Attorney Anderson administered the oath of office to: Mayor Wilbur Bishop - Term expiring 12/31/76 Councilman Ralph C. Barkhurst - Term expiring 12/31/78 Councilman Alan W. Mickelson - Term expiring 12/31/78 Mayor Bishop and Councilmen commented with respect to their goals ani obdec:tives. Maycr Bishop read his statement of goals and priorities during his term of cff:ce. Maycr Bi?hop comav_nted on the following items: fiscal responsibility, major street and arterial improvements; planning, rezoning, beautification of the city, law e-•.forcement and public safety; public works and sewers, parks, greenways, bike paths, library, building department, consideration of civic center, citizen participation in city goverment., co:nty cooperation end coordination, city administration, staffing, consideration of city fire district, and annexations. ELECTION OF PRESIDENT OF COUNCIL (a) Motion by Councilman Mickelson to nominate John Cook to serve as President of Council; seconded by Councilman Barkhurst, Nominations were closed. Nomination of John Cook was approved by unanimous written ballot of Council, CRAG REPRESENTATIVE AND ALTERNATE SELECTION (a) City Administrator suggested the Mayor serve as representative for an indefinite period df time. (b) Motion by Councilman Cook that Mayor Bishop be representative and Cc•.ncilmen Barkhurat serve as alternate representative for an ir•l%fta.ite p•-icj Cf tine•; seconded by Councilman Mickelson. Approved by unanimous vote of Council present. Approved by unanimous vote of Council.present. CRAG PLAN ADOPTION PROCEDURE (a) City Planner has been working with CRAG representative Rod San-dos regarding regional planning. Planner recommended joint meeting of City Council and Planning Commission to hear CRAG's presentation. Council recommended February :, 3, 1975 or an alternate date of February 17, 1975. City Planner to make arrangements and report back to Council. APPOINTMENT PROCEDURES AND UPCOMING APPOINTMENTS Mayor Bishop recommended the selection committee be composed of 3 members, Mayor, City Administrator and a 6 month term for each Councilman. Council discussed matter and recommended the Chal:ran of the respective board or committee where appointment is under considerstioc. he asked to attend the interview and screening meeting. Concensus of Council was tet have 4 member committee. City Administrator recommended Council consider adoption of rules or by-laws for conducting meetings. Council requested City Administrator to prepare recommended rules and by-laws as well as resolution setting forth council policy with respect to meeting attendance by appointed board and committee members. Council also discussed the formation at some future date of a charter review committee. ZONE CHANGES NPO #1 City Planner stated public hearing will be held January 13, 1975 and discussed the NPO #1 rezoning and recommendations of Planning Commission. Council and staff requested interested property owners be notified of the proposed change by certified mail. NPO #2 PLAN ADOPTION City Administrator recommended Council consider some aspects of NPO #2 such as land uses and traffic patterns and make decision on park site after park board meets with NPO #2. Mr. Christensen and Mr. Stan discussed with Council the proposed park site as recommended by NPO #2. Council will consider NPO #2 plan at January 20th study session. HUNZIKER ROAD PUBLIC NEARING - L.I.D. Director of Public Services 6 Facilities synopsized progress to date and stated public hearing will be held at January 13th meeting. Council will then be requested to adopt ordinance setting forth boundaries and assessment method. AUDIT REPORT TO MANAGEMENT City Adrainistrator commented on auditors report to management and discussed with Council implementation of recommendations. AUDIT AGREEMENT City Recorder distributed proposed agreement stating the staff would prov.idP mere supportive information for auditors and the fee for the 1974-75 audit wr,...11d remain the same. Council will consider approval at next meeting. AERIAL MAPPING CHARGES City staff proposes to recover some of the expense for the aerial mapping ty charging the following rates for copiest For Tigard citizen, xerox copy for personal use - 25C Commercial user $200 per blue line sheet Other Governmental entity $80.00 per blue line sheet Sale of reproducible copy to other governmental agency with the understanding they are not to sell copies - $150 per sheet. Council and staff discussed separating revenue from sale of maps, however cssde no decision at this time. AMENDMENT TO ORDINANCE No. 73-24 VEHICLES IMPOUND ORDINANCE Chief of Police outlined memo recommending amendments to ordinance. Council and staff discussed proposed amendments and concurred with Chief's recommendation. Item will be on January 13th 6gends. PAGE 2 - STUDY SESSION MINUTES - JANUARY 6, 1975 FOWLER JUNIOR NI.GSH DISCUSSION City Administrator reviewed public forum and procedure of public opinion poll. Council discussed question of proposed use, alternative