangle area be amended as per staff
recommendation.
(S) Area South of Durham Road (vicinity of USA Treatment Plant) be
designated for institutional use.
(6) Area between I- 5 and 72nd (vicinity of Lake Grove Interchange) be
designated Commercial/Professional.
Councilman Scheckla expressed concerns regarding changes of policy #26.
(e) Public Hearing closed.
(f) Motion by Councilman Cook, seconded by Councilman Mickelson, to continue
consideration of NPO #5 Plan at future study session.
Approved by unanimous vote of Council.

15. APPEAL - ZONE CHANGE - The Plar...ing Couuai:;sion approval of a request by Donald Pollock
for General. Plan and Program Review of a 15 unit single family planned development
in a "R-10, Single Family Residential" zone between SW Pathfinder Way and SW
Walnut Street (Wash. Co. Tax Map •2S1 2BC, Tax Lot 1900) which decision has been
appealed to the City Council.
City Attorney clarified that only a summation of previous testimony received by
the Planning Commission would be heard by Council.

Lengthy discussion by Council, staff and public regarding potential
drainage problems.
(d) Planning Director stated the potential negative impacts of project had been
identified and mitigating measures developed, therefore staff found the plan,
as approved by the Planning Commission, to be appropriate for site and recommended
denial of the appeal.
(e) Public Hearing Closed.
(f) Motion by Councilman Cook, seconded by Councilman Mickelson to deny appeal.
General discussion by Council followed.
Councilman Cook commented he found the proposed plan more than adequate
for handling potential drainage problems.
Co,,;ncilman Wakem stated his support for denial of appeal was with the understanding
the developer would clean stream and improve channelization for the flow of water.
Majority of Council concurred with Councilman Wakem.
Approved by 4-1 majority vote of Council, Councilman Scheckla voting Nay.

(a) Mayor Bishop reported the following motion received unanimous approval by
the Washington County Planning Commission at their June 29th meeting:
"We are going on record as approving alternative #3 and Mayor Bishop's
suggestion to be taken into consideration. We are suggesting not only developers
establish right-of-way but the Washington County Engineering Staff be
directed to establish a corridor after study and put it on maps and
institute proper procedure to acquiring right-of-way and as part of the motion,
I also urge that the Mayors of Tigard and Beaverton and the Board of County
Commissioners immediately begin a joint study to improve Scholls Ferry Road
from Murray to State Highway 217 so through traffic can be induced to go
that way."
23. REPORT ON BUILDING DEPARTMENT STATE CERTIFICATIONS.
(a) City Administrator referred to his July 7th memo regarding certification of
Building Department employees and commended the Building Department staff
for their efforts.
24. REPORT ON PROPOSED COUNTY REAL ESTATE TRANSFER TAX APPLICABILITY WITHIN CITY LIMITS

its present form.
(b) City Administrator recommended adopting a resolution in opposition to the
transfer tax in its present form.

(b) Revenue Sharing - State
Administrator advised Council the following things need to be done in order
to receive revenue sharing funds this year:
(1) Council must enact an ordinance accepting revenue sharing funds and send a
copy of the ordinance to the Executive Department not later than July 31, 1977.
(2) The Budget Committee must hold a public hearing, after adequate public
notice, on possible uses of the funds.
(3) The City Council must hold a public hearing, after adequate public
notice, on proposed uses of the funds.
(4) Not later than July 31, 1977, the City must certify to the Executive Department
that the required hearings, before the Budget Committee and City Council,
were held.
Council concurred to meet with the Budget Committee for a hearing July 25th
on the possible uses of the funds and to call a special Council meeting for
a hearing July 26th on proposed uses of the funds.
(c) Council concurred to meet 8:00 A.M., Thursday, July 17th to canvass—the vote,
(d) City Administrator recommended approval of supplemental bills amounting to
$4,058.77.

