(b) Council and Mayor each individually stated they had contacts
from interested parties regarding this matter and because
of the Fasano guidelines would not discuss the merits of the
case. All stated they were not prejudiced in making their
decision and therefore felt they would not have to disqua:.i+y
themselves.
(c) City Planner stated the Planning Commission had recomaended
approval, however, since that time many things have changed
and based on the Tigard Municipal Code felt the applicant
had not carried the burden of proof.
Council and staff discussed the ramifications of the
Fasano guidelines, if the minor land partitioning require-
ments have been met and if the request was in compliance with
the comprehensive plan.
(d) Motion by Councilman Barkhurst to uphold the appeal of N.P.O.

granting of request may require an undesirable burden be
placed on the community; further, that it is not in confor-
mance with Section 17.74.030 of the Tigard Municipal Code;
motion seconded by Councilman Mickelson.

Mayor Bishop stated he would vote in favor, however, he did not
agree entirely with the teat.

Attorney Anderson replied to Mayor Bishop's comments stating
there was no conflict of interest on his part and wished to
thank the Councilmen for their confidence and support.

Bar Association or a designated member of the Association to
assist Council in screening, interviewing-and making evaluation.
Mayor Bishop also suggested an ordinance be adopted establishing
the office of Legal Counsel and upon receipt of recommendation
of screening committee, make the appointment to the position.
16. OTM BUSINESS
(a) C£ty Administrator stated an L.C.D.Cc meeting would be held
March 11, at Washington County; also noted meeting of
T-CAP�Wediiesdayo 6:45 A.M.--at-Chet.
City Administrator suggested Mayor and Council call special
meeting March 179 1975 to %anvas vote of March 139 1975
election. Special meeting to start at 7:30 P.M.
Tom Whittaker, from audience,, asked for Council guidance in
considering future minor land partitionings. Council will
respond later.
