Request for exception to allow issuance of building permits for
4 model homes. Property is located on the N.E. corner of S.W.
115th Avenue and S.W. Gaarde Street, Tax Map 2S1 3DC, Tax Lot 900.
(a) Public Hearing 8:00 P.M.
Mr. Nick Bunick, applicant, testified
Discussion by Council and applicant regarding proposed
development of S.W. 115th and applicant's participation
in improvements of S.W. Gaarde intersection.
Motion to close public hearing: Councilman Norton,
seconded by Councilman Bergmann.
Approved by unanimous vote of Council.
(b) Motion by Councilman Norton to approve exception to
Columbia Custom Homes with the condition there be an
execution of a subdivision compliance agreement which
would include improvement of S.W. 115th Avenue either through
L.I.D. or through private funds.
Motion died for lack of second.
(c) Motion by Councilman Bergmann to grant exception with
conditions:
1) Building permits would not be issued until City had
executed a subdivision compliance agreement containing
provisions for the improvement of 115th either privately
or by Local Improvement District.
2) Applicant agrees to share in cost of traffic signal at
99W & Gaarde as provided in exceptions grante.. other
private parties;
3) Model home openings shall coincide with completion of
115th Street improvements; seconded by 'Councilman Norton.
Approved by unanimous vote of Council.

City Administrator recommended granting exception as it would
not be detrimental to the traffic problem at_the'Gaarde inter-
section.

(A) Administrator stated Lee Miller had requested relief regarding
her problem in Mira Park wherein several lots have been sold and
the streets have not been accepted for maintenance by the City -
