MINUTES OF MEETING FEBRUARY 12, 1962`
Those present: Mayor Phillips, Councilmen Aitken, Hanneman, Verharen
and Woodard, and Attorney Anderson.
Meeting called to order at 7:30 P. M.
Minu.es of February 5, 1962 meeting read and approved.
Mayor Phillips called on Mr. P. E. Perrine, who presented Portland
General Electric's Franchise for approval. Attorney Anderson recom-
mended acceptance of the Franchise, Councilman Verharen-MOVED for
approval, SECOND by Councilman Woodard and unanimously accepted,
thus becoming Tigard City Ordinance No. 62-5.
Mr. Perrine then presented Portland General Electric's City Manager
from Newberg, Oregon, Mr Frank Calcord, who explained the operation
of the Lighting Districts. Mr Ralph Wickham, Lighting Consultant,
presented Portland General Electric's brochure covering a complete
re-lighting job including Highway 99 which would cost the City
$1,230.00-per month, an annual cost of $14,760.00. The lighting
of Highway 99 could be excluded, reducing the cost to approximately
$8,980.00 annually. ' Either proposalcould be adopted by the City
under a 5`year agreement withPortiand General Electric. Each
councilman was presented a copy of the brochure for study.
Mayor Phillips then introduced Mr. Edward F. Brady, Freight Rates
Consultant, who 'went over maps of the area painting out the area
to be covered and the city's potential area. Mr* Brady called at-
tention to the problems of adjacent cities which had not included
their,potential industrial area and are now,suffering freight-wise
because of the omission. Tigard's freight '!rates are the highest
on the list, and Tigard should now be able to take advantage of
change made;possible by incorporation. Mr. Brady'recounended the
Council notify Common Carrier Truck Lines of the 'City's'incorpora-
tion indicating the area covered as well as the potential indus-
trial area.
Councilman Woodard reported letters from Johansen Plumbing Company
regarding Phase III, and Heinkel Plumbing Contractors' regarding
Phase ;II at the Tigard Shopping #Rlaza,'' had been turned over to
Attorney Anderson, together with actual facts and figures. Repre-
t 'sentatives of both firms had read the Ordinance at the Sanitary
1 Plant, neither firm have had completed plans available for the
t engineer to check.
The TV inspection of sewer lines has been delayed.
Councilman Woodard recommended that "turn off notice letters" be
sent the past due sewer service patrons who have not replied to
certified letters sent out January 23, 1962,' and the clerk was so
instructed. 'Councilman Woodard will request Superintendent Janoe
to check the Julian''Hutchens complaint about the extra sewer
service charge.
Councilman Verharen reported having talked with Mr Ames, president
of the'Water Board,'regarding cleaning the office, the suggestion
of_quarterly'water billing, and the need to cut down on the clerk's
work load. All of these matters to be: taken up at the Water Board
meeting on February; 13, 1962. He reported that Auditor Savage is
going ahead with setting ;up the bookkeeping records for the City.
Councilman Hanneman reported having talked with Father Rayner
regarding Mrs Julian Hutchens complaint about church-goers parking
on her property and in her driveway, and hopefully the situation
will be improved. `. p
Regarding Fanno Creek Bridge,�tnc_ilman Hanneman reports there '
appears to be no furtherand it is expected the
County work"there will commence as soon as the North Dakota Bridge
is completed.
CounciaLman Hanneman reported letter from Mr Ayers of the State
Hi0iway Department stating the City's share of State Highway
Funds for the last half of 1961, $6,502.29 will arrive shortly.
Councilman Hanneman brought up the problem of maintaining and re-
pairing streets where the County is responsible, and the loss and
_extra expense incurred when the necessary work is delayed until the
road bed is dammed. Legally the City cannot touch County rights
of way. He questioned what might be done in event the State turns
down the City's request for repairs on Ash, ,Lincoln and McKenzie '
Streets. Attorney Anderson expressed the possibility of working
out an arrangement with the County to match funds to bring the worst
streets up to standard.
Attorney Anderson also suggested the City give consideration to an
ordinance requiring a sub-divider toriattw_4 the streets to standard
condition beforeconsidering a plat. He also expressed that people
should be encouraged to ;petition the Council regarding streets badly
in need of repair, in which event property owners would be assessed
for improvements. �•,
Councilman_AtTinem in had attended e Tigard Development Corporation
meeting,P'ebruary 2, 1962, where it appeared there was some disagree-
ment,.-'it had been suggested they come to agreement and then approach
the City Council.
There was discussion of the difference in ordinances, Attorney
Anderson expressing that Franchise Ordinances are contracts for 'a
snecifxacl term and cannot be changed for the term of the contract.
Other ordinances may be legislative ordinances and may be changed
at any time.
The problem of coin-operated drycleaning establishments was discus- _
sed. These are 'comparatively new and there are no controlling'State
ordinances. There have been complaints of faulty;installation and
since such a plant is in prospect at the Tigard Plaza it was planned
Councilman :Woodar4 'would`check on the experience of'the';plant at
Oswego [which has been in,operation for`about ''a year.
Regarding Surveyor's Plat for the Lomita Terrace Sub-division now
awaiting Engineer ,Carter's approval. Mr Klock has nothing to go on
until he gets Engineer Carter's`O.K. 'It was,.agreed'`Mr Klock would
call Maa��}}or Phillips whenever there is a delay and"the mayor will
make =e "th e'matter is kept in hand.
Attorney Anderson reported West Coast Telephone Company Ordinance
is in the.hands of their manager;, ,and is basically the same as that
' approved"for Portland General Electric and should be ready for
adoption at next Council meeting'. A tentative meeting regarding
Northwest Natural Gas Franchise is set for Thursday, February 15, 1962.

Preliminary draft on Bancroft Bonds should be ready for next
Council meeting,and the Agreement with Motes collection station
should also be ready for that meeting.
Mayor Phillips reported the Tigard 'Eater Board is making a serious
study of-Tigard's future water needs.
Mayor Phillips read'letter from Mr Burton, president of Metzger
Sanitary District, stating their plans have progressed too far to
consider any changes, and suggesting Tigard proceed on its own, _
in solving the problem of sewer expansion.
Mayor Phillips called attention to meetings scheduled February 14, 1962
` with the Beaverton Rural Fire Department February 19, 1962, when the
budget will be considered, nd February Z6, 1962 when the sewer ex-
pansion problem will be stuAied.
Councilman Woodard presented bills for approval. On Motion by
Councilman Aitken, SECOND by Councilman Woodard, bills totalling
$1,`833.37 were approved for payment.
On Motion by Councilman Hanneman, SECOND by Councilman Woodard
meeting adjourned at 10:30 P. M.