Subject: Comments on Agenda Items
Item #6 - The Selection Committee recommends the appointment of Larry King to
the last remaining vacancy on the Park Board. Larry has lived at 12055 SW 118th
for 7 years. He is 35 years old,an instructor of geography at Portland Community
College and was recommended by Ann McKee.
Item #7 - This resolution amending Terry McKee's term of office is a housekeeping chore
to bring his term of office into conformance with the Municipal Code.
Item #9 - Taxi rates - Our survey of Beaverton and Lake Oswego reveals that
current rates in those cities are similar to existing rates in Tigard and
less than those requested by Broadway Cab Co. Mr. Bruno has been requested to
attend the meeting and explain this discrepancy. Unless Mr. Bruno's comments
reveal a compelling justification for the rate increase, my recommendation will be
for defeat of the proposed ordinance increasing _rates.
Item X611 - Watkins Place Vacation - Applicant has secured the necessary
signatures to validate the vacation petition. As the public hearing has been held
with no objections, and the vacation was recommended by staff to facilitate
orderly redevelopment of the property, it is recommended that this ordinance
receive favorable action.
Item #13 - Last meeting, Council received a letter from Mr. Duane Christie appealing
application of the S.D.C. on the expansion and remodeling of the old Ernie's
3 Boys Market. The administrative determination made by this office was to apply
the S.D.C. for each parking space required by the Code for the uses proposed. The
basis for this determination was that the site has been vacant for several years
and hence was not generating traffic at the time of adoption of the S.D.C.. Because
the ordinance does not specifically address this type of situation, it is appropriate
that Council hear and make a determination on this matter. That decision will serve
as guidance to staff on any similar situations which may arise.
Item #24 - County Real Estate Transfer Tax - The County Commissioners have proposed
several taxing measures to overcome a projected deficit. The Tigard City Council
has supported the adoption of a County Systems Development Charge and a County-side gasoline
tax.
The County is also proposing a real estate transfer tax which should not receive
support from the City of Tigard for several reasons as follows:
1. Unlike the S.D.C. which is to be collected only in unincorporated areas, the
transfer tax would be collected on any title change in the County; thereby
perhaps precluding a Tigard transfer tax or requiring a double tax if Tigard
were to approve a transfer tax.

2. Unlike the gas tax, there is no sharing of revenues with cities.
3. Tigard Council has entertained the possibility of enacting a real estate
transfer tax.
If the County's proposal were modified to either provide for a sharing of
revenues or to be applicable only to unincorporated areas, then I feel the
objection could be removed. Assuming that Council concurs in these
observations, I will have a resolution expressing objection to the County's
proposal for consideration Monday night.

Gentlemen:
It has come to my attention that the Tigard City Council shall
be considering the plan designation for certain properties
in the vicinity of S.W. 85th Avenue and Durham Road. The
Unified Sewerage Agency of Washington County is an owner of a
substantial amount of property in this area and is therefore
interested in any action the Council may take.
At present the property is designated residential, and it is
my understanding that your Planning Commission at a meeting
in May recommended that this designation be retained. Your
Planning staff has recommended that the designation be changed
to institutional. I concur wholeheartedly with the staff
recommendation.
A large part of the property is the site of the Unified Sewerage
Agency's Durham Wastewater Treatment Plant. In addition the
Agency has recently acquired properties west of S.W. 85th
Avenue and adjacent to the plant site. Our intent in acquiring
these properties is to provide an area for plant expansion and
to develop the properties in a fashion consistent with main-
taining the aesthetically pleasing environs of the area.
I am sure you are aware of some controversy that has surrounded
the operation of the Durham plant. Although there has been
some criticism of the Agency's operation in the area, it is the
Agency's desire to be a good neighbor. The plant itself is of
course a tremendous benefit to all the people residing within
the Unified Sewerage Agency boundaries. At the same time the
Agency is attempting to make the plant an attractive asset to
the local community itself.
The taxpayers of the Unified Sewerage Agency have invested a
large sum of money in this particular area. I would hope that
further development in the area will support this investment as
well as contributing to your community.

The development of property owned by the Agency and lying
between the plant and the high school is of course a concern
of all our neighbors. Our intent in this area is definitely
not in the nature of residential development, but rather the
development of other uses, such as the staff recommended,
institutional type uses, that would not only be compatible
to the plant, but also the high school and all properties in
the area.
The Agency certainly has no desire to allienate the people in
the area. Our desire is to establish a use on the property
that is not only beneficial to the Agency and all the people
of the district, but a benefit to the local community. Good
land use planning will help ensure that the common goal, of
functional use and community desires, shared by the Agency and
its neighbors are fulfilled.
Again, I would state that I fully support your staff's recommen-
dation for institutional designation on the property and

