Meetingcalledto order by Mayor Woodard at 7:30 P. M.
Mayor Woodard called for reading of the Minutes of the meeting
of September 23, 1963 . The Minutes were read and upon call
for corrections or ommissions, none:being heard,:the Minutes '
were ordered to stand approved as read.
Mayor Woodard: We are going to open and read the bids on the
sewer line that connects on both ends,with the one that Gonzales
is putting under the railroad tracks;, Gonzales is boring,under
the tracks and installing the casing for the sewer pipe. '
Bunyard & Pettit - Lump sum bid of $3726.00; bedding
gravel unit price of $6.00 per cubic yard in place.
Oscar A. Lakanen Inc. Lump sum bid $3985.85;
bedding gravel if required $4.75 per cu. yd.
Duplex Tray Company labor and materials for the
sum of $4291.15;''bedding rock in place at'$6.00 per
yard as directed.
Clackamas Construction Co., lump sum price $6480.00;
gravel or crushed rock for bedding or precover,placed as
requested at $6.00 per yard.
CouncilmanJohnson: Do any of these firms estimate how much
bedding gravel is necessary?
Mayor Woodard: I would like to have Mr. Boydston look these
bids over to see if they have all come up to the;specifications
as' requi.red. Maybe he can tell us the amount of gravel required.
Mayor Woodard: We have bids in for the police radio which will
be 'read at this time.
Tarbell Communication Sales - $825.00 f.o.b. Tigard;
with an alternate bid for demonstrator unit $595.00 f.o.b.
Tigard, installation will cost $35.00.
'Councilman Johnson: What wattage is that?
Mayor Woodard: It says "per,your specifications".

Motorola Communications and Electronics have also
submitted another bid Model.u63HHT-1100, 80 watt
completely transistorized receiver, power supply and
partial transistorization of the transmitter, to operate
on 12 volts and with'a standby current drain of .3 amperes,
f. o. b. Tigard - $891.00 - same equipment prepaid and
installed in a police partol car - $891.0, delivery
5 - 7'weeks.
Councilman Cooper: I move we table this until our next
regular meeting until we can look into it. Motion seconded
by Councilman Johnson. Upon call for vote, motion was passed
by Council, majority members being present.
Mayor Woodard: We now have the bids on the police car. (Reading

4' Dr. Sdn W/Special Police Pkg. V2145 — List price including
Freight and Dealer handling also service which includes 1000

30 days and is subject to any price increases announced by
Chevrolet Motor Division.
Triangle Motors at McMinnville 'could'not meet the
specifications, so they did not quote.

Mayor Woodard: According to the bids here, the Dodge has the
lowest price.
Some discussion'followed with respect to the various bids and
specifications.'
Attorney Anderson: I would suggest that you go back to the
bidders who did not offer 145 H. P. or thereabouts and find r
outwhat they can offer. It is possible; after opening bids
to negotiate the bids.' We try to conceal these bids so that
` we know that we are putting them in a comparable basis and the
bid would;be 'selected on comparable terms.
After some further review of the bids it was decided to request,
Del: Ball Ford Company and Knauss Chevrolet to either adjustor
resubmit bids, if they so desired, to fall within the''required
specifications.

Mayor Woodard: I think we could have a meeting Friday night;
we should be able to get Del Ball Ford and Knauss Chevrolet
squared around by that time
Councilman Johnson: I move we table this temporarily until
Friday evening. Motion seconded by Councilman Bergmann. Upon

