CONSENT AGENDA Councilman Barkhurst commented his motion at September 22nd meeting, with respect to consent agendas, was intended to limit the consent agenda to the specific items mentioned in his motion and did not include items such as agenda items 5e and 5f. Motion by Councilman Barkhurst; seconded by Councilman Moore to remove items 5e and 5f from the consent agenda: Mayor Bishop accepted request of Councilman Barkhurst. Council and staff discussed proper procedure to remove items. Council concurred that the request of any single Councilman or member of the audience could remove an item from the consent agenda. It was proposed, after a trial period, a resolution be adopted setting forth guidelines for removal and items to be considered. 4. APPROVAL OF MINUTES - Regular Meeting September 22; Special Meetir_g October 6; Study Session October 6, 1975. (a) Motion to approve: Councilman Cook; seconded by Councilman Mickelson. Approved by unanimous vote of Council. 10. APPROVAL BY COUNCIL AND AUTHORIZATION OF MAYOR AND RECORDER TO EXECUTE: Granting of Easement to Unified Sewerage Agency for sewer construction purposes. (a) City Administrator reported U.S.A. has requested City authorize granting an easement through the pump station located on Bonita Road near S. W. 74th Ave. Council and staff' discussed the ownership of the pumps. City staff to check out and report back to Council. (b) Motion by Councilman Cook to grant easement and authorize execution; seconded by Councilman Moore. Approved by unanimous vote of Council. 11. PUBLIC HEARINGS: (commencing at 8:00 P. M.) A. PUBLIC HEARING - Zone change request from County RU-4 (residential) to City of Tigard R-7 (single family residential) Church of Christ, property located at S. W. 98th and Durham Road, Tax Map 2S1 11CD, Tax Lots 300 and 400. (a) Public Hearing opened. City Planner synopsized background and facts. (b) Public testimony - none - Public Hearing closed. (c) Consideration by Council Council and staff discussed amending Section 4 to include the specific conditioa!n as granted by Washington County as well as correcting typeographical error and renumber last section to @Section 5". RESOLUTION No. 75-50 - A RESOLUTION EXPRESSING APPRECIATION OF THE CITY OF TIGARD TO DON PHILLIPS FOR HIS SERVICE TO THE PUBLIC AS A MEMBER OF THE TIGARD BUDGET COMMITTEE. (a) Motion to adopt: Councilman Mickelson; seconded by Councilman Moore. Approved by unanimous vote of Council. 14. ESTABLISHMENT OF CRITERIA FOR LIABILITY INSURANCE AGENT SELECTION (a) City Administrator requested Council set the criteria for selection of agent and suggested the following guidelines be used. (1) Agent selected should have large enough firm to handle City business. (2) Agent should have prior municipal experience. (3) Agent should be readily available and near the Tigard area. Councilman Barkhurst suggested City contact present insurance company and ask the-L to provide a list of local agents and if they chose, to makc recommendation. City Administrator stated it was City's intention to interview agents and crake recommendation to Council. Council concurred with suggestion. (b) Motion by Councilman Moore to accept the suggestions and criteria as suggested by City Administrator in selection of agent; motion seconded by Councilman tii::kr_I.b r . (b) SOUTHERN PACIFIC ANNEXATION City Administrator displayed map indicating amended area to be considered by Boundary Review ComT,ission. Proposed annexation contained 97.04 acres. (c) TUALATIN - TIGARD CITY BOUNDARIES City Administrator reported staff met with representatives of City of Tualatin and Boundary Review Commission to firm up potential boundaries for cities of Tualatin, Durham and Tigard. Taking into consideration the natural drainage and existing sewer lines, the boundaries were proposed to be located in the vicinity of Boones Ferry Road .and Jean Road. City Administrator also stated there were two petitions for sewer L.I.D. 's on S. W. 72nd, (d) GRANT STREET City Administrator stated the asphalt has been laid, however, cars were parking on the walkway. City Administrator recommended a no parking zone be established on the sidewalk side and the installation of posts along the sidewalk to restrict cars and keep them off the walkway. Council concurred and requested a no parking ordinance be prepared. (e) COOPERS AND LYBR.AND City Administrator recommended City renew its contract with auditors for fiscal year 1975-76 at estimated cost of $4750 . Also firm had an over-run in time for 1974-75 audit and has submitted a statement for additional $250. City Administrator recommended City pay the amount for additional services. (1) 'Motion by Councilman Barkhurst to pay $250. and accept proposal for 1975-76 audit; seconded by Councilman Mickelson. Approved by unanimous vote of Council. (f) BOUNDARY REVIEW COMMISSION COMMUNICATION RE: EXTRA-TERRITORIAL SEWER MAIN AND SERVICE EXTENSION City Administrator reported discussion with Gary Kramer of U.S.A. and Don Carlson of Boundary Review Commission regarding U.S.A. and City's position that the City is part of U.S.A. District and would not come under the provision of extraterritorial connection guidelines. City would thereby avoid sending routine requests to Boundary Review Commission. Boundary Review Commission staff is researching this approach. (g) NPO #3 City Planner distributed copy of NPO #3 as adopted by NPO and Planning Commission.
