The meeting was called to order at 7330 P.M. by May^!- Xyle who
opened the meeting with the pledge of allegiance. Kyle .
asked for corrections, additions or omissions to the Ll- -:=S of
the meeting of June 28, 1965. None being offered the minutes
were then approved.
Mayor Kyle: I was contacted by Mr. Cox, State Highway Commission,
last week`and 'they did not accept our contract as presented on
June 28,-1965. On page 4, paragraph 6, last acntence, our
contract read "it is agreed by the parties that upon approval
by,the State of the plans and specifications a grade separation
structure will be provided at the future intersection S.W.
Garden Place and said highway by the State." The Highway Contract
read "it is agreed by the parties that upon approval by the

Councilman Woodard: I.'move that we allow the;Mayor tc_ �9salve

Motion seconded by Councilman.Klock. Upon call for the v,.Ce;the
motion was' unanimously approved by'Counr.il, all members being
present.
Mayor Kyle' introduced Mr. Peter Opton, King City Insurance,
who has prepared' a program of the Insurance for the City of
Tigard. ;Mr. Opton explained the report and asked that the
City consider a blanket policy which would include the Park.
The :Council will review the Insurance program and have further
discussion on the Insurance Lovarage at their next meeting
July 26, '`1965.
Mayor Kyle': We will now have a Public Hearing in regard to a
zone, change on the property located at 13015 S.W. Pacific Highway
for Mrs. Ruby D. Prison, Tax hot 2900, and the requested zone
change is from A-2 (Multiple .Dwelling) to C-3 (Rata'" ^ommerci.al) .
Since there was no response the Public Hearing was therl ,7osed.
We have an Ordinance 65-22 Granting a Zone Change';-t-o :-,aby
D. Prison. If there are no objections from Council, we will
have the City Recorder read the Ordinance three times by title
only,.

Councilman Klock- I move that we adopt Ordinance 65-22r Motion
seconded by Councilman Woodard. Roll call of vote resulted as

Mayor Kyles We have an.Ordinance 65-21 Annexing to the City
of Tigard. if there are no objections from Council, we will _

title only, being an Ordinance ANNEXING TO THE CITY OF TIGARD,
LANDS OF PATERSON ET AL, COMMONLY KNOWN AS THE "PATERSON
WEST TIGARD AREA", WASHINGTON COUNTY, OREGON,
Councilman Woodard: I move that the City adopt Ordinance 65-21.
Motion seconded by Councilman Klock. Roll call of vote resulted
as follows: Councilman Woodard, AYE; Councilman Bergmann, AYE;
Councilman Klock, AYE; Councilman Shinn, 'AYE; Mayor Kyle, AYE.
Councilman Woodard read a letter from Tigard Plaza eg ':ai.rg
the'sidewalk, and they do not plan to construct a sidewal:. at;
this time.
The road man was supposed to be here this week but he has
not arrived as yet.
Councilman Bergmann: The census enumeration is finished,
although the State Board of Census has not certified it we
have unofficially, just over 2200. This is an increase of a
little over 200 people--our last census was officially 1980.
You all have copies of the Salary Increase Schedule Program.
This program consists of five six months periods.

Councilman Kloc I have niet with the Vire Chief and his
Assistant twice, and they have not .m_teted the fire zona study

Councilman Shinn: I have a report from Chief Batchelar,
(reading report) and the Chief has also a`uamitted a work schedule
(reading schedule)
Mayor Kyle presented a Mayor's badge, (1962-64) to Co,:. :>n
Woodard.
Mayor Kyle- I have here a list of equipment, which is now at
the Sewage Treatment Plant, and we would like to declare this
equipment su.rplus and advertise the equipment for sale in the
newspaper.

Councilman Woodard, I move that we declare this equipm4: surplus
and advertise the equipment for sale in the newspaper. Motion
seconded by Councilman Bergmann„ Upon gall for vote the motion
was unanimously approved by Council, ;.all members being present.
Mayor Kyle read a letter from Stevens and Thompson regarding an
extension on the contract with Mr. Everett L. Wiggins. Mr.
Wiggins has asked for an extension from July 18, 1965, to August
4, 1965. "Mr. Meigs, Stevens and Thompson, Inc., ;recommends —"
that the first request for extension<from May 30, 1965, ;to July
18, 1965, be grant-ed without reservation. Mr. Meigs suggested
that 'rather than liquidate damages after July 18, the City
retain the cost of supervision-between the ''18th and the actual
date .of completion.
Attorney Anderson suggested that we refer to the Con'—,ct be-
fore making any decision on the extension of the ccni'vact-.
Councilman Klock2 1 movd that we have a legal interpretation
of the contract before::granting an ext—.3ion. Motion sec0nded'

to hire two part-tiny employees for general cleanup purposes

Mayor Kyle I would like to recoucaen3:that 'we hire a City;

Councilman Klrieka 2 move that we advertise for a City Administrator,
for the City of Tigard, to be hired n,:.. later than September 1,
1965, at a salary of $8,000.00.. Motion:seconded by Councilman
Woodard. Upon:call for vote 'the motion was unanimously approved

Mayor Kyle introduced officer Murley, our new patrolman.
Mr. Meigs- I would like to request a meeting with City Planning
Commission to .discuss the proposed sewer line. The main rrroblem
with the sewer_- for ch._. :,,6C."Pacific Highway Annexation will:be
obtainings easements. When we designed the interceptor for the
City a year and a half ago we were asked by the City to secure
the easements and we did so. We. have maps here of ;the area'
that were prepared by Aerial Mapping Service. Copies of these
maps may be obtained at Stevens & Thompson, Inc.'
Mayor Kyles We will now have the paying of the bills.