proposals and reasonable cost. Council discussed acquiring site only as first phase of program and then conducting feasibility study with respect to remodeling, demolition, etc. City Administrator requested to come back with another proposal for Forum's use reflecting this alternative. B.O.R. FUNDING INFORMATION Councilman Cook apprised Council of the available B.O.R. funds. City Administrator recommended Council consider submitting two applications to Washington County; one for Cook Park Land Development (3rd phase) and another for land acquisition (possibly O'Mara site). Council concurred with his recommendation. Staff will begin preparing appli.: cations. DISCUSS SCHEDULE FOR BUDGET ADOPTION City Administrator reviewed schedule and sequence for completion of task analysis, union negotiations and budget adoption. After discussion with staff and Council it was concensus to allow 2 1/2 weeks additional time for possible budget election. UNION. NEGOTIATIONS City Administrator requested Council go into executive session under provisions of ORS 1973 Chapter 172, Section 6 (2) (a) and O.R.S. .192660 (2) (a) for the purpose of discussing union negotiations. REGULAR MEETING ADJOURNEDt 11:45 P.M. Executive session was duly called under the provisions of Oregon Laws of 1973 Chapter 172, Section 6 (2) (a) and ORS 192660 (2) (a). Purpose of the discussion: Union negotiations parameters. (a) Motion by Councilman Cook to appoint City Administrator as Chief negotiator as well as Chief Adams and Doris Hartig as part of the negotiation team; seconded by Councilman Barkhurst. January 3, 1975 TO: City Administrator FROM: Chief of Police SUBJECT: Ordinance Amendment RE: Ordinance 73-24 Abandon Vehicles Sir: I wish to request some language changes in the "notice to remove vehicle from public street" form, whereas there has been some confusion on the part of citizens when a vehicle has been posted with the notice. Citizens have made the inference that once they give notice that the vehicle is not abandoned, it does not have to be moved, which is not the case. I have been working with the City Attorney (Roger Anderson) since October to develop a new notice form, whereby this problem will be reduced. Draft I of the proposed notice is attached for your review; the language changes are under- lined, and in addition to the notice I am proposing an additional ordinance be printed on the reverse side of the notice form (Ord. No. 70-41 or Title 10.28.020) which deals with advertising for sale on public street, vehicle storage on public street, etc. With this format we will. have the ability to deal with this problem more effectively, whereby the citizen will be properly informed of the ordinance requirements, reduce the need for citations, and gain voluntary compliance. The old notice form is provided for comparison with the proposed changes. Respectfully, .B. Adams Chief of Police RBA:ac (DRAFT I) NOTICE TO REMOVE.VEHICLE FROM PUBLIC STREET Ordinance No. 75 of the City of Tigard provides for the removal of vehicles which have been left upon a city street in the same position for more than 5 days, and which appear to have been abandoned. Vehicles which are abandoned on the streets constitute a nuisance and a potential traffic hazard. This vehicle has heen observed by officers of the police department in the same position for over days, and an investigation has failed to disclose the ownership of the vehicle or the reason for its being parked for this period of time. The owner of this vehicle is hereby advised that this vehicle will be removed from the street under Ordinance No. 75-� unless the owner removes this vehicle from the location or good cause is shown, satis- factory to the Chief of Police, why this vehicle should not be removed by the owner or removed and impounded by the City of Tigard. Failure to remove this vehicle or to show good cause why this vehicle should not be removed within 24.hours of the posting of this notice is held by the ordinance to indicate that the vehicle is an abandoned vehicle to be impounded by the City of Tigard, Police Department, for disposition as provided by the ordinance. Posting Date and Time (OVER) In addition to the foregoing, Title 10.28.020 of the City of Tigard Municipal Code sets forth the following parking limitations. 10.28.020 Purposes for which parking is prohibited. No person shall park a.vehicle on the right-of-way of any highway, or upon any public street or public way within the •city _limits for any of the..foilowing purposes. .(1) . Advertising, selling or offering merchandise for sale; . (2) Displaying such vehicles for sale; (3) Washing, greasing or repairing such vehicle except as may be necessitated by emergency; (4) Displaying advertising.upon such vehicle; (5) Storage, junk or dead storage for any period of more than fort -eight hours, except that this subsection shall be subject to the limits elsewhere prescribed in the city motor vehicle code.or as may be prescribed by the Oregon State Motor Vehicle Code.
