Bishop, Councilman Ralph C.. Barkhurst, John E. Cook, Alan W. Mickelson, Robert C. Moore; R. B. Adams, Chief of Police; Fred A. Anderson, Legal Counsel; Richard Bolen, City Planner; Bruce P. Clark, City Administrator; Doris Hartig, City Recor.!ar. 2. LITTLE LEAGUE REPRESENTATIVES - REQUEST TO ADDRE::S COUNCIL In the absence of the representative from. L ttwa 14aEt e, Councilman Cook synopsizad the !satuat_on regarding Little League clubs practicing at the Cook Park ball field. It was staff and Council's opinion the weather conditions would dictate when the ball field could be used and stated under present conditions the field was still too wet to use. 3. CITY ATTORNEY SELECTION PROCEDURES Mayor Bishop submitted by memo some suggestions for replacement of City legal counsel. Council and staff discussed the forming of a screening committee, interviewing of applicants, vh.%ther reimbursement be on contrr.c'6ual or retainer basis, guidelines for selection, as wel1 as what k.."nd of services the City would expect. " Consensus of Council was to request Ed Sullivan, Don Ashmanakaa, Fred Anderson, and someone, the Multnomah County Bar Association President would recommend, who has had municipal experience, be on the screening committee. City Administrator to prepare a program of steps to be taken in the selection process relating to the role of the proposed screening committee. 4. Council discussed designating areas of concern for each Council member. It was tho consensus of Council all should become familiar with all the functions of the City, however, concern was expressed that Council may become involved more than as a representative, but in the administra- tive and operational activities. Formation of other committees was discussed and it was• suggested each Councilman reviaw the ;Mayor's recommendations and discuss with the City Administrator their concern and recd-nendation. City Administrator to synopsize and report back to (a) Streets And Roads. Formation of StrLkata Uta Ronds and problems of implent!:V%g :it:7?,e.y the City having jurisdiction over the entire right-of-way. It waa suggested that such a Committee, if formed, could attempt to meet with Washington County Street & Road Committee to seek some cooperation and attempt to find some solutions to improve the roads in the Tigard area. (b) Human Relations Commission. Mayor Bishop requested discussion on Human Relations Commission be set over pending further information from the League of Oregon Cities. (c) Fire St's. Council discussed and requested City Ad1_`t!=tr prepare resolution for Council consideratnon stab3ish- ing a committee, stating the purposes and guidelines for fire study. Committee to study the Tigard area and consist of seven members, five within the City limits. Consensus of Council was the committee would study the feasibility of de-annexation from the Tualatin Rural Fire District. 5. iWNDARY E MANSION COMMITTEE AND ANNEXATION POLICY DRAFT STATEMENT. Consensus of Council was to discuss this as one item. r-.T't:r Bishop read proposed policy statement and requested Council comments. Council and staff discussed annexation policy -nd what might be City's sphere of influence. It was the consensus of Council that the Mayor and Councilman Barkhurst revise policy statement for consideration at next Council meeting. 6. VACANCY APPOINTMENT. Mayor Bishop commented the interviewing committee had met and would recommend the reappointment of Don Jacobs to the Library Board. This item will be considered at the next Council meeting. 7. S.MR_ASSESSMENT RELIEF REQUEST - TOM WHITTAKER Attorney Anderson summarized a memo to Cr•rT-711 regarding the assessment and stated in his opinion there was no legal basis upon which the City could adjust the assessment. Attorney Anderson stated that he took into consideration Mr. Whittaker's statement that the adoption of the flood plain ordinance put the property in the position of being assessed for an improve- ment from which it cannot benefit. Attorney Anderson further 14, stated that if a building permit were denied Mr. Whittaker, then the failure of benefit to the property might be a matter of fact that could be considered. Mr. Whittaker stated he would like some statement from Council that attempts of development would be viewed within the framework of the sewer sasesswert. CRAG PLAN RESPONSE Council to study City Admilnistr.ator'r an-p:c nn- prr; '"ed zc respond at next regular Council meeting. 10. GARBAGE FRANCHISES City Administrator stated he had entered into preliminary nego- tiations for extension of the franchises and felt that there is a compusity concern about the exclusive nature of the franchises for particular areas in the City. The City Administrator suggested Council meet with the holders of the garbage fran- chises April 7 and at a later date hold a public hearing for comments from the public. N.P.O. #1 PLAN TEXT City Administrator synopsized the conflict of C-P and C-3 zone in the N.P.O. text and the N.P.O. plan map. The Council and staff agreed to consider second reeding of ordinance at the next regular Council meeting.and if the ordinance is adopted, at a later date, amend the text to conform to the N.P.O. plan map. 14. POLICE CAR BIAS Chief of Police reported local dealers had indicated they -ers interested in b:.dding in competition with State of Oregc. 'bid prices'on police vehicles. Chief of PcbL.a rea:.ested Ccs nc!.' approval to use State's specification for cars and request bids from local dealers. Council concurred and item will be placed on next agenda. 15. LIBRARY REPORT City Administrator reported copies had been distributed to Council and requested they review the report. •16. OTHER Councilman Moore inquired about the travel trailers selling food in various locations throughout the City. ROLL CALL: Present: Mayor Wilbur A. Bishop, Councilmen Ralph C. Barkhurst, John E. Cook, Alan W. Mickelson, Robert C. Moore, R. B. Adams, Chief of Police; Fred A.• Anderson, Legal Counsel; Richard Bolen, City Planner; Bruce P,, Clark, City Administrator; Doris Hartig, City Recorder. Special meeting was called to order by the Magor with the common consent of the Council for the purpose of canvassing the results of the March 13, 1975 election. The City Recorder reported the tally of votes with respect to purchase of the Fowler site as follows: 162 Yes Votes 439 No Votes 1 Vote Incorrectly Marked Total vote received: 602 The majority of the ballots read "no" defeating the proposition. Motion by Councilman Moore to record and accept the results of the election; seconded by Councilman Cook. ,Apprdvasi by unanimous vote of Council. Meeting adjourned 7:40 P.M.
