Contract for construction to be signed after execution of agree- ment for payment with Elementary School District. Motion by Councilman Saxe to 'Award Bid to Paul Construction Company in the amount of $5,366.00 subject to recommendation of City Administrator. Seconded by Councilman Knauss Approved by unanimous vote of all Council members present. 6. RESOLUTION #11 - RATIFYING ALL PROCEEDINGS OF S. W. PACIFIC HIGHWAY SEWER IMPROVEMENT DISTRICT AND SALE OF:BONDS` c' Resolution read in full., Page 1, 6/26/67 Motion by Councilman Knauss to adopt Resolution #11, Seconded by Councilman Saxe Approved by unanimous vote of all Council members present. 7. ORDINANCE NJMBER 67`38 - An Ordinance Ratifying and Confirming all prior proceedings with respect to,the "S. W. MAIN STREET IMPROVEMENT DISTRICT"; Confirming prior determination heretofore made that the properties abutting upon S.W. Main Street are specially benefitted" and declaring that the total estimated cost of the work being undertaken, except for the sum of $26,000., shall be apportioned and`assessed_to the said properties; Disposing of objections to the said assess- ments after hearing thereof; ratifying and adopting the apportionment;and assessment of the estimated cost to the respective lands within the Assessment District according to the special and peculiar benefits accruing thereto from the improvement; spreading the assessment; directing the City Recorder to enter all assessments in a separate lien docket of the City; Reserving the right to adjust the assessments on a proportionate basis with respect to any greater or lesser cost`of. the total work than as estimated and declaring same to be a lien on the respective properties until paid; and declaring an emergency (a) Objection of Oregon Electric Company was reviewed by City Administrator, Attorney Anderson, and Council, and it was determined that the 'objection was not a"valid one. Motion by Councilman Saxe to overrule the objection of Oregon Electric Railway Company, Seconded by 'Councilman Moore. Approved by unanimous vote of all Council members present. (b) Ordinance Number 67-38 - Ordinance read three times by title and number Council did not request that Ordinance be read :in full. Motion by Councilman Saxe to adopt Ordinance Number '67-38, Seconded by Councilman Knauss Adopted by unanimous vote of all Council members present. '8.. RESOLUTION TO TRANSFER FUNDS WITHIN THE GENERAL FUND, SEWAGE DISPOSAL FUND AND ROAD FUND (a) Transfer recommendations submitted and made a part of the record. Recommendation of City Administrator to transfer funds for general welfare of City. Page 2, 6/26/67 Motion: Councilman Knauss, Seconded by Councilman Saxe Approved by unanimous vote of all Council members present. 9. SIGN CODE - Setting of Public Hearing for Planning and Zoning Commission Action It was recommended by City Administrator that Council and Planning Commission hold a ,joint meeting to discuss the sign code before the public hearing date. Public Hearing 7;30 P.M., August 8, 1967, Council Chambers, City Hall, Tigard, Oregon Motion: Councilman Knauss, Seconded by Councilman Moore Approved by unanimous vote of all Council members present. 10. CONDEMNATION OF LANDS OF ROBERT SCOTT TO PROVIDE A 20° ROAD EASEMENT TO COOK PARK (a) Recommendation of CityAdministrator to authorize City Attorney to proceed with Condemnation of lands of Robert — Scott. Councilman Knauss 'suggested that the City try, to negotiate with Mr. Scott before proceeding with condemnation. Motion by Councilman'Saxe to authorize City Attorney to contact Mr. Scott and explain fully,to him the intentions of the 'Council regarding condemnation of road to Cook Park, and if_Mr. .Scott should answer in the negative, the Attorney is authorized to negotiate with Mr. Scott for settlement and make a formal offer in writing, and if this is not accomplished,: the Attorney .is to proceed with condemnation of lands of Robert 'Scott to provide a<20' road easement to Cook Park, Seconded;by Councilman Moore Approved by unanimous vote of all Council members present. 11. S. W. MAIN STREET IMPROVEMENT DISTRICT PROGRESS PAYMENT #2 TO DALE SAND AND GRAVEL (a) Report given by City Engineer - Total to date. $29,450.09 (b) Second Progress Payment $23,500.19 Motion by Councilman Knauss to pay Progress Payment #2, Seconded by Councilman Saxe Approved by unanimous vote of all Council`members present. 12. ANNEXATION ORDINANCE ANDERSON/OLSON/LAWRENCE':ANNEXATION Public Hearing 8500 P.M Page 3,:6/26/67 Mr. Moore testified and requested clarification of proposed annexation boundaries Hearing Closed. City Administrator requested that this item be tabled until ' July 10, 1967, until the Highway Department gives their consent to annex a portion of the highway which is included inthis annexation proposal. Motion by Councilman Knauss to table this Ordinance until July 10, 1967, Seconded by Councilman Moore. Approved by unanimous vote of all Council members present`. 13. ADJOURNMEW. 8:40 P.M.
