(a) Approved as submitted.
4. WRITTEN COMMUNICATIONS
(a) Letter from Ken Meng, Director, Washington County Public Works,
reporting vacancy on Co-ordinating Committee of Portland-Vancouver
Metropolitan Transportation Study Committee.
(b) Letter from Larry Sprecher, Beaverton City Manager, regarding
meeting to be held February 4, 1969, 7:30 P.M. Beaverton City Hall,
regarding proposed recreation and water control project in
Beaverton-Tigard area.
5. WALNUT STREET SEWER EXTENSION - GRIFFIN & BRAYSON AGREEMENT
(a) City Attorney recommended Mayor and City Recorder be authorized
to execute the agreement even though Mr.. Joe Chamberlain has not
signed.
(b) Motion by Councilman Bergmann authorizing Mayor and City Recorder
to sign agreement on behalf of the City; seconded by Councilman
Moore.
Approved by unanimous vote of Council.
(c) City Administrator recommended acceptance of Maintenance Bond
be withhelduntil'the agreement has .been executed by all parties.

(a) City Administrator recommended item be continued to February 10,
1969, Council Meeting. -

9. GRANT STREET - WALNUT AVENUE- STORMDRAIN
(a) City Administrator reported serious storm drainage problem
in the area and that staff had made a preliminary study on
formation of a stormd.rain improvement district. Administrator
and Director of Public Works explained several plans for
dividing assessment. Estimated total cost of project is $8300.
Letters were sent to interested property owners informing them
of informal public hearing on project. Interested property
owners were asked for comments regarding formation of storm
drainage district. Mr. Val Mack of S.W. Grant questioned cost
of project and if his present storm tile could be used.
Council requested Administrator to continue to work with
Property owners to form improvement district.
10. ORDINANCE - 69-2 - AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS
IN SECTION 10, T2S, R1W, W.M. WASHINGTON COUNTY,
OREGON, COMMONLY KNOWN AS "CANTERBURY CREST
ANNEXATION" (located vicinity of S.W. Pacific
Highway & Canterbury Crest)
(a) Continued from January 13, 1969 Council Meeting_
(b) Mayor Kyle stated Public Hearing was closed at last Council
Meeting and as Council wished more time to consider annexation
ordinance no action was taken on proposed annexation ordinance.
Since there was considerable interest in this annexation, Mayor
Kyle reopened the Public Hearing.

Mayor and Council discussed ramifications of annexing this property
and extension of sewer service to this area in view of fact it is
estimated City will reach sewer plant capacity sometime` in the summer
of 1969.
(c) Motion to adopt: Councilman Bergmann, seconded by Councilman
Moore.

11. ORDINANCE - 69-7 - AN ORDINANCE SETTING HEARING WITH RESPECT TO
PROPOSED ANNEXATION OF THE LANDS OF JAMES J.
PRAGGASTIS, et al and TED L. MILLAR, et al, in
Section 10, T2S, R1W, W.M. WASHINGTON COUNTY,
OREGON, AND DIRECTING GIVING OF NOTICE THEREOF.
(a) Setting of Public Hearing, February 24, 1969, 8:00 P.M.,
(b) Motion to adopt: Councilman O'Halloran, seconded by Councilman
Moore.
Approved by unanimous vote of Council.
(c) Council requested City Administrator inform petitioners that
annexation does not necessarily guarantee they will receive
sewer service.
12. ORDINANCE - 69-2 - AN ORDINANCE RATIFYING AND CONFIRMING RESOLUTION OF
CITY COUNCIL OF TIGARD OF MAY 1967, ACCEPTING THE
TRANSFER OF S. W. MAIN STREET AS A CITY STREET FROM
WASHINGTON COUNTY, OREGON, AND DECLARING AN EMER-
GENCY.
(a) Motion to adopt: Councilman Moore, seconded by Councilman
Bergmann.
Approved by unanimous vote of Council.
13. SEWER POLICY STATEMENT
(a) City Administrator read proposed policy statement regarding
proposed
future connections to.Tigard's sewer system. Mayor and Council
discussed policy statement and possibility of,City of'Tigard's
system reaching capacity,
(b) Motion to adopt policy as submitted: Councilman Moore, seconded

A. Attorney Anderson reported the Barth vs. City of Tigard case, regarding
zoning, settled without trial'. LL l
B. Mayor Kyle requested Council and staff give serious thought in regard
tounificationof service-districts<in 'area.
C. Resolution 69-1 - Resolution authorizing the Mayor to sign on behalf
of the City of Tigard'accepting a state grant for
$17,011.00 forconstructionof the Pinebrook
Interceptor Sewer:
(1) Motion to adopt Resolution: Councilman Larsen, seconded by
Councilman O'Halloran. Approved by;unanimous vote of Council. '
D. City Administrator asked authorization to proceed with engineering
studies on proposed new trunk sewers for 'Derry Dell District and S.W.
98th: Council instructed staff to proceed.
