The meeting was called to order at 8:00 P.M. by Mayor
Kyle who opened the meetingwith the pledge of allegiance.
Mayor Ryle: Pursuant to Section 222-120 of Oregon
Revised"Statutes we are holding a public hearing on the
annexation proposal. I would like to read the Notice of
Public Hearing. Mayor Kyle then read the Notice of
Public Hearing, a copy of which is attached hereto, and
made a part of the minutes the same as if copied herein
in full.
Mayor Kyle called attention to the map on the wall
showing the area to be annexed.
Mayor'Ky.le:' I would like to bring to your attention the
following according to the official records of Washington
County. (1) The total area within the annexation proposal
comprises of 72.58'acres of which 56.78 acres are repre-
sented by
epresentedby owners who have consented to the annexation
of their ownership to the City of Tigard, this represents
78.12% of`the;total-area within the area,;,proposed to be
annexed. (2) According to the current years assessment
roll, the total assessed valuation of assessable property
within the boundary area proposed to be annexed to the
City of Tigard is $167,200.00-.and of this value consenting
ownership; includes $116,800.00 of assessed lands repre-
senting 69.86% of the total. (3) The area included
within the boundaries on the annexation proposed is
divided into a`50 tract ownership with a total of 50
owners of which 35 owners have consented to the annexation
or;a percentage of 70% of the total owners consenting;
to :annexation to the 'City of Tigard. This, under the
law, is a triple two-thirds law for two-thirds of the
property ,owners'.having two-thirds of the acreage composed
of two-thirds of the evaluation. The City has been
authorized to accept this land for our annexation. I
might bring to the attention of the audience that under ,
ordinance 65-3, the City of Tigard passed the following
Ordinance and Twill read that in ,part.
Mayor Kyle then read a portion of Ordinance 65=3
which set forth the rate of'taxation for the area to be
annexed.
He declared the meeting open for the Public Hearing
and asked if anvone wished to testify.

Mr.. Stearns: I have a petition signed by approximately
50 taxpayersin the area who wish to withdraw their names
from the petition and do not wish to be annexed to the
City of Tigard.
Mayor Kyle asked the City Attorney what action should
be taken on this petition.
Attorney Anderson: 1 would suggest that the petition
be tabled and the legal aspects, if any, in this matter
be considered at a later time.
Mr. L. Anderson was opposed to annexation and felt that
the cost would be too great for him at this time. Mr.
Anderson also represented Mr. Lawson who was unable to
attend the meeting. Mr. Lawson was also opposed to
annexation.
Mr. B. Begg'who lives adjacent to the property to be
annexed questioned if his property could be assessed
for sewage.
Mr. Clark, Mrs. Jung, Mr. Setnicker and Mrs. Savage
all outside the area to be annexed testified,
Mr. B. Brazauski'of the Planning Commission questioned
Council about the $4.00 per foot assessment.
Mayor Kyle: The cost would have to be determined by the
engineer. The $4.00 per running foot is an average of
the cost forthesewers we now have installed.
The subject of assessment and cost to property owners
was discussed by Council, Attorney Anderson and members
of the audience.
Since no one wished to testify further the public hearing.
was closed and the meeting adjourned.
