To clarify the situation, concensus of Council was to strike the motion for adoption
by the maker and seconder. Councilman Moore and Barkhurst withdrew motions made

City Administrator suggested new wording in the title as well as Council consider
reviewing the findings and evidence.

Section 5, item 4, wording, second line, to delete "with 8 foot side-walks".
Add Section 5, item 5, That each street improvement recorLtnendatiun contain<:d in
Exhibit C above be executed and emplaced by the applicant.
Add Section 5, item 6, That all street and public improvements be made to meet cit,
standards, including but not limited to curbs, sidewalks and storm drainage.

City Administrator discussed with Council the question of enforcing the ordinance
and if City should buy equipment. Concensus of Council was to use equipment avail-
able and if problems occur staff will advise Council.
13. HUNZIKER STREET L.I.D.
(a) City Administrator gave status report of recent developments as follows:
P.U.C. order, relating to relocation of railroad signals, denied the City's request
for funds and further ordered that the City shall pay for the costs for relocation.
Council and staff discussed appeal time and options open to city. City staff to
review and report back to Council.
Legal Counsel, on behalf of City, filed complaint in Washington County Circuit Court
regarding the P.G.E. franchise and relocation of utility poles. Complaint asks the:
court to interpret the franchise with respect to payment of costs related to
relocation of poles.
Driveway aprons have been installed and work is in progress on storm drainage. Bad
weather has shut down work temporarily.

(a) City Administrator reported the property owner requested the item be removed frrnn
the agenda.
15. PANEL MEMBER - LOCAL GOVERNMENT REORGANIZATION STUDY SPONSORED BY NATIONAL ACADEMY OF
PUBLIC ADMINISTRATION
(a) Council and staff discussed possible candidates. It was suggested fonrer members
two tier government study group might be interested in serving on this comnit tee.
Concensus of Council was to advise CRAG City has no recommendation at this time.

Request by Roger Belanich for zoning map amendment to zone a parcel at S.W. 121st,
Scholls Ferry Road, and 122nd, presently zoned Washington County Suburban Residential
to Tigard C-4, Neighborhood Commercial, (Washington County Tax Map 1S1 34B, Tax Lot
500). Application denied by Planning Cgmmission.
(1) City Administrator reported letter of appeal received from Belanich and
recommended Council set public hearing for 8:00 P. M., December 8, 1975.

SUBJECT: Proposed Dedication of Open Space Land Vicinity of
72nd and Bonita Road
A Mr. Kimbal Logan, representing a property owner has requested that the
City consider accepting lands described as flood plain by Tigard ordinance
for the purpose of public open space use. The area is zoned for and
presently used as light manufacturing. Mr. Logan has stated that the owner would
describe the land to be dedicated to the public so that only the flood plain would
be conveyed.
