Resolution No. 10-05 CITY OF TIGARD, OREGON TIGARD CITY COUNCIL RESOLUTION NO. 10- 0S A RESOLUTION AMENDING A PORTION OF RESOLUTION NO. 09-44—THE MASTER PEES AND CHARGES SCHEDULE,PERTAINING TO PARK SYSTEM DEVELOPMENT CHARGE (SDC) AND SANITARY SEWER CONNECTION FEE. WHEREAS, the City of Tigard has a Master Fees and Charges Schedule; and WHEREAS, die methodology for establishing the amount of the Parks and Recreation System Development Charge (Parks SDC) is set forth in Resolution No. 0497;and WHEREAS,Resolution No. 04-97 calls for the amount of the Parks SDC to be adjusted annually; and WHEREAS, calculations following that methodology call for an adjustment to be made m the amounts of the Parks SDC for calendar year 2010;and WHE12EAS, pursuant to the terns of the Intergoverunental Agreement (IGA) with CleanWater Services (CWS),CWS determines the amount of the Sanitart Sewer Connection Fee and the percentage to be retained by the City of Tigard;and WHEREAS,pursuant to the terns of that IGA, the City oETigard is required to collect that fee in the amount determined by CWS;and WHEREAS,CWS adjusted the amount of the Sanitary Sewer Connection Fee and the retention percentage effective 7/1/09; and WHEREAS,The City of Tigard has properly collected that fee in that proper amount since the effective date of 7/1/09 and has retained the proper percentage; and WHEREAS, the amount of die Sanitary Sewer Connection Fee and the retention percentage set forth in the Master Fees and Charges Schedule has not yet been updated and requires correction. NOW,THEREFORE, BE IT RESOLVED by the Tigard City Council that SECTION 1: The City of Tigard City Council hereby adopts the adjusted amount of the Parc System Development Charge as enumerated and set forth in the attached sc hedude (Exhibit A). SECTION 2: The City of Tigard City Council hereby adopts the corrected amount of the Sanitary Sewer Connection Fee and the corrected amount of die retention percentage as enumerated and set forth in the attached schedule (Exhibit B). The Park SDC is a ane-time fee charged to new development to help pay a portion of the costs associated with building additional parks and trails to meet the needs created by both residential and commercial/indnstrial growth. The SDC revenues can only be used on cupxcity-increasing capital improvements and cannot be used to repair esisung park facilities. Padc SDCs are assessed on new resi hmoal development on.a per-unit basis and against commercial and industrial development on a pe,sur ployee basis. City of Tigard EXM81T A. Pees and Charges Schedule Park SDC Annual Adjustment 4/10/2001 Parks SDC fees shall be adjusted amivaRy on January 1s[ofeach ycnr beginning in 2002. The new fee will be determined by multiplying the existing fees by the avenge of two indices,one irlham g changes in development/cro s'truction costs and one reflecting changes in and acquisition costs. The average of these two indices is a reasonable npproadt because die Parks SDC fee is roughly split 50%between land acclu sition land development components. I he index for the Land Acquisition component will be the base cost for residential tract land in Tigard,as detervrtried by the NM dangton County Appraises The average cost for residential tract land was selected because it is readily identified and is the lowest priced of the buildable lands in Tigard. Changes in this base cost can be calculated in terms of a percentage increase,to create the level of change to die original index,and projected to the overall acquisition cost. In accordance with Measure 5,the Washiri County Appraises s c ffce will determine apprised values on July 1 of each year. The index for die Land Development component of the Parks SDC vill be the Construction Cost Index for the City of Seattle as published in the December issue of the Engrossing News]accord (ENR). The Seattle cost index mill be used because the city is the geographically closest to Tigard of tveaip metropolitan areas for which the ENR maintains cost data. This index is adjusted monthly,quarterly,and annually. The annual index for each year will be selected beginning with the index for December 2002. The annual index will be used because it is available in December and most closely c.aundr,with the)anunry 1st implementation of the Pad:SDC fee adjustments.