call for vote, motion was unanimously passed, majority members
being present.
Attorney Anderson: I have the Mayor's Proclamation of United
Nations' Day. (Mayor Woodard read the Proclamation and proclaimed
October 24th as United Nations' Day.)
Attorney Anderson: With reference to the Southern Pacific
Company; we have a matter of a Resolution in order to execute
this easement instrument and since we are asking, we should not
object.
Councilman Cooper: I so move that we adopt the resolution to
execute this easement. Motion seconded by Councilman Bergmann
and upon call for vote, motion was,unanimously passed, majority
members being present.
Attorney Anderson: I think each of you received a copy of the
Traffic Ordinance; for the last page you have, which did not have
the effective date, please substitute this page. _(Giving each
Councilman a rewritten page 26.)
You directed me to prepare to sell the $150,000.00 of
Sewer Bonds and the proceedings have been approved. I have here
an Ordinance to authorize the sale of these Bonds.
Ordinance #63-13 was then read.in full and then again by
title only; being an OrdianceProviding,for the Issuance and Sale"
of Sewer Bonds of the City of Tigard, in the amount of $150,000.00
and Declaring an Emergency.
Councilman Johnson: I move we adopt Ordinance number 63-13.
Motion seconded by Councilman Cooper. Upon Roll Call of vote,
the following tabulation was made Councilman Cooper voting AYE;>
Councilman Bergmann voting AYE; Councilman Johnson voting AYE;
Mayor Woodard voting AYE. Councilman Klock being absent the
vote was `unanimous, majority members being present.
Mr.` Boydston: Bunyard and Pettit are low bidders with a total
cost of $4,026.o0 against Lakanen+s bid of,$L�,223.00. I_,see
no reason why you should not 'award the contract to Bunyard and
Pettit. I think that the recommendation should be, the contract
should be awarded subject to furnishing required bond and
insurance and specified time oy completion. I :feel that probably
a,30 day time of completion would be more than adequate and
comply with the :easement from Southern'Pacific.
Councilman Johnson: I so move. Motion'seconded by Councilman
Bergmann and motion unanimously approved, majority Counil being
present.
Attorney Anderson: I 'have prepared the Curfew Ordinance for
approval by Council.
Ordinance No. 63-14 was then'read in its entirety and then by
title only, being "An Ordinance prescribing Curfew Hours,
prohibiting unaccompanied minors from being in 'public `places
'
during certain hours, prohibiting parents, guardians and cusdodians'
from allowing minors to be in public places during Curfew Hours,
providing ;for the enforcement of this Ordinance, and prescribing
penalties..

Councilman Cooper: <L move we adopt Ordinance number 63-14.
Motion seconded by Councilman Bergmann. Upon call for vote, the
motion was unanimously approved, majority members being present.
Mayor Woodard: The'people interested In the library have asked
if we are willing to allow them to use the two back rooms. They
propose to establish a library free of any expense to the City.
I would liketo hear any comments.
Councilman Johnson: I move we so allow the use of the two
rooms. Seconded by Councilman Bergmann. Upon call for vote,'
the motion was unanimously approved, majority members being
present.
Mrs. Beverly Bender spokeaboutthe appointment of the library
board. Attorney Anderson suggested there is a procedure set
up in the State Statutes that we should follow; probably by
Ordinance, he felt, setting up a Board of five members. City
Council would appoint the Board, or probably the Mayor could
appoint them.
Mayor Woodard Would you please have an Ordinance drawn up
setting up the library organization.
Attorney Anderson: The matter of vacating the part of`Warner
Avenue, that was referred to me at theprevious meeting; I have
examined the papers and find they are lacking consent from an
abutting property owner, so Ihave referred it back to Albertsonts
to comply with this requirement.
Mayor Woodard: Regarding Jim Willockfs annexation; Jim Willock
is .1008 feet from the City property. My idea is we should put in
a 12" line, because this line is going to be put in to take'
in all the territory south"of his and east to the Highway. 1
think it would be well to put a .trunk line up that street so `
as not to have to run parallel lines again.
The question is, who is to pay for that line. I have
some ideas, some of this land cannot be .assessed: because it Is
field land. I talked to the Attorney about it and he:said 'that '
we could probably work;up some ideas with-Willock and `assess'some
of that property on the basis of a regular 811 line and we assume
the 'cost of the balance of :the extension.
Rather than having "to come to Council on each move,,I
would like the Council to give me authority to go ahead and work
out the best for;us that I can get;between Mr. Willockrand the
property owners so when we are ready I would have to come to
Council with the proposition.
Councilman Bergmann: I so move the Mayor proceed in
that;manner. Motion seconded by Councilman Johnson. Upon call
for vote, the motion was unanimously approved, majority members
being,present.
Mayor Woodard: He wants to know within two weeks;
he can't get any money unless we let him know if`:the-,line.will
go in. Iwill have Meigs of Stevens and Thompson survey the
line';
Attorney Anderson submitted a memorandum concerning
review and settlement of sewer connection problems and he was
authorized to proceed as set forth in his memorandum.
Mayor Woodard: The Planning ;and Zoning Commission has asked '
for authority to put a t} foot wide 'strip of cork across the
wall (pointing to the northwest wall and "above the drinking

