(a) Buildi;ig:Official recommended that refund of building per-
mit fee be denied if request is not aiiWin 120 days from
issuance of permit. Council and staff discussed past city
policy to authorize refund of building permit fees and
retain plan check fee. Uniform building code provides
reinstatement of permit for an additional 1/2 of original
fee may be allowed if application is made within one
year after permit is void.

mail cover letter stating future Councfr policy will conform
with uniform building code; seconded by Councilman Mickelson.

ject including proposed boundaries, assessment method,
estimated cost to property owners, city participation to
be 20% of cost, as well an location of sidewalk to be on
north side of street.

City Planner-reported to Council Mr. Setniker'a conditional use
application did not accurately reflect the lot size. it appears
there will be problems in development of proposed site due to
reduced size of lot. City Planner to report back developments
to Council.

Dear Sirs:
We have a concern which we would like to call to your attention. We hope that you
can give it some consideration during your study session.
We have been attempting to conserve the natural resources of our planet as well as
support sound environmental practices in our home.' One of our main activities in
this regard has been to attempt to recycle as much of our solid waste as is possible.
In doing this we have been able to cut down the quantity of solid waste we generate
to about one grocery bag full per week. It is at this point that our concern
arises.
Our current rate for garbage hauling is $3.25 per month during which time our can
is emptied once -per week or a total of four times. Since our can is only filled
one time a month, we thought it reasonable to suggest that our can be emptied only
once per month on a regular basis. We were informed that if this were done our
monthly bill would be reduced to $2.75. We feel that it is unreasonable to cut our
use of this service by 75% and have the bill reduced by less than 20%. In checking
on the terms of 'the garbage hauling contract we were informed that any action would
have to be taken by the City Council.
We would, therefore, like to suggest for your consideration a clause in the
garbage contract which would allow for a more flexible fee schedule for less
frequent regular service. Our suggestion of a fair per can price would be $1.00
which would exceed the per can rate now in effect and yet be reasonable enough to
encourage people in this most important area of solid waste control. At the
present time it seems almost as though we are being penalized for trying to do
something positive for the environment. We are aware of some neighbors who have
discontinued the service rather than pay at the current rate for once a month
pickup.
As we see it, a more flexible fee schedule would be of interest not only to the
citizens of Tigard but would be a positive encouragement for conservation and
recycleing efforts.
We appreciate your time and consideration of this matter and trust to the good
judgement you have shown in previous matters. Thank you very much.

On June 27, 1974 our company took out a permit (No. 74- 130) for an
apartment building on our Summerfield Project. To this date this
building has not been started. We cannot predict a date for construction
of this building and would like at this time a refund of the permit fee.
I am requesting a refund of the permit fee only, realizing that the plan
check and recording fees are for services which have been rendered.
This amounts to $156. 00 out of a total charge of $239. 50.

Gentlemen:
Yesterday evening I attended the public hearing of the Tigard Planning Commission
and gave testimony for Air-King Manufacturing Corporation on how the NPO Plan #1
would affect us. The original notice listed a classification of C-3, which would
kill us. I stayed and heard the discussion of the Board for adoption of the plan
with Staff recommendations that Air-King property be zoned YI-4.
From what I heard in the Board discussion after the public hearing, it would seem
that the original NPO Plan did recognize the M-3 zoning for the Air-King property.
However, a line was drawn which inadvertently went across the middle of the
Air-King property rather than the north boundary line. This split the zoning on
our property so far as the NPO Plan #1 went.
Our property is bounded on the Westerly side by Burnham and on the Southerly side
by Hall Blvd. and on the Easterly side by the railroad. It seems apparent to me
that no violation of the NPO Plan could be caused by zoning the whole property
M-3 instead of part of it. I would assume the original intent was in fact to zone
the whole property M-3. We're essentially wood processors and do some light wood
manufacturing, all of which is clearly spelled out in the M-3 classification. The
M-4 zorie is unclear as to whether we would be a conforming use or not. Acccrdingly
adopting this classification would create problems when non3 exist.
In order to prevent any future work on interpreting, it would seem in the best
interest of both the City and Air-King to have our total piece of property zoned
M-3. Accordinglyo I would like to make this a formal request. Kindly let me
know what I should do to implement this so that you might take favorable action.
