Clark, City Administrator; Fred A. Anderson, Legal Counsel-, Nick Hiebert. Director of.Public Services and Facilities; Russel Austin, Building Offical; Winslow Brooks,'City,Planner;:Donald Rea, Police Lieutenant; Doris Hartig, City Recorder. 2. Building Official'rRussel"Austin requested authorization`to refund a $134.00 building permit fee to Hollcraft Homes, Inc. as the customer had decided. not to build. Director of Public Services and Facilities also recommended a refund of the sewer permit fee as the request was made within 90 days from time of issuance of permit. 'Council concurred with request and item.will be on next regular council meeting agenda. 3. A. STREET VACATION REQUEST Summerfield #4 -`Director of Public Services and Facilities discussed Tualatin Development Corp. request for a street vacation of a 20 foot wide strip of land between Lots 7 and'8 Marguerite Ochs Tracts within plat of Summerfield #4. Director of Public Services and Facilities recommended'vacation'as the land has no public use value now or in the future. Council requested item be placed on next Council agenda. B. S.W. 107th - Mr. E. M. Thomas and Bud Snyder of S.W. Fairhaven Street discussed with Council and staff the problem of maintaining the unimproved portion of S.W. 107th. Council requested staff to secure further information as to how land was platted, locations of utilities# etc. Council concurred with.going the easiest route tovacatethe street and,bring to Council for further"consideration. 4. 'FLOOD PLAIN ORDINANCE Council,, staff and Jim Harris, representative of Harris h McMonagle consulting firm, discussed flood plain ordinance as proposed by the Planning Commission. It was the concensus of Council after the public hearing August 12th to study the matter further. 5. PLANNING COMMISSION VACANCY City Administrator reported he interviewed Herman Porter who was interested in serving on the commission. Previously the committee had interviewed Ray Emms and Allan Popp. - The Committee will meet this week to make recommendation for appointment. b. BUS SHELTER LOCATION City Planner recommended moving the bus stop on S.W. Pacific Highway in front of Girods to the new post office site. Staff to investigate further and report back to Council. 7. LERON HEIGHTS SEWER CONTRACT —Addendum Director of Public Services and Facilities stated there was an overlap of area for sewer surcharge purposes in the Leron Heights Interceptor-Derry Dell contracts. The area under consideration is in the Clydesdale and Cottonwood Subdivisions. Council would like to consider the matter further. 8. S.W. HUNZIKER,STREET PLANS Jim Harris of McMonagle and Associates explained proposed plans and alternates for improvement of street. Director of Public Services and Facilities recommended an informal meeting of the property owners at a study session before formation of the L.I.D. and that the City would set street standards, and assessment policies so Page 2 Study Session Minutes August 5,1974 a. (cont.) that cost estimates can be established. Director of Public Services and Facilities to request,property owners to meet with Council for informal discussion of improvements. 9. SEWER PERMITS =City Administrator stated the U.S.A. and D.E.Q. has authorized the City to issue sewer permits with no restrictions. The 100 sewer permit allocation to City of Tigard is being investigated by the City_Administrator. 10. CITY POLICY -Dedications City Administrator stated in the past, the City policy has been to require dedication of property as a condition for approval of various typese of requests however recently the City has established conditionsthat the value of the land to be dedicated be, credited to that property at the time an L.I.D. is formed. Council thereby was notifiedofthis change in policy. 11. OTHER Councilman Cook requested status of S.W. 115th. Director of Public'Services and Facilities stated the paving was scheduled for approximately August 15th. Director of Public Services and Facilities requested Council establish a policy requiring annexation when a sewer contract agreement is executed. 'Council voted '2-2.
