MINUTES OF MEETING SEPTEMBER 28, 1964
Present: Mayor E. A. Woodard; Councilmen F. J. Cooper;
F. H. Bergmann; C. n. Klock, Sr. and City
Attorney F. A. Anderson.
Mayor Woodard called the"meeting to order at 7:30 P M. and
requested reading of the Minutes of the meeting of September
14, 1964 which were then read and upon call for corrections
or omissions, none being offered the minutes were ordered
to stand approved as read.
Mayor Woodard: With reference to the Paterson agreement and '
the easement on the Greenwell property; these both are held
up until our engineer checks further in these matters. I
imagine we will have an answer for the next meeting.
In connection with the estimate of insurable value of
the City Hall building, the following was given to us by
Mr. Brandon. He quoted the estimated current!•replaaament
cost at $36,410.00 and the estimated current insurable
value at $20,934.00. Depreciation at $13,900.00 and less
foundations and piping at $1576.00 or an insurable replace-
ment cost of $34,834.00.
Attorney Anderson You should have the replacement value
determined without any question then if you feel that is
the figure, it should be insured for that amount. You
would cover for the replacement cost and find out what that
is.
Councilman Klock: I would move we insure the building for
replacement cost and authorize the Mayor to:meet with the
insurance company and determine the exact figure of re-
placement cost_. Motion seconded,by Councilman Cooper and
upon call for vote was unanimously approved by Council, all
members present.
Mayor Woodard: Do we want to insure the books and equipment;
we should take an inventory before we'determine the amount
of insurance.'-.
We have an Ordinance annexing the 'Lindner property, being
Ordinance number 64-18.
Councilman Cooper: I move we read the'Ordinance the required
three times by title only. Motion seconded by Councilman '
Klock and unanimously approved by Council.
Ordinance number 64-18 was then read by the City Recorder„
by title the required three times, being "An Ordinance
annexing to the City of Tigard, Oregon, landscomprising a
portion of Lot One, 'amended plat;of North Tigardville
Addition."

Councilman Bergmann: I move for the adoption of ordinance
64-18. Motion seconded by Councilman Klock. Roll call of
the vote resulted as follows: Councilman Cooper, Aye;
Councilman Bergmann, Aye; Councilman Klock, Aye; Mayor Wood-
ard, Aye. Motion passed unanimously.

Anyone in the audience have anything to
Mayor Woodard:
bring up at this time. There, is a man here who wants to
operate a'taxi service in Tigard. Mr. Harvey Croft addressed
Council with respect to his proposal to operate a taxi in
the'City of Tigard and after various questions by Attorney
Anderson and the Council with respect to the method of
operation,and franchise and the equipment he was going to
use the Council decided to request of the League of Oregon
Cities what information they might have,with respect to
taxi-cab operation in cities similar to the size of Tigard.
Mayor Woodard: We have Ordinance number 64-19 being "An
Ordinance describing form of nominating petition for
elected offices of the City of Tigard." The City,Recorder
will now read the Ordinance in full and by title.
Councilman Cooper: I move for the adoption of Ordinance
number 64-19. Motion seconded by Councilman Bergmann. Roll
call of vote resulted as follows: Councilman Cooper, Aye;
Councilman Bergmann, Aye; Councilman Klock, Aye; Mayor
Woodard, Aye. Motion passed unanimously.
Mayor Woodard: As you know there are three positions to
be filled, two for-a four year term and one for a two year
term. The two receiving ,the highest votes would fill the
four yeartermsand the next lower number of votes the two
year term'.
Attorney Anderson: I have an Ordinance prepared which
corrects-a ;previous ,ordinance, with regard to an area vacated
and an area dedicated in Frewing orchard ' Tracts. (Attorney ;
Anderson explained the Ordinance by describing :to Council
the territory involved.)
Councilman Cooper moved that Ordinance number 64-20 be read
the required three times by title only. Motion seconded by
Councilman Bergmann and unanimously approved.
The City ;Recorder then read'Ordinance number 64-20 the re-
quired three times by'title only being '}An ordinance re-
pealing and canceling'Ordinance number 64-9 and amending
Ordinance number 64-7 to correct the legal description of
an area vacated and an area dedicated in lieu thereof for
public road purposes in Lot 2 and part of Lot 1, Frs*ing
Orchard Tracts, in Section 2, Township 2.South,' Range l
West, Willamette Meridian, Tigard, Washington County, Oregon."