NEW HOUSES & BUILDINGS TO BE CHARGED FOR EXTRA CAPACITY ROAD WORK By PROPOSAL
Public input on the proposed county ordinance to establish a systems
development charge on new construction, to be earmarked for extra capacity
street facilities and traffic controls made necessary by growth, continues to
be solicited by the Washington County Commissioners. They can be contacted by
mail or telephone in addition to regular weekly public meetings.
On June 28 Commissioners approved changes in the proposal as suggested
by longtime Aloha developer Glen Gordon, President of the Washington County Land
Use Council. The charge for each new single family residence was left unchanged
at $250. Fee for mobile home park spaces was modified from $150 to $175 per space.
Builders of new apartments and multi-family housing would be charged $175 per
unit rather than the initial proposal of 5250 per housing unit.
The charge for new commercial, industrial and institutional buildings was
shifted from a parking space formula to a fee of $250 for each $60,000 of value.
There is a provision to waive large project payments until occupancy. Replacement
of a building which is removed or destroyed by fire would be exempt up to the charge
rate of the old structure. Wording on purpose and intent has been strengthened.
If adopted, the system development ordinance will apply only to areas
outside city boundaries. However, the concept has been discussed at meetings of
city officials and-Tigard recently adopted an ordinance of this type.
The idea, as explained by Commission Miller Duria, is one of a user concept.
Road and sidewalk construction inside a subdivision in the county has been and will
continue to be funded by the developer and ultimately the home buyer. This
ordinance will require the builder to pick up a portion of the costs of adjacent
street widening, turn lanes, and traffic lights to accommodate the increased
traffic. Money collected for new units in a particular area would be spent as
nearly as possible in that area. This is one part of a road financing plan, along
with the proposed 10 gasoline tax for general maintenance, and will not have any
bearing on the general fund budget.
We are not opposed to growth for it has been many benefits, states
Commissioner Ray Miller, but the new developments must be willing to assume
responsibility for cost of expanded facilities. There are no funds at present for
this work and it would not be fair to charge it to all property taxpayers, he concluded.

Dear Mayor Bishop:
On June 6, the Tri-Met Board adopted goals and policies committing
the agency to developing a greatly expanded transit system capable of
meeting anticipated demand in 1990 and flexible enough to meet any unanticipated
major increase in ridership in the future.
The attached memorandum outlines the details of this decision and
also identifies several "next steps". The goals and policies adopted by
the Board are attached.
Our preliminary technical work indicates that a regional light rail
system may well be the most efficient and, in the long run, the most economical
system to carry out high capacity goals. Virtually all elected officials in
the region, most planning commissions and staffs, citizen groups, and ultimately
all of us - the taxpayers - will be involved.
Three specific "next steps" will be of interest to you:
* The Banfield project must move ahead with greatest possible
speed. A light rail line from Gateway to Lents should be
added as an alternative (not as a replacement) to the Gateway-
to-Gresham segment along East Burnside Street.
* The CRAG Board of Directors will be asked to assist the Tri-Met
Board in determining which of the two other major corridors -
Oregon City or Sunset - should come next. Cooperative technical
work needed to support CRAG Board and Tri-Met decisions has been
funded with a federal planning grant. The technical work and the
CRAG Board decisions should be completed within ten months so
the next corridor project can begin immediately upon completion
of the Banf.ield decisions.

* Tri-Met will appoint a Special Task Force on Transit Financing
to help it determine which additional sources of local financ-
ing support are appropriate and possible.
Board action provides a region-wide policy context for public transit
in the future with light rail as the preferred mode for high density corridors
on a system-wide basis. However, each corridor decision will still be made on
a project-by-project basis including alternatives analysis under the National
Environmental Policy Act and the full Environmental Impact Statement process.

At their June 29th meeting the Washington County Planning Commission
adopted the 135th Street extension as proposed by their staff
(Alternate #{3) . I attended that meeting and gave the commission
a short history of what has occured in Tigard over the past year
regarding this issue and informed them that the Council has
yet to reach a final decision. A schematic map of the selected
alignment is attached. The County Engineering staff presented
at the meeting an "engineered" route which follows the general
topography and minimizes the amount of cut and fill required.

I am pleased to report that Tigard has a well qualified Building Department and
commend the employees achievements to the Council.
