(4) Planning Director recommended Council denial of appeal but
stated there was a real need for that type of facility in the
community. He further pointed out there was concern for public
safety and requested Chief Adams report to Council on his findings.
Chief Adams summarized his memo to the Planning Director recommending
four specific conditions be identified in permit if Council were to
approve the conditional use permit.

Moore.
Councilman Mickelson sustained from voting as he was not present to
hear the testimony.
Motion passed by unanimous vote of Council voting.
(c) ZONING ORDINANCE AMENDMENT
A proposed amendment of the Tigard Municipal Code, amending Chapter 18,
Zoning, Section 18.20 Single Family Residential zones, to include a new
zone classification for 3 dwelling units per acre (R-10).

Mr. Wright questioned why NPO #3 plan was requesting R-7 zoning be
changed to R-10 zoning in their planned area.
City Administrator pointed out NPO #3, the Planning Commission and
City Council had been through the hearing process at which time the
public was invited to attend and testify. Administrator concluded
the NPO #3 plan sets out the rationalization and justification for
the type of zoning classification and was available for Mr. Wright's
review.
(4) Planning Director recommended Council approval.
(5) Discussion followsed by Council and staff.
(6) Motion directing staff to prepare an ordinance amending City zoning
code accordingly; Councilman Cook, seconded by Councilman Moore.
Passed by unanimous vote of Council.

Zoning, Section 18.12.100 - Yard Requirement Setbacks - amending additional

to control the thistle and ragweed problem.
(c) Council Concurred to. cancel Monday, May 17th for a study session.
(d) Council requested RePac check the Pine trees at the end of Main
Street by Fanno Creek to determine if they can be straightened.

In lieu of approving a new agreement the Tigard Water District
will file a surety bond in the amount of $5,000 to meet the require-
ments of Ordinance No. 76-11. Our insurance representative, Mr.
Vern Kraits, Oliphant and Bates Insurance Company, will be contacting
your office for appropriate forms, etc.
I am proud to report that the Tigard Water District is on the
threshold of completing all pipe line replacements within the city
limits. Thereafter, only pipe lines for new developments and instal-
lation of meters on existing mains will be necessary. Following is
a final list of those pipe lines located within the city scheduled
for replacements

Enclosed herewith is an original and copy of a proposed agreement relating to
Water District work in public wpps. This agreement has been drafted and approved
by the City Council at your request to set up an Sgreement between the City and
the District in lieu of the existing ordinance requirement for the posting of a
$5,000 security bond in conjunction with your Street Opening Permit.
I think you'll find that the peo*osed agreement serves the purpose of defining
and facilitating our dealings with one another insofar as our common public
trust responsibilities are concerncd.
It would be appreciated if you could bring this matter to your Board in the
near future, so that we can clear the record of the pending $5,000 security
bond mutter.
Obviously, you still have the choiee of filing the security bond if this
proposal does not meet with your satisfaction.

THIS AGREEMENT made and entered into this Z,& day of

of , 1976, by the Tigard Water District.
W I T N E S S E T H:
1. The parties to this agreement are the City of Tigard,
a municipal corporation of the state of Oregon, hereafter referred to as
"the City," and Tigard Water District, hereafter referred to as "the
District." The parties enter into this agreement for the purpose of
establishing courses of conduct between them and rules to govern their
behavior in dealing with each other in order to facilitate and make as
{ efficient as possible their dealings with one another. To the extent that
{ this agreement does not explicitly refer to and describe a particular
aspect of the relationship between the parties, any such undescribed aspect
i shall be defined by and governed by the statutory and common law of the state
of Oregon, and by the Charter and Ordinances of the City of Tigard.

2. All pipes, valves, meters, pumping equipment, controls,
and other property owned by or in the possession of the District and
now located within the corporate limits of the City shall be deemed to
i be covered by the terms of this agreement and to be located in accordance
herewith, and the location and placement of the same is hereby approved.
The City reserves the right to vacate, alter or close any public right-
of-way street, bridge or public place.
3. The District shall, if requested to do so, file with

the City Engineer or other city official designated by the City maps or
sketches showing any proposed construction work to be done by the District
within the corporate limits of the City, such construction work shall be
done in a safe manner in accordance with the requirements of the applicable
state laws and city ordinances.
4. The District, with the approval of the City or its properly
constituted designees, may make all necessary excavations in any public
r-ight-of-way, street, alley, road or other public road or place for the
purpose of erecting, constructing, repairing, maintaining, removing and
relocating pumping equipment, pipes, meters, valves, and such other equip-
ment and materials as may be necessary or useful ill fulfilling the proper
functions to be performed by the District.
s S. Ir'hen any excavation shall be rnade pursuant to the provisions
of this agreement, the District shall restore that portion of the public
right-of-way, street, allay, road or public way or place upon which the
excavation was made to the same condition it was in prior to the exca-
vation, and all works shall be clone in strict compliance with t1le rules,

regulations, or.din.inces or orders which may be adopted from time to time
during the continuance of this agreement by the City or as rnrty he otherwise
provided by law. rhe City, at its option, may require that any opening
in any public right-of-way, street, alley or public highway may be filled
in and the surface replaced by the City and the cost thereof, including
inspection and supervision, shall be paid by the District, and the City may
require the prior deposit with the City Treasurer of the sum estimated by
the City to be sufficient to pay the cost to be borne by the District prior
to the excavation of said public right-of-way, street, alley, or public
highway.

I 6. That the City, by its properly constituted authorities,
shall have the right to cause the District to move any pipe, pumping
equipment, meters, valves, or other equipment or material whenever the
relocation thereof shall be for the public necessity, and the expense
of such movement shall be paid by the District.
7. Nothing in this agreement shall be construed as in any
way preventing the City from constructing, reconstructing, sewering,
a
grading, paving, planking, repairing, widening, altering or doing any work,
- surface or subsurface, that may be desirable on or in any of the public

rights-of-way, streets, alleys, roads or public ways or places, but all such
r work shall be done, if possible, in such a manner as not to obstruct, injure
fi

or prevent free use and operation of, the said water system of the District.
4 8. , Whenever it shall be necessary in constructing, reconstructing
1 sewering, grading, or in making any other improvement in any public right-
of-way, street, alley, road or other public way or place, to remove any
equipment or material, including pumping equipment; pipes, valves, and
meters belonging to the District, the District shall upon ten days' written
irtice from the City, or its properly designated authorities, remove such
equipment or materials, and if it fails, neglects or refuses so to do,
the City, by its properly constituted authorities, may remove the same at
the expense of the District.
9. This agreement shall continue to be in effect and to be
binding upon the parties until 'such time as both parties may agree to
abandon it or to replace it with another agreement. It is agreed by the
District that in the event it ceases to exist or is merged into or with
another domestic-. water supply corporation or is replaced by county-wide
water supply entity, this agreement shall be binding upon any successor
i, or any surviving entity.