Councilman Klock: I move for the adoption of Ordinance 64-20.
Motion seconded by Councilman Cooper. Roll call of vote
resulted as follows: Councilman Cooper, 'Aye; Councilman
Bergmann, Faye, Councilman Klock, Aye, Mayor Woodard, Aye.
Motion passed unanimously,
Mayor Woodard: Regarding the bridge on Ash Street; I
would ask the council for permission to go ahead and ask
the state for the $20,000.00 for building the bridge. ' I
asked the County and the County stated it could be built
for $17,000.00. If that is so we would have $3,000.00 for
building the street. I understand from Councilman Klock it
may not be too long before he will have plenty of dirt to
give us. We will need a crossing in there to get to the
siphon during high water.
It will not cost its anything for the loan; I saw this
last ,year, they didn't use all of the $150,000.00. it
will take us a little time as we have to draw the plan of
the bridge, we would have to send that in.
Councilman Bergmann' Does the State supply the money; we
previously discussed this, how can they do that without
the plans.
Mayor Woodard: We would ask the County to build it; they
gave us a figure on the bridge of $17,000.00.
Councilman Klock: I think it might be well to get a set of
typical plans. It might have to be by stat¢ compliance rather
than county and then get an estimated cost from the county.
We would have something more positive to work on.
Mayor Woodard We will get ahold of them and see if they
have typical plans.
We have a letter from Mr. Phillips in regard to Brook-
side Avenue. (reading the letter, which was arecommendation
by the Commission for the approval of a?petition by;residents
in the Brookside area requesting the name of the street to;
remain Brookside Avenue and the cul-de-sac to be Brookside
Court instead of Watkins Avenue as it originally appeared
on the plat.
Councilman Bergmann: I move we accept the recommendation of
the Planning Commission. Motion seconded by Councilman Klock
and upon;call for vote was unanimously approved by Council,
all members present.
Mayor Woodard: We have a memorandum from Attorney Anderson
to the Municipal Judge with respect to the traffic citations
of non-residents who fail to appear before the 'Court. , (The
Recorder was requested to read the memorandum)

Councilman Coopers Nothino.
Councilman Bergmann: On the Police Department; Don has a
2 weekvacationcoming and he has asked to start his vacation
on October 16th., I would like to have a decision from the
Council what they propose to do to replace him while he is
gone. Would it be the feeling to hire someone while he
is away as the work cannot wait until his return.
Councilman Klock: Can you double up?
Councilman Bergmann: If it were only foroneweek perhaps
we could.
Mayor Woodard: I don't know whether we could hire a man
that would do the work that Don does anyway.
Some discussion followed betweenCouncil members with
respect, to the number of hours and the possibility of using
Sheriff's Reserves. After this discussion;Councilman-Berg-
mann moved Mr. Goodrich be given the additional hours and
the additional compensation for the vacation period. After
some discussion on the motion the question being called for
the motion was seconded by Councilman Klock and,Mayor Wood-
ard'stated that was the idea to work him 80 hours during`'
this man's vacation and Councilman Bergmann advised you
would have to term it 80 hours "in a five day week. A
roll call of votes resulted as follows: Councilman
Cooper Nay; Councilman Bergmann, Aye, Councilman Klock,
Aye, Mayor Woodard, Nay. This motion was therefore lost.
Councilman Bergmann: I would move that R. M. Goodrich work
the extra 40 hours for two one week;periods at his normal
rate of;pay. Motion seconded by `,Councilman Klock. Roll
call resulted as follows: Councilman Cooper, Nay; Councilmen
Bergmann, Klock and Woodard, Aye '. This vote resulted in
three in' favor"and one against, motion passed with majority
in favor.
Councilman Klock: I move we adjourn. Motion seconded by
Councilman Bergmann and unanimously,approved :by Council.
