Special meeting was duly called by Mayor Larsen with common
consent of Council for the purpose of considering the
applications for exception to moratorium to allow issuance
of building permits in accordance with ordinance 71-38 as
amended by Ordinance 72-3.

(a) City Administrator recommended rejection of bids on
the steel building as the School District has not
solved the problem regarding purchase of the incinerator.
(b) Motion by Councilman Bergmann to reject the bids;
seconded by Councilman Moore.
Approved by unanimous vote of Council.
4. RESOLUTION No. 72-5 A RESOLUTION AUTHORIZING AND ADOPTING AN
AMENDMENT TO CONTRACT DATED SEPTEMBER 8,
1970 BETWEEN THE CITY OF TIGARD AND THE
UNIFIED SEWERAGE AGENCY OF WASHINGTON s,
COUNTY, OREGON,WITH RESPECT TO THE
OPERATION AND MAINTENANCE OF THE SEWAG3
TREATMENT PLANT IN THE CITY OF;TIGARD, AND
RE-DEFINING THE CITY'S PERCENTAGE OF
'PARTICIPATION WITH RESPECT TO SEWER
SERVICE CHARGES.
(a) City Administrator stated proposed resolution amends
the contract for U.S.A. to operate the sewage treatment
plant and pump stations effective February 1, x'1972.
All personnel will be transferredand utilities for
Operation of the,'plant will be charged to;U.S.A. City
will maintain the collection system. City will receive
n 30/ of the monthly sewer servicer charges instead of
70%. City Administrator noted the amended,agreement
should be corrected to indicate September 8, 1970 as
date of original contract.
(b) Motion to adopt: 'Councilman Norton, seconded by'council-
man Bergmann.
Approved by unanimous vote of Council.

Those who testified:

Wayne Gibbens, Murray McCormick Engineering Group,
explained new plan for exit off S.W. 99W, south of
Gaarde, with a shoo-fly or off-•ramp arrangement onto
frontage road. Mr. Gibbens suggested the speed limit
in the area be lowered to 40-45 mph.
MAYOR LARSEN RECESSED THIS MEETING AT 7:50 P.M. AND RECONVIINED AT
8:00 P.M.
Public Rearing Continued
Those who testified:
Mr. Allan Stewart, SIJ Development, stated the County
and State felt the first plan would not serve the
purpose and the new plan was better. Mr. Stewart
indicated their willingness to participate in the
cost of the off-ramp.
Council and staff discussed signalizing of intersection
Of S.W. Gaarde and 99w.
Councilman Moore suggested Council consider the two
applications for exception to the moratorium be
considered together.
No objection was voiced by Council.
(c) Applicant is Culver Construction Company, property
is located south of Gaarde Street 800 feet west of
99W, Map 2S1 10A, Tax Lot 1501. Request for exception
to allow issuance of building permits in accordance
with Ordinance 71-38 as amended by Ordinance 72-3.
(d) Public Hearing continued from Council Meeting January

City Administrator discussed various alternatives
available in reaching a decision.
(e) Motion by Councilman Bergmann to close public hearing:
' t seconded by Councilman Norton.
Approved by unanimous vote of Council.
Council and staff discussed conditions to be imposed.
(f) Motion by Councilman Bergmann to ,grant exception to
SIJ Development Company to construct;apartments with
the following conditions:
1. - Building permits will not allow occupancy of any
dwelling units until the completion and acceptance
of 112th Street by the City in conformance with an
executed Street Dedication Compliance Agreement.
2. 'Building permits shall not be issued until a permit
is secured from the Oregon State Highway Division
allowing the construction at private expense of an
off-ramp (shoo-fly) from 99W onto the frontage 'road
and the closure of the existing intersection of. S.W.
Gaarde Street and the frontage road and that a cash
deposit to cover such cost of the-off-ramp;be placed
in trust with the City of Tigard.

• 3. Building permits will not allow occupancy of
any dwelling units until the State of Oregon
Highway Division has approved and accepted the
off-ramp for public use and that a sum of money
equal to � of City share for signalization of 99W
and Gaarde intersection be placed in trust with
the City; seconded by Councilwoman Paisley.
(g) Councilman Norton moved to amend the motion to read
4 of the cost of the Johnson Street signal be
deposited with the City in trust; seconded by
Councilman Moore.
Amendment was approved by unanimous vote of Council.
_ Call for vote on amended motion was approved by
unanimous vote of Council.
(h) Councilman Bergmann moved that exception be granted
Culver Construction Company with the same conditions
as SIJ Corporation; motion seconded by Councilman
Moore.
Approved by unanimous vote of Council
