City Council Packet - 04/27/1964 TIGARD CITY COUNCIL' MINUTES OF MEETING APRIL 27 1964 Present; Mayor E. A. Woodard; Councilmen F. J. Cooper; F. H. Bergmann; N. E. Johnson; C. E. Klock, Sr. (; and City Attorney F. A. Anderson. Mayor Woodard called the meeting to order at 7:30 P.M. and requested reading of the Minutes of the Meeting of April 13, 1964. The minutes were read and upon call for correct- ions or omissions, Councilman Bergmann requested that on Page 6 the minutes should show Mr. Dei Ball and Dr. Bissett were in the room but the, did not tally. Councilman Klock advised that on Page 3, in regard to the parking signs on Southwest Pacific Highway I also made a statement that I felt that every business man who had built his place prior to zoning that we should give them a reasonable time or intended time for the no parking restrictions rather than immediately. Councilman Bergmann; on Page 6 third paragraph from the bottom says "his salary will stay until the end of six months." The pay, schedule would come up at the end of ..,__ present fiscal year. The otatcmcnt ;n the minutes ;s in conflict with the previous motion. Mayor Woodard: With these corrections the minutes stand approved as read. We will proceed with the reading of the minutes of the special meeting; April 21, 1964. The minutes were read and upon call for corrections or omissions, none being offered, the minutes were ordered to stand approved ' as read. Mayor Woodard: Does anyone in the audience have anything to bring up before Council? Attorney;'John Walker:' Addressed Council stating he was appearing on behalf o£ Mr. ,Otis T. Cagle with respect to the no parking restrictions on S.W. Pacific Highway ,for a ,`distance of 100 feet N.E. and 75' S.W. from the curb returns on S.W. McKenzie. (There ;was considerable dis- cussion on this subject which was entered into between Mayor Woodard, Attorney Walker, Councilman Klock and City Attorney Anderson.) Mayor Woodard: _ I think we should take thin under advise- ment and see what can be done about it. Next we have a hearing on the Vacation of the street going into the 'Meth- odist Church yard. City Attorney Anderson explained to the Council the problem involved and suggested that Council might want to hear from anyone in the audience that wants to speak for or. against it. 4-27-64 - Page l Mavor Woodard: Does anyone in the audience have anything to say for or against this matter. Mr. Godfrey: (For the Methodist Church) The only thing I couldsay is, the church is in .favor of this move and it is compatible with Mr. Willock's thinking; I would suggest we go ahead with the proceedings as they have been lined up. Councilman Klock: 'Due to the:fact we are all in agreement, I would make a motion that we accept the Vacation by means of substitution of the street as planned. Motion seconded by Councilman Bergmann. Upon call for vote the motion was unanimously approved by Council, all members being present. City Attorney Anderson explained the necessary steps to conclude this matter and Councilman Klockmovedthat the proposition be 'approved and that the Attorney be instructed to do whatever is necessary to carry it out. Motion seconded by Councilman Bergmann. Upon call for vote motion was unan- imously. approved by Council all members being present.' Mayor Woodard: Anyone else in the audience have anything to bring up. (No response) . ' -Councilman Johnson has a letter in regard to parking on Highway number 217 from Dr. Bissett (at this time Councilman Johnson read the letter to the Council)c There followed some discussion on this matter, participated in by,Mayor, Woodard, Councilman Klock, Councilman Johnson, Councilman Cooper and Mr. C. E. Janoe. No formal action was taken. Mayor Woodard: The next item on the agenda is Nalley's contract. (Mayor Woodard read a 'letter from Nalley's which cited their request to renew the contract from July 1 1964, through June 30, '1969, with an additional request' to renew for an additional five years beyond July 1,' 1969.`- ) They are 'satisfied if we extend the present contract as is for another five years with the option of giving them another five year period the same as we have on the one now in operation. I' would'-recommend to the 'Council that we accept this and ask for motion to renew. Councilman Bergmann: I move we renew Nalley's contract as is for 'five years with a five year option beyond June 30, 1969. Motion seconded by ,Councilman Cooper. ; Upon call for vote the motion was unanimously approved by Council all members,being present. Mayor Woodard:` The next matter would be the easements on the interceptor; do we have some further information? City Attorney Anderson: I can report only I have had no success in trying to negotiate the easements; the only thing that can be done is to proceed otherwise. 4-27-64 Page 2 The question of connecting the sewer on Mr. Schulte's property was discussed inasmuch as Mr. Meigs, Mr. Janoe, Mr, Roney and Mayor Woodard arranged for opening of the manhole at the location on Johnson Street to determine if the physical connection were feasible. e Mayor Woodard; Next on the agenda is the flag pole. We have a bid from Janoe's Concrete Products. ' The p rtce quoted is $265.00 'installed. The only other one we had was from Ace Iron Works, $196.90; that price was not installed. Councilman Cooper: Is that for a galvanized pole? Mr. Janoe: Yes. Councilman Cooper: I doubt very much whether we could get that pole put in therefor $68.00, cutting the re- inforcing iron that is in there, it would be quite'a job. I believe we-probably-might be better off in accepting the - bid installed for $265.00. I move that we accept the bid - of Janoe Concrete Products of $65.00. Motion seconded by Johnson. upon call for vote the motion was unanimously approved by Council, all members being preseaic. Mayor Woodard: The Chamber of Commerce