Knauss, City Administrator Robert K. Logan, Doris Hartig, City Recorder. Absent: Councilman Robert C. Moore, City Attorney Fred. A. Anderson, City Engineer Keith C. Thompson 2. PLEDGE OF ALLEGIANCE 3. MINUTES FOR APPROVAL, March 11, 1968. (a) Councilman Bergmann requested minutes be corrected to show adjournment time as 9:00 P.M. (b) Minutes were approved with correction. 4. ADOPTION OF PERSONNEL MANUAL (a) Motion to adopt:- Councilman Bergmann, seconded by Councilman Ball` (b) Motion by Councilman Bergmann to amend personnel manual as follows:- Vacation schedule be changed from one day per month to 5/6 day per month of service. Leave with pay will be given an employee when called as witness for'civil' as well as public court cases. Motion seconded by Councilman Ball. Approved by unanimous vote of Council present. 5. RESOLUTION 68-7 - AUTHORIZING CITY TO APPLY FOR BUREAU OF OUTDOOR RECREATION FUNDS IN THE'AMOUNT'OF $3,460. FOR , COOK PARK. (a) Motion to adopt resolution: Councilman Bergmann, seconded by Councilman,Knauss. Approved by unanimous vote of Council'present. 6. RESOLUTION '68-8 -vSUB-DIVISION ORDINANCE (a) Setting Public Hearing April 8,` 1968, 18:00 P.M. Motionto set Public Hearing: Councilman Ball, seconded by ,Councilman Knauss. Approved by unanimous vote of Council present. { page I 7. STAN ADKINS BUILDING PERMIT REFUND (a) City Administrator reported Fir. Adkins had applied for a refund -of-his building permit issued March 3, 1967. The City has'not 'established a policy for refunding of building permit fees•and .suggested if Council was agreeable to a refund that it be :in .the form of'credit on a future building permit. The Administrator further pointed out that there was an outstanding bill of .$100. for the pumping of the Pinebrook Treatment plant, and that any refund or credit given by Council could be applied to Mr. Adkins bill. Mr. Adkins stated he didn't feel he should pay the $100. fee as he .was .unable to build for about one year even though he had deposited $9,00o. cash with,the City as his portion of the Pinebrook sewer connection fee. (b) Motion by Councilman Bergmann to,retain the plan checking fee Of;$95.75 and refund the building permit fee of $191.50 in the form of credit on building permits; seconded by Councilman Ball. (c) Councilman Bergmann moved .to .amend .the :motion to deduct the $100. owed to the City for pumping the Pinebrook Sewer Plant. Motion died for lack of a second. Vote on motion before Council was as follows: Councilman Ball AYE; Councilmen Bergmann and Knauss abstained from voting Motion passed. Council .took .no action on the $100. outstanding bill of Mr. Adkins. S. J. A. PATERSON SEWER CONTRACT AMENDMENT (a) City Administrator recommended this matter be set over to next Council Meeting. 9. REZONING APPLICATION OF ESTATE OF ERWIN T. WILLS, Q. B. GRIFFIN AND J. W. BRAYSON, -Map 2S1 4A, Tax Lot 100, Present zoning S-R, ' Requested zoning R-7. (a) Setting of Pnblic,Hearing April 8, 1968, 8too P.M. (b) City Administrator explained the property under consideration will not.be annexed until May .29, 1968, and the City Attorney had,not.ruled on what action could.be.taken for the requested zone,.change. City,Administrator hoped.to have an answer by next Councii.Meeting. Zone change .had.been'approved unanimously by Planning;and Zoning Commission. Washington County, Oregon (a) Public Hearing 8:00 P.M. No Testimony, Public Hearing closed (b) Motion to adopt: Councilman Knauss, seconded by Councilman Ball. Approved by unanimous vote of Council present. 11. ORDINANCE 68-17 - AN ORDINANCE ANNEXING TO THE CITY OF TIGARD LANDS OF FLORIAN P. PETERS, JR. & JEANETTE L. PETERS, being Lot No- 43 in Leron Heights No. 2, a subdivision of record in Washington County, Oregon (a) Public Hearing - 8:00 P.M. No Testimony, Public Hearing closed. (b) Motion to adopt: Councilman Bergmann, seconded by Councilman Knauss, Approved by unanimous vote of Council present. 12. CORRECT ORDINANCE NUMBER FOR KESSLER & PIERCE ANNEXATION TO 68-15. (duplication of numbers) (a) Motion to correct-number to 68-15: Councilman Knauss, seconded by Councilman Ball. Approved by unanimous vote of Council. 13. PINEBROOK SEWER` (a) City'Administrator`reported staff was prepared and requested authorization to call for bids on Pinebrook'Project, bid to be awarded April 22, 1968. Proposed construction starting date to be June 1,1968. (b) Motion to call for bids: Councilman Bergmann, seconded by Councilman Ball. Approved by unanimous vote of Council present. 14. SPEED CONTROL ON 121ST 'STREET (a) Mayor Kyle reported .to Council petitions had been presented by residents in the area of 121st Street recommending to the Speed Control Board that the speed limit remain 25mph from Manzanita Court to S. W. Katherine Street. City Administrator brought to Council's attention the State Speed Control! Board had proposed to establish the 'speed limit on 121st from Scholls Highway to S. w. Walnut to 4Emph and from Walnut to S. W. Gaarde to 40mph. Council pagei3 (3-25-58) recommended speed be reduced on S. W. 121st Avenue from Scholls Road to S. W. Manzanita Court, be 35 mph, and, from S; W. Manzanita Court to S. W. Gaarde Street, 30 mph, Residents in area indicate this speed limit would suffice in meeting the need to reduce speeding: Motion by Councilman Ball the City recommend our speed limit on S. W. 121st Street, of 25 mph, be recognized, and, the State Speed Control Board recommended speed not.exceed 35 mph to Manzanita " Court, and 30 mph from Manzanita Court to S. W. Gaarde.
