City Administrator stated School District was requesting the Comprehensive Plan be
amended to remove the park site designation on the old Fowler Junior High site.
Council discussed item and referred matter back to Planning Commission for
consideration.

Councilman Cook requested recommendation from Chief of Police and that item be
discussed at next Study Session.
(d) HUD for Existing Housing Program
City Administrator stated that City has no established housing program.

City Administrator reported the Fire Department has ruled they will not issue a
permit, howeverand that at his direction Chief of Police Adams signed a portion of
the permit with conditions.

Council and staff discussed parking problem on both locations, es well as inability
to review ordinance and the area under consideration.

21. POSITION STATEMENT - LEASING OF SPACE FOR CITY HALL, LIBRARY AND POLICE DEPT.
(a) Mayor Bishop discussed with Council the leasing of space for City Hall, Library and
Police Dept. Several firms have contacted Mayor and staff with respect to City
leasing space and Mayor Bishop requested Council direction and policy statement.
Concensus of Council was that City was not ready to move nor has the money available
to participate and the City should not pursue any leasing arrangements until the
issue is- approved by the voters.
22. ACCEPTANCE OF S. W. 115th STREET AND AUTHORIZE FINAL PAYMENT - KEARNEY BROS. $4,335.
(a) City Administrator recommended acceptance of S. W. 115th Street and authorization of
final payment :in"the amount of $4,335.

23. APPROVAuL OF AGREEMENT - LEGAL SERVICES FOR CITY OF TIGARD.
(a) City Administrator synopsized meeting with Attorney Joe Bailey and distributed copy
of letter of agreement. City Administrator recommended acceptance and retaining
Attorney Bailey as City Legal Counsel effective July 1, 1975.
(b) Motion by Councilman Barkhurst to retain Joe Bailey of the firm of Schwenn, Bradley,
Batchelor and Bailey under the terms as stated in the City Charter and as stated
in Mr. Bailey's letter dated June 23, 1975 and his services to be effective July 1,
1975. Motion seconded by Councilman Cook.
Approved by unanimous vote of Council.
24. MEMO - REQUEST FOR PAYMENT OF LEGAL FEES - HECK vs. BOOMER
(a) With respect to defencse of a civil rights case, City Administrator discussed with
Council Officer Boomer's request. Council considered if this would set a precedent
for future incidents and if Officer Boomer should have gotten City authorization
prior to retaining private Legal Counsel. The question of City Policy and if
appropriate to pay was discussed by staff and Council.

25. OTHER BUSINESS
(a) City Planner discussed with Council the formation of NPO No's 4 and 5. Planni: .
Commission's reconmendation for the composition of the groups and the qupsti.-:1n
equitable representation was discussed.
(b) Motion 'by Councilman Barkhurst that NPO No. 4 - Tigard Triangle - be restructurt,; 1-
retain Item 1 and delete Items 2 and 3 and thereby having a representation or 7
residential and 5 business-commercial landowners; motion seconded by Council-man
Mickelson.

RE: Private attorney fees incurred by Officer Boomer
to protect his personal interest in the amount of
$255.50 (see attached billing)
Sir:
I am forwarding to your office a request from Officer
Boomer for payment of legal fees in the amount of $255.50, as indicated
above.
Officer Boomer retained J.D. Bailey, who assisted in the
defense of this case with the insurance company attorney. Subsequently,
a finding of not guilty was rendered by the jury of alleged civil
rights violations.
I wish to request every consideration possible be given
this matter.