is going to pay for the ceiling and installation in the Library room and Mr. Nicoli is going to do the work. I think we should thank the Chamber of Commerce for being so kind as to donate this. I think it would be well to write them a letter accordingly. I now have plans ready for distribution to bidders for the Lincoln Street and 95th Street to repair;, the leaks in the sewer system. I have asked the Recorder to give these drawings out to prospective bidders and to have the bids returned for review at the May 11th meeting. The Police problem will be next and also:the Ordinance for policing. The Recorder will read the - 11 be number '64-5, in full and then Ordinance, which w by title. (The Ordinance, 64-5, was then read in full and by title only.) Councilman Cooper: I move that Ordinance number 64-5 be adopted. Motion seconded by Councilman:Bergmann. Upon call for vote the motion was unanimously approved by Council, all members being present. Mayor Woodard: We require two resolutions for the acceptance of McKenzie Street and Lincoln Avenue to comply with the memorandum from City Attorney Anderson. Councilman Johnson:. I move that we accept McKenzie Street, from Highway 99W west to Grant Street, as a City street. Motion seconded by Councilman Bergmann. 4-27-64 - Page 3. Upon call for vote the motion was unanimously approved by Council, all members being present. Councilman Johnson: I move that Southwest Lincoln Avenue from Greenburg south to the north line,of Kimberly be accepted as a City street. Motion seconded by Council- man Bergmann. Upon call for vote the motion was unanimously_ approved by Council, all members being present. Councilman Johnson: Tonight you are letting out for bids for the repair of the sewer on 95th Streed and Lincoln Avenue; we have put out some money on 95th and we are supposed to have that oiled this year. Also, we had planned in our bid from the County the re-surfacing of Lincoln Avenue; I would like to suggest that we do not finish either one until you get,done digging them up for your sewer. Councilman Klock: I have a letter here from Irvington Machine works. There was a question from some people on Knoll Drive about this property. I met with the gentlemen from Irvington Machine with regard towhether the building was -legal and forth Before�_ opportunity to forth. -DC1V1C 1:.11411 ail reply they 6had Ja copyofthe following letter signed by Mr. Mayes. (Reading letter.) I called Ivan Jack and indicated we had this letter from Irvingont Machine and he could come down to the City Hall and take copies of it. (Reading letter from Irvington Machine.) They could make'a copy of the Irvingont Machine letter and send it to Mr. Mayes. Councilman Klock: Considering ,so ,much time is being required of Councilmen in detail work and which will no doubt be increased and feeling they cannot devote the time required; that being,the case I would like to have an investigation into the possibility of a City Manager or City Administrator to be responsible, with the exception of policies which would remain with the Council. One such person to be selected by the Council with the _< recon mendation of the City committee. It is my opinion this is legal under our Charter. As ;to the 'cost, that woul_,-have to be determined by the Council. For a committee to further this, I would like to have a committee selected by a fair minded person interested in the betterment of Tigard and I cannot think of a better person than Curtis Tigard. Councilman Bergmann: I sec nothing wrong with looking into it and finding out the practical side of it. Councilman Klock: I would like to see an entirely,neutral group that is for the betterment of Tigard. 4-27-64`- page 4. Councilman Klock:: Z would like to see the a}visability of it. This Council is cietting to be a time-consuminq job and as time goes on .it is Bettina to be more sc. I have selected Cu.- Tigard for this, I did not sl_eak to him about this: my opinion would be for him to select' a committee, perhaps not even let us know who thev are; there are other people that would want a constructive pattern for the benefit of Tigard. Mayor Woodard: I would say you should give the Council a chance to think this over so they know what they are stepping into. Councilman Klcck: I didn't say to select-a City Adminis- trator but to have a study made and at that particular time we would at least have something to think about. I can't see anything wrong, I think"it is giving the tax payers of Tigard a very fair break. A study of anything is certainly riot harmful. It gives you the answers you are supposed to have; it is only as a studv for such benefit as it may be. Perhaps we are scratching somebody else's burns but time doesn't permit us to do all these things. Mayor Woodard: It is just for a study. Councilman Klock: Yes, that is what I said. I would "like to make a motion that, if accepted by Mr. Tigard, that he would select a committee of Tigard residents to investigate all facts pro or con of a _City,,Administrator, one to be appointed by the Council, with the policy making left the responsibility of the Council, all the detail administration and so forth to come under the pattern, whatever the `normal;pattern is for such an action. Motion seconded by Councilman Bergmann. Upon call for votes the motion was passed by majority vote of Council, Councilman Cooper voting NAY; all Council members being present. Mr. Curtis Tigard advised he would give the matter some thought and advise later whether;he would accept. Councilman Bergmann advised Mr. Goodrich had been finger- printed.and taken a physical examination by Dr. Martin Johnson and no further action is needed by the City Council in the matter,of hiring. Councilman Cooper: I wish to restate my motion; I'move that Mr'. Batchelar_ be instructed to take a physical examination. immediately. (Motion was not seconded.)