fountain); so they can, put up their maps. They will glue this
on there and put a metal frame around it. l understandBill
Thatcher will furnish the cork free, the frame binding we will
have to pay for. ' - I would like to hear any comments or a motion.
Councilman Bergmann: I move that we allow the cork to be installed
on the wall. Motion seconded by Councilman Johnson. Upon call
for vote the motion was unanimously approved, majority members
being present.
Mayor Woodard: On the question of police hours; I would
suggest we stay with the same practice as Beaverton as to hours.
We are not set up at the present time to pay overtime for a
police officer. We are in the hopes we can;get extra police
we can use. According to our budget, the way we are running
now, we will run pretty close at the end of the year. I would
like to see that we allow no overtime at this time for police.
Councilman:Bergmann: Then we will curtail the activity to
40 hours per,week, thatos fine.
I also have something else. We have a list of
some of the necessary forms we use in our filing system and we
have a reasonable price of $30.00 for all of the printed material.
(There was some discussion about a card for
check data.) It was stated this card would be furnished by
the Jaycees,'free of charge to the City.
Mayor Woodard: The item that was in the paper (Tigard Times)
the other day; there was an item in there about Councilman
Bergmann and the policeman. I don't think it was very,good
to state that seventy,'percent of our police,pay would come out
of fines. I have had a lot of people ,jump me asking are we
going to be a "Dundee" or "Dayton".
Mayor Woodard read a note from the Recorder regarding the receipt
of ten books (250) traffic citation tickets received from the
League of Oregon Cities.
Councilman Johnson, do,you have anything on the meeting.
Councilman Johnson: : The only thing on that meeting was the
fact it boiled down to the `fact the people involved admittted they
didn1t have a,good plan; when we;presented them with the facts
the State would not meet with them, they decided they better go
back and get a better plan. They didnt:t see why the City should `
have to,pay 25 percent of putting in this other road, they;said
they could change :that.
Also the light we requested at Johnson, Main and 99W
is going to cost us approximately $4000.0o; the State says;
$8,000.00 and we have to pay half;and the maintenance and all
the electricity that is used in the City. I pointed out to
them in following the' way they have been doing business, I 'don't '
think it is going to be too long ;before'they have a 'Freeway
by-passing Tigard. I dontt think we are going to have to be
too apprehensive about what is going to happen. It was also
pointed out'as far as 217 is concerned that is' a State Highway,
they can't do anything. Even if the State were to put this in
it would be a minimum of three years as they have no:money to
do it.
Mayor Woodard read a letter from the Washington County Health
Department in regard .to Irvington Machine Works advising they
were conducting tests and would advise the City the ;result:of
their findings. Mayor Woodard also read a letter from Mr. Wallace
in regard to seepage into his home after the sewers were laid.
Attorney Anderson suggested}a letter should be 'written him that
from out 'best advice it is improbable that it is sewer leakage.

Mayor Woodard: This trouble Mr. Cooper has had with his
sewer line up there, I finally got the figures the way this
thing 3s laid out and he'did-have an excessively:long branch
line. , The contractor saved himself trouble by not going down
the center of the street. Mr. Cooper has been charged for a
45 foot branch line, which I don't believe was fair, nor does
Mr. Carter. Since l had him get the figures on what the charge
was I feel Mr. Cooper did have a right to complain. I would
make a`suggestion that Mr. Cooper be allowed to take the 20 feet
Off of that line and that we give him credit. It Is 20 feet that
he should get back, I got the figures and I"got the contour of
the. road. (Addressing Mr. Cooper) -Would you be 'satisfied if
we make that adjustment, it amounts to $70.75,
Councilman Cooper: Yes I would accept that.
Attorney Anderson: You should have the assessment record
credited.
Mayor Woodard; Is Mr. Cooper satisfied? Councilman Cooper: Yes.
Mayor Woodard: I would ask for a motion .
Councilman Johnson: I so move. Seconded by Councilman Bergmann.
Mayor Woodard: The motion has been made that we credit Mr.
Cooper's assessment charge ,in the amount of $70.75. All those
in favor give their consent. Councilman Bergmann, Councilman
Johnson and Mayor Woodard voted AYE; Councilman Cooper abstained
from voting; Councilman Klock was absent.
Mayor Woodard: We will now pay the bills. Treasurer-Councilman
Cooper 'then read the bills.
Councilman Johnson: I move these bills be paid. Motion seconded
by Councilman Bergmann. Upon call for-vote-motion was unanimously
approved, majority members being present.
Councilman Johnson: 1 move we adjourn. Motion seconded by
Councilman Cooper. Motionunanimouslyapproved.
