Mayor Bergmann noted the following communications were received: (a) Copy of Planning Director's letter of resignation. (b) Copy of Councilman Mickelson`s resignation from Planning Commission and Design Review'Board.' 3. TRI-MET SERVICE DISCUSSION' (a) Clark noted Tri-Met had responded to citizens on Ann Street and opened meeting for audience discussion and testimony. Pinebrook (b) Leonard Smith from Tri-Met answered questions posed by audience. Tri-Met will investigate alternate routes and have results back to Council within a week or two. Carolyn Gainer, Tri-Met representative also spoke. 4. Communication from Commonwealth, developers, ie: application of Flood Plain Ordinance provisions. (a) City Administrator gave background facts. (b) Ted Jensen, attorney far Coammonwealtlt, discussed facts presented in Letter. It Baas noted that prior to approval of the preliminary plat, $72,466.23 was ��.�~� . C._.�-e_-�- `, �� � ,. -2- 4. (cont.} spent on this project. In addition, there has been contractor fee obligations incurred in the amount of $25,000.00. (c) Attorney Anderson cited Supreme 'Court`decision which stated if there is` a substantial start by investment or activity on ground and if contractor/ owner is acting in good faith, project could attain vested rights to continue. Council must determine whether there is a substantial start and if 'owner is acting in good faith'. (d) Council generally concurred in the fact that Commonwealth had acted in good faith and will take formal action at next regular meeting by resolution subject to Commonwealth supplying the City with records of the financial commitments and expenditures. �o COMdIERCIAL & HUNZIKER STREET ENGINEERING PLANS PRESENTATION (a) Jim Harris of Harris & McMonagle presented and discussed the Hunziker Street plans which show a realignment of Hunziker directly across from Scoffins. Also depicted was a' 60' right-of-way;keeping with 44 feet paved street and 2 sidewalks. Estimated front foot cost is $40.44 exclusive of right-of-way acquisition and railroad signal relocation. (b) Discussion ensued regarding sidewalks and bike paths and the proper provision of such. (c) It was determined that at the next study session cost estimated for a 60' right-of-way with both 36' and 44 paved widths and sidewalks would be presented. Also to be prepared were alternate assessment methods. (d) Commercial Street plans were reviewed and it was determined that for both` _ Commercial and Hunziker staff would attempt to collect data upon which a determination of specific benefit to properties and general public benefit might be made. Concensus of Council was that each street provided some general public benefit and should be participated in by the City. 6. PROPOSED AMENDMENTS TO PLUMBING CODE (a) Building Official Austin synopsized proposed amendments noting that the purpose was clarificationsimplification and conformance with State Plumbing Code fee structure. Attorney Anderson to review and ordinance to be placed upon, next agenda. 7. HOUSING AND URBAN DEVELOPMENT ACT OF 1974. (a) City Administrator presented a written synopsis of the law and made a verbal flip chart presentation ending with a recommendation that the City tentatively prepare an application. Council concurred and instructed City Administrator to propose a step by step procedures for application preparation. 8. OTHER: (a) City Administrator noted that entire overlay program was complete. (b) City Administrator noted that 14 sidewalk/pathway coupons and 8 storm drainage coupons had been received to date.
