Resolution No. 09-62 CITY OF TIGARD, OREGON TIG ARD CITY COUNCIL RESOLUTION NO. 09- (pQ A RESOLUTION OF THE CITY COUNCIL APPROVING THE PETITION PROPOSING THE FORMATION OF A SPECIAL AQUATIC DISTRICT (Tigard-Tualatin Aquatic District) WHEREAS, the Tigard-Tualati�'i School District("TTSD") has determined that itis not economically feasible for TTSD to operate the aquatic centers at Tigard High School and Tualatin High School (the Aquatic Centers) on a long-term basis;and WHEREAS, concerned citizens seek the formation of Tigard-Tualatin Aquatic District ("TTAD"),a special parks and recreation district formed pursuant to Chapter 266 of the Oregon Revised Statutes for the limited purpose of managing and operating the aquatic centers owned by the'ITSD at Tigard High School and Tualatin High School; and WHEREAS, the affected districts ("the Districts") and the principal Act of those Districts that will comprise TTAD have been identified as follows: City of Tigard, ORS Chapter 221 City of Tualatin, ORS Chapter 221 City of Durham, ORS Chapter 221 City of King City, ORS Chapter 221 Tigard-Tualatin School District, ORS Chapter 332 Northwest ESD, ORS Chapter 334 Tualatin Valley Fire&Rescue, ORS Chapter 478 Clean Water Services, ORS Chapter 451 Metro, ORS Chapter 268 TriMet, ORS Chapter267 Tualatin Valley Water District, ORS Chapter 264 Enhanced Sheriffs Patro District, ORS Chapter 451 Portland Corm-nunity College, ORS Chapter 341 Tualatin Soil &Water Conservation District, ORS Chapter 568 Clackamas County Soil&Water Conservation District, ORS Chapter 568 Clackamas County Community College, ORS, Chapter 341 Clackamas County Extension Service and 4H District, ORS Chapter 451 Library of Clackamas County, OR Chapter 451 Urban Road Maintenance District, ORS Chapter 451 Port of Portland, ORS Chapter 778 City of Portland, ORS, Chapter 221; and WHERE-AS, the concerned citizens have presented a petition (the "Petition) for formation of the TTAD, and the Petition includes the affected Districts and conforms to ORS 198,750(1); RESOLUTION NO. 09- Page 1 NOW THERE FORE, BE IT RESOLVED BY THE Tigard City Council that: SECTION 1: The petition attached as Exhibit 1 to this Resolution is hereby approved. ATT-HST- City Recorder—City of Tigard 1:\Citpvide\Counci1 Pacitets\llicket'09\01)1)915\9 15 09 Rev Res Approve Aquatic Ctrs Mb"ntdoc RESOLUTION NO. 09 - Page 2 BOARD OF COUNTY COMMISSIONERS WASHNGTON COUNTY, OREGON PETMON FOR TTIB FORMATION OF A SPECIAL DISTRICT (Tigard-Tualatin.Aquatic District) Pursuant to ORS 198.705 to 198.955,the signators hereto petition the Washington County Board of Commissioners to initiate proceedings for the formation of a special district to be called the Tigard-Tualatin Aquatic District: The nature of the proposed special district is a parks and recreation district organized under ORS Chapter 266 with the limited purpose of managing and operating the aquatic centers owned by the Tigard-Tualatin School District(TT'SD) at Tigard high School and Tualatin High School. The counties affected by the proposed special district are Washington County and Clackamas County. The territory in the proposed special district is inhabited. Exhibit I 5 The proposed special district will be managed by a five person board of directors to be elected at large by the registered voters within the special district. The proposed permanent tax rate to support the services and functions of the proposed special district in the manner described in the economic feasibility statement required by ORS 198.749 is 9 cents per thousand dollars of assessed value of real property within proposed special district. The formation of the special district is subject to the following terms and conditions: The funon of special district will be limited to managing and operating the aquatic centers at Tigard Nigh School and Tualatin 1'ligh School.
